MEMO DATE: July 14, 1977
REGARDING: Livestock License at 6351 Jefierson Street N.E.
An inspection was conducted on this date. There were four cages°'
of rabbits located on the northeast corner of the property, �
approximately 7 feet from the fence to the east and approximately
12 feet from the fence to the north. Four adult rabbi ts and
seven iunmature ra.bbits were present. There existed approximately
three inches of litter and feces beneath the cages. This did
contribute to an odor that was detectable in the immediate vacinity
of the cages. Cleaning and maintaining the cage area on a weekly
basis should eliminate most, but not all of the odor. Mr. Pukal
has been requested to present with his application, a signed
statement from his imm�.diate neighbors that they are aware of his
application and don't object to the license being issued as long
as a nuisance is not created. If the livestock license is issued,
the following items should be stipulated;
l. Clean and maintain the cage area on a weekly basis.
2. Move the cages to be in compliance with the City Code (30 feet
from adjacent residential property linesy�.
3. It is recom�nended that a maximum be set on the number of
rabbits to be kept.

The Regular Meeting of the Fridley City Council of July 11, 1977 was called to
order at 7:35 P.M. by Mayor Nee.

Mayor Nee led the Council and audience in the Pledge of Allegiance to the Flag.

PUBLIC HEARING MEETING, JUNE 13, 1977;
MOTION by � ouncilman Schneider to approve the minutes of the Public Hearing Meeting
of June 13, 1977. Seconded by Councilwoman Kukowski. Upon a voice vote, all
voting aye, Mayor Nee declared the motion carried unanimously.
REGULAR COUNCIL MEETING OF JUNE 20, 1977:

�• Mayor Nee requested several changes in the agenda. The first was to consider Item 7,
"Cons9deration of Providing Financial Support to Teen Center" under "Old Business".
He also requested two letters of correspondence be added to the agenda, one from
William Scott and the other from the Springbrook Nature Center Foundation; and to
add "Consideration of License for Canterbury Pub".
MOTION by Councilman Hamernik to adopt the agenda as amended. Seconded by Councilman
Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously. .
OPEN FORUM, VISITORS:
Mrs. LeaAnn Sporre of the Environmental Quality Coimnission invited the Council to
attend their meeting on July 19, 1977 at 7:30 P.M. at the City Hall. She stated
representatives from the Minnesota Pollution Control Agency will be in attendance
at this meeting and will explain noise pollution and how it affects your health.
There also will be a discussion regarding sound abatement.
Mr. Fred Stuve, 6361 Jefferson Street, appeared before the CounciT to speak on behalf
of himself and his neighbors regarding an application the Council will be receiving
from a resident at 63�1 Jefferson to permit the raisirig of rabbits. Mr. Stuve stated
there are abaut 10 to 14 rabbits at the premises at 6351 Jefferson and that it has
P- become a problem. He indicated it was not possible for him to sit in his backyard
ibecause of the odor problems caused by the rabbits.
� Mayor Nee asked if they have spoken to the resident about this and if he is aware of
the nuisance.
Mr. Stuve stated he had not spoken with the neighbor and that he probably isn't
aware of the problem.
Mr. Sobiech, Public Works Director, stated, at this point, they have not seen the
application, but will make an inspection and report back to Council.

