I received a copy of your letter to Mr. Franzen and have placed it
in my files concerninq this issue. Mr. Franzen appeared at our
office on Thursday, January 17, 1991 to discuss the issues which
are currently in noncompliance.
We determined two new dates by which Mr. Franzen will need to
comply with his stipulations for the variance request which was
approved by the City Council in 1990. Mr. Franzen will be required
to remove the shed by February 15, 1991. I will inspect the
property on that date and send a follow-up memo to you for your
files. The hardsurface driveway must be installed by Mr. Franzen
on or before July 1, 1991 and again at that time I will reinspect
the property for compliance.

Dear Mr. Franzen:

It has come to our attention that recent improvements you have made to your properly
are causing damage to an adjacent properiy due to changes in storm drainage. City
Code 205.04.04(I) states that land shall not be altered in a manner that causes flooding,
erosion or deposits of mineral on adjacent properties (copy enclosed).
Apparently, a fence improvement you have recently constructed on your east property
line has changed the direction of flow of upstream storm drainage in such a fashion that
it is causing flooding of an adjacent garage. It is suggested that you remove the small
boards along the bottom of the east fence that has changed the original flow pattern.
It is also suggested that if you put down plastic sheeting and rocks along the back of
the garage, this storm water would be directed past both your garage and the neighbor's
garage.

RE: Drainage Issue between 585 Janesville Street N.E. and
590 Kimball Street N.E.
Dear Mr. Franzen:
Recently I spoke to you regarding the drainage situation between
the above referenced properties. It is my understanding that storm
water runoff has created a problem on the northerly portion of the
property at 585 Janesville Street N.E.
The City's Public Works Department has inspec�ed this site and
determined a recommended course of action for addressing this
situation. Enclosed is a copy of a drawing indicating that the
problem could be resolved by both property owners creating swales
�at the rear of your respective properties. In addition, the.
property owner at 590 Kimball Street N.E. should remove small
boards placed at the base of chain link fence along the easterly
portion of his property and the property owner at 585 Janesville
Street N.E. should remove all dirt placed along the south side of
the fence separating the two properties.
It is anticipated that this drainage problem would be substantially
eliminated by following the recommendations as indicated in this
letter and the accompanying drawing.

It would be my suggestion that you contact an attorney regarding
both of your questions. .
The city is not involved with the well. This was more or less a
neighborhood thing that existed back in 1890 or so when this plat
was recorded. If the actual well hole exists on your property,
you could be required, by State law, to disable it properly.
However, inasmuch as this well, and access to it, is mentioned on
many deeds, in this neighborhood, there could be some consid�rable�
legal questions to settle.

Dear Mr. Franzen:
You have requested that I provide information from our files with
respect to the drainage dispute between yourself and your neighbor
to the south. It is my understanding that this problem has now
been resolved by construction of a swale near the property line,
but that you and your neighbor will soon be appearing in court in
a case which involves actions related to this issue.
From reviewing our files, it appears that you obtained Building
Permit #20089 on August 28, 1989, to construct a detached garage
at the rear of your property. Subsequently, on April 5, 1990, you
obtained Building Permit #20282 which was in part to expand this
garage. It is my understanding that the work related to these
permits has been completed, and the garage constructed and expanded
as planned.
Earlier this year, your neighbor to the south (Mr. Kuusisto)
contacted the City's Public Works Department to discuss a drainage
problem he was experiencing. On June 11, 1992, Mark Winson, former
Public Works Director sent you a letter (copy enclosed) requesting
that you remove boards from the fence on the east side of your
property and install plastic sheeting and rocks along the rear of
your garage in an attempt to improve the drainage situation for
your neighbor. Subsequently, you contacted our office to further
discuss this issue and possible means of reducing or eliminating
any drainage problem which existed.
After inspecting the site and discussing this matter with yourself
and Mr. Kuusisto, I sent a letter on June 25, 1992 (copy enclosed),
outlining a course. of action to resolve this problem. In that
letter I indicated that both you and Mr. Kuusisto should construct

swales at the rear of your respective properties to help alleviate
the situation. In addition, I indicated that you should remove the
small boards at the base of your chain link fence along the east
portion of your property and Mr. Kuusisto should remove all dirt
placed along the south side of the fence separating your two
properties.
Shortly thereafter, you took action to remove the boards from the
base of the east side of your fence as I had indicated. You stated
that you subsequently attempted to create a small swale near the
fence on your property as I had requested, but th.at such efforts
were substantially unsuccessful since Mr. Kuusisto continued to
place dirt near this location.
Several weeks later, Public Works Director, John Flora, inspect�d
the property and met with both you and Mr. Kuusisto. It is my
understanding that he began a drainage swale along your property
line to correct this problem and that you and/or Mr. Kuusisto
completed this swale after Mr. Flora's departure. As I stated
earlier, it is my understanding that this swale has substantially
corrected any drainage problem which had been occurring.

Dear Mr. Franzen:
Thank you for calling with your plans for construction of an ice
fishing house at 590 Rimball. As we discussed during that phone
conversation, this building would cause you to exceed the percent
lot coverage allowed in your zoning district. I believe however, we
have reached an agreement as to; what is appropriate storage of
this structure?
As you may recall, one of the stipulations of your variance request
(approved in 1990) was that you remove an 8' x 16' storage shed
from your property. A variance was granted to allow 28.6� lot
coverage, rather than the 25� allowed ity code. The stated purpose
of your variance was to allow construction of an addition on the
front of your existing home. The addition was campleted.
In addition now to that 28.60, an ice fishing house has been
constructed. That ice fishing house constitutes additional lot
coverage and would require review by the Appeals Commission. The
City does have broad discretion to deny variances and the Appeals
Commission and City Council would quite likely say "no" to another
variance request, considering the 1990 action requiring removal of
your 8' x 16' shed.
The solution that you have suggested eliminates the need for a
variance and includes the following elements:
-- an October 9, 1995 ice fishing house assembly completion
date;
-- an October 9, 1995 ice fishing house dismantling
completion date;
-- an October 9, 1995 ice fishing house storage date.
Storage of this structure shall be done neatly and in a manner that
assures that it will not be visible from public right-of-way or
adjacent properties. This solution is acceptable. Staff does
however, caution that there will be no grace period extensions.
Beyond October 9, 1995, the presence of an assembled or openly
stored ice fishing house will represent a willful violation of the
