It has come to our attention that there has been a significant amount of landscaping done to the rear yards
of a number of the homes along the north boundary of the Heather Oaks Subdivision. This letter is being
sent to all residents along this line.
There is a 10-foot-wide drainage easement centered on this line to allow storm water runoff to drain to the
east and west into holding ponds. This area is intended to be swaled to channel this runoff. Landscaping
which raises the yard and changes this swale impacts the way storm water drains. City Code states that
changes on one property must not affect the neighboring properties. If we receive complaints that one
property has changed the drai.nage pattern so that water runs onto an adjacent property in a manner contrary
to its original design, we must investigate and possibly initiate Code Violation proceedings.
In order to avoid future conflicts, we request that you discuss any significant projects with your neighbors
so that concerns on these projects can be resolved before a problem is created. If you have questions and

In our June meeting we discussed some of the problems with drainage along your north property line. I left
that meeting with the understanding that you and your neighbors understood the problem and would be
solving it among yourselves. Since that time, our Public Works Director, John Flora, met with you and Mrs.
Hanscom to again go over what needed to be done. Specifically, to dig a swale from the rocked area in the
northwest corner and down into the drainage ponding area. This will work to control the direction of runoff
in a direct line to the pond. Mrs. Hanscom can then build up the ground level against her garage to allow
water to flow into this swale and reduce the flooding she has in her driveway after rains. To date, none of
this work has been done.
I feel that this is a simple matter to solve. Landscaping has been changed which is causing a drainage
complaint. Corrective action needs to be taken. I will be inspecting the properrty� periodically and if I do not
see any progress within the next week or two, I will be forced to begin code enforcement proceedings.
