RESOLUTION NO. 86 -1962
A RESOLUTION RELATING TO THE MAKING OF ASSESSMENTS FOR CERTAIN
SEWER AND WATER MAINS, LATERALS, AND SERVICE CONNECTIONS
BE IT RESOLVED, by the Council of the City of Fridley, Anoka County,
Minnesota, as follows:
Section 1. The provisions of Ordinance No. 113 of the City of
Fridley provide that no connection shall be made or
continued in use at any time with respect to any
sewer or water service serving the property of any
person or occupant of any parcel if payment has not
been made or provided for (by assessment or otherwise)
with respect to said parcel or property of the full
and proportionate share of the cost of such service
to the parcel or property.
Section 2. The City Clerk shall accordingly investigate and search
the records of the City with respect to the connections
made and in use and with respect to payment of charges
and assessments and costs thereof and determine whether
or not any parcel of land or property is connected to
_ and making use of the sewer and water systems of the
City without having paid or provided for (by assessment
or otherwise) of its full and proportionate share of the
cost of such service to the parcel or property.
Section 3. That upon such determination the Clerk shall give notice
to the owner or occupant of the charges, assessments, and
costs to be so apportioned and to be paid, and upon fail-
ure of the owner or occupant to make such payment or
provide otherwise therefor within a reasonable period of
time (not in excess of 60 days) the Clerk may and shall
prepare an assessment roll with respect thereto and upon
a hearing held thereon and confirmation of the roil, the
assessments therein contained shall be certified to the
County Auditor in the same manner as provided by Statutes
in other cases.
Section 4. The Clerk upon receipt of any such monies, shall deposit
the same in the funds of the City, first to the credit
of any fund or account established and created with re-
spect to the construction of such improvement and service
and payment of the costs thereof; provided that should
such deposit and credit create a surplus in such fund
or account, then the Clerk may deposit the same to any
similar fund or account in which a deficiency exists.
