RESOLUTION NO. 139-193
RESOLUTION ORDERING IMPROVEMENT AND FINAL PLANS AND SPECIFICATIONS
(STORM SEWER PROJECT NO. 53 - POLK STREET)
WHEREAS, Resolution #125-1963 of the City Council adopted the
4th day of September, 1963, set the date for hearing on the proposed
improvements, as specifically noted in the Notice of Hearing attached
hereto for reference as Exhibit "A", and
WHEREAS, all of the property owners whose property is liable
to be assessed with the making of these improvements (as noted in
said notice) were given ten (10) days published notice of the Council
hearing through two (2) weekly publications of the required notice, and
the hearing was held and the property owners heard thereon at the
hearing, as noted in said notice.
NOW, THEREFORE, BE IT RESOLVED, By the Council of the City of
Fridley, Anoka County, Minnesota, as follows:
1. That the following improvements proposed by Council Resolu-
tion #125-1963 are hereby ordered to be effected and com-
pleted as soon as reasonably possible to-wit:
A. All of the improvements as noted in the notice of hearing
on the same as are noted (in Exhibit "A") in said notice.
That the work above may be cansolidated with other areas as
one improvement.
2. The work to be performed under this project may be performed
• under one or more contracts as may be deemed advisable upon
receipt of bids.
3. Comstock and Davis, Inc., Consulting Engineers, are hereby desig-
nated as the Engineers for this improvement. They shall prepare
final plans and specifications for the making of such improvements.
ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY THIS 30TH DAY OF
SEPTEMBER, 1963.

CITY OF FRIDLEY
NOTICE OF HEARING ON IMPROVEMENTS
WHEREAS, the City Council of the City of Fridley, Anoka County,
Minnesota, has deemed it necessary and expedient that the improvements
hereinafter described be made.
NOW, THEREFORE, NOTICE IS HEREBY GIVEN THAI on the 30th day of
September, 1963, at 8:00 o'clock P.M., the City ouncil will meet at
the City Hall in said City, and will at said time, and place hear all •
parties interested in said improvements in whole or in part.
The general nature of the improvements is the construction (in
the lands and streets noted below) of the following improvements, to-wit:
CONSTRUCTION ITEM:
A. Storm Sewer and Appurtenances located in all of the streets and
serving all of the area described as follows:
Polk Street - Lynde Drive to the South, an area lying south of
Lynde Drive, east of T.R. No. 65, north of T.H. No. 694 (Highway
#100), and West of the extension of Fillmore St.
ESTIMATED 2,840.00

That the area proposed to be assessed for said improvement is
as follows:
For Construction Item A, above:
All of the land abutting upon said streets named above and all
lands within, adjacent and abutting thereto.
All of said land to be assessed proportionately according to
the benefits received by such improvements.
That the Council proposes to proceed with each of said
improvements as separate improvements except as hereafter other-
wise provided by the Council all under the following authority,
to-wit: Minnesota Laws 1953, Chapter 398 and laws amendatory thereof,
and in conformity with the City Charter.

EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF REGULAR MEETING
HELD SEPTEMBER 30, 1963, AT 8:00 O'CLOCK, P.M., AT THE CITY HALL, CITY
OF FRIDLEY, MINNESOTA.
Pursuant to due call and notice thereof, a special meeting of
the City Council of the City of Fridley, Minnesota, was duly held at
the City Hall in said City on Monday, the 30th day of September,
1963, at 8:00 o'clock P.M.
'he following members were present: Mayor Nee, Councilmen
Sheridan, Brook, Wolke, Johanson
and the Following were absent: None.
he Clerk announced that the proposed assessment for
STORM SEWER IMPROVEMENT PROJECT NO. 53
had been filed in his office ot the 4th day of September, 1963, and
that notice of a hearing on said assessment to be held at the special
meeting of the Council on the 30th day of September, 1963, had been
given in the form and manner as provided by law. The Clerk presented
an affidavit showing publication of such notice in the official news-
paper, which affidavit was examined and found satisfactory and ordered
placed on file.
The Mayor announced that the meeting was open for consideration
of objections to the assessment heretofore filed with the City Clerk for
STORM SEWER IMPROVEMENT PROJECT NO. 53
The Clerk reported that written objections had been filed by
the following persons affecting the following described lots,
pieces or parcels of land, to-wit: NONE
The following persons were then heard and presented their
objections to said assessment:
