Mr. Bolin stated the pet�tioner is requesting a variance request to reduce the front yard setback from 35 feet to 28 feet to allow the construction of a 96 square foot covered entrance/foyer. The code requires a minimum front yard setback of 35 feet. Currently9 the petitioners home sits back approximately 36 feet from the front property line. They are planning to construct an 8 foot x 12 foot foyer on the front of their home which would decrease the front yard setback to 28 feet. The property is zoned R-1, Single Famlly, as are the surrounding properties. !'� ^ APPEALS COMMISSIOn :ETING, APRIL 14, 1999 PAGE 2 Mr. Bolin stated the petitioner's summary of hardship states, °Our existing entrance is currently 3 feet x 6 feet. Unfortunately, due to the proximity of the entrance to the staies, it has been unusable for us. The door is centered on a newel post that restricts greeting space. We also have concems for disabled family members navigating entrance to our home safely." Mr. Bolin showed a photo of the home as it currently exists and a drawing of the home with the proposed addition. Mr. Bolin stated staff has no recommendation due to the fact that this request is within previously granted dimensions. If the Appeals Commission chooses to approve the variance, staff recommends the following stipulation: 1. Property owner shall obtain building permits prior to construction. Mr. Kuechle stated the site survey shows the street width as 33 feet. He asked if there is a boulevard in that area or is the lot line and street line one and the same? Mr. Bolin stated that in looking at the diagram, it appears that they are the same. He did not believe that Ironton was paved the full 33 feet. He thought the street was somewhat less than the 33 feet. There may be a one to two foot boulevard on each side of the street. Mr. Kuechle stated his general impression was that the street is a bit narrow. Mr. St. Amold stated he had no additional comments. His sister-in-law has a prosthetic leg, and recently she has been confined to a wheelchair due to complications following a kidney transplant. It is difficult for her to visit with the front foyer as it is, because there is little room to maneuver the wheelchair. It is also restrictive for elderly parents. He works in construction, and OSHA would not allow an entrance such as this. He would like to expand the entrance, have a little more storage with closet space in the additiono and decorate the house a little bit. Ms. Mau stated that refemng to the diagram of the proposed entrance, the petitioner would have a window facing the street and the entrance would come in from the side where the driveway is located. Mr. St. Amold stated that is correct. There will be a cedar sidewalk from the driveway to the new entrance. The sidewalk and railing will be done in cedar. They will not have � ramp but small steps. Dr. Vos stated it seemed that not everyone is set back 35 feet in this neighborhood. Some are closer. It is not very consistent. The petitioner's house won't be that much different than some of the other homes down the block. Mr. St. Amold stated the setbacks do vary. He thought it just depended on when the houses were built. His house was the last one built in 1988. The other houses on t�� street were built mainly in the late 50's or ear8y 60's. . � . He asked if the petitioner had received any comments from the neighbors. Mr. St. Amold stated that when they first moved to the house, there was no landscaping by the Creek and there were erosion problems. He has worked on that. He has done a lot of work around the house and yard to enhance it. He put in a shrub fence across the front. The neighbors are always curious about what this year will bring. He has never had a problem with any of his neighbors. He enjoys his neighborhood. He is just trying to enhance their home to help them be able to stay. Dr. Vos asked if staff had received any comments from the neighbors. Mr. Bolin stated he did not receive any calls. Mr. Kuechle asked if there is a boulevard between the lot line and the curb. Mr. St. Amold stated that when a survey was done two years ago� the surveyor measured from the street to the beginning peg. From the ground peg to the back side of the curb is 17 feet 6 inches. Mr. Kuechle stated he thought there was something special in the ordinance about a storm shelter or an energy efficient entrance. Mr. Bolin stated there is something in the ordinance. He believed that one could encroach into the front setback 5 feet if the covered entrance is under 40 or 50 square feet. The code basically allows a small vestibule on the front of a house, but this is larger. Dr. Vos stated it seems like the neighborhood has inconsistent setbacks. That is to this homeowner's advantage in that his house will not be much different along the street by having the proposed entrance. The petitioner also has some configurations on the lote He cannot build to the east. The lot is also not rectangular. It has a cut off on the side so there are some topography things. This request seems like a minimal encroachmen� into the front yard. It does not destroy the neighborhood. He would vote in favor of the request with the stipulation. Mr. Kuechle concurred. The iinpact is minimal in that neighborhooda The front of the lot appears significantly wider than most lots so the impact of a house on one lot sitting forward a little further will be mitigated quite by the fact that the houses are not so closeo The lines of reference are not so clear. The foyer is small as an entrance. Her brother had the same type of entrance and did the sanne thing fio his house. It improved the looks of the outside of the house as well as the value of the inside of the house. She would vote in favor of the request. Mr. Jones agreed. He did not see an impact on the neighborhood. While it may encroach into the front yard setback, it is not obvious with the other houses in the neighborhood. The house is a nice looking house now, and the addition will certainly add to the looks and improve the neighborhood. He was impressed with the photo of the entrance. He knows of several other houses in the City that have the same kind of entrance, and there is the same issue of difficulty in entering. He would vote in favor of the variance.
