OPEN FORUM (VISITORS):
Bert Martinez, 7786 Beech Street N.E., thanked Council for the quick response to the flooding
issues he is having in his area. He thanked the Council and Mayor for restoring his confidence in
the system.
Don Anderson, 7304 West Circle N.E., said he works at SuperAmerica and had some concerns
with the safety of the quiet zone railroad crossing.
Mayor Lund said that he will alert the Police Department and ask them to take a look at it.
PUBLIC HEARING:
4. Public Hearing on Street Improvement Project No. ST. 2008-2.
MOTION by Councilmember Varichak to open the public hearing. Seconded by
Councilmember Barnette.
UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE
MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING OPENED AT
7:43 P.M.
Rick Pribyl, Finance Director, said this project assessment pertains to the street milling and
overlay on the 2008-2 Project. The project assessment involves 56 properties for a total assessed
cost of $107,384.03. The assessment is for 10 years and the interest rate is 6'/z%. Staff
recommends that the public hearing be opened, public testimony heard, and the hearing
continued until the Council meeting of October 27, 2008, along with the resolution certifying the
assessments. This continuation is due to the requirement to allow a two-week notice on mailing
of the parcel specific notices on the assessment before holding the public hearing.
Mayor Lund asked for clarification on the total cost; the agenda book showed $106,000 and the
presentation $107,384.03.
Mr. Pribyl said that the figure of $106,000 was the best estimate at the time, but the correct
figure is $107,384.03.
Councilmember Bolkcom asked for explanation on the notices and what happened.
Mr. Pribyl said that the notices did not go out in time to meet the 14 day requirement.
Jim Kosluchar, Public Works Director, said that the mailing went out on time but there were
errors on the pin numbers. Correct notices were mailed but they will not meet the 14-day
requirement. The City Attorney said this process would be the best way to handle the situation.

Mayor Lund asked if there would be testimony heard today and more at the next meeting.
Councilmember Bolkcom said it did not look like anyone was present. She asked for
clarification that the original notices went out with the incorrect pin numbers and a second letter
went out correctly indicating that the public hearing was set for October 27.
Mr. Kosluchar said that is correct.
MOTION by Councilmember Saefke to continue the public hearing until October 27, 2008.
Seconded by Councilmember Varichak.

6. Resolution Appointing Election Judges for the 2008 Election Cycle.
Deb Skogen, City Clerk, said Election Day is Tuesday, November 4. This year the election
candidates include Federal, State (including a constitutional amendment), County, City,
Columbia Heights School District 13, Hospital District and Judicial Offices. The City offices up
for election are Mayor (Scott Lund/Pam Reynolds) and Councilmember-at-Large (Bob
Barnette/Rick Wolfe).
Ms. Skogen said Anoka County provides election support to the City through voter registration,
election administration training for City staff, election judge training, absentee ballot voting, and
preparation of the ballots and programs for the Accu-vote and Automark memory cards.
Ms. Skogen said absentee ballots are available from October 3 through November 3. This is for
voters who will be absent from the precinct on election day due to temporary or permanent
disability, religious observance, serving as an election judge, or inability to get to the polling
location. Voters can get an absentee ballot by mail by contacting the City Clerk's office to
request an application at 763-572-3523 or accessing the City's website at www.ci.fridlev.mn.us.
Absentee ballots can also be picked up at the Anoka County Courthouse (3rd Avenue and Main
Street in Anoka), Elections Office (first floor on 3rd Avenue side), Monday through Friday from
8:00 a.m. to 4:30 p.m. and Saturday, November 1 from 10:00 a.m. to 3:00 p.m.

