11�' day of August 1999, on a petition for a variance pursuant to the City of Fridley's Zoning Ordinance, for the
following described property:

Per.Section 205.07.03D.(1.) of the Fridley Zoning Code, to reduce the required
front yard _setback :f.rom 35 feet to 18 feet for an existing home due to the
widening of East River Road and subsequent modifications to Ironton Street on
Lots 1& 4, Block G, Ri�erview Heights Addition, generally located at 500 Ironton
Street.
Ms. Skotten.id, Planning Intem, stated that the petitioners are requesting to reduce their
required front yard setback from 35' to 23' due to the widening of East River Road and
the subsequent modifications to Ironton Street. The hardship as stated by the petitioner
is.that if something should happen to their house they could not rebuild on an existing
foundation. At some point in time they could sell even though the front setback is non-
conforming without any problems. When they built 22 years ago, they placed it on the
lot as far�away from East River Road as they could. � Staff recommends approval due to
the hardship of land created by taking of added right-of-way required for East River
Road Improvement Project. This request is within previously granted dimensions.
Ms. Beaulieu asked how many properties have the same problem with the road
construction. � --
Mr. Bolin stated that 40 properties were identified a couple o� years ago as having
potential problems due to the expansion. Some of the potential problems identified a
couple of years back aren't problems at this time. Some of the proposed areas to be
taken by the County are just easements now that don't require any variances at this
time.
MOTION by Ms. Beaulieu, seconded by Ms. Mau to close the public hearing.

accessory buildings in their front yard. The two mai reasons this request has staff
support are (1) the fact that there was a building pe it for the garage granted in 1976
that had a stipulation on the permit stating that it only eeded to be setback 25' from the
south lot line and (2) the shape of the lot doesn't leav the property owners many ofheP

HARDSHIP STATEMENT
In regards to the front setback. We as the owners of the nonconforming set back wouid
like to see something in writing stating that if something were to happen to our house
we could rebuild on the existing foundation. Or at some point in time we could sell,
even though the front set back is nonconforming; with out any problems. When we built
house 22 years ago we placed it on the lot as far from East River Road as we could.
We also have our house and deck about as close as we can go to rear of our property,
making it impossible to rebuild any further to the rear. So. as you can see we
desperately need some kind of a commitment from City of Fridley conceming this
matter.

ANALYSIS
Section 205.07.03.D.(1) requires a front yard setback with a depth of not less than
thirty-five (35) feet is required. The petitioners are seeking to decrease the required
front yard setback from 35' to 23' due to the widening of East River Road and
subsequent modifications to Ironton Street.
Attached is a map of the petitioner's property. The area shaded is the area the County
is taking in order to realign Ironton Street with East River Road. The County has taken
6.5' to 20' off the northem property line for a realignment of Ironton Street to improve
traffic flow for those wishing to continue accross East River Road onto Ironton. The
petitioner will only have a setback of about 23' after the road improvements are made.
This is clearly a hardship not created by actions of the landowner.
