a 4 foot berm which has been placed on his property.
I would appreciate receiving a report on the complaint of a 4 foot berm on
Mr. Kell's property to provide to the City Council.

I haye had several telephone coazversations and meetings with Mr. & Nirs. Kell
regarding the grading of t��e berm on the Lake Pointe Develogner�t site east
of their pr�pext.y.
Mr. Kell claims that the bezm on the Iake Pointe site was not shown on the
plans he viewed at our public meetings and that the beun is too high.
The grading plans and landscape plans for the Lake Pointe DeveloFxnent site
both shaw the bennin �rirh Mr. Kell objects. Mr. Rell was present at the meetings
with the archit,ect at the site wh�xe tt�e plans wexe explained and also at the
public mreting at the Civic Cent� lield to infornn people of the plans for their
area. •
The berm is enti�ely on the Lake Pointe property and the only cY,anges to the
Kell's pxsoperty is saae minor grading t�o level their yard, which �ae did at
their rec;ues� and the area that was disttarbed on their property wi].1 be resodded.
The berm oai the Iake Pointe site has been se�ed and will be landscaped with
ts�ees acco�ding t�o the plans.