Ms. Skogen said election judges are paid volunteers who must designate a party but work on a
non-partisan basis on election day. Election judges come from a variety of places; recommended
by friends or other election judges, polling locations, or individuals who have expressed interest
to city or political parties. Election judges are required to attend a minimum of two hours of
training.
Ms. Skogen said the County provides a test grid for marking ballots. City staff marks ballots by
hand and with the use of Automark City staff tests Accu-Votes by running test ballots for each
precinct on two separate memory cards. A Public Accuracy Test is completed to ensure
accuracy of the equipment.
Ms. Skogen said election judges will arrive on election day at 6:00 a.m. to set up polls. The
polls open at 7:00 a.m. and close at 8:00 p.m. Election judges tally results, modem results to the
County, and close down the polling location. Election supplies and equipment are returned to
City Hall when done. Voter pre-registration closes October 24 and voters may register on
election day with appropriate identification. If anyone needs help on election day to find their
polling place they can ca11763-571-3450 or go to http://�ollfinder.sos.state.mn.us/.
Councilmember Barnette asked if the best way to get local results the night of the election is to
watch the City's local cable channel number 17.
Ms. Skogen said that is correct. Residents can also connect with the Anoka County website.
Mayor Lund asked if the alternates have already been selected.
Ms. Skogen said yes.
Councilmember Bolkcom asked what a new voter would need for proper identification.
Ms. Skogen said a new registered voter would need a current MN Driver's license, a learner's
permit, ID card or Tribal ID card with current address. A new voter could also bring someone
with who personally knows them to verify residency. Voters could also bring a current ID that is
not valid along with a utility bill dated within 30 days of the election.
MOTOIN by Councilmember Bolkcom to adopt Resolution No. 2008-46. Seconded by
Councilmember Saefke.

7. Approve Special Use Permit Request, SP #08-13, by HDR Architecture, Inc., for Unity
Hospital, to Allow an Expansion of the Hospital on the North Side of the Existing
Building in an R-1, Single Family Zoning District, Generally Located at 550 Osborne
Road N.E. (Ward 1)

Mr. Hickok said that a public hearing was held at the October 1, 2008, Planning Commission
meeting. After a brief discussion, the Planning Commission unanimously recommended
approval of the special use permit request, with the twelve stipulations presented by staff. Staff
recommends Council's approve.
Councilmember Bolkcom asked if the petitioner has met the stipulations of the last Special Use
Permit.
Mr. Hickok answered yes. The landscaping is done near the entrance by the south parking lot.
After evaluating the site, additional surveying was done and industrial equipment was screened
by sizeable evergreen trees. The petitioner went an additional step and painted the mechanical
equipment which minimizes the appearance.
Councilmember Bolkcom asked if there had been any complaints from neighbors.
Mr. Hickok answered no.
Councilmember Bolkcom asked about the issues that came up in the past with the parking on
the street and smoking in the neighborhood.
Mr. Hickok said he has heard no additional complaints. One person called to thank the
petitioner for painting the mechanical equipment. Another person called concerned the
petitioner was going to take a home down but that was not true so she was okay.
Councilmember Bolkcom asked if the petitioner was okay with the stipulations.
Mr. Hickok said yes.
Pat Belland, VP Operations, Unity Hospital, provided some clarification on the Radiation
Therapy area that will be located behind the Cancer Center. A tunnel will be built to take
patients back and forth to radiation. It would be an ideal situation to move the Radiation
Therapy area into the Cancer Center but it is extremely expensive to move the vaults. Unity and
Allina are very excited to bring the Cancer Canter to Unity Hospital and Fridley. Developers
have worked very closely with staff to meet the City's expectations.
Councilmember Bolkcom asked how long it will take to build the Cancer Center.
Mr. Belland said they hope to be finished the fourth quarter of 2009.
Councilmember Bolkcom asked about parking and if they would need additional stalls.
Mr. Belland said that they did not anticipate the traffic increasing right now but eventually
anticipate the program growing.
Councilmember Varichak asked why they didn't choose to put the Cancer Center by the
current Radiation Therapy area.

