Dear Mr. Kerl:
On May 4, 1988, it was acnfim�d by an on-site inspection that the property
at 520 Hugo Street N. E. does not meet the minimum standards necessary to
mair�kain a pleasant and prosperous suburban environment. While major o�de
requirenents are satisf ied, the following item does not comply with the
perfonaanoe stanc]ards of the City Code:
L Operation of an illegal business in an R-1 district. While home
occupations are allawed in the City of Fridley, there are several
restrictians on their operation. At this time the City is requesting
that you vol�ntarily oease and desist aperatian of this business. Please
make arrangements to find a legal location for the operation of this
business by May 16, 1968.

Zaning Code.
Your imnediate actian to wrrect this situation would be a cgeat 3mprove�ment
for your property a�d the entire aa�m�nity as well. An inspection w311 be

Sane time before May 6, 1988, I reaeived a ooqnplaint frcxn a Fridley resident
regarding the operation of a medianical manuf act uring business at 520 Hugo
Street N.E. �is address is zoned One F�nily Dwelling District, R-1. The
aomplainant stated that there was a considerable amount of noise from the
site, and that traffic to and fran the site is a problem. The complainant
also stated that there was a'�ired man" employed at 520 Hugo Street N. E.
On May 6, 1988, inspection of 520 Hugo Street revealed evidenoe � some type
of manufacturing activity occurring in the garage. This officer did not
tresgass on to the property. Tools and equignent in the garage associated
with the manufacturing of inechanical parts were visible fram the public
ri5ht-�f-way, A ten (10) day notice of non-compl iance was issued and
delivered throu� aertified mail.
On May 9, 1986, Mr. Kerl phoned to request I meeting. I later had to
reschedule the meeting. When I phoned Mr. Kerl at 784-0337, he answered the
phrne with the business indentification of "Mechanical Speciality." This
phone ntmber was listed in the Fridley white pages under Alfred A. Kerl of
520 Hugo Street N. E. I later oonsulted the FYidley yellaa gages and fo�nd no
listing for "Med�anical Speciality. "
The Zoning Code does allaw hane occupatioa�s in One Fa�nily Dwelling Districts,
R-1. Several restrictions are imposed on the operation of hane oocupations.
The definition of a hane occupation in the City Code is:
34. Eane Occupati�.
Any occupation or profession engaged in by the occupant of a dwelling unit
and carried on within the tnit and not in an accessory building. Any home
oocupation shall be clearly incidental and seoondary to the principal use of
the prenises and shall not ci�ange the residential diaracter. The following
are criteria af hane oocupatians:
A. Professional offices, minor regair services, photo or art studios,
dressnaking, teaching and similar uses.
B. No stock in trade is stored outside the dwelling �it.

C. No over the v��ter retail sales are involved.
D. �htranoe to the hane occupation is gained fran within the structure.
E. Tead�ing is to be limited to six (� or less studerits at any given time.
F. Licensed hcene based Family Day Care that serve twelve (12) or fewer
d�ildren when one (1) care giver is provided and licensed hame based Group
F�►ily Day Care that serve fourteen (14) or fewer dlildren when two (2) care
givers are prwided, as defired b� the Minnesota Rule, Parts 9502.0300 to
9502.0445. (Ref. 864)
G. In addition to spaoes reyuired by the occ�pant (fanily), there is no need
for more than two (2) additional g�rking spaoes at any given time.
H. bnplayees shall oonsist o� manbers of the i�nediate fanily only.
Clearly, the hane oocugatio� at 520 Hugo Street N. E. is not inoompl ianoe with
the oode. �is home occupation is occurring out of the garage rather than
f ram with in the dwell ing unit. When v iew ing the pr ope r ty f ran the publ ic
ric,-ht-of- way the hane oocupation appears to be a prinicipal use rather than
an inciderital �se. �e noise associated with this home occupation is not
dzaracteristic of a residential district.
Other possihle violations of the section of the code are: the storage of
stock and trade outsicie the dwelling unit; over the counter retail sales;
entranae to the hane occupation is not obtain throuc,� the dwelling unit; and
emgl ayee shall oonsi st of ism�edi ate f am ily ma�bers.
Staff recoo�nencls that Mr. Kerl be given sixty ( 60) days to relocate. If
a�ter sixty (60) days Mr. Kerl has failed to relocate or demonstrate a good
faith effort taaard relocation staff recoommends forwarding the matter to the
oourt for legal action.

I am writing as a matter � follaa-up to our May 11, 1988, meeting. �e City
of Fridley staff is pleased with your quick and reasonable response to the
May 5, 1988, rr�tioe o� r�onoompl ianoe.
It was explair�ed to you by Jock L. Rohertson, Comn�nity Developnent Director,
and myself that the operati� of a mechanical manufacturing business in a
One- Family Dwelling District, R-1, was absolutely illegal. There are no
a�ninistrative prooedures or germits �nder which this �se would be permitted
in an R-1 district. This activity is pernitted in either a Liqht or Heavy
Industrial District, M-1 or M-2. I have attadled copies of these two section
of the City Code for your review.
You have agreed to relocate your business in a legally zoned location by
Septenber 1, 1988. The City staff is in agreement with this deadl ine and
wishes to meet with you on Friday, July 1, 1988, to cietermine your progress
towara meeting this deadlirye.

Dear Mr. Kerl:
The City of Fridley has established a City Code for the purpose of promoting a pleasant
and attractive suburban environment A recent inspection of the property at 520 Hugo
Street N.E. revealed that not all Code requirements are presently being met. Listed below
is an item which does not comply wi#h the City Code:
1. Discontinue outside storage of a pickup truck topper located "4-sale" in the front
yard.
Your prompt attention in correcting this situation would greatly assist us in helping make
Fridley a better place to live. An inspection will be conducted on or shortly after May 25,
1996, to determine compliance.
