RESOLUTION NO. 163-1963
A RESOLUTION DIRECTING THE SALE & PURCHASE OF TEMPORARY IMPROVEMENT BONDS
IN ACCORDANCE WITH LAWS OF 1957, CHAPTER 385.
BE IT RESOLVED By the City Council of the City of Fridley, Anoka County,
Minnesota, as fol7ows:
THAT WHEREAS it has heretofore been determined by this council to issue
temporary improvement bonds in order to provide the necessary funds for
the construction and payment of expendes relative to the following improve-
ment nrojects: to-wit:
Street Improvement Project #1963-1
as per plans and specifications approved by the City Council; and
WHEREAS it has been determined that there is at the present time an amount
in excess of $52,000.00 in the following fitnd, to-wit:
REGULAR SPECIAL ASSESSMENT FUND (Sinking Account)
which.sum will not be required for other purposes prior to October 15, 1965,
IT IS THEREFORE determined to be in the interest of the City of Fridley that
the sum of 52,000.00 of Special Assessment Fund (Sinking Account) BE INVESTED
as authorized by law and in accordance therewith it is hereby determined to
purchase the sum of $521000.00 of the aforementioned Street Improvement Project
#1963-1 Bonds Series "A" temporary issued under date of October 15, 1963.
UPON their initial issuance in accordance with the provisions of Minnesota
Statutes, Sec. 429.091, 471,96 and 471.66, out of the funds in Regular Special
Assessment Fund (Sinking Account) and on behalf of said fund at par and accrued
interest as of the date of delivery of said bonds and completion of such sale; it
being farther determined to be reasonable and advantageous to Sinking Account
of the Regular Special Assessment Fund to invest it in said temporary improvement
bonds and to be reasonable and advantageous to the City to sell said temporary
improvement bonds to the Sinking Account of the Regular Special Assessment
. Fund, in accordance with the provisions of this resolution.
SEC. 1. The City Manager and Treasurer are hereby authorized and directed
to take any and all steps necessary to effect the provisions of theaforegoing
resolution and to make such transfer of funds as may be necessary from time
to time to give effect to the provisions hereof.

EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF FRIDLEY,
OF A REGULAR MEETING HELD OCTOBER 21, 1963, AT 8:00 ofclock P.N. AT THE
CITY HALL, CITY OF FRIDLEY, ANOKA COUNTY, MINNESOTA.
The matter of the construction of certain improvements, and the hearings
held heretofore on tale same were discussed, and Council being fully advised in
the matter, Councilman Sheridan introduced the following resolution and moved
its adoption.

A RESOLUTION 07DERING IMPROVEMENT, APPROVAL OF PLANS, AND ORDERING ADVERTISE-
MENT OF BIDS.
WHEREAS, the resolution of the City Council adopted on the 1st day of
July, 1963, set the date for hearing on the proposed improvements, as
specifically noted in the notice of hearing attached hereto for reference
as EXHIBIT "A", and,
WTTER7AS, all the property owners whose property is liable to be
assessed with the raking of these improvements (as noted in said notice)
were given ten (10) days published notice of the Council hearing through
two (2) weekly publications of the required notice, and the hearing was
held and the property owners heard thereon at the hearing, as noted in
said notice.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Fridley,
Minnesota, as follows:
1. That the following improvements heretofore proposed by Council resol-
ution are hereby ordered to be effected and completed as soon as
reasonably possible, to-wit:
(a) All of the improvements as noted in the notice of hearing on
the same as are noted (in Exhibit A" in said notice) except
(none); that the work involved in said improvements as listed
above shall hereafter be designated as:
SANITARY SEWER AND WATER IMPROVEMENT PROJECT NO. 61-1963
2. The plans and specificatons prepared by Comstock and Davis,
Consulting Engineers, for such improvements and each of them, pursuant
to the Council resolutions heretofore adopted, a copy of which plans
and specifications are hereto attached and rade a part hereof, and
are hereby approved and shall be filed with the City Clerk.
3. The work to be performed under SANITARY SEWER AND WATER IMPROVEMENT
PROJ7CT NO. 61-1963, shall be performed under one contract.
The City Manager shall accordihgly prepare and cause to be inserted
in the official newspaper advertisements for bids upon the making of such
improvements under such approved plans and specifications. The advertise-
ment shall be published for three (3) weeks (at least 21 days), and shall
specify the work to be done and will state that bids will be open.ed and
consiconsidered at 12:00 Noon, on the 4th day of November, 1963, in the Council

of the City Hall, and that no bids will be considered unless sealed
and filed with the City Clerk, and accompanied by a cash deposit, bid bond,
or certified check payable to the City for five per cent (5%) of the amount
of such bid. That the advertisement for bids for SANITARY SEWER AND WATER
DITROVEVENT PROJECT NO. 61-1963 shall be substantially in form as that
noted in Exhibit "a" attached hereto for reference and made a part hereof.
ADOPTED BY THE COUNCIL OF THE CIT7 OF FRIDLEY THIS 21ST DAY OF
OCTOBER, 1963.

seconded by Councilman Brook, and upon vote being taken thereon the
following voted in favor thereof: Unanimous

WHEREAS, the City Council of the City of Fridley, Anoka County, Minnesota
has deemed it necessary and expedient that the improvements hereinafter des-

EXHIBIT "B"
NOTICE TO CONTRACTORS
Sealed bids will be received and publicly opened by the City of Fridley,
Anoka County, Minnesota, at the office of the City Manager, on the 4th day
of November, 1963, at 12:00 Noon, and will be considered by the City
Council of the City of Fridley, at a regular Council Meeting, at 8:00
P.M., on the 4th day of November, for the furnishing of work and materials
for the installation of Sewer and Water Improvement Project No. 61.
he project consists of the following approximate quantities:
2,850 Lin. Ft. 8" and 6" Sanitary Sewer Tines with appurtenances
2,300 Lin. Ft. 12" and 6" and I" Water Lines with appurtenances
All in accordance with plans and specifications prepared for the City of
Fridley, Minnesota, by Comstock & Davis, Inc., Consulting Engineers,
1446 County Road "J", Mihneapolis 32, Minnesota, Telephone: SUnset 4-9346.
Plans and specifications may be examined at the office of the City Manager
and copies may be obtained for the ontractor's individual use by applying
to the ,Lngineers and depositing with the Engineers $25.00 for each set.
The deposit will be refunded to each bidder submitting a bonafide bid upon
return of the documents in good condition with in ten (10) days from the
date of opening bids and to non-bidders upon return of thedocurents in
good condition prior to the bid opening.
Bids must be made on the basis of cash payment for the work, and accom-
panied by a cash deposit, certified check (on a responsible bank in the
State of Minnesota), or a bidder's bond and made payable without con-
dition to the City of Fridley, Minnesota, in an amount of not less than
5% of the total amount of the bid.
The City Council reserves the right to reject any and all bids and to waive
any informalities in any bids received without explanation.
No bid may he withdrawn for a period of thirty (30) days.