Mr. Belland said that they had thought about doing that, but from a campus perspective, they
wanted to put this Center in front of the hospital. They are also looking into future construction
and the need to expand, so the first floor will be built to support additional floors if needed.
Councilmember Barnette said he attended the open house at Unity and was impressed with the
enthusiasm of staf£ This new facility will be a great addition to Unity Hospital and the City.
Mayor Lund asked if there was more than one owner of the property.
Mr. Hickok said that Unity owns the maj ority of the property with the exception of the
professional building.
Mayor Lund commented that the professional building owns quite a bit of green space.
Mr. Hickok answered they do.
Mayor Lund said he looks forward to a master plan and new development.
Councilmember Bolkcom asked if the petitioner is aware of Stipulation No. 13 and the changes
in Stipulation No. 11.
Don Rolf, HDR Architects, said that in order to connect the professional building to the hospital
building, they would need to be in agreement with the property owner of the professional
building; but they were in agreement with both stipulations.
MOTION by Commissioner Saefke to approve the Special Use Permit request, SP #08-13, by
HDR Architecture, Inc., for Unity Hospital, with the following thirteen stipulations. Seconded
by Councilmember Bolkcom.
1. The petitioner shall obtain all necessary permits prior to construction.
2. The petitioner shall meet all building, fire, and ADA requirements.
3. City engineering staff to review and approve grading and drainage plan prior to issuance
of a building permit.
4. Landscape and Irrigation plan to be reviewed and approved by City Staff prior to
issuance of building permit.
5. No outdoor storage of equipment or materials along the south side of the maintenance
building.
6. The subject property shall be maintained free of any and all construction debris.
7. Construction vehicles shall not bring materials before 7:00 am. or after 9:00 p.m. Monday
through Friday and 9:00 a.m. to 9:00 p.m. on Saturdays.
8. The addition shall be architecturally compatible with the existing building and finished
with complementary siding and color scheme.
9. No future additions/expansion of this site shall occur unless a Master Plan has been
submitted detailing what the full build-out could be for the site.

10. Future expansion of the Virginia Piper Cancer Institute shall require an approved
alternative vehicular and pedestrian circulation plan that continues to allow an on-site
east-west connection.
11. City staff will evaluate the need for structured parking on this site, when the Master Plan
is submitted in early 2009.
12. A pedestrian crosswalk shall be established from Lot A various parking lots to the Cancer
Center to accommodate safe pedestrian movement.
13. A pedestrian crosswalk shall be established from Lot A to the Professional Building to
accommodate safe pedestrian movement.

8. Informal Status Report.
Councilmember Bolkcom said that tomorrow the League of Women Voters will meet at 7:00
p.m. She also mentioned that she worked at the recycling event and was amazed to see the
amount of televisions, computer monitors and electronics people brought in. This was the last
recycling event of the year.
Mayor Lund said that Saturday night will be Pumpkin Night in the Park at the Springbrook
Nature Center. All are welcome. The activities start at 6:00 p.m.
Councilmember Bolkcom said the memorandum relating to the depth of the driveways was sent
to Mr. Hughes. Staff discovered that all forms were in conformance with City standards. She
asked when the final work will be done.
Jim Kosluchar, Public Works Director, said that the contractor has the curb and gutter installed.
They are behind on the landscaping due to rain, but are catching up.

