PUBLIC PURPOSE SERVED BY REQUIREN�TT: Section 205.053, 4A, requires a mini.mum front yard set�ack of 35 feet. Public purpose served by this requirement is to provide open space for off-street parking without encroaching onto public rig+�Y�t of way. Also for the aesthetic consideration not to reduce the "building line of sight" encroachment into a neighbor's front yard. B. 5TATED HARDSHIP: "The normal 35 foot setback would place the. house behind both adjoining houses and would place it in the creek bed. It is requested that the setback be the average setback (26� feet) between the two adjoining houses." C. ADMINI5TRATIVE 5TAFF REVI�I'ni: With the approval of the variance, the off street parking would be 28� feet including the 2 foot boulevard area. Parking could all be ma.intained on the property without encroaching onto public right of way. The building line of sight would not be encroached upon as the house to the west was granted a front yard variance to 30.8 feet (verified at 29.5) in May of 1976 to construct an attached garage and the house to the east was built in 1948 with a setback of 23.3 feet. Other houses along this block also have less tha� the 35 foot setback due to the natural terrain of the land and the location of the creek. The Department of Natural Resources was contacted and has approved construction on this lot with certain conditions in relation to keeping the creek banks in their natural state. Schnabel commented�that it v�as a nice wooded lot and hoped he would save as many trees as possible. � PJIs. Gabel agreed that the trees should be saved and noted that lze ha.d done a nice job at the other houses he had built. P'Ir. Doyle, the petitioner� stated that his map would show the pr�oblem better than the aerial photograph. He stated that he had his surveyor go out and show them the water line on the map. The creek was the culpret. L^Jhat he �vould like to do is put a home in here that v�ill not be as big as the normal 960. It �rould be about.9�0 on the main floor arid he was trying to uuark it in� ���ith a garage which v�as -tough on this lot. He shovaed the Co�!unissioners his proposal. The widest garage he could get an the lot was a single car garage. The house would have a walkout from the lower level laoking out to the creek. He could put in a house without a garage and meet all the requirements but wanted to put in the gara�;e. Mro Plemel agreed that he should have the gar�ge. Mr. Doyle stated that previous owner of the lot.got letters from the DNR and had soil borin5s taken and surveys done and did an extensive amount of work. They took three soil borings. He stated it would require extra work but `vould work out. T�r. �emper asked if he had a buyer and what the price would be. Mr. Doyle stated that he did not have a buyer. The price would depend on rvhether or not h.e finished the lower level. If the lower level were not �'inished� it would run in the mid to upper �50's. I:'ir. Gabel stated that then he would almost have to finish the lower level especially if he soid'.to a family with children. P�r. Doyle stated that for a small house, it offer.ed a lot of room. The dimensions v�ere 24 x 36 and with the entryway it would be a little over 940 square feet. Altog�ther, up and,down� about 175D square feet. Tti'Is. Gabel asked if he would put rooms over the garage? 1�Zr. Doyle stated he wouldn't with this plan. That would be a 2-story situation. �T�s. Sehnabel stated that they were concerned:about his staying away from -the water line. NTr. Do;�le stated that he was well aware of that, and he would�take extra precaution about that. T:�s. Gabel asked if they would have to do any banking or terracing? P:Tr. Doyle stated that they.would have to do a little and he v�ould like to create a creek-garden-side effect. � Ms. Gabel stated that then the ce�ent block on the back of �the garage would be exposed. Mr. Doyle stated that was correct. Ms. Schnabel stated that there was a telephone pole in the middle of the lot and asked if they would move it? P'!r. Doyle stated that �'SP would have to move it.
