Mr. Bolin stated that the property is zoned R-1 single family residential. The lot was platted in 1922, and the home was built in 1961. The garage was built in 1962. The petitioner's home is on the comer of Broad and Hugo. All the properties on Broad have the same setback. The petitioners are reconstructing the existing garage in order to eliminate some structural deficiencies that currently exist. The slab inside the garage is broken up and there are problems with water rotting the doors out. The proposed garage will not encroach on the setbacks any more than the existing garage would. Mr. Bolin stated the petitioner's hardship states: "The garage cannot be built to meet current City codes due to the lack of land. Appearance wise, leaving it where it is would look much better." Mr. Bolin stated staff has no recommendation for this request as there have been similar variances granted in the past. If approved staff suggests the following stipulations. 1. The petitioner shall obtain all necessary permits prior to the demolition or reconstruction of the garage. 2. The petitioner shall build the south wall of the garage in accordance with the three- foot side yard setback requirement. 3. The petitioner shall build the south wall with all building code requirements relative to firewall construction. 4. The petitioner shall not engage in any home occupation within the garage. 5. The petitioner shall ensure that the garage shall be built to be architecturally compatible with the principal structure. � 6. The petitioner shall have a code-required hard surface driveway installed to serve the garage within twelve months of the issuance of the building permit for garage construction. Mr. Tynjala asked how close the firewall of the proposed garage would be based on a three-foot setback. Mr. Bolin stated that it would be almost six feet. Ms. Leslie stated that they measured it in May to be five feet nine inches between the garages right now. Dr. Vos asked if it was staff s suggestion that they go three feet from the lot line no matter what the neighbor's garage is so they do not have to get a variance. Mr. Bolin stated that is correct. Once it is three feet from the property line, they are over six feet from the neighboring garage. Mr. Kuechle asked if this lot meets the legal requirements for lot size. Mr. Bolin stated that the legal lot size is 7,500 square feet. At this time the lot•does not meet the size requirements, but that does not affect this petition. Mr. Leslie stated the present garage lines up with all the other garages. Ms. Leslie stated there is some space behind the garage where they would like to put a patio for the kids. Dr. Vos asked if they had any difficulty with the stipulations. Mr. Leslie asked if the firewall had to be sheet rocked. � � '1 APPEALS COMMISSION MEETING. Mr. Kuechle asked how far the neighbor's garage was from the lot line. Mr. Kuechle stated that it is important to establish the lot line. A surveyor may need to come in and find it. Mr. Jones stated that it is important to know if they are three feet from the line. The building inspector should know where the lot line is. Mr. Wil Bonine, 601 Glencoe Street, stated his garage is directly to the south, and he has no problem with this variance. MOTION by Dr. Vos, seconded by Mr. Jones, to close the public hearing. The issue of finding those lot line monuments is important to make sure they are not within the setbacks before the slab is poured. This seems consistent with the rest of the neighborhood. Dr. Vos stated that it is in the character of the neighborhood. He would be in favor of this. SUNIlVIARY OF PROJECT The petitioners are seeking to decrease the side yard on a street from 25' to 17' to a11ow the construction of new garage at the setback that exists for the present garage. Complete demolition of the e�cisting garage will occur prior to the new garage being built. All pre- existing non-conforming sta.tus will be eliminated once the original garage is demolished. Appea�ance-wise leaving it wheYe it is would look much betteY. " SUMMARY OF ANALYSIS The petitioner is reconstructing their garage to eliminate structural deficiencies that currently exist. Their plan is to reconstruct the garage with no additional encroachments. Staff recommends that the gazage be no closer to the lot line between g�a�es than 3' RECOMMENDATION City Staff has no recommendation due to the fact that these requests are within previously granted dimensions. Stipulations recommended VAR #90-14, 350 Osborne Road allowed 15' Sta.ff Report Prepared by: Scott Hickok ANALYSIS The petitioner is reconstructing their garage to eliminate structural deficiencies that currently exist. Their plan is to reconstruct the garage with no additional encroachments. Staff recommends that the garage be no closer to the lot line between garages than 3'. This will require that when the garage is reconstructed that it be moved toward the deck (north) approximately 2 feet. Code requires a minimum setback of 3' from a property line such as this. Moving the garage north will eliminate the need for a second variance. Because the neighbor's garage is closer than 3' to its property line, a cumulative total of 6' of separation cannot be attained without moving the Meinicken/Leslie garage even further north. Therefore, a firewall separation will be required, on the south wall of the new garage, if the new garage is constructed closer than 6' from the neighbor's garage. A firewall sep�ration is basically achieved through the utilization of specific sheetrock and the elimination of all windows and doors on that wall. If the Commission recommends approval of this variance, staff recommends a stipulation regarding the fire wall. RECOMMENDATION City Staff has no recommendation due to the fact that these requests are within previously granted dimensions.
