Notice is hereby given that the<Appeals Co�ranission of the City of Fr�idley
will conduct a Public Hearing in the City Council Chambers at 6431 University
Avenue Northeast at 7:30 p.m. on Tuesday, June 15 , 1982 in regard to the
following matter:
Consideration of a Variance Request, pursuant to
Chapter 205 of the fridley City Code, to reduce
the front yard setback from the required 35 ft.
to ll ft. to allow the construction of a 22 f t.
by 24 ft. attached garage, subject to approval of
a Special Use Permit for a second accessory building,
and/or, reduce the side yard setback from 10 feet �o
5 feet on the living side of a dwelling, so the
existing garage can be converted to living area if
the Special Use Permit is denied, �11 on Lot 4,

A. PUBLIC PURPOSE SEFtVED BY REQUIFtEMENT:
Section 205.053, 4A, requires a front yard setback of not less than 35 feet.
Public purpose served by this requirement is to allow for off-street parking
without encroaching on the public right of way and also for aesthetic
consideration tA reduce the building ".line of sight" encroachment into the
neighbor's front yard.

area.
Public purpose served by this requirement is to maintain a minimum of 20 feet
between living areas in adjacgnt structures and 15 feet between garages and
livinq areas in adjacent structures to reduce exposure to conflagration of
fire. It is also to allow for aesthetically pleasing open areas axound
residential structures.
B. STATED HARDSHIP:
"Only location where I can build a garage of the size needed."

This home is located at the end of Jackson Street and there are no other
homes that front on Jackson south of the petitioner. The petitioner wants
to build an attached garage in front of their existing house and have the
access door f ace north and utilize their existing driveway. 2'hey would
also like to keep their existing garage of which they will be requesting a
special use permit. If the front yard variance is granted and the special
use permit denied, they will then need to convert their exiting garage to
living area and they will need a side yard variance for it. If the Board
approve� these requests, we would recommend that no windmas be placed on
the north wall of the converted garage.

Mr. Flora, Public Works Director, stated this lot is the last lot on
Jackson Street and is a deac7end street with a cul-de-sac. He stated the
petitioner i.s requesting a special use permit for construction of a second
garage.
Mr. Flora stated the original plan was for the petitioner to convert the
existing garage into living space, however, he now requests the use of
both garages for storage purposes.
Mr. Flora stated the Planning Cammission has recammended aproval of this
special use permit to allow the construction of a second accessory
building.
MO'i�ION by Counclman Schneider to concur with the recommendation of the
Planning Catmiission and grant special use permit, SP �82-08 to all�a for
the construction of a second accessory building at 6271 Jackson Street.
Seconded by Councilman Barnette. Upon a voice v�ote, all voting aye, Mayor
Nee declarecl the motion carried unanimously.
