NOTTCE IS NEREBY GIVEN THAT the Appeals Corronission of the City of Fridley will
meet�in the Council Cham6er of the City Hall at 7:30 PM on Tuesday, September 20,
1�'77 to consider the following matter:
A request for variances as follows: Section 205.053, B, 1
to reduce the required 10 foot side yard setback for iivirrg
areas in an R-'L zone to 4.5 feet and Section 205.053, 4, B,
5, B to reduce the required 25 foot side yard setback for
attached and unattached accessory buildings with entrances
off of a side street on corner lots to 20 feet, to allow for
the construction of a house and garage located on Lot l,
Block 3, Meadowlands 2nd Addition, the same being 6750
Kennaston Drive, Fridley, Minnesota. (Request by Donald H.

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
1. Section 2�5.053, 4, [B, 1] requiring a 10 foot side yard
setback for living areas in an R-1 zone.
Pu6lic purpose served by this section of the code is to
maintain a minumum of 20 feet between living areas in
adjacent structures and 15 feet 6etween garage and
living areas in adjacent structures to reduce exposure
to conflagration of fire. Also to allow for aestheticalTy
pieasing open areas around residential structures.
2. Section 205.053, 4, [B, 5, B] requiring a 25 foot side
°+��e��g setback for a corner lot.
Public purpose served by this section of the code is to
reduce tfie traffic hazards presented by an entrance too
close to an antersection.
B. S�ATED HARDSHIP:
1. The family is converting the existing attached garage into
a living area which is now 4.5 feet from the side property
line.
2. The site for the new garage is to be on half of the present
concrete sla6 area with the back half becoming a patio. This
leaves the new opening for the garage 20 feet from the corner
line.
C. ADMINISTRATIVE �TAFF REVIEW:
1. The existing garage is 4.5 feet from the property line.Qonversion
of this area into a�iving area would leave � feet between them

2. The intersection af 68th Street and Kennaston Drive is an interior
traffic crossing in a residential area.

of he meeting had been received by the Planning Gommission
d they would be sent along to the City Council.

� Mr. Berry indicated that he wanted to construct a detached
garage at the rear of his home that vrould exit onto 68th Avenue.
He said that the existing garage, that tivas attached to the
house vrould be made into a family room. He explained that
a variance �ras needed because the family room vrould bring
the home livin� area closer to the property line. He
said that the other variance ti;tas needed to enable them to
construct the �arage and be able to leave space for a
patio at a future date.
Chairperson Schnabel asked about the cement slab �hat was
sho�m on a picture that the Coramission had of the property.
Mr. Berry said that all the presently existing cement slab
would be removed.
Mr. Holden suggested that the Commission study the survey.
He said that it iFrould make it easier to understand exactly
tivhat the Berry� s vrere planning.
Mr. Holden asked exactly hoi�� large the garage would be.
Mr. Berry said it ��rould be 24� X 24'.
Chairperson 5chnabel asked if r2r. Berry had communicated
tivith the neighbors to the j7est. ..
Mr. Berry,said that he had talked to the neighbors and that
they had no objections.
Chairperson Schnabel asked if there ��ras presently a drive-
way exiting�onto Kennaston Drive.
Mr. Berry said that there tivas presently a drive���ay, but
that it ��rould be removed entireiy once the construction
was completed.
Ms. Gabel asked if Mr. Berry ��ras planning any opening on
the South side of the proposed family room.
Mr. Berry said there �:►ould be no openings on the South side.
He said that the existing South �rindotiv ti�rould be removed.
Chairperson Schnabel asked tha� in terms of building the
ne�v garage and making the existing garage into a family
room, t•rhat hardships might have existed.
Mr. Berry said that presently he only had a single car
garage. He said th�t they ot�med ttivo cars and he ti�ranted
more storage space. He said that the family really needed
more garage/storage space than they needed the extra
living space.

Mr. Barna vranted to know how wide the propoeed family
room ��rould be.
Mr. Berry said that it would be 14 feet wide,
Chairperson Schnabel asked if Staff felt that there
�ould be any problems rrith the garage being setback in
terms of line-of-sight.
Mr. Holden indicated that there was a substantial
boulevard in the area and that there shouldn�t be any
problems tivith the line-of-sight.
Chairperson Schnabel asked v�hen Mr. Berry planned
t4 start construction.
Mr. Berry said that they planned to start the
garage as soon as possible. He said that very likely
they r�ouldn�t start on the Family Room until Spring.
Mr. Barna asked if there �vould be an exterior entrance
to the family room.
Mr. Berry said that there tivould be an exterior
entrance to the family room at the rear of the house. He
said that the existing garage door facing Kennaston Drive
tivould be eliminated.
Mr. Barna pointed out that as soon as the garage i�aas
completed, the existing drive���ay ���ould have to be removed.
Mr. Berry tiras in agreement.
MOTION by Mr. Barna, seconded by Ms. Gabel� to close
the Public xearing. Upon a voice vote, all voti:ng aye,
the mot�.on carried unanimously. The Public Hearing 1ras
closed at 7:55 P.M.
Ms. Gabel said that since there t��ould still be
11.?5 feet betr�een the living areas, she could see no
problem.
There caas some discussian regarding the exact distances
the structures were fror� the property lines. Mr. Holden
said �that he didn�t have the exact distances. H8 said that
�hey did have the e.cact distance bet<<�een the structures�
from wall to irall, and that ti�ras 11.75 feet.
MOTION by P�Zr. Kemper, seconded by AIs. Gabel, that ` the
Appeals ComMission apurove the request for variances to the
Fridley City Coc?e as follo��rs: Section 205.053, B, i� to
