The above entitled matter came before the City Council of the City of Fridley
and was heard on t�e 3rd day of �u , 19�, on a petition
for a variance pursuant to e City of r� ey s Zon�ng Ordinance, for the
following described property:
To reduce the required side yard setback for an attached garage from 5 feet to
3 feet to allow a 14 x 16 foot detached garage to be attached and increase the size
to 22 x 34 feet on Lot 9, Block 1, Carlson's Summit Manor North Addition.

Mr. Flora srtated a n�::ber of ne' ghbors spoke against the variance,
therefore, it was denied by th Appeals Commission, but they reo�r.ar.end

Mr. F1rn, the petitioner, ated he has spoke with his neic�bors, since the
neeting of the Appeals ission, and they are in agrea,ern with his plans.

Mr. Flora stated the Appeals da�mission reoommended denial to reduce the
setback fran five feet to two feet.
m�cilman FYtzpatrick stated staff had reoommended three feet from the
s�uth property lire, rather than the two feet requested by the petitioner.
He stated the petitioner proo�eded with his original req�est, theref ore, it
was denied by the Appeals CAmmission. He stated there has been no
neic�borhood opposition to this variance and felt the petitioner has no
alternatave as it is r�ot feasihle to bui.ld in the hack.

Mr. Flora stated if the petitioner were to build a de ed c$rage, he would
not reed a varianoe, how�er, he Frefers to atta� ' to his present house
with a new room to be provided between the ex' ing house and t't�e new
garage. Mr. F1ora stated the Ap�als Oannissi was split on whether or
not this was a self-imp�sed hardship and ' was a spl it vote on thei r
reaomnendation for apprwal.
A9r. Day, the petitioner, stated the r n he desicyied it in this manner was
because he dic�'t have er�ouc� roan the side to build an attached garage
the sze he wished. He stated he anted a triple garaye for thEir three
vehicles. He stateci� with �e ape of the lot, the only way to build a
garage that large is to the r aE the property and he would like to attad�
a t�,�a ac��.ioa to inclt�de di�iu��g an� rec,�earian r-c�rr i7etween irhe existing
structure and new qara addition.
Mayor Nee asked w e neic�bor, [�s. Traabridge, was opposed. Mr. Flora
stated Mrs. Z�ow dge di�'t l�vw if this addition would affect the resale
val ue of her e. She al so sta ted she di dn' t want to be th e ca use f or
denial c� ' varianoe request.

will conduct a Public Hearing in the City Council Chambers at 6431 University
Avenue Northeast at 7:30 p.m. on Tuesday, May l4 ,`1985 in regard to the
following matter:

to Chapter 2A5 of the Fridley City Code to reduce
the side yard for an attached garage from 5 feet

Section 205.07.3D.2b, requires a side yard of not less than 5 feet
between an attacbed aocessory building and a side property line.
Publie purpose serned by this requirement is to maintain a minimum of
20 feet between living areas in adjacent structures and 15 feet between
garages and livin� areas in adjacent structures to reduce exposure to
conflagration of fire. It is also to allow for aesthetically pl easing
open areas around residential struetures.

C. flDMIBISTR�TIYE STAFF REVIEfi:
The owner presentlq has a 1$ x 26 Poot garage loeated 5 feet from the south
property line and 6 feet from the house. They would like to replaee this
gara�e with a 23 x 34 foot garage to be attaehed to their house and be
located 2 feet from the south property line.
The staff reeommends t&at the Board cons3der reducin� the garage width to 22
feet, leaving 3 feet from the south garage wall to the south property line.
The existing garage to the south is 5 feet from the eommon progerty line.
The Board should also stipulate that the south wall of the new �arage be a
firewall with no openings.
