A RESOLUTION RECEIVING THE PRELIMINARY REPORT AND CALLING A PUBLIC
HEARING ON THE MATTER OF THE CONSTRUCTION OF CERTAIN IMPROVEMENTS:
(SECOND STREET BETWEEN 57th AND 58th)
WHEREAS, the construction of certain improvements is deemed to
be in the interest of the City of Fridley and the property owners
affected thereby.
BE IT RESOLVED, by the City Council of the City of Fridley, as
follows:
1. That the preliminary report submitted by Comstock and Davis,
Inc., Consulting Engineers, is hereby received and accepted.
2. That this Council will meet on the 15th cay of November, 1960,
at 7:30 o'click P.M. at the City Hall in the City of Fridley
for the purpose of holding a Public Hearing on the improvements
noted in the Notice attached hereto and made a part thereof
by reference, Exhibit "A ".
3. That the area proposed to be assessed for said improvements
and each of them as noted in said notice are ?11 the lands
and are -s as noted in said notice: All of the same to be
assessed proportionately according to the benefits received.
4. That the City Manager is authorized and directed to give
notice of such Public Hearing by publishing a notice
thereof in the official newspa.per of the City of Fridley
according to law, such notice to be substantially in the
form =nd substance of the notice attached hereto as Ex-
hibit 11,411.

EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THIS CITY OF
FRIDLEY OF A REGULAR MEETING HELD ON NOVEMBER 1, 1960, AT 7:45
P.M., AT THE CITY HALL, CITY OF FRIDLEY, A1,C?,A COUNTY, MINI, -ESOTA
The matter of the construction of certain improvements, and
the he ^rings held heretofore on the same were discussed, and Council
being full advised in the matter, Councilman Wolke introduced the
following resolution and moved its adoption.
RESOLUTION NO. 150 - 1960
A RESOLUTION ORDERING IMPROVEMENTS, APPROVAL OF PLANS, AND ORDERING
ADVERTISL:G FOR BIDS.
WHEREAS, the resolution of the City Council adopted the 3rd
day of May, 1960 and the 2Cth day of September, 1960, set the date
for hearing on the proposed improvements, as specifically noted in
the notice of hearing attached hereto for reference as EXHIBIT "A ".
WHEREAS, all the property owners whose property is liable to
be assessed with the making of these improvements (as noted in said
notice) were given ten (10) days published notice of the Council
hearing through two (2) weekly publications of the required notice,
and the hearing was held and the property owners heard thereon at '
the hearing, as noted in said notice.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of
Fridley, Minnesota, as follows:
1. That the following improvements heretofore proposed by council
resolution are hereby ordered to be effected and completed as
soon as reasonably possible, to -wit:
(a) All of the improvements as noted in the notice of hearing
on the same as are noted (in Exhibit "A" in said notice)
except (none): that the work involved in said improvements
as listed above shall heareafter be designated as:
STORM SEWER IMPROVEMENT PROJECT NO. 43 - 1960
STREET SURFACING IMPROVEMENT PROJECT - 1961
2. The plans and specifications prepared by Comstock and Davis,
Inc., Consulting Engineers, for such improvements and each
of them, pursuant to the council resolutions heretofore ad-
opted, a copy of which plans and specifications are hereto
attached and made a part hereof, are hereby approved and shall
be filed with the City Clerk.
3. The work to be performed under STORM SEWER IMPROVEMENT PROJECT ,
NO. 43 - 1960 and STREET SURFAC1hG IMPROVEiYIENT PROJECT N0. -1961
shall be performed under one contract.
The City Man -ger shall accordingly prepare and c -use to be
inserted in the official newspaper advertisements for bids
upon the making of such improvements under such approved
plans and specifications. The advertisement shall be pub-
lished for 3 weeks (at least 21 days), and shall specify
the work to be done ?nd will state that bids will be opened
and considered at 12 :00 o'clock boon, on the 22nd day of
November, 1960, in the council chambers of the City Hall,
and that no bids will be considered unless sealed and filed
with the City Clerk, and accompanied by a cash deposit, bid
bond, or certified check payable to the City for five per
cent (5 %) of the amount of such bid. That the advertisement
for bids for STORM SEWER IMPROVEMENT PROJECT N0. 43 -1960
and STREET SURFACING IMPROVEMENT FROJECT - 1961 shall be
substantially in form as that noted in Exhibit "B" attached
hereto for reference and made a part hereof.

NOTICE OF HEARING ON IMPROVEMENTS
WHEREAS, the City Council of the City of Fridley, Anoka County,
Minnesota, has deemed it necessary and expedient that the improvements
hereinafter described be made.
NOW, THEREFORE, NOTICE IS HEREBY GIVEN THAT on the 4th day of Oct -
ober, 1960, at 8:00 o'clock P.M., the City Council will meet at flee
' City Hall in said City, and will at said time and place hear all parties
interested in said improvements inwhole or in part.
The general nature of the improvements is the construction (in the
lands and streets noted below) of the following improvements, to -wit:

A. Storm Sewer System for the Marian Hills area located in and serving
all of the area described as follows:
1. .That area South of T.H. No. 100; East of T.H. No. 65; North of
South Corporate Limits; and West of East corporate Limits:.

B. Street Surfacing, including stabilized base, grading, graveling,
blacktopping, curb and gutter, serving all of the area described as follows:
1. That property adjacent and abutting thereof on 53rd Ave. NE.
from Fillmore to Johnson; Fillmore to 53rd to 507 Feet South;
Pierce from 53rd to 507 Feet South; Buchanan from 53rd to
South Corporate Limits and Lincoln Street from 53rd to
Buchanan.

All of said lands to be assessed proportionately according to
the benefits received by such improvements.
That the Council proposes to proceed with each of said improve-
ments as separate improvements, except as hereinafter otherwise provided
by the Council all under the following authority to -wit: Minnesota Laws
1953, Chapter 398, and laws amendatory thereof, and in conformity with
the City Charter.

EXHIBIT "A"
NOTICE TO CONTRACTORS
Sealed bids will be received until 12:00 o'clock Noon on the
22nd day of November 1960 by the City Council of the City of Fridley,
Minnesota, at the office of the City Manager, for the furnishing of
work and materials for the construction of Storm Sewer and Street
Improvement Project Number SS43.
The project consists of t13 following approximate quantities:
3-500 Lin. Ft. 12 -30" Storm Sewer with appurtenances.
16,800 14. Yds. Bituminous Surfacing
10,000 Lin. Ft. Bituminous Curb
1,900 Cu. Yds. Stabilized Base.
All bids must be made upon printed proposal forms, furnished
and in accordance with the plans and specifications. Plans and
specifications may be examined at the office of the City Manager
and copies may be had for the Contractor's individual use by applying
to the Engineers, Comstock & Davis, Inc., consulting Engineers, 1446
County Road "J ", Minneapolis, 21, Minnesota, Telephone: SUnset 4 -9346.
Plans and specifications may be had by depositing $25.00 per copy.
Bids must be made in the basis of cash payment for the work
and accompanied by a cash deposit, certified check on a responsible
bank in the State of Minnesota, or a bidder's bond, and made pay-
able without condition to the City of Fridley, Minnesota, in the
amount of not less than 5% of the total amount of the bid, accompany-
ing such cash deposit, certified check or bidder's bond. The City
Council reserves the right to waive any informalities in any bid
received, and to reject any or all bids received, without explanation.
No bid may be withdrawn for a period of thirty days.