AN ORDINANCE ADDING A NEW CHAPTER TO THE FRIDLEY CITY
CODE: CHAPTER 8. CRIMINAL HISTORY BACKGROUND
1NVESTIGATIONS FOR CITY EMPLOYMENT AND LICENSING
The Bureau of Criminal Apprehension (BCA) audits Law Enforcement Agencies every few
years for compliance with criminal justice data practices. The BCA has guidelines regarding
local law enforcement access to Minnesota Computerized Criminal History (CCH) information
for non-criminal purposes. After our last audit, the BCA recommended that we have a City
ordinance in place regarding background checks for City employment and licensing purposes
that use criminal justice data. The Fridley Police Department completes approximately 100
background checks per year. Staff worked with the League of Minnesota Cities in drafting an
ordinance that is acceptable to the BCA.
The audit guidelines require:
o A city adopt an ordinance regarding the use of CCH data for hiring and business licenses
background check purposes.
o Access to CCH data is limited to a law enforcement agency.
o The ordinance expressly authorizes the use of CCH data for the screening of the
applicant.
o The ordinance must comply with Minnesota Statutes Chapter 13 with specific attention to
the elements of the "Tennessen Warning" and "Informed Consent."
o Notification of the applicant for reason(s) of denial of employment or license and of the
process for questioning CCH results at the Bureau of Criminal Apprehension (BCA).
Staff inet to discuss the requirements and drafted an ordinance which has been reviewed by the
City Attorney and the BCA. A few small changes have been made and the ordinance would now
meet the BCA audit requirements. Staff recommends holding the first reading of the ordinance.

CHAPTER 8. CRIMINAL HISTORY BACKGROUND 1NVESTIGATIONS FOR CITY

The City Council of the City of Fridley hereby finds, after review, examination and
recommendation of staff, that the Fridley City Code be hereby amended by adding the following
Chapter as follows:
CHAPTER 8. CRIMINAL HISTORY BACKGROUND 1NVESTIGATION FOR
CITY EMPLOYMENT AND LICENSING
8.01. PURPOSE
The purpose and intent of this Chapter is to establish re�ulations that will allow the Citv of
Fridlev Police Department access to Minnesota's Computerized Criminal Historv information for
specified non-criminal purposes of emplovment and licensin� back�round investi�ations.
8.02. CRIMINAL BACKGROUND 1NVESTIGATION FOR CITY EMPLOYEES AND
APPOINTEES.
The Citv of Fridlev Police Department is required to do a criminal historv back r� ound

8.04. PROCESS OF CRIMINAL BACKGROUND 1NVESTIGATION
1. When conductin� the criminal historv back�round investi�ation to screen emplovment
and license a�plicants, the Police Department is authorized to access the a�propriate code
maintained in the Minnesota Bureau of Criminal A�rehensions Computerized Criminal HistorX
information. Anv data that is accessed and acquired shall be maintained bv the Police
Department under the care and custodv of the chief law enforcement official, or desi�nee, and
retained as required bv the General Records Retention Schedule for the Citv of Fridlev Police
Department. A summarv of the results of the Computerized Criminal Historv data mav be
released bv the Police Department to the Citv Council, Citv Mana�er and citv staff as
appropriate.

2. Before the investi�ation is undertaken, the a�licant must authorize the Police
Department bv written consent to undertake the investi�ation. The written consent
must fullv com�ly with the provisions of Minnesota Statutes Chapter 13 re a� rdin� the
collection, maintenance and use of the information. Except for the positions set forth
in Minnesota Statutes Section 364.09, the Citv will not reject an a�lication for
employment or a license on the basis of the a�plicant's prior conviction unless the
crime is directiv related to the position of emplovment or license sou�ht and the

Stacy Stromberg, City Planner, stated the petitioner, Don Rolf, of HDR Architecture,
Inc., on behalf of Unity Hospital is seeking a special use permit to allow the construction
of a free-standing building on the north side of the existing hospital, which is in an R-1,
Single Family zoning district. The hospital is located at 550 Osborne Road.

