REDUCE THE FRONT YARD SETBACK FROM 35 FEET TO 29.5 FEET TO
ALLOW THE CONSTRUCTION OF AN ADDITION. GENERALLY LOCATED AT
5096 HUGHES AVENUE N.E.:
Ms. Dacy, Community Development Director, stated that this request
is for a variance to reduce the front yard setback from 35 feet to
29.5 feet to construct an addition to the front of this home. She
stated that the.petitioner is also proposing to create a covered
walkway to the new entrance of the dwelling unit. She stated that
the petitioner received a special use permit for a second garage
in 1986.
Ms. Dacy stated that this area was platted in 1954, and there are
homes built closer than the typical 35 foot setback.
Ms. Dacy stated that the Appeals Commission recommended denial on �
a 3 to 1 vote, and staff concurs with this recommendation.
Mr. Awaijane stated that both his neighbors were at the Appeals
Commission Meeting and have no objection to his addition. He
presented photos of those homes in the area that have less than
35 foot setliacks. �
Councilwoman Jorgenson stated that she did not feel the issue was
the setback but the amount of lot coverage.
Mr. Awaijane stated that with the addition the lot coverage would
still only be 24 percent. _.____ _
Councilman Billings asked if there was a policy regarding averaging
front yard setbacks.
Ms. Dacy stated that there is a section in the Zoning Ordinance
regarding this issue, which she explained.
Councilman Billings stated there is a certain amount of logic that
if there is a situation on a street where there are a number of
homes that do not meet the minimum setback, the variance is not
going to create a hardship on other properties. He felt that this
theory applies in this particular case. He stated that if the
petitioner's figures are correct, the average front yard setback
is 29 feet.

Councilman Schneider stated that there was no neighborhood
objection, and the other properties in the area have similar
setbacks.

the Appeals Commission recommended approval of th variance on a
3 to 1 vote based on the fact that 16 feet will r main between the
two properties. She stated that staff has rec,c�hmended denial, as
the petitioner can meet the Code requirements�
Mrs. Buck stated that the addition woul�' be 20 feet from the

The petitioner requests that a variance be granted to reduce
the required front yard setback from 35 feet to 29.5 feet.
This will allow the construction of an addition to the
dwelling unit located on Lot 9, Block 7, Carlson's Summit
Manor South, the same being 5096 Hughes Avenue N.E.
Site
Located on the property is a single family dwelling unit with
an attached two car garage, as well as a detached two car
garage. The property is zoned R-1, Single Family Dwelling,
as are the adjacent properties. To the west of Main Street
are properties which are zoned M-2, Heavy Industrial.
The petitioner received a special use permit for a second
accessory building in 1986. There were no stipulations.
Analysis
Section 205.07.03.D.(1) of the Fridley City Code requires a
front yard setback of 35 feet.
Public purpose served by this requirement is to allow for off-
street parking without encroaching on the public right of way
and also for aesthetic consideration to reduce the building
"line of sight" encroachment into the neighbor's front yard.
The petitioner is proposing to construct a 6' x

Carlson's Summit Manor South Addition was platted in 1954.
The adjacent properties, such as 5108 and 5084 Hughes Avenue,
were built prior to 1956, and the City has no building permits
of record for these dwelling units. The property directly
adjacent to the subject parcel (5108 Hughes) meets the 35 foot
setback requirement. The property at 5120 Hughes does not

meet the setback requirement, as it has a front yard setback
of 30 feet. The City does not have a permit of record for the
dwelling at 5120 Hughes Avenue; however, the City does have
a garage permit for this address which was approved in 1955.
The ordinance requiring the 35 foot front yard setback was
adopted in 1955. The evidence presented indicates that
adjacent structures may have been constructed prior to the
adoption of the 35 foot front yard setback in 1955.
The petitioner has reasonable use of the property without the
proposed addition. The subject parcel is not unique as
compared to adjacent properties. The petitioner has the
option of constructing a vestibule as per Section
205.04.06.A.(4), provided it does not extend more than five
feet into the setback and does not exceed 50 square feet.
Recommendation
Staff recommend that the Appeals Commission recommend denial
of the variance request, to reduce the front yard setback from
35 feet to 29.5 feet.

The Appeals Commission voted 3-1 to recommend denial of the
request to the City Council.

Ms. McPherson stated this particular subdivision was platted in
1954. There are adjacent properties which have homes closer to the
street than the subject parcel. The house directly north, 5108
Hughes Avenue, does meet the 35 foot requirement. However, 5120
Hughes does not meet the setback requirement because it is
approximately 30 feet from the property line. The petitioner
submitted a list of other properties in the area that are closer
to the street than the subject dwelling, but there are no records
in these address files to indicate that variances were granted or
when the structures were built. It is possible that those
structures were built before the setback requirement was adopted
by the City.
Ms. McPherson stated the petitioner has reasonable use of the
property. The petitioner could construct a vestibule which is
defined differently from what the petitioner is proposing. This
would be permitted without a variance. Staff recommends the
Appeals Commission recommend denial of the request.
Ms. Smith asked if lot coverage is a problem.
Ms. McPherson stated, if the variance is granted, the petitioner
would have a lot coverage of 24% with the proposed addition. Lot
coverage of 25% is allowed.
Ms. Savage asked the petitioner to state the hardship and address
the alternatives as outlined by staff.

