BEFORE THE
BOARD OF APPEALS
TO WHQM IT MAY CONCERN:
NOTICE ZS HEREBY GIVEN THAT the Board of Appeals of the City of Fridley
will meet in the Council Chamber of the City Iiall at 7:30 P.M. on 7�e�day,
April 13, 1971 to consider the following matter:
A request for a variance of Section 45.053, 1B,
Fxidley City Code, to reduce the minianum lot
area, for a lot recorded before December 29, 1955,
from 7,500 aquare feet to 5,500 square feet to
allow the construction of a dwelling on Lots 3 and
4, Block R, Riverview Heights Addition, the same
being 611 Sugo Street N.E., Fridley, Minnesota.

MOTION by 8arju to receive the letter from Ms, Brieder.
Seconded by Drigans. Upon a voice vote, there being no nays, the motion carried
unanimously.
Mr. Wade continued the garage will be placed 8 feet from the property line because
of a 6 foot drainage and utility easement mnd will be constructed to match the
house.
MOTION by Drigans to close the public hearing.
Seconded by Harju. Upon a voice vote, there being no nays, the �tion carried
unanimously.
MOTION by Harju to recommend to the Council approval of the variance with one
stipulation: The construction trim of the garage-�match the haaae to enhauce the
appearance of the property.
Seconded by Drigans. Mr. Drigans added he felt the hardship was the fact that
the garage would have to be set back far on the property to meet the Code
requirement and the applicant would lose a lot of his back yard. The applicant
is just trying to line up his garage with his home.
Upon a voice vote on the 1�IOTION, there being no nays, the motion carried unaniffiously.

Mr. A1 Williams was present to present the request. He presented a sketch of the
lots to the Board which ahowed that each lot is 25 feet by 110 feet.
Mr. Williams stated the land or either side of these lots is built on so there is
no additional adjacent property available to obtain to add to the lots to make a
larger building site. He continued the house will be 26 feet by 38 feet with a
10 foot setback on the West aad a 14 foot setback on the East for a driveway. There
will be no garage•

Mr. Williams had been requeeted by the City Council at the Council Maeting of
Apri1 19, 19'71 to bring hi� buildinq pl�ns back Eor Council review whqn they

were ready. Councilman H�rris asked about the Ordinance requiremen�s £or
a garaqe. The City Enqineer said that on substandard lots there is not a
requirement to build a garage, the only requirement is for a hard sux�face
drivew�y. I3� ,pointed out tha� if this is granted, it will be the first
permit without a garage this year. The Cowncil studied the side �ard
varianGes, arid agreed it would be a difficult lot to put a garage on.
Councilatar� Kelshaw mentioned the possibility of a carport, but Mr. Williams
was not �.n favor of this. Councilman Harris asked ha� many similar lots
were left �n t.1ze area and the City Engineer answered there were about a
half dozen �.n this area.
MOTION by Coun�ilman Breider to approve the building plans and issue the
building pexzuit. Seconded by Couricilman Liebl. Upon a voice vote, all
voting aye, M,ayor Kirkham declared the motion carried unanimously.
Robert Schroer, E_ast Ranch Estates, Permit for Swimmin Pool Sales •
Mr. Robert Schroer introduced Mr. Andie Haugen who is interested in leasing
space fra� Mr. Schroer for displaying his swimming pools. Sales would be
conducted fx�n a moveable building which would also be saleable as a
dressing room or cabana type building. Mr. Schroer said they were not
clear whether they would need a permit to sell swi�ing pools and also
whether a permit was needed for the building.
Mr. Schroer explained just where.the pool sales w�ould be located and said that
the area would be landscaped. The Council studied the plan that was
presented. Councilman Harris said that this would require a special use
permit and he read the part of the Ordinance covering sale of inerchandise
in the open rather than in a salesroom. The City Engineer explained that
there is nqi a yearly license required, but will be a special use permit
covering a certain time limit.
The Council said that this would need a hearing before the Planning Com-
mission, and the Commission would ordinarily set up a public hearing
before the surrounding property owners, but as there are only a couple
of surrounding �roperty owners, perhap� if they were willing to waive the
public hearing, it could qo to the Plaraning Ca�mission for their recam-
mendation at their meeting of May 6th, and c�e back to the Council at
their meetin� of May 10, 1971.
There was a discussion reqarding the building that will be used. The City
Attorney said that he would really think this would be called merchandise
rather than a building as it is saleable, and will not be there permanently.
Councilman Liebl pointed out that each year Holiday puts up a temporary
building outdoors which does not require a permit. Councilman Harris asked
if the building would be removed after the season is over. Mr. Schroer
said that agr�e�aent with the swimming pool c�apany was for one year, with
a one year option. Councilman Harris felt that the Planning Coma�isaion
cauld set some mutually aqreeable stipulations on how long the building
could be on the premises. The City Engineer said that he would work with
Mr. Schroex to see if the waivers could be received fra� the other pro-
perty owne;s . .
