Variance #00-2`� was issu�e o allow a building addition. The variance decreased the required front yard setback from 35' to 31' and the side yard setback for living area from 10' to 5'. The Povliizkis are not sure they want to make this large investment in their property until Anoka County removes or improves the vacant, boarded property it owns at the comer of East River Road and Hugo Street. Over the past year, City Staff and Mr. Povlitzki have had a number of discussions with Mike Kelly of Anoka County's Highway Department. Neither the City nor Mr. Povlitzki have received a concrete answer as to the County's plan for this home acquired through ROW acquisition. The Anoka County Board transferred ownership of this property from the Highway Department to the County HRA just this past week. It will most likely be a number of months before any plans are finalized for the reuse or demolition of this vacant, boarded property. The 31 foot setback was approved by through the variance process 1976. The petitioners would like to construct additional living area above the existing attached garage. The property is zoned R-1, single family, as are all of the surrounding properties. The lot was platted in 1922. The home was built in 1967. Mr. Bolin stated the petitioner's hardship summary states: We would like to enlarge the entryway to our home and we are seeking a variance that would allow us to bring the entryway part of our home even with the front of the garage. Curren#ly our garage is five feet from our properfy line and we are seeking to put an addition above the garage." Mr. Bolin stated that the proposed addition would not encroach onto the side yard anymore than the existing garage. The petitioner would like to add onto the front of the home in the entryway area to construct a new entryway lined up with the front of the existing garage. This would allow the petitioner to move his front door out. Currently the front door and service door to the garage open into each other and this would give more room. The proposed expansion would mimic the brick and cedar already found on the house. Mr. Bolin stated staff has no recommendation on this request. Similar variances have been granted in the past. A side yard variance was granted to 4.4 feet for living area at 150 Talmade Way (VAR #98-05), and a front yard variance was granted to 20 feet for a new home and garage at 6330 Arthur Street (VAR #00-11). This garage location was approved when the garage was constructed in 1976 reducing the front yard setback to the 31 feet. The proposed entryway would be consistent with that. Mr. Bolin stated that is correct. Dr. Vos asked if this impacted the neighbor's ability to come in requesting a variance asking for five feet as well. Mr. Bolin stated that it would not. That neighbor would still have the same right to request a variance. Mr. Kuechle asked why the variance request was necessary on the front part. Mr. Balin sta#ed tha� this year staff is loeking at redt�cing the required front yard setba�k for porches and entryways down to 30 feet. A covered porch or vestibule tha� is not enclosed can encroach into the front yard setback, but this would be enclosed. Mr. Marti Povlitzki, petitioner, .stated that he did not have anything to add to stafPs presentation. Mr. Kuechle asked how the entryway would be constructed with the split level. Mr. Povlitzki stated that if you go up the stairs from the entryway, you would go right to a closet. That will be made into a hallway with 4 steps up into the addition on top of the garage. Mr. Kuechle stated that they are taking the garage roof off and that would be an eight foot wall. Mr. Povlitzki stated that they are thinking that rather than going the full eight feet in the front they could possibly go with a_five or six foot wall so it does not look so high. The back will probably be a little higher, but they do not want it to look awkward. Dr. Vo� asked if he knew why the garage was set back 31 feet �ather than tt�� �5 fee�:� Mr. Bolin stated that was to save a window that is located behind the garage. Dr. Vos asked if the neighbor to the east was okay with this. Mr. Povlitzki stated that the neighbor does not have any concerns. There are no windows on the east side. Ms. Jackson and Mr. Tynjala concurred with Dr. Vos. Mr. Jones stated that he would vote in favor of the variance. Mr. Kuechle stated that he, too, would vote in favor of the variance. The house to the east is lower so it would tend to look less towering which mitigates it a little. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING WAS CLOSED AT 7:43 P.M. ., APPEALS COMMISSION MEETING, AUGUST 23, 2000 PAGE 4 Dr. Vos stated that it seems like a reasonable request and is not encroaching any more than the garage is already. The neighbor to the east is not concemed about it. Putting the entry level with that garage seems to be reasonable. He would vote in favor of the variance. Ms. Jackson and Mr. Tynjala concurred with Dr. Vos. Mr. Jones stated that he would vote in favor of the variance. Mr. Kuechle stated that he, too, would vote in favor of the variance. The house to the east is lower so it would tend to look less towering which mitigates it a little. MOTION by Ms. Jackson, seconded by Mr. Jones, to approve Variance Request, VAR #00-23, by Marti and Nina Povlitzki, with two stipulations: 1. The petitioner shall obtain all necessary building permits prior to construction. 2. The petitioner shall be architecturally compatible with existing home.