Ms. Stromberg stated the petitioner is proposing to construct the Virginia Piper Cancer
Institute building, which will be approximately 19,000 square feet in size. The free-
standing building will be connected to the hospital by a link and will be located north of
the existing hospital building.
Ms. Stromberg stated the subject property is zoned R-1, Single Family as are all of the
surrounding properties, with the exception of the medical clinic to the east. The property
is located on Osborne Road, east of University Avenue and is approximately 35 acres in
size when including the land is which the Professional Building is located on. The
hospital was originally constructed in 1965.
Ms. Stromberg stated including the proposed request, the City has reviewed 3 special
use permits for additions to Unity hospital within the last 5 years. In 2003, the City
Council approved a special use permit to allow a 2,375 square foot expansion to the
Radiation Therapy Center which is located on the south side of the building. In 2006, the
City Council approved a plan for the Hospital's Emergency Department that allowed for
the remodel of 11,000 square feet and an approximate 9,600 square foot addition.
Ms. Stromberg stated hospitals are a permitted special use in the R-1 zoning district
provided that the proposed expansion complies with the requirements for the special use
permit, subj ect to the stipulations suggested by staff. The proposed expansion will allow
for the construction of a free-standing building to be used as the Virginia Piper Cancer
Institute on the north side of the existing hospital. The approximate size of the proposed
building is 124 ft. by 142 ft. When including the length of the connection link to the
hospital; the proposed building will be approximately 19,000 square feet. The petitioner
has stated that there will not be an increase in new patients for the first 3 years, as these
patients are currently being seen at the Cancer Center that is within the Unity
Professional Building. After year 3, new patients will be increased by approximately
1,096 patients per year and this will only increase staff by 2 employees.
Ms. Stromberg stated in 2006, Unity Hospital conducted a parking study to see if
additional parking was warranted to be constructed. The result of the study determined
that they had adequate parking on site to support the addition to the Emergency
Department. However, the Hospital elected to proof 151 parking stalls, which were to be
installed at such time as the City or the Hospital determined it was necessary. To date,
demand for these stalls hasn't been warranted.
Ms. Stromberg stated in order to allow for the construction of the Cancer Center, 44
parking stalls will need to be removed. City Code requires the proposed building to have
65 parking stalls. The petitioner plans to install 135 parking stalls, which will meet City
code requirements.
Ms. Stromberg stated the proposed expansion meets lot coverage and setback
requirements.

Ms. Stromberg stated while the proposed project meets City code requirements to allow
for the construction of the proposed building, staff does have some general concerns.
These concerns are related to hard surface parking, site circulation, and the need for a
Master Plan for the site.
Ms. Stromberg stated as indicated above, this is the third special use permit request that
the City has reviewed within that last 5 years. Each addition requires the need for
additional parking. As can be seen from an aerial, the site mainly consists of building
and parking lot. As the hospital continues to expand there is going to be a need to
provide better parking options other than surface parking. City staff would request that
before subsequent additions are constructed to the hospital, a Master Plan be submitted
showing the City what the maximum build-out is for the site. A Master Plan will help
provide the City with a potential future plan for the Hospital and it also is good strategic
planning. Staff would recommend that the Master Plan include information about full
build out of the site, taking into account parking, storm water management, and
landscaping needs.
Ms. Stromberg stated another staff concern is related to on site circulation. The location
of the proposed building will impact vehicular and pedestrian circulation on the site by
eliminating the existing east-west connection. The petitioner is proposing to move that
east-west connection approximately 160 ft. north of the existing connection, just north of
the proposed Cancer Center building. The site is planned to be re-worked to allow the
current one-way driveway off of Osborne Road to accommodate two-way traffic to
access the new connection. The new connection will allow two-way traffic which will be
able to access the signalized intersection allowing patients/visitors to go either east or
west on Osborne Road. The concern that staff has is that the petitioner has articulated
that the Cancer Center will likely be expanded further north in the future. If that happens,
the proposed east-west connection within the site will be eliminated. Staff realizes that if
that happens there may be other access options to the site, other than what exists today.
However early indications from Anoka County are that additional access to Osborne
Road would be unlikely. Directing traffic to Lyric Lane and Sth Street also would not be
a favorable option for the City as these are not designed to be arterial streets. As a result,
staff will stipulate that future expansions of the Cancer Center will require an approved
alternative circulation plan that continues to allow an on-site east-west connection.
Ms. Stromberg stated City Staff recommends approval of this special use permit request
as hospitals are a permitted special use in the R-1, Single Family zoning district, provided
that the proposed expansion complies with the requirements for the special use permit,
subject to the following stipulations:
1. The petitioner shall obtain all necessary permits prior to construction.
2. The petitioner shall meet all building, fire, and ADA requirements.
3. City Engineering staff to review and approve grading and drainage plan prior to
issuance of a building permit.
4. Landscape and Irrigation plan to be reviewed and approved by City Staff prior to
issuance of building permit.
5. No outdoor storage of equipment or materials along the south side of the
maintenance building.

