Sec�io____n 2� The Inspector of Buildinga shall, before isaui�g any pe�rmit for
thF� erection of anp buildiag or structure, or for any add3,tion to aay exis�-
ir� building or strucCure, ox for any► al.terations or repaixs to an� e�is��.ng
bu3Zdin� or stiructure, upon application therefor, require the gaymen� U� the
applicant for such permit of fees t0 the amount herein below set forth a��
in the manner herein provided to-wiC:
2.1. For any such permit �or the erection o,f any fire-proof building, other
thrn a garage� warehouse, factory or grain elevator, or for the erection of
any fire-proof addition, for s3mi.lar occupancy, to any existing buildis�g
shal�. be at the rate of $1.40 for each one thousand cubic feet, or frac��.�n
tl?ereof, in such cubical coatents.
2a2. For any such permit for the erection of any fire-proof garage, wasehouse,
factozy or gra3.n elevator, or for the erection of any fire-proof e�ditic�n,
�or similar occupancy, to any existiag building shall be at the rate o� $1.25
fo�r each oae thousand cubic feet, classified as 01f3.reproof11 by Section 502 of
the Mitsneapolis Building Code.

1. The sound level requirements oP this section shall apply at the
property or zoning lines of the sound receiving unit. Measurements may be
made at any location on the property for evaluation purposes and to aid in
the enforcement of other sections of this Chapter.
2. The sound levels as atated below �hall be the highest sound levels
permitted in each of the zoning districts as defined in Chapter 205 of the
Fridley Code.

3. Sound levels resulting from cumulative travel of motor vehicles on
State and County highxays and railroads are exempt Prom these Receiving
Land Use Standards but not other sections of this Chapter relating to
motor vehicles and railroads. Thi� does aot exempt individual motor
vehicles from any and all federal� State� or local regulations. It is the
intent of the City to reduce highway noise in the various land areas
surrounding highxays to, or belox, the requirements of this section when
and wherever possible.

Re: Placement of Air Conditioners in Side Yards
Dear Mr. Ruusisto:
In answer to your inquiry about the placement of your neighbor�s central
air conditioner in his side yard adjacent to your house, We offer the
following:
First, ve have enclosed a copy of the appropriate City Ordinance.
Please note that to place an air conditioner ia the side qard, he needs
to obtain a Citq Permit. The City poliey is that prior to the issuance
of the permit, he Would need your xritten permission on the installation
in the side yard.
If he is unable to obtain the xritten statement from you, We will then
test the sound transmission level of his unit and if it does not meet
the standard� they Will either have to move the unit or install a sound
control device to bring it into eompliance vith the Code.
Please take special note to the statement in the Ordinanee that WindoW
air conditioners must also meet the sound transmission standards. This
means that unless the two of you can resolve this issue, We must
undertake the sound tests oa both units and enforce the Ordinance
uniformly.
We Will make the tests, if necessary, at your eonvenience or certainly
not later than June 1� 1983 so that the situation can be resolved prior
to the 1983 cooling season.

Section 2. The Inspector af Buildinga ahall, before is's�iag anq perroit for
e�ie erection of any building or atructure, or for anq addition to any exiet-
ing building or structure, or for mny alteratioas or repairs to any e�is�ing
bu3ldiag or etructure, upon application therefor, require the pag►men� by the
applicant for such permit of fees to the amount herein below aet forth �nd
in the manner herein pxovided to-wit: -
2.1. For any auch permit for the erection o.f aay fire-proof building, othex
�han a gar�ge� warehouae, factory or grain`elevator, or fos the erectioa of
anq fire-proof addition, for similar occupancy, to anq exiatiug building
shall be at fi�ie rate of $1.40 for each oae thousand cubic feet, or fraction
thereof, in such cubical contents.
2.2. For aay such permit for �he erection of any fire-proof �arage. warehause,
factory or grain elevator, or for the erection of any fire-proof additioa,
for similar occupancq, to any existiag buildiag shall be at the rate of $1.25
for each oae thousaad cubic feet, clas�ified as "firepraof" by"Section 502 of
the l�•inneapalis 8uilding Code.
