When I was looking for a house in to buy in 2004, one of the my personal requirements was to find a property that either had an exiting four stall garage or a lot layout that would accommodate a four sta11 garage in the future. At the time of the purchase of the property I was aware that a pe�mit was pulled for the existing detached garage in 1959, by previous owners, which showed the existing garage to be 3 feet for the property side yazd as the code states today. I assumed the existing structure was built within the code setback requirements and the new addition would be as well. After hiring a certified surveyor to fmd and/or replace my property irons it appears that the e�cisting garage is a non-conformant structure being only 2.55' from the south side yard. My intention is to build off the existing garage so that the south side of the completed structure will be one continuous wall. T'he proposed building that will be constructed consists of a new garage addition off the back side of the existing detached gara.ge. The new addition will be constructed out of 2x6 dimensionallumber, plywood, siding, and shingles to match the conshuction of the existing garage as much as possible. The hip roof of the existing detached garage and house will also be added to the new addition so that the new addition will appear as it belongs architecturally. In Addition the existing garage will be raised 2' to remedy an existing issue with ground line along the south side of the building sloping towards the structure and to accommodate a new 8'x16' insulated garage door. The property is located on Rainbow Drive, just north of 61St Avenue. There isn't a building permit on file at City Hall for the existing home, so staff would assume that it was constructed prior to 1960, which is when the existing detached garage was constructed. At the time the permit was issued for the garage, the plans showed that it would be set back at 3 ft. from the side yard property line. Current City staff would assume that though it was the previous owner's intension to build the garage at 3 ft. from the property line, it ended being constructed closer to the property line, therefore falling short of meeting that required setback by .45 feet. City code requires that detached accessory structures in the rear ' ' s+a+ a�¢ aiax a�m a�w yard be set back 3 ft. from the property line. As stated above, when the original garage was constructed, it was intended to be 3 ft. from the property line; however 49 years later, a certificate of survey shows the garage at 2.55 ft. from the property line. As a result, the petitioner is seeking a variance to recognize the existing non-conforming setback and is seeking a variance to allow a 24 ft. by 21.67 ft. addition to the garage that will be setback at 2.65 ft. at the closest point. The subject property and proposed addition will comply with all other code requirements, including but not limited to setbacks, lot coverage, and allowable size allotment for an accessory structure. When I was looking for a house in to buy in 2004, one of the my personal requirements was to find a property that either had an exiting four stall garage or a lot layout that would accommodate a four stall garage in the future. At the time of the purchase of the property I was aware that a permit was pulled for the existing detached garage in 1959, by previous owners, which showed the existing garage to be 3 feet for the property side yard as the code states today. I assumed the existing structure was built within the code setback requirements and the new addition would be as well. After hiring a certifed surveyor to find and/or replace my property irons it appears that the existing garage is a non-conformant structure being only 2.55' from the south side yard. My intention is to build off the existing garage so that the south side of the completed structure will be one continuous wall. The proposed building that will be constructed consists of a new garage addition off the back side of the existing detached garage. The new addition will be constructed out of 2x6 dimensional lumber, plywood, siding, and shingles to match the conshuction of the existing garage as much as possible. The hip roof of the existing detached garage and house will also he added to the new addition so that the new addition will appear as it belongs architecturally. In Addition the existing garage will be raised 2' to remedy an existing issue with ground line along the south side of the building sloping towards the structure and to accommodate a new 8'x16' insulated garage door. Stacy Stromberg, stated the petitioner, John Sowada, is seeking a variance to reduce the setback �for an detached accessory structure in the rear yard from 3 feet to 2.55 feet to recognize the placement of the existing garage and to allow the construction of a 24-foot by 21.67-foot addition to the existing garage, at this home which is located at 6120 Rainbow Drive. Ms. Stromberg stated the recognition of the non-conforming setback is reqaired prior to issuance of any building permits for the proposed addition. Ms. Stromberg stated the summary of hardship submitted by petitioner reads, "A permit was pulled for the existing detached garage in 1959 by the previous owners, which showed the existing garage to be 3 feet from the side yard property line as code requires. I assumed the existing structure was built meeting code requirements and the new addition would as well. After hiring a certified surveyor to find my property irons, it appears that the existing garage is a non-conforming structure at 2.55 feet from the south side lot line. My intension is to build off the existing garage so that the south side of the completed structure will be one continuous wall." Ms. Stromberg stated the subject properiy is zoned R-1 Single Family as are all surrounding properties. The property is located on Rainbow Drive, just north of 61S` Avenue. There is not a building permit on file at City Hall for the existing home, so staff would assume that it was constructed prior to 1960, which is when the existing detached garage was constructed. At the time the permit was issued for the garage, the plans showed that it would be set back at 3 feet from the side yard property line. Cunent City staff would assume that though it was the previous owner's intension to build the garage at 3 feet from the property line, it ended being constructed closer to the property line, therefore falling short of ineeting that reyuired setback by .45 feet. Ms. Stromberg stated City Code requires that detached accessory structures in the rear yard be set back 3 feet from the property line. As stated above when the original garage was constructed, it was intended to be 3 feet from the property line; however 49 years later, a certificate of survey shows the garage at 2.55 feet from the property line. As a result the petitioner is seeking a variance to recognize the existing non- conforming setback and is seeking a variance to allow a 24-foot by 21.67-foot addition to the garage that will be setback at 2.65 feet at the closest point. Ms. Stromberg stated the subject property and proposed addition will comply with all other code requirements, including but not limited to setbacks, lot coverage, and allowable size allotment for an accessory structure. - Ms. Stromberg stated the existing garage already has a window along the south wall, which is the wall that is 2.55 feet from the property line and the petitioner plans to install an additional window along the south wall of the proposed addition, which will help to add visual interest and break-up an otherwise 45- foot featureless wall. Ms. Stromberg stated City staff has no recommendation as similar variances have been granted in the past as follows: • VAR #00-02, 1363 53`� Avenue Variance approved to reduce the side yard setback from 5 feet to 2.5 feet Ms. Stromberg stated staff recommends that if the variances are granted, the following stipulations be attached: 1. Petitioner shall obtain all necessary building permits prior to construction of addition. 2. Addition shall be architecturally compatible with the existing home and finished with complementary siding and color scheme. 3. Windows, as the petitioner has proposed in his plans, or another architectural treatment shall be designed to add visual interest and break-up the aesthetic of the 45-foot wall on the south side of the proposed garage expansion. Plans shall be reviewed and approved by staff, prior to issuance of a building permit. Commissioner Jones asked whether staff has heard from any the neighbors, particularly the ones facing the house to the left? Ms. Stromberg replied, no, staffhas not heard from any neighbors.. Commissioner Jones asked Ms. Stromberg, if this garage was setback 3.0 feet away from the property line and the addition would come no closer than 3.0 feet from the property line, would the petitioner already have a building permit and this would not even be before us? 2 Ms. Stromberg replied, that is correct. John Sowada, 6120 Rainbow Drive NE, stated he has talked with the lady who lives in the house to the south, and she is fine with his garage expansion. He has also talked with a couple other neighbors, and they do not see any problem with it either. Commissioner Sielaff commented it is preriy straightforward.