6. The subject property shall be maintained free of any and all construction debris.
7. Construction vehicles shall not bring materials before 7:00 am. or after 9:00 p.m.
Monday through Friday and 9:00 a.m. to 9:00 p.m. on Saturdays.
8. The addition shall be architecturally compatible with the existing building and
finished with complementary siding and color scheme.
9. No future additions/expansion of this site shall occur unless a Master Plan has
been submitted detailing what the full build-out could be for the site.
10. Future expansion of the Virginia Piper Cancer Institute shall require an approved
alternative vehicular and pedestrian circulation plan that continues to allow an on-
site east-west connection.

Ms. Stromberg stated staff has had some conversations with the petitioner and members
of Unity Hospital today who have indicated they're working on getting a master plan
designed for the site. As a result staff has eliminated Stipulation No. 11 from what is in
the Commission's packet to now read, "City staff will evaluate the need for structured
parking on this site, when the Master Plan is submitted in early 2009." Representatives
of Unity Hospital have told staff they will have something to show the City in January-
February 2009.
Commissioner Kondrick asked Ms. Stromberg when she says, structured parking, she
means parking ramp?
Ms. Stromberg replied, correct.
Commissioner Sielaff stated he was a little confused about the circular route to the
professional building. Coming from Osborne, how is that changing from what is out
there now? He asked about the scenarios.
Ms. Stromberg replied, currently they have the east-west connection existing on the site.
For example, if somebody is coming eastbound on Osborne Road, they could turn into
the campus and go to professional building. They then have the option to access the
existing east-west connection and leave the sight through the signalized stoplight and go
either east or west on Osborne Road. If somebody is going westbound on Osborne, they
will have to turn in on Madison to get to the professional building and use the back
parking lot. The petitioner is proposing to have a new east-west connection on site. If
the cancer center is expanded further north, they are going to lose that connection. So
there will no longer be and east-west connection on site and that is staff's concern.
Chairperson Savage pointed out that concern is addressed in Stipulation No. 10.

Ms. Stromberg replied, that is correct.
Commissioner Dunham asked whether Stipulation No. 5 is something that was carried
over from the last special use permit?
Ms. Stromberg replied, yes.
Commissioner Sielaff asked what does it mean to proof 151 parking stalls?
Ms. Stromberg replied what that means is the petitioner has designated on the site plan
an area, west of their existing parking lot, and then an area south of their existing parking
lot, that they could have 151 stalls if the City deemed they were necessary.
Commissioner Sielaff asked how did staff determine whether there was no need for the
other parking stalls?
Ms. Stromberg replied that in 2006 Unity Hospital did a survey of their parking needs to
determine if there current parking was being utilized and if additional staff were
warranted.
Chairperson Savage asked the petitioner if they had any problem with any of the
stipulations?
Don Rolf, with HDR Architecture, replied, no, we've addressed No. 11.
Commissioner Kondrick asked him whether he understand the importance of the traffic
flow. He just wants it to be record that they understand this.
Chairperson Savage asked if there was a reason behind the name "Virginia Piper" for
the cancer center?
Pat Belland, Vice President of Operations, Unity Hospital, stated the Virginia Piper
Cancer Institute is actually on the Abbott-Northwestern campus under the Allina
Hospitals and Clinics umbrella which is what Unity is a part of. They have identified the
protocols and approach to treatment of cancer care under the Virginia Piper Cancer
Institute as the ultimate care for Allina's patients.

Commissioner Sielaff stated the fact they are willing to do a master plan by 2009
resolves any concerns he would have.

