The line was �urcharged backed up) in i965 (spring). It has been
cleaned twice, as a result of routine cleaning, since 1972, when tire bouglit
the jetter. It recei.ved special attention on two other occasions w}ien
fresh. sand tivas not�d by Chester Sw�uison in the n�anhole at Kennaston and
Jackson (it was televised and sealed then). It was cleaned from Nlississippi
Street to 68th in 1978 by Chet and Bruce because of a large i•oot mass tliat

to it at tiVest Moore Lake Drive.

included in the "high ma.intenance area" li�t� Uc��:au5e of so few backup
problems with it. However, the "drop" n�ihole at G8t1� �u�cl Jdckson is
part of a group of "drop" manholes checked monthly as a precaution. The
other drop maiiholes are at Lynde and Polk; Rice Creek Road just east of
Carrie Lane; 52nd apart�nents; and all those along 73rd Service Drive iii
N1elodp Manor.
Television records and routine cleaning recards are available on th�
line. The manhole at 68th and Jackson was last visua.11y checked by_Chet

Attached is the claim of P�1r. and Mrs. Steies in this matter, and a
report of the•sewer backup at 6730 and 6740 Jackson Street submitted
by Chester Swanson of the City Public Works Department. This is the
matter about which we telephoned you yesterday. Mr. and htrs. Steies
were out of town at the time the incident occurred. P�r. Steies
recently returned home and asked yesterday that a claims adjuster
be sent to his home as soon as possTble.
John Flora, Qirector of our Public llorks Department (571-3450 X 159)
has viewed the premises and talked with the Steies sons who were at
home at the time of the incident. Ralph Volkman, Superintendent of
the City Public Works Department (571-3450 X 157) is another contact
for you in this matter. We suggest that you contact our Public 4lorks
people prior toFinitiating any other action in this matter. -
<<1r. Steies indicated verbally to us that it is likely his neighbor at
6740 Jackson Street will also file a claim against the City.

Re: Sewer Backup Claims against City
I passed on your questions to Dale Hadtrath, our insurance agent, and
he advises the following: �
1. Re the Public Works people helping the homeowners who have suffered
a sewer backup: yes, this could be construed as an acceptance of
liability.
2. The best thing to do in the case of a sewer backup is to notify
the insurance company as soon as possible so they can get an adjuster
to the site•irranediately* - ,
3. The insurance company criteria for City liability are standard. Tt
is not up to the City to determine liability; it is up to the in�urance
company. Any change the City might have in philosophy toward such
incidents would have no effect on the insurance procedure; no insurance
company would consider it. "
4. As in other areas of insurance that we carry, the monies that are paid
out on claims has an effect on our future insurance rates. There is
no way to predict what that effect will be without actual figures.
*This backs up what we were discussing this morning. I think there is a
misunderstanding in the Public Works Department aboutfhis. For instance,
if a� City vehicle is damaged, I do get after the department for estimates'
and often the claim is�submitted with the estimates rather than beforehand
and we haven't been getting after people about that. But maybe we should.
My understanding of insurance claims in general is that general policy
should be to get a claim submitted as soon as is possible after an incident
occurs, no matter what type of claim it is. .In the case of the sewer �
backup homeowners, it can be a simple claim wherein they state that they -
do not yet have any estimated value to the damage. Any claim will get
the insurance company invol�ved and the process started.
Rusty and the others are not�incorrect in advising people to make/get
estimates and keep track of things. They are however in error in telling
people that they should hold off su6mi�ting a claim until they have all
pertinent information. When people are interested in making a claim
against the City, they should be told to put their claim in writing and
deliver it to us, or they should be told to call me for information.

1 taiked this morning with John Allbright of Western, Mr. Steies and
Mrs. Wozny.
7he adjuster met hir. and Mrs. Steies at their home about 3 p.m. yesterday
and tocak pictures. The adjuster told them to get someone in to malce
estimates re the floor. Mr. Steies said he thinks they can clean off the
wall and is hoping t.hat there is not a serious tvall problem that will me�n
ripping them apart. Mr. Steies' atiitude was much different today and
he thanks all people at City Hall for getting the adjuster out there. He
said the adjuster told him he had to leave�in a hurry as he had to be
in the City offices�before closing time.
t1rs. Wozny said the adjuster didn't know about their backup problem, th�t
Yhe adjuster had stopped by because of what he had been told by P1r. and
Mrs. Steies. The adjuster took pictures so they can start �nore cleanup
and made an appointment to get back to them on Friday. Mrs. Wozny said
they will have their list of estimated expenses by Friday and will try to�
get a copy tc, us as well as the adjuster.
