PUBLIC PURPOSE SERVED BY REQUIREMENT: Section 205.053, 4, A, requiring a front yard setback of 35 feet. Public purpose served is to allow for off-street parking without encroaching on the public ri�ght of way. Also for aesthetic con- . sideration to reduce the "building line of sight" encroachment into the neighbor's fro�t yard. Section 205.053, 4, (B,2), requiring a minimum of 5 foot side yard from an attached garage. Public purpose served is to provide space between individual structures 5o as to guard�against radiant heat which would spread a fire from one structure to another. Tt also provides sufficient access into the rear'yard for emergency purposes. It also reduces the condition of overcrowding of the residential neighborhood. 6. STATED HARDSHIP: This is the best alterrative in order to (1) save the kitchen window, (2) maintain lower level bedroom on the West side of the house, (3) retain trees, landscape and creek surroundings on West side of house, and (4) provide for a patio on the West'side of the house. C A.DMINISTRATIVE STAFF REVIEW: The proposed garage addition will project 17.5 feet from the house to the East property line, It will also encroach approximately 4 feet .iato the front yard, The Southeast corner of the proposed garage will 6e approximately 20 feet from the neighbors detached garage which is set back near the rear property line. The neighaor's house is over 20 feet from the proposed garage wall. The petitioner would like to shift the garage forward into the front yard in order to save the kitchen window on that side. In addition to the existing curb depression and driveway, the other reasons given for placing the garage on the East side are to save a lower level bedroom, retain landscaping and trees and provide for a patio. Technically it would be "possible" to build on the West side, but it would be more costly. The soil conditions on the West (creek) side may also increase the costs of alternative eonstruction on the West side of the house. The zero setback would no� restrict rear access to the house for fire fighting purposes, and the separation between buildings is 20 feet. A full one hour rated separation wall with no openings will be required in the East wall of the garage. Staff feels that the owner should be advised to enter into some recordable agreement with the neighbor to the East in order to trespass during construction, snow removal and future maintenance on the East wall of the garage. The f�or�t:and sideyard setbacks as a matter of objection.will have to be considered in the light of any of the neighbors concerns. _��� . Public purpose served is to allow ior off-street garking without encroaching on the public right of way. Also for aesthetic consideration to reduce the "building line of sight" encroachment into the neighbor's front yard. It also provides sufficient access into the reax yard for emergency purposes. It�also reduces the condition of overcrowd- ing of the residential neighborhood. B. STATED HARDSHIP: This is the best alternative in order to (1) save the kitchen window, (2) maintain lower level bedroom on the West side of the house, (3) retain trees, landscape and creek surroundings on the West side of house, and (!�) provide for a patio on the West side of the house. C. ADMINISTRATIVE STAFF REVIEt�J: The proposed garage addition will project 17.5 feet from the house to the East property line. It will also encroach approximately 1� feet into the front yaxd. The Southeast corner of the proposed garage will be approximately 20 feet from the neighbor's detached garage which is set back near the rear property line. The neighbor's house is over 20 feet from the proposed garage wall. The petitioner would like to shift t:�e garage forwaxd into the Sant yard i.n order to save the kitchen window on that side. In addition to the existing curb depression and driveway, the other reasons given for placing the gaxage on the East side are to save a lower level bedroom, retain landscaping and trees and provide for a patio. Technically it would be "possible° to build on the �ti'est side, but it would be more costly. The soil conditions on the West (creek) side may also increase the costs of alternative construction on the West side of the house. The zero setback would not restrict rear access to the house for fire fighting purposes, and the separation between buildings is 20 feet. A full one- hour rates separation wa11 with no openings will be required in the East wall of the garage. Staff feels that the owner should be advised to enter into some recordable agreement with the neighbor to the East in order to trespass during � construction, snow removal and future maintenance on the East �rall of the garage. The front and sideyard setbacks as a matter of objection will have to be considered in the light of any of the neighbor's concerns. Mr. and Mrs. David Swanson were present� along with I�Tr. Kenneth Sporre, builder. Mr. Sporre showed the Commission plans of the house and explained how they would be attaching the gaxage, and said it would basically be a duplicate of the Capp model home with the brick and the trim. He explained that it would look like a split-entry home� and said they would be adding�windows and improving the whole house, and wouldn't be just adding the garage. Mr. Sporre stated they had asked the neighboring property owners if they had any objections, and presented the Board with seventeen letters from the residents stating they had no objections to the building of the garage. ��, � . ' "�� Fridley Appeals Commission Meeting - October 12, 1976 Page 3 MOTION by Gabel, seconded by Plemel, that the Appeals Commission receive the seventeen letters in reference to the request for variances. Upon a voicE vote� all voting aye� the motion carried unanimously. Mr. Sporre stated that this was basically the only place a gaxage could be put on the property. He said that they would note on the survey that the neighbor�s garage was very close to the lot line i.n back, and that was ��hy the Swansons would have to go fortirard; also because there was only one window in the kitchen at this time and they didn't want to lose it. He explained the garage would be brought right up to the window. Mr. Sporre added that the other side of the lot was low and close to the creek� so this was about the only place a garage could be built. He said it would be a small double garage, but two caxs would fit. Mrs. Schnabel asked if the garage would protrude slightly in front of the house. Mr. Sporre answered that it would, and explained i;hat t�as why tney were going with the roof line they had chosen--to tie them together. He said that the way it existed now the front of the house faced the street, but in essence when they got done it would face the creek. He added that both sides of the garage would. be fire walls. Mr. Gabel said she had gone out and looked at the property, and it seemed to her that this was the only feasible plan. Mrs. Schnabel asked hotr soon they planned to start construction, and l�r. Sporre answered they would start as soon as they were granted the variances. P�Zr. Swanson said that the driveway and curb depression were already in. He said the house was about 12 years old, and they had owned it for almost six years. He did not have a garage at the present time. Mrs. Schnabel said there had been some discussion in the Staff Report on making an agreement with the neighbors as far as tresspassing for snow removal and during construction of the garage. She stated she thought that maintenance of the East wa11 should be a consideration from the neignbor's standpoint because that side of the garage �rould face the Seegers. rTr. Swanson said that he lrnew the Seegers and that would be no problem. A�Irs. Schnabel asked if the overhang would stop at the property line� and I�ir. Holden said it would. Pir. Holden commented that other than the agreement �rith the neighbor to the East concerning trespassing� he had no questions. Mrs. Schnabel asked about the strip of land between the two properties, and Mr. Sporre stated that most of that belonged to the Seegers. He said they had some small trees there now� and would probably just plant some shrubbery. Mr. Barna asked what type of siding they would be using, and Mr. Sporre replied they would use masonite� the same as the house. . MOTION by Barna, seconded by Plemel, that the Appeals Commission close the Public Heaxing. Upon a voice vote, a11 voting aye, the motion carried unanimously. Mr. Plemel said he was wondering if the agreement should be in the form of an easement and be recorded, and r1r. Holden sa.id that was basically what he had in mind. hir. Mr. Barna commented that he thought the plan yrould be a great improvement� and the hardships �ere all viable and sensible. Mrs. Gabel added tnat even if they could build the garage on the other side, the� would have no yard. Mr. Plemel asked how wide the lot was� and Mr. Barna said it was 83.6�' in the front and 82.3' � the rear. � MOTION by Barna, seconded by Gabel, that the Appeals Comm�ssion approve the request for variances with the stipulation that a three foot easement be obtained from the property owner to the East for maintenance of that side of the garage. Upon a voice vote, all voting aye, the motion caxried unanimously.