Mayor Nee questioned if there would be objections to the permit,�if sanitary
conditions were correct. Mr. Stuve indicated he probably wouldn t object to
one or two rabbits, but didn't feel there should be any more.
Mayor Nee stated he felt they had the right to object, if the rabbits were creating
a nuisance.
PUBLIC HEARING
PUBLIC HEARING ON REZONING REQUEST, ZONING ORDINANCE AMENDMENT ZOA #77-02, ROBERT
FLATEN; REZONE FROM M-1 0 k-1 - 1 6 EL STRE T E:
MOTION by Councilman Fitzpatrick to waive the reading of the Public Hearing notice
and open the Public Hearing. Seconded by Councilman Schneider. Upon a voice vote,
all voting aye, Mayor Nee declared the motion carried unanimously and the Public
Hearing opened at 7:47 P.M. _
Mr. Sobiech stated this is a request to rezone property from M-1 to R-1 at 176 Ely
Street. He stated the property to the East, adjacent to the railroad tracks, is zoned
M-1 and there presently is an industrial operation at this site.
Mr. Sobiech stated the Planning Co�nission recortonended approval of the rezoning. He
advised the majority of the residences in the area are single fami•ly.
Mr. Sobiech stated one of the items that was not discussed at the Planning Cortunission
meeting was the screening, which the zoning ordinartce provides for between R-1 and
industrial property. He questioned Mr. Flaten if he would provide a screening fence.
Mr.. Flaten stated he would put up�the screening fence.
Mr. Herrick, City Attorney, felt, if Mr. Flaten wanted a screening fence, he would have
to install the fence, since Mr. Flaten's property was zoned industrial and he is making
the request for it to be residential.
MOTION by Councilman Fitzpatrick to close the Public Nearing. Seconded by Councilman
Hamernik. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously and the Public Hearing closed at 7:55 P.M.
OLD BUSINESS:
RECEIVING REPORT ON HOLIDAY VILLAGE NORTH IN REGARD�TO PROGRESS IN
Mr. Sobiech stated, approximately six weeks ago, representatives of the Holiday
Yillage North store were invited to the Council meeting to review the operations
of their store which were causing problems in the neighborhood, specifically
carts being taken from the premises and left in residential areas around the store
and the problems of litter.
Mr. Sobiech stated, following the Council meeting, m�nbers of the staff inet with
representatives of Holiday Village. t4r. Sobiech referred the Council to the
letters and memos dated July 6 and 7, 1977 regarding this subject in which certain
steps were outlined to try and eliminate the problems. He noted, representatives of
Holiday have changed the operation in order to try and eliminate the cart and litter
problems.
He stated Holiday would just as soon not get involved in fencing at this time, if
the problem can be resolved. They will, however, provide additional landscaping
around their property to help contain the litter. Additional help has been hired
to monitor the outside area and Mr. Sobiech stated he felt improvements have been
made since the Council meeting.
Mr. Tauer, 5866 2nd Street, indicated the cart situation has improved and noted
Noliday has some signs posted in the store. He stated, as far as the litter, he
would have to wait and see if the landscaping will help: He stated, if he has
any objections in the future, he will again came back to the Council.
CONSIDERATION OF PROVIDING FINANCIAL SUPPORT TO TEEN CENTER:
Councilwoman Kukowski stated, at the last Council meeting, there was a presentation
from the kids who attend the Teen Center as well as the Teen Center Director.

Mr. Barna stated he understood the funds are temporary and most of the items he
ment9oned would be funded on a temporary basis. He felt the City will have a
better chance for continued funding, if it is pointed out the money is going for
cortmunity services rather than equipment outlay.
Mayor Nee cortmented that actually the CitY does not receive much Revenue Sharing
Funds because of the formula used for taxing.
Mr. Qureshi explained the City is penalized by the State and Federal governments
because Fridley is taxing residents at a low rate. Mr. Qureshi stated, if the
Council wished. expenditures could be taken from equipment and used for human
services. He indicated, at the public hearing of the budget, Revenue Sharing
Funds will be earmarked for certain items and then a general form will be submitted
to the government indicating the Council's intended use of these f�nds. �
Councilman Schneider questioned, at budget time� if the Council decides to delete
or substitute items, if there would be any problem. Mr. Qureshi indicated there
would not be any problems in making changes. Mr. Qureshi explained the main
purpose of this public hearing is to comply with the requirement of holding the
hear9ng to obtain input from interested citizens. .
MOTION by Councilman Fitzpatrick to close the Public Hearing regarding expenditures
of Revenue Sharing Funds for 1978. Seconded by Councilman Schneider. Upon a
voice vote, all voting aye, Mayor Nee declared the motion carried unanimousl� •