Mr. Awaijane stated staff said he could go with a 50 square foot
addition without a variance. He wants to go 6 feet. The front of
the house is flat. He wants ta build in front to give the house
a different look. He and his wife are also having another child
and need more space in the house. Adding on to the house will not
only provide the needed space but also give the house a different
look at the same time. There are four houses on the same side of
the street that are 25 feet or less to the street. The neighbors
have no objections.
Ms. Savage stated that in order to grant a variance, the Commission
must determine that there is a hardship.
Ms. Smith asked if Mr. Awaijane had any alternatives.
Mr. Awaijane stated that, in order to build in the back, there is
a deck which would need to be removed. The variance would give
them a chance to add something to the house and to upgrade the
neighborhood. The addition would not look bad. He would have to
take out plumbing if an addition were built to the rear, and there
is also a swimming pool in the rear that would need to be removed.
Ms. Smith asked if they could go out the front 5 feet.
Ms. McPherson stated a vestibule as defined does not meet the
petitioners' needs. The request is for living space which is
different than the definition of a vestibule that is in the Code.
Mr. Awaijane stated the house will still be set back further than
the neighbors' even though it would be at 29.5 feet. Not the
neighbor next door, but the other neighbors are closer than_what
is being required of him.
Ms. Smith asked that if the Commission denied the variance, what
would the petitioner's alternatives be?
Mr. Awaijane stated there is nothing he can do. He wants to use
part of the living room for a bedroom and break up the straight
lines in the front of the house. He would also like to brick the
front of the house.
Mr. Serie, a neighbor of Mr. Awaijane at 5072 Hughes Avenue, stated
he came to the meeting to see what his neighbor had planned. He
stated this is one of the newer hous�s in the neighborhood. He
believed there was a fire at one time and the house had been
rebuilt. He stated he had no objections to the addition.
Mr. Fitzer, a neighbor at 5108 Hughes Avenue, stated the addition
would add to the appearance of the house.

Ms. Smith asked if it would bother Mr. Fitzer if the addition
extended to the front of the house next to him.
Mr. Fitzer stated, no. Their house would then be about flush with
his house and that it would make a difference in the look of their
home.
Mr. Serie stated Mr. Awaijane's house is a flat-faced building, but
if the addition is done tastefully in front, it would add character
to the house. The house is not very appealing as it is.
MOTION by Mr Kuechle, seconded by Ms. Smith, to close the public

Ms. Smith stated there are other options to putting an addition on
the house, but in this case she did not see that it is going to
create a problem. The public purpose served by this is to keep
off-street parking from encroaching and also aesthetics. She did
not see that the addition would interfere with aesthetics or site
lines. She would be inclined to recommend approval.
Mr. Kuechle stated he had some concerns. The house is high and
others in the neighborhood are single story. If the house was
brought out another 6 feet, it may have a negative impact; and he
is not convinced that the negative impact is offset by the stated
hardship. He did not know the floor plan as it now exists to
determine if it would be possible to add to the rear. Without
granting the variance, the owner still has the option of doing
something with the front for aesthetics. He would be inclined to
vote for denial.
Ms. Beaulieu stated she did not hear the hardship according to
their definition. She was impressed that the neighbors did not
mind and seemed to._be in favor of the change.
Ms. Savage stated she had similar problems with the request. It
is a difficult decision. Her first impression, after seeing the
house, was that an addition to the front would make the house seem
like it was rather far forward. It may be that it is the size that
gives it that impression. She had difficulties with the hardship.
She did not see that a hardship was shown; however, there are other
factors including neighbors' opinions. In one sense, it does seem
like it would not adversely affect the appearance and possibly that
the public purpose would not be adversely affected. She has
difficulty with the fact that under the law, the Commission is
supposed to be operating that there is a hardship and there are
other options. As far as aesthetics, there are other options. She

would be inclined to vote for denial. However, what the Commission
decides is not the final decision.

Ms. McPherson stated the varianc request is to reduce the side
yard setback from 10 feet to 6 fe t to allow the construction of
a three-season porch at the rear of a garage addition at 372 - 66th
Avenue N.E. The property is zone R-1, Single Family Dwelling.
The petitioner is proposing to cons ruct a garage addition and to
the rear would be..a three-season po ch addition. The petitioner
has a building permit to start the g rage.addition since it meets
the setback requirement of 5 feet fro the side lot line. The Code
requires a 10 foot side yard setback djacent to a living area and
the proposed addition would be 6 fe t from the lot line. The
petitioner has several alternatives. She would be allowed to
construct a deck, a detached screened azebo, or reduce the width
to meet the setback requirement. This would limit it to being 6
feet wide as opposed to 10 feet which ay not be a viable size.
The adjacent property to the east appear to have a setback to the
living area of 10 feet. There is living rea next to the proposed
construction.