CERTIFICATION OF DELINQUENT UTILITY SERVICES

Attached is a resolution for the purpose of certifying delinquent utility accounts to the County for
collection with property taxes in the year 2009.
All property owners have been notified that the utility bills are being certified to the County and have
been given adequate opportunity to pay their bill. The penalty shown on this resolution is in addition
to the regular penalties that accrue on the utility bills. The number and dollar value of accounts
varies each year. We cannot be sure of the final count or dollar value until mid-November since
property owners have until that time to pay without penalty.
For your information, the chart below shows the certification history at this point in the process for
this year and the past two years.

A RESOLUTION CERTIFYING CERTAIN DELINQUENT UTILITY
SERVICES TO THE COUNTY FOR COLLECTION WITH THE 2009
PROPERTY TAXES
WHEREAS, certain utility services for the City of Fridley are delinquent in payment, and
WHEREAS, Chapter 402, Water and Sewer Administration, Chapter 113, Solid Waste Disposal and
Recycling Collection, Chapter 216, Storm Water Drainage Utility, and Section 1.02 of the City
Charter provides for the certifying of delinquent charges to the County for collection with the
property taxes, and
NOW, THEREFORE BE IT RESOLVED, that the City Clerk is hereby authorized and directed to
certify the following charges to the County for collection with the property taxes payable in the year
2009, to wit:
All these noted in Exhibit "A" attached hereto and made a part hereof by reference.

Six Cities Water Management Organization Appointment

Earlier this year, staff form the Cities in the Six Cities Water Management Organization (Six Cities WMO)
were advised by the attorney for the Six Cities WMO that city staff representation on the Six Cities WMO
board were no longer permitted by state statute. The City of Fridley has had a resident representative,
John Flora, who formerly was a member of City of Fridley staff. Jon Haukaas served as an alternate.
Both these individuals' appointment to the board preceded the statute precluding staff from representing
a community on the board.
While Mr. Flora fulfilled the requirements of a non-staff citizen representative to the board, and after
some discussion, Mr. Flora advised that he no longer wished to serve as the representative to the Six
Cities WMO. Other member communities, including Blaine, have had to appoint new representatives to
the Six Cities WMO to fulfill the statutory requirement.
The City advertized for a replacement and alternate representative, and received no interest.
Subsequently, Donna Bahls advised that she was interested in serving as the City of Fridley's
representative. She attended the October meeting to evaluate the board, and agreed that she would be
willing to represent the City of Fridley as its citizen representative.
The attorney for the Six Cities WMO has advised that City Council can legally serve as representatives
to the board. has advised that they are willing to represent the City as an alternate.
Recommend the City Council approve the attached resolution appointing Donna Bahls as the
representative and as the alternate to the Six Cities Water Management Organization.

A RESOLUTION AMENDING THE CITY OF FRIDLEY'S REPRESENTATIVE TO
THE SIX CITIES WATERSHED MANAGEMENT ORGANIZATION
WHEREAS, the City of Fridley entered into the Joint Powers Agreement establishing the Six Cities
Watershed Management Organization, and
WHEREAS, the City is to appoint one representative and one alternate representative as a member of the
Six Cities Watershed Organization, and
WHEREAS, the appointed member is also to be designated as the Subdistrict Representative of the Six
Cities Watershed Organization, and
WHEREAS, Resolution 108-2000 appointed John Flora as the City representative and John Haukaas as
the alternate representative to the Six Cities Watershed Organization, and
WHEREAS, Donna Bahls is a resident of the City of Fridley, and