RECEIVING PETITION N0. 13 IN FAVOR OF RAISING RABBITS IN THE BACK YARD OF THOMAS
Mr. Sobiech stated the Environmental Officer made inspection at 6351 Jefferson
Street N.E., after the last Council meeting, when residents on Jefferson brought
it to the Council's attention that rabbits were being kept at this residence.
Mr. Sobiech stated the Council has a report from the Environmental Officer
regarding his inspection in which he indicates, if proper means are taken to
ensure maintenance of the cages and the cages are located according to the code,
consideration should be given of the livestock license. If the license is
approved, the number of rabbits should be limited.
Mr. Sobiech stated the property owner was requested to circulate a petition to
adjacent property owners to determine if they objected to the license.
MOTION by Councilman Schneider to receive Petition No. 13 in favor of the livestock
license. Seconded by Councilwoman Kukowski. Upon a voice vote, all voting aye,
Mayor Nee declared the motion carried unanimously.

the livestock license. Seconded by Councilwoman Kukowski. Upon a voice vote,
all voting aye. Mayor Nee declared the motion carried unanimously.
Councilman Schne.ider noted that one name appears on both petitions. Councilman
Schneider verified the fact that, according to the code, the cages should be
30 feet from the property line.
Counc9lwoman Kukowski asked where the people resided who were in favor of the
livestock license. The two residences in favor were at 6350 and 6340 Madison.
Councilman Schneider questioned the applicant, Mr. Pukal, what was being done
w9th the young rabbits.
Mr. Pukal stated so far there have been eight young and one was given away and
the others may be given away or eaten. Mr. Pukal indicated he has had the rabbits
since this spring.

Councilman Schneider stated he did visit Mr. Stauve's house, 6361 Jefferson Street
N.E., and checked on the situation and basically concurred with the Environmental
Officer's recortonendation. He indicated the rabbits, at that time, were unkempt.
Mayor Nee indicated the purpose of the license procedure is to ensure the rabbits
do not become a nuisance; and apparently, in this case. they have.
Mr. Herrick, City Atiorney, siated the main purpose of the ordinance is when
individual situations come to the attention of the City, the Council can then determine
- if a license should be granted. Ne stated, obviously, the kind aad number of animals,
size of the lot and proximity of other people are factors to be considered.

Councilman Schneider questioned Mr. Pukal where he would move the cages so they
would meet the code. Mr. Pukal stated he would put them in the middle of his lot
and then plant a row of bushes.
Mr. Pukal stated, when the Environmental Officer visited his residence, there
appeared to be litt`le problem with the odor. Mr. Pukal stated he agreed he would
clean the area every week.
Counciiwoman Kukowski questioned how old the rabbits are before they are given
away. Mr. Pukal stated eight weeks.
Mr. Stuve stated, over a weeks time, there will be enough odor accumulated to
affect the neighbors. He also stated flies are present and feels it is a health
hazard, as well as an odor factor.
Councilman Schneider questioned Mr. Pukal, if the license was denied, if it would
create any hardship. Mr. Pukal indicated he wouldn't go broke, but has about $60
invested in the rabbits. Councilman Fitzpatrick asked how many licenses they have
issued for keepinq rabbits. Councilwoman Kukowski felt most people only have
one or two and immediately get rid of the young.
Councilman Schneider felt possibly limiting the number of rabbits kept; however as
it is naw, it is a nuisance to other neighbors.
Mayor Nee stated, from the petition, he gathers this must be a substantial probl�n.
Councilman Hamernik felt, if the area was cleaned only once a week, it would be
objectionable and create a nuisance.
Mr. Pukal felt he should be able Yo have some pets, even if they wanted to limit
the number.
Mayor Nee questioned if he had room in the garage for the rabbits. Mr. Pukal
indicated he had, but the garage was to the property line. Councilman Schneider
indicated he hated to deprive anyone of the right to raise rabbits, but because
of the opposition, he moved the following motion.
MOTION by Councilman Schneider to deny the livestock license to Mr. Pukal. Seconded i
by Councilman Hatnernik. Upon a voice vote. Councilman Schneider, Councilman Hamernik, �
Councilman Fitzpatrick, and Mayor Nee voted in fav.or. Councilwoman Kukowski voted . �
against. Mayor Nee declared the motion carried by a 4 to 1 vote. �

Mayor Nee stated he regreted taking this action, but the reason for the ordinance �
is to handle this kind of complaint. He indicated he hoped Mr. Pukal understands �
their problem. He suggested Mr. Pukal could possibly negotiate with the neighborhood '�
`: on another location and the number of rabbits. Mr. Pukal stated, if it bothers the �
� neighbors, he will just drop it. Even though he would like to keep the rabbits, �
t. he doesn't want to fight with the neighbors.

