Re: Refuse Container Placement and
Re£use on Ground
During a routine inspection o� the refuse handling procedures used in your`
neighborhood of Fridley, it was determined that you were maintaininq your refuse
containers on the boulevard and allowing refuse to gather by your mailbox.
Section 113.04 of the City Code states that, "The cantainers shall be placed
in the reax of the premises, or may be placed in the side yard setback if screened
so as to be out of view from the street and from adjoini.ng properties or in a
garage located on the premises. In no event shall containers be placed aext ta
the street or curb or be placed or ma.intained in such a way as to unreasonably
interfere with the use of adjoining property." Also Section 113.08 of the City
Code states that, "Any acctunulation of refuse on any premises not stored in
containers which eomply with this chapter, or any accumulation of refuse on any
premises is hereby declared to be a nuisance and shall be abated by order of the
Health Authority".
Subsequently, you will be required to remove your cvntainers from their
present location to a position in compliance with the aforementioned sectian,
and clean and maintain the boulevard free of all deposited refuse. A mernber
of the City staff will be conducting a reinspectian on or about ten (10) days
from the date of this letter to determine compliance.
At this ti.me I would bring to your attention the requirement that allaws
food waste products and similar garbage to be stored only in approved, meta.l,
30 gallon or smaller, refuse containers with the lid in place. This pre.cludes
the use of plastic bags as a container for garbage unless inside a metal con'�ainer.
The City is confident in your cooperation and desire to ma,ke Fridley a
better community to live in. If any questions or problems arise from this letter,

It was brought to the City's attention on March 26, 1979 tha.t you are
doing automotive repairs out of your garage.
Although the City Code does permit home occupations, they must be
conducted in accardance with the requir enents as stated in Section 205.02
of the Fridley City Zoning Code, which defines a permitted haane occupation
as;
"Any gainful occupation or profession engaged in by the occupant
of a dwelling at or from the dwelling when carried on within a
dwelling unit and not in an accessory buiTding (garage) and
which is clearly incidental and secondary to the residential use
of the pr�nises and does� not change the character thereof,
provided that no signs other than those norma.11y utilized in a
residential disLrict axe present, no stock in trade is stored
outside the building, over the counter sales are not involved,
and entrance to the home occupation is gained fram within the
structure. �uch use includes prof essional offices, minor
repair services, photo or art studios, dressnaking, or teachinq
and similar uses; however, a home occupation shall not be
interpreted to include tourist homes, restaurants, or similar
uses. Teaching shall be limited to four (4) students at any
given time. No home occupation shall be permitted that results
in the need for more than two (2) parking spaces at any given
time in addition to spaces required by the occupant (family).
Occupations requiring the hiring of �nployees other than members
of the iuunediate family shall not qualify as home occupations."
Therefore, the City is sending you this letter to insure any hame occupation
complies with the above listed section of the City Code.
