they understood and felt secure that the petitioner explained ex ctly how
he intended. to make the proposed addition without any drawings they could
•act on it. hir. Kemper said he thought he really didn't have o see a plan,
and would prefer to act on it. Mr. Barna said he would go long with that.
Mr. Plemel asked if they could stipulate that large tr s be planted. Mr.
Schmidt said he worked with trees and suggested they ould cost between
$85 to $100, planted. Mr. Kemper asked Mr. Holden f he thought this could
be worked into the landscape plan, and Mr. Holde replied he thought it could.
As. Kemper asked where the trees would be plan d� and rlr. Holden said they
would have to be planted very close to the f ce. Mr. Barna asked if Mr. Barker
•�ould object to the trees being planted on is property, and Mr. Barker said
he would be iailling to take trees anywhe he could get them. He added that
his only concern with this whole thing as that they were going to damage his
pxoperty by doing this, and added th he was an appraiser and he knew this.
He suggested that if the owners of & I didn't think it would damage his
property they should pay for an a raisal before and after.
�ir. Goldstein and his attorne stood up and prepared to leave, saying they
were ready to drop the whol thing. Mr. Plemel asked them to please reconsider.
Mr. Kemper said the proble that they faced was that even if the Appeals
Commission was in favor the variances,I�1r. Goldstein would still have the
Planning Commission to o through and then the City Council. hirs. Schnabel
explained the Planni Commission would just review the minutes of this
meeting, and the C' y Council would have another hearing on it.
MOTION by Pleme , seconded by Barna, that the Appeals Comrnission recommend
to Council ap oval of the request for variances with the following stipulations:
1) The bloc plan for improvement of the landscape (greenery and shrubbery
planted on he East, West and South) be implemented, and 2) The roof design
be no hi er than the original building and the parapet no higher. Upon a voice
vote� voting aye, the motion carried unanimously.
Chairnerson Schnabel informed Mr. Goldstein that this would go before the
City Council on September 13th.

Public purpose served by this section of the Code is to allow for off-street
parking without encroaching on the public right of way. Also, the aestheiic
consideration of the neighborhood to.reduce the "building line of sight"
encroachment into the neighbor's £ront yard.
B. STATID HARDSHIP: Need garage space, have no other practical way to �o.
C. ADMINISTRATIVE STAFF REVIEW: 820 Kennaston Drive N.E. is an unusual lot
in that its entire front yard is on the street radius. On a typical lot
the proposed addition would be in the side yard, but in this case, it
comes closer to the front property line than the required 35� setback.
The addition will not be allowed to encroach into the Southerly 6' of the
lot due to the presence of a drainage and utility easement. Addition
on to the rear of gaxage would not be a very 'practical' solution because
of shifting cars in the garage and the already reduced size of the back
. yard. .
Staff feels that the neighbo�s concerns would be the most important.
Staff has no objection to this request.
Mrs. Arlin Eeters stepped forward to present the request. She stated they had
an existing single car garage and were proposing to add another 1 2 car garage an.
She explained they would both be used as garages with some storage space. Mrs.
Peters said she had a noie from the adjacent neighoor stating they had no
objections to the addition.
MOTION by Plemel, seconded by Kam�er, that the Appeals Comrnission receive
the note from Mrs. Loretta Pastwa, 860 Kennnston Drive N.E.• Upon a voice
vote, all voting aye, the motion carried unanimously.
Mrs. Peters explained they always had one car sitting out now, and in the
summer there were usually both cars because of bieycles, lawnmowers, etc., in
the existing garage. She stated they planned to reside and reroof the house.
Chairperson Schnabel asked if there was a City boulevard, and Mr. Holden said
there was a 7� boulevard. She asked if the structure next door was some
considerable dista.nce from the common lot line. Mr. Holden said he didn�t have
a veriiying survey, but thought the house was built about 20' from the property
line. Mr. Kemper commented that seemed like a lot of room between structures
to him. He said he thought there was a visual problem, but there was a lot of
green area and he didn�t think the visual problem would be particularly great.
Mr. Barna said he thought there would be plenty of view for safety purposes.
Mr. Holden sated there would be about 5' of the garage sticking out.
Mrs. Peters said they had a boat, snowmobiles, bicycles, etc., and really needed
the space. She added they also had two children who were approaching driving
age.
MOTION by Barna, seconded by•Plernel, to close the Public Hearing. Upon a
voice vote, all voting aye, the motion carried unanimously.
Mr. Barna stated the need had been established, and the building line of sight
encroachment wouldn't be that great in his opinion� so he would be in favor.

ADMINISTRATNE STAFF REPORT
A. PUBLIC PURPOSE SER BY REQUIRII��NT: Section 115.02, 5, B, requiring a
6 foot fence around wimming pools.
Public purpose served b�this requirement is to protect unescorted i.ntruders
from the dangers of the p�Ql area.
B. 5TATED HARDSHIP: Petitioner 'd their fence was a vertical redwood
non-climbable fence be�;ween 5 t 6 feet in height around the perimeter of
the back yard and was completed b ore April 15, 1976 before the ordinance
requiring a 6 foot fence was estab 'shed. Additionally tne petitioner
states that the neighbors share the eling that aesthetically 6 foot fences
are deterrents to the neighborhood.
C. ADMINISTRATIVE STAFF REVIE4J: The existin vertical redwood fence surrounding
the backyard of 1t37 Rice Creek Blvd; was co tructed this past spring before
the ordinance went into effect. The old ordi ce required only a lt foot
fence. The new ordinance went into effect on h 15, 1976. 1^he new
ordinance was written, in paxt� because the City elt that a four foot
. chain link fence axound a pool was not enough of a eterrent to small
children entering the pool area.
.
This fence is haxd to climb because there are no horizo tal slots to provide
steps. There appear to be neighboring fences adjacent t the North� East
and South sides of the fence in question. The proximity o these fences
would appear to make it more difficult to scale than a sing fence.
A possible solution, though technically difficult, would be to aise
alternate slots of the fence to a six foot height from grade aro d the
entire fence perimeter. These slats would be approximately 6" ap t.
Several pool building permits have been issued since the new ordinan
went into effect, and several existing fences have been altered in ord
to meet this requirement.
Staff�s concern in this matter is that the "intent" of the ordinance is
maintained.