RESOLUTION NO. 2008-
RESOLUTION ADOPTING ASSESSMENT FOR THE
2008 STREET IMPROVEMENT PROJECT NO. 2008-2
WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard
and passed upon all objections to the proposed assessment for the 2008 Street Improvement Project
No. 2008-2.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FRIDLEY, MINNESOTA:
Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby
accepted and shall constitute the special assessment against the lands named therein and each tract of
land therein included is hereby found to be benefited by the proposed improvement in the amount of
the assessment levied against it.
Such assessment shall be payable in equal annual installments extending over a period of ten years,
the first of the installments to be payable on or before the first Monday in January, 2009, and shall
bear interest at the rate of 6'/z percent per annum from the date of the adoption of this assessment
resolution. To the first installment shall be added interest on the entire assessment from the date of
this resolution until December 31, 2009. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.
The owner of any property so assessed may, at any time prior to certification of the assessment to the
county, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid
within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the city
treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31
of the year in which such payment is made. Such payment must be made before November 15 or
interest will be charged through December 31 of the next succeeding year.
The Finance Director shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the county. Such assessments shall be collected
and paid over in the same manner as other municipal taxes.

Attached you will find the final assessment roll for the 2008 Nuisance Abatement along with the
Resolution to adopt the assessment.
The assessment includes 56 properties at a cost of $52,761.79. The assessment will be certified for 1
year at an interest rate of 6.5%.

RESOLUTION NO. 2008-
RESOLUTION ADOPTING ASSESSMENT
FOR 2008 NUISANCE ABATEMENT
WHEREAS, pursuant to proper notice duly given as required by law, the council has met and
heard and passed upon all objections to the proposed assessment for the 2008 Nuisance
Abatement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FRIDLEY,
MINNESOTA:
Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby
accepted and shall constitute the special assessment against the lands named therein and each
tract of land therein included is hereby found to be benefited by the proposed improvement in the
amount of the assessment levied against it:
Such assessment shall be payable in equal annual installments extending over a period of one
year, the first of the installments to be payable on or before the first Monday in January, 2009,
and shall bear interest at the rate of 6% percent per annum from the date of the adoption of this
assessment resolution. To the frst installment shall be added interest on the entire assessment
from the date of this resolution until December 31, 2009.
The owner of any property so assessed may, at any time prior to certification of the assessment to
the county, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the city treasurer, except that no interest shall be charged if the entire assessment is
paid within 30 days from the adoption of this resolution.
The Finance Director shall forthwith transmit a certified duplicate of this assessment to the
county to be extended on the property tax lists of the county. Such assessments shall be
collected and paid over in the same manner as other municipal taxes.
PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY THIS

interest for one yeaz on all unpaid installments.
The owner of any property so assessed may, at any time prior to certification of the assessment to the
county, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the city treasurer, except that no interest sha11 be charged if the entire assessment is paid

Attached you will find the final assessment roll for the 2008 Street Improvement Proj ect No. St.
2008-1 along with the Resolution to adopt the assessment.
This proj ect included 310 properties. The assessment will be for 10 years at a rate of 6.5%.

RESOLUTION NO. 2008-
RESOLUTION ADOPTING ASSESSMENT FOR THE
2008 STREET IMPROVEMENT PROJECT NO. 2008-1
WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard
and passed upon all objections to the proposed assessment for the 2008 Street Improvement Project
No. 2008-1.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FRIDLEY, MINNESOTA:
Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby
accepted and shall constitute the special assessment against the lands named therein and each tract of
land therein included is hereby found to be benefited by the proposed improvement in the amount of
the assessment levied against it.
Such assessment shall be payable in equal annual installments extending over a period of ten years,
the first of the installments to be payable on or before the first Monday in January, 2009, and shall
bear interest at the rate of 6'/z percent per annum from the date of the adoption of this assessment
resolution. To the first installment shall be added interest on the entire assessment from the date of
this resolution until December 31, 2009. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.
The owner of any property so assessed may, at any time prior to certification of the assessment to the
county, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid
within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the city
treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31
of the year in which such payment is made. Such payment must be made before November 15 or
interest will be charged through December 31 of the next succeeding year.
The Finance Director shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the county. Such assessments shall be collected
and paid over in the same manner as other municipal taxes.
