AF-AG - 47836e _ :� , INDEMNIFICATION AND HOLD HARMLESS AGREEMENT � THIS AGREEMENT, entered into this � day of April, 1990, by and between Robert Franzen, a single person, and the City of Fridley, a municipal corporation located in Anoka County, Minnesota. WHEREAS, Robert Franzen is the fee owner of property located at 590 Kimball Street N.E., Fridley, Minnesota, legally described as Lots 37 and 38, Block E, Riverview Heights Addition; and WHEREAS, Robert Franzen has made application for a building permit from the City of Fridley to construct a detached garage on said property; and WHEREAS, the proposed garage is partially located within a private well access easement which runs along the rear eight feet of said Lots 37 and 38, Block E, Riverview Heights Addition; and WHEREA`S, the City of Fridley is agreeable to issue a building permit for the construction of said garage provided that Robert •` Franzen indemnify and hold the City harmless from any claim that may , be made because the garage is located on a portion of said easement; NOW, THEREFORE, Robert Franzen hereby agrees to indemnify and hold harmless the City of Fridley, its council and employees from any claim for damages as a result of the construction of said garage on the above described easement. That as a condition of this indemnification the City of Fridley agrees to immediately give written notification to Robert Franzen upon rece�iving notice of any claim which may be asserted against the City. �.�.,.. y y , ._ ' F This notice shall be delivered by the City either to Robert Franzen personally or by mailing a certified copy of the notice to Robert ' Franzen, 590 Kimball Street N.E., Fridley, MN 55432. Upon receipt of any claim, Robert Franzen will immediately settle said claim, or in the alternative, shall have the right to dispute the validity of said claim. In either event Robert Franzen agrees to indemnify the City of Fridley, its council and its employees from the claim or any legal fees which may be incurred by Robert Franzen for purposes of defending the claim.
