G, Riverview Heights, the same being 570 Ironton Street N.E., with
the following stipulation:

Ms. Dacy stated that it is recommended that Council approve this

The Assistant Public Works Director reviewed the case p�x the Appeals
(�mnni.ssion's direction, arxl he determined that the petitioner's problem
could be solved by regrading the front yazrl. However, he also indi.cat�ed
that this solution may not totally ensure that water would not enter the
house. A swale would need to be created to direct water to fl� in a
riorthwesterly direction across the petitionex's yaYrl. Regradirig will need
to occur if the foyex is constructed to er�sure that �rater is directed away
from the house.

Attached please find the above referenced staff report. The
Appeals Commission voted unanimously to recommend approval of the
variance request to reduce the required front yard setback from 35
feet to 25 feet to correct the existing nonconforming conditions.
The Appeals Commission also voted unanimously to recommend to the
City Council approval of a further variance to 21 feet if the
petitioner's water problem could not be solved by regrading the
property, with the following stipulation:
1. The petitioner shall provide a hard surface driveway by
June 1, 1992.
Staff has determined that while regrading the property would
alleviate the petitioner's water problem, it would not totally
ensure that water would not enter his house. Regrading will need
to occur if the proposed foyer is constructed.
Staff recommends that the Council concur with the Appeals
Commission action to bring the property into conformance and to
deny the request to reduce the front yard setback from 35 feet to
21 feet.

allow the construction of a 16 square foot foyer onto the
front of the house, on Lots 43 and 44, Block "G", Riverview
Heights Addition, the same being 570 Ironton Street N.E.
MOTION by Mr. Kuechle, seconded by Dr. Vos, to open the public
hearing.
IIPON A VOICE VOTE, CHAIRPERBON SAPAGE DECLARED THE MOTION
CARRIED AND THE PIIBLIC HEARING OPEN AT 8:13 P.M.
Ms. McPherson stated this property is located in the Riverview
Heights area. The property is zoned R-1, Single Family
Dwelling, as are the surround properties. The petitioner is
proposing to construct a 4 ft. x 4 ft. foyer and attached
carport to the side of the house. The carport does not
require a side or rear yard variance. However, if the
Commission approves the variance request, it would also apply
to the front line of the carport.
Ms. McPherson stated the petitioner is currently experiencing
severe drainage problems such that the lot slopes from east
to west and the water, as it flows across the petitioner's
yard, flows through the front door into the living room. The
petitioner hopes that by constructing the foyer at a slightly
elevated height, the water will be blocked and flow past the
house toward the west.
Ms. McPherson stated staff has suggested that the drainage
could be solved by regrading the front of the property to
direct water away from the house toward the street and then
toward the west. This might be simpler and less expensive for
the petitioner and accomplish the same goal.
Ms. McPherson stated the proposed variance will not have any
affect on the petitioner's parking situation.
Ms. McPherson stated staff is recommending that the Appeals
Commission recommend denial of the variance request. However,
if the Commission chooses to approve the variance request,
staff is recommending the following stipulation:
1. The petitioner shall provide a hard surface driveway
by June l, 1992.
Ms. McPherson stated that the Commission could choose to
recommend approval of a front yard variance from 35 feet to
25 feet to bring the house into conformance, and the carport

would have to start at the front of the existing house. The
carport as proposed is in line with the proposed foyer.
Mr. Mark Hillstrom stated that instead of a hard surface
driveway, he would like to put in rock as he thought it would
help with the drainage. He did not think a hard surface
driveway would help the drainage problems.
Ms. McPherson stated an acceptable alternative might be brick
paving blocks. That would allow the water to flow through the
blocks.
Mr. Kuechle asked what Mr. Iiillstrom thought about the
possibility of regrading the property to divert the water away
from the house.
Mr. Hillstrom stated he did not think regrading would work
very well because of the way the property slopes from the
north.
Ms. Savage stated that Mr. Hillstrom certainly does have a
problem. She asked if it is possible for someone in the City
Engineering Department to visit the site and see what
alternatives there are for correcting the drainage problem.
Ms. McPherson stated that might be possible.
Dr. Vos stated his main concern is that the petitioner
believes that the only way to solve the problem is by building
the foyer.
Mr. Kuechle stated he did not see adding the foyer as an
answer to Mr. Hillstrom's drainage problems. Something needs
to be done with the drainage flow.
Dr. Vos stated that the foyer is basically an air lock,
because the petitioner will have two entrances to his house,
first into the foyer, and then into the main dwelling unit.
He believed the Code says a foyer can encroach into the fror�t
yard without a variance.
Mr. McPherson stated that Section 205.04.06.A.(3) states:
"Decks, unenclosed porches, canopies and steps to building
entrances may extend not more than ten feet into any required
front or rear yard setback and not more than three feet into
any required side yard, provided they do not extend nearer
than five feet to any lot line."
MOTION by Dr. Vos, seconded by Mr. Kuechle, to close the
public hearing.

Ms. Savage stated this is a difficult decision. She did not
want to continue the nonconformance by bringing the house even
closer to the street, even though the foyer could improve the
appearance of the home and solve the drainage problem.
However, she would like see if there are any alternatives for
solving the drainage problem, other than the foyer. It is
obvious something needs to be done; and if there is not a
reasanable alternative, then she would be in favor of granting
the variance.
Dr. Vos stated he realizes that the petitioner's house is
already in nonconformance, and he is not opposed to
encroaching 4 more feet into the nonconformance, just because
of the location and the kind of hardship he saw from the road
on that front door. He did not believe the drainage is going
to be solved by digging a hole. He would vote in favor of
having the petitioner look at a foyer as one of his solutions
for the drainage problem. If, between now and the Council
meeting, the petitioner decides that he can do it by regrading
and not building the foyer, then he can just ask for the
variance for the carport.
Ms. Smith agreed. She stated she did see a hardship with this
drainage problem. She believed that granting the variance for
the foyer will improve the property, especially with the
stipulation for a hard surface driveway.
Mr. Kuechle stated he would recommend approval of a front yard
variance from 35 feet to 25 feet to bring the house into
conformance. However, he would be in favor of approving the
front yard variance from 35 feet to 21 feet for the foyer if
a drainage solution is not possible with regrading.

City Council approval of variance request, VAR #91-11, by Mark
Hillstrom, per Section 205.07.03.D.(1) of the Fridley City
Code, to reduce the front yard setback from 35 feet to 25 feet

Notice is hereby given that the Appeals Commission of the City of
Fridley will conduct a Public Hearing at the Fridley Municipal
Center at 6431 University Avenue N.E. on Tuesday, May 14, 1991, at
7:30 p.m. for the purpose of:
Consideration of variance request, VAR #91-11,
by Mark Hillstrom:
Per Section 205.07.03.D. (1) of the Fridley City
Code, to reduce the front yard setback from 35
feet to 21 feet, to allow the construction of
a 16 square foot foyer onto the front of the