SUBJECT: Livestock License at 6351 Jefferson Street NE
Attached please find the license application and a memo per-
taining to the referenced item. It should be noted that residents
in the area adjacent to the site appeared before the City Council
at the meeting of July 11th expressing concern with the issuance
of the livestock license.
As noted in the review by the Environmental Officer, with appro-
priate maintenance of the rabbit cages the license could be
issued without causing a nuisance in the neighborhood. Also
recommended was establishment of a limit to the number of rabb�ts,
which should perhaps correspond to the number at the present
time, which is 11.
The Environmental Officer has suggested to the petitioner that
he also submit a letter which would indicate that the adjacent
residents have no objection to the issuance of the livestock
license.
It is requested that the issuance of the license be considered
at the Council meeting of July 18th.

REGARDING: Livestock License at 6351 Jefferson Street N.E.
An inspection was conducted on this date. There were four cages
of rabbits loca.ted on the northeast corner of the property,
approximately 7 feet from the fence to the east and approximately
12 feet from the fence to the north. Four adult rabbits and
seven immature rabbits were present. There existed approximately
three inches of litter and feces benea.th the cages. This did
contribute to an odor that was detectable in the immediate uacinity
of the cages. Cleaning and maintaining the cage area on a weekly
basis should eliminate most, but not all of the odor. Mr, Pukal
has been requested to present with his application, a signed
sta.tement from his imm�.diate neighbors that they are aware of his
application and don't object to the license being issued as long
as a nuisanee is not createcl. If the livestock license is issued,
the following items should be stipulated;
l. Clean and maintain the cage area, on a weekly basis.
2. Move the cages to be in compliance with the City Code (30 feet
from adjacent residential property linesy.
3. It is recoaonended that a maximtun be set on the number of
rabbits to be kept.

The term livestock as used herein means horses, cows, goats, rabbits, sheep and fowl. (Ref. 76)

The person who shall keep such livesiock within the City of Fridley shall not aliow odors and smelis which are
offensive to the peopla inhabiting the City. Organic matters shail not be allowed to accumulate for more than
one (1) week at a time and removed oftener if it is necessary to eliminate odors and smelts which are offensiv� to
the peaple inhabiting the City. (Ref. 76)
301.04. HoUsing
Proper housing in the form of barn, coops or hutches shall be provided any area where the livestock is permitted
to roam, shall be adequately fenced to insure the keeping of the livesfock on the ownePs premises. Wheraver
such area abuts upon a residential area on which dwellings are erected, there shali be a strip oF land af feast 30
feet wide between such abutting property and the area on which the livestock is kept.
301.05. Licensing Procedure
A license to keep livestock shatl be granted only upon application made to and filed with the City. The
application for license shall be in writing signed by the appiicant and flled with the Clerk. It shall state the
applicant's full name and address and contain a complete description of the livestock to be kept as to kind and
number and a description of the premises showing the adjoining property, fence lines aFid housing facilities.
The Council in considering whether a license should be granted, may consider the nature of the livestock, the
possible effect on adjo3ning propefties, the fence lines and housing facilities, the sani;ation control and the
effect on the g8neral health and welfare of the community.
301.06. Fess
The annuat license fae and expiration date shall be as provided in Chapter 11 oi this Code.
301.07. Inspection

Any authorized officer of the City shall at any reasonable time be permitted upon the premises where livestock is
kept for the purpose of making inspection as to compliance with this chaptar. (Ref. 76)
301.08. Penaltiss
Any violation of this chapter is a misdemeanor and is subject to ail penalties provided for such violations under
the provisions of Ch2pter 9p1 of this Code.
