This letter serves to inform you that your application wi{I not be processed and is being returned due to the fact that the proposed lot split would create a non-conforming lot . Under current city code, a lot must have a minimum lot width of 75'. Under a proposed ordinance change going before the Planning Commission in January, only 50' of lot width is required. One important requirement of the proposed ordinance, however, is that the lot must have been created prior to December of 1955. As a result, a lot split done at this time would not make lots 51 & 52 conforming. An examination of the survey enclosed with the application, reveals that a portion of the attached garage was built on the east %2 of lot 50, which was formerly part of your neighbors lot. Because of the fact that the garage was built over the old property line, it is not possible to administratively reverse the lot combination form you filed with Anoka County. Due to location of the garage, it is not possible to split the lots into the two lots that existed prior to you purchasing the additional lot. Again, the lots would not meet current code requirements and would be created after December 1955. The City has enclosed your lot split application and has begun the refund process on the application fee.
