A. STATED HARDSHIP:

1. By keeping the roof line and north wall continuous, the
appearance will help increase the value of the home and
homes around it.
2. Without having to angle the room, it will make the job
much easier for the contractor and save us a great deal
of added expenses to the addition.
3. To meet the ten food code, we would have to cut the size
of the room to approximately nine feet which would be too
small for a bedroom.

B. ADMINISTRATIVE STAFF REVIEW:
Request
The petitioners are requesting a variance to reduce the
required side yard setback from 10 feet to 9 feet. The
request is for Lot 6, Block 6, Donnay's Lakeview Manor
Addition, the same being 5744 Jackson Street N.E.
Site
Located on the property is a single family dwelling unit with
a detached two car garage. The property is zoned R-1, Single
Family Dwelling, as are the properties to the north, south,
east, and west.
Analvsis
Section 205.07.03.D.(2).(a) requires a side yard setback of
ten feet between any living area and side property line.
Public purpose served by this requirement is to maintain a
minimum of 20 feet between living areas in adjacent structures
and 15 feet between garages and living areas in adjacent
structures to reduce the possibility of fire. It is also to
allow for aesthetically pleasing open areas around residential
structures.
The petitioners are proposing to add an addition to the rear
of the property which will include a bedroom and an open patio
area under the roof overhang (please see attached elevation).

The lot is unusual in the fact that it is a modified pie-shape
instead of the typical rectangular lot, as is commonly found
throughout the City. There are similar lots within this same
neighborhood; however, the average width of these lots at the
location of the dwelling is wider than the petitioners' lot.
The petitioners have several alternatives that would allow
them to meet the code requirement. The alternatives include:
angling the addition so that it is parallel to the side lot
line, or reducing the size of the proposed bedroom by one
foot. Angling the proposed addition to run parallel with the
side lot line would create a skewed room in relation to the
existing house. This would also add considerable expense in
purchasing special rafters, etc., to accommodate this angle.
Shortening the bedroom by one foot would create a bedroom that
is 9 feet wide. The Uniform Building Code does not stipulate
a minimum room width; however, it does require that all rooms
of the house, with the exception of one, be 70 sq. ft. in area
(the remaining one is to be a minimum of 120 sq. ft. in area).
In speaking with Darrel Clark, Chief Building Official, he
stated that an average bedroom size for today's construction
is a minimum of 10 ft. x 12 ft.
By allowing the one foot encroachment, the impact to the
adjacent property is minimal, as the adjacent house is in
front of the addition. The property is unique in its shape
and while there are similarly shaped lots in the neighborhood,
they have greater widths where the dwelling is located to
accommodate future expansions.
Recommendation
Because of the unique shape and size of the lot and because
the proposed addition will not adversely impact the adjacent
property owner, it would be in the spirit of the code to grant
the variance to reduce the side yard setback from 10 feet to
9 feet. Staff recommends that the Appeals Commission approve
variance reguest, VAR #91-08.

To Whom it May Concern:
James and Mary Kostick, who are current owners of the residence at
57/�4 Jackson Street 1VE in Fridley have brought it to my attention
they wish to add on to the back side (�+Test) of their house. They
have explained to me the request for a varience to the city ordinance
where the footings must be ten feet from the side property line. I
understand the addition they wish to build will set the footings nine
feet from the property line. I have no objection to this addition.

CONSIDERATION OF VARIANCE REOUEST, VAR #91-08, BY JAMES AND MARY
KOSTICK•
Per Section 205.07.03.D.(2).(a) of the Fridley City Code to reduce
the side yard setback from 10 feet to 9 feet to allow the
construction of an addition on Lot 6, Block 6, Donnay's Lakeview
Manor, the same being 5744 Jackson Street N.E.
MOTION by Ms. Smith, seconded by Mr. Kuechle, to open the public
hearing.

AND THE PIIBLIC HEARING OPEN AT 7:31 P.M.
Ms. McPherson stated the property is located west of Moore Lake and
near the intersection of 58th Avenue and Jackson Street N.E. The
property is zoned R-1, Single Family Dwelling, as are the
properties surrounding it.
Ms. McPherson stated the petitioners are proposing to construct an
addition off the rear of the single family dwelling unit located

on the property. The addition will contain a bedroom and a
patio area under the roof overhang.
Ms. McPherson stated the lot is unusual in that it is not a typical
=ectangular lot which is common within the City. The lot is a
modified pie-shape. There are similarly shaped lots within the
same neighborhood; however, this particular lot is unique in the
fact that it is narrower where the house and buildable area are
located.
Ms. McPherson stated the petitioner has two other alternatives:
(1) Shortening the bedroom by 1 foot and creating a bedroom that
is 9 feet wide; or (2) angling the addition so that it is parallel
to the side lot line.
Ms. McPherson stated the first alternative to reduce the width of
the bedroom by one foot is a viable alternative; however, the Chief
Building Official, Darrel Clark, has stated that minimum bedroom
sizes seem to be 10 ft. by 12 ft. and he thought a 9 foot width was
exceptionally small for a bedroom. There is no minimum Uniform
Building Code dimensions for particular room sizes.
Ms. McPherson stated the only requirement is that rooms be a
minimum of 70 sq. ft. The second alternative would add
considerable expense to the proposed project, because special
rafters and structural materials would have to be purchased.
Ms. McPherson stated that by allowing the one foot encroachment,
the impact to the adj acent property is minimal , as the adj acent
house is in front of the addition.
Ms. McPherson stated that because of the unique shape and size of
the lot and because the proposed addition will not adversely impact
the adjacent property owner, staff recommends the Appeals
Commission approve the variance request.
MOTION by Mr. Kuechle, seconded by Ms. Smith, to close the public
hearing.

AND THE PIIBLIC HEARING CLOSED AT 7:37 P.M.
Ms. Smith stated she concurred with staff's recommendation. The
encroachment is only one foot and it is not encroaching on any
other buildings on the ne�ct lot. Practically, there is no other
alternative for the petitioner.
Ms. Savage stated she also agreed. As pointed out in the staff
report, this is a unique lot and the encroachment would not
adversely impact any other properties. She, too, would be in favor
of approval.

Ms. McPherson stated this is an update of Planning Commission and
Council actions.

meeting. Upon a voice vote, Chairperson Savage declared the motion
carried and the April 16, 1991, Appeals Commission meeting
adjourned at 7:45 p.m.
