Mr. Bolin introduced Mr. Ben Martig, who has been an intem with the City of Fridley
since last September. Mr. Martig did the research for the first variance request and will
present the staff report for that request.
1. PUBLIC HEARING: CONSIDERATION OF VARIANCE REQUEST. VAR #99-
04. BY DEBRA STRAND:
Per Section 205.07.03.D.(1) of the Fridley Zoning Code, to reduce the front yard
setback from 35 feet to 29 feet to allow the construction of an enclosed porch on
Lots 35 and 36 and the west 10 feet of Lot 37, Block H, �Riverview Heights,
generally located at 590 Hugo Street.
MOTION by Ms. Beaulieu, seconded by Ms. Mau, to waive the reading of the public

Mr. Martig stated the property is located at 590 Hugo Street. The petitioner is
requesting a decrease in the front yard setback from 35 feet to 29 feet for a 120 square
foot open air, covered porch. The home is loc�ated on a corr�er lot. The porch addition
is proposed at the front of the home.
Mr. Martig stated the petitioner stated the hardship for the request included the
deterioration of the front steps and sidewalk, prevention of water running into the
basement, prevention of ice build-up in the winter; and improved safety for older visitors
and the handicapped.
Mr. Martig stated the porch was taken from the rambler redesign example provided by
the City; however, the proposed porch will actually be on the opposite side.
Mr. Martig stated staff has no recommendation regarding this request because the
request is within previously granted variances. If the Appeals Commission chooses to
approve the request, staff recommends the following stipulation:
1. The property owner shall obtain required building permits prior to construction.
Dr. Vos asked if it makes a difference if the porch is open or enclosed for this type of
variance request. Could the petitioner enclose the porch without coming in for anotheP
variance?
Mr. Bolin stated, yes.
Mr. Martig stated he thought they would need a separate permit if they were putting in
electricity.
Ms. Mau asked if the setback was different because it was a comer lot.
Mr. Martig stated he did not believe so. The front yard is th� same, although the side
yard is different.
Ms. Strand stated she was very concemed about the first statement that said this was
an enclosed porch. She spent a lot of time talking with people and showing a copy of
her plans because neighbors were concemed that this would be a screened-in porch o�
the front of the house. She does not foresee enclosing the porch at all. As far as the
electricity, does that mean that if the porch was enclosed, she would then need a
different permit?
Mr. Kuechle stated that when anyone changes electrical service, an electrical pePr�i� i�
required.
Ms. Strand asked if she needed a permit for a light.
Mr. Kuechle stated it does not make a difference. This is a State requiPer�ente

Ms. Strand stated her only comment was to clarify that this is an open porch. The only
difference in her porch is that the base will be enclosed with a materiai that will match
the siding of the house. Staff approved this.
Ms. Beaulieu asked if the neighbors opposed the request after they leamed the porch
would be open.
Ms. Strand stated they did not say much after that so she does not know.
Ms. Mau asked if staff had received any comments.
Mr. Martig stated he has received no comments.
Mr. Rider stated he lives next door to Ms. Strand. He is the neighbor that would be
most affected by the proposed porch. He has no problem with the porch as proposed.
He believes it will be a valuable asset to her house that in tum is a valuable asset to
their neighborhood and an asset to him as well. She has done construction projects in
the past. They are neat, tidy and clean. He was sure this one would be the same.
MOTION by Dr. Vos, seconded by Ms. Beaulieu, to close the public hearing.

THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:43 P.M.
Ms. Beaulieu asked if there should be a stipulation that the porch stays open.
Mr. Bolin stated it is very difficult to do that.
Dr. Vos stated that in previous variances, some were covered entrance foyers so there
is a precedent.
Mr. Jones asked why it makes a difference.
Mr. Kuechle stated an enclosed porch gives the feeling of coming out further into the
front yard.
Mr. Jones stated that, if approved, the petitioner can build the porch and at some point
in time enclose the porch without another permit.
Mr. Kuechle stated, yes. It would require a permit, but not another variance.
Dr. Vos stated he would support the request. It seems like it is in the spirit of the code,
It does not stick out too far for the neighborhood. The property owner to the east who is
most affected is here and supports it. He would vote in favor of the request.
Mr. Kuechle concurred. In the neighborhood, the houses are spread out enough that
this does not give the feeling that the porch is sticking Uray out in reference to the other
houses. He would vote in favor.

Mr. Bolin stated the property has an interesting history. Th property was platted in
1961 and was zoned R-2 at that time. In 1963, Mr. Ed Chie obtained building permits
for an eight-unit apartment building on that lot, but it was nev built. In 1964, the City
changed the zoning so that only duplexes were allowed in the -2 zoning district. The
eight units that were proposed were no longer allowed in that d trict. In 1970, Mr.
Chies sued the City trying to obtain the original building permit. settlement basically
allowed the R-3 standards to be applied to the property, and Mr. hies would be
allowed to build the eight-unit building. In 1986, the zoning maps ere accidentally

ANALYSIS
Section 205.07.03.D.(1) requires a minimum front yard setback of 35'. The applicant is
seeking to decrease the required front yard setback from 35' to 29' to allow the
construction of a 120 square foot °open air" front porch. An open air porch is typically
constructed of wood or wood altemative with a roof supported by posts.
The proposed porch would be 20' in width and extend 6' from the front of the home.
Drawings of the new porch suggest that it would architecturally enhance the front of the
home.
The proposed porch is modeled after the Daily Homes Rambler, Remodeling Plan #2 of
the �Fridley Remodeling Handbook; Rambler Edition° (see attacheo�. However, the
porch is planned to be located on the opposite side of the home as depicted in the
model plan.
