NEW BUSINESS:
1. Resolution Regarding the Administration of the Minnesota Wetland Conservation Act
in the City of Fridley within the Coon Creek Watershed District.
Darin Nelson, Interim City Manager, stated the Minnesota Wetland Conservation Act (WCA)
requires local governmental units (LGU) to implement rules and regulations promulgated by the
Board of Water and Soil Resources. Fridley served as the LGU within the former Six Cities
WMO. Six Cities WMO has since dissolved, with the areas to the north becoming part of
CCWD and the areas to the south becoming part of the MWMO. CCWD already serves as the
LGU implementing the WCA for several cities under its jurisdiction. Staff recommends is
recommending Council adopt the resolution establishing CCWD as the LGU for the
implementation of the Wetland Conservation Act in areas of Fridley that are within the CCWD.

2. Resolution in Supporting of an Application for a Minnesota Lawful Gambling Premises
Permit for Spring Lake Park Lions at Shorewood Restaurant Located at 6161 Central
Avenue N.E. (Ward 2)
Darin Nelson, Interim City Manager, stated this resolution is in support of an application for a
Minnesota Lawful Gambling Premises Permit for the Spring Lake Park Lions at the Shorewood
Restaurant located at 6161 Central Avenue. An updated memo and resolution have been
provided to the Council. The original memo and resolution made reference to the Spring Lake
Park Youth Hockey Association. That was a typo. The Spring Lake Park Lions are applying for
a permit.
Mr. Nelson stated Minnesota state law requires a gambling organization applying for a State
Premises Permit to contact the city in which it will be conducting lawful gambling to provide a
resolution in support of their application. The Fridley Lions had been conducting lawful
gambling at the Shorewood Restaurant until their lease was cancelled in November. Changes to
the City Code require the establishment to work with a City organization and should no
organization be available, the establishment may choose another organization. The Shorewood
did have discussions with the American Legion. Both parties, however, decided it was not a
good fit.
Mr. Nelson stated the Shorewood has chosen to work the SLP Lions to conduct lawful
gambling. Staff verified the SLP Lions have no outstanding issues with the Minnesota Gambling
Control Board, and the Police Department conducted background checks on the SLP Lions and
their officials and found no adverse police contacts. Staff recommends Council's approval.
ADOPTED RESOLUTION NO. 2013-08.
3. Approve 2013 Pay Equity Report.
Darin Nelson, Interim City Manager, said this is commonly referred to as "Pay Equity" or
"Comparable Worth." The Local Government Pay Equity Act requires local governments to
establish equitable compensation relations to eliminate sex-based wage disparities in public
employment. Local governments are responsible for complying with the law at all times and
must report their data every three years. The City of Fridley is required to report the 2012 data
by January 31, 2013. Test results indicate the City is well within the required compliance
ranges. Staff recommends Council's approval.

4. Appointment—City Employees.
Darin Nelson, Interim City Manager, stated staff recommends the appointment of Don Roberts
to the position of Engineering Technician II effective February 12, 2013. Mr. Roberts is
currently working as a Sr. Transportation Generalist for MnDOT where he has been a chief
inspector since 2009. Prior to MNDOT, Mr. Roberts worked for the City of South St. Paul for
11 years. Mr. Roberts is filling the position vacated by Daniel Belair in August of last year.

Mr. Nelson stated staff is also recommending the appointment of Claudia M. Diggs to the
position of Fire Inspections Office Assistant effective February 28, 2013. Ms. Diggs is
experienced in the area of fire inspections and administrative support and previously worked for
the City of Maple Grove as a Fire Inspections Office Assistant for five years. At Maple Grove,
she provided administrative support to inspections staff in working with property owners, issuing
permits and corrections orders, and assisting with code enforcement projects. Ms. Diggs is
currently working for the Shiloh Village School District in Shiloh, Illinois, as an administrative
assistant and plans to relocate back to Minnesota.

OPEN FORUM VISITORS:
Councilmember Bolkcom asked for an update regarding the parking at Wal-Mart.
Jim Kosluchar, Public Works Director, replied that a speed restriction sign has been put up and
no parking signs have been placed on both sides of the street by the east entrance to Wal-Mart.
Councilmember Bolkcom said that a lot of cars were parked in the "no parking" area yesterday.
Mr. Kosluchar said warning tickets were being issued. Now the area will be enforced with
parking tickets.
Scott Hickok, Community Development Director, presented the "eQuality — Pathways to
Potential" video for Council.
OLD BUSINESS:
8. Second Reading of an Ordinance Amending Chapter 205, Section 205.03, Defining
"Crematory," "Mortuary," and "Retort," and Section 205.15, Allowing "A Crematory
in Conjunction with a Mortuary" as an Accessory Use in the C-3, General Shopping
Zoning District.
Scott Hickok, Community Development Director, stated that public hearing was in December
and the first reading on January 7. The petitioner is seeking a text amendment to add language to
the C-3, General Shopping zoning district that would allow a crematory as an accessory to the
mortuary use at the subject property, which is located at 6210 Hwy 65. The text amendment
includes adding the definitions of Crematory, Mortuary and Retort. Conditions placed on
accessory use include:
• Crematory must be licensed annually by the State of Minnesota Department of Health.
• Crematory must be inspected annually by the State of Minnesota Department of Health.

• Emissions from the operation of the retort must meet State of Minnesota Pollution
Control Agency standards.
• The retort must be properly maintained and serviced by the manufacturer at minimum
every 18 months.
• Mortuary will employ a fully trained, Certified Cremation Technician, capable of
overseeing the operation and maintenance of the crematory and retort equipment.
• Mortuary will make copies of State licensure renewals and annual inspection reports
available to the City Building Inspector upon request.
Mr. Hickok stated staff has determined these conditions are necessary for the proposed
accessory use to be compatible with the purpose and intent of the commercial zoning ordinance.
Staff has provided Council with a list of licensed crematories within the metro and state. Staff
has contacted the Minnesota Department of Health which is in charge of licensing crematories.
There are 54 Crematories licensed in Minnesota. The Minnesota Department of Heath licenses
the crematory annually and checks for things such as tracking of the human remains, whether
required permits have been received, safety, and visuals of the retort and stack.
Mr. Hickok stated the Planning Commission held a public hearing for TA #12-02 at its meeting
on November 21, 2012. No members of the public attended the hearing to speak on this issue.
The Planning Commission recommended approval of TA #12-02, with no stipulations. The
motion carried unanimously. Staff recommends Council hold the second and final reading of the
ordinance to approve TA #12-02.
Councilmember Varichak said she researched this after the meeting on December 10 and met
with Shannon. She called crematoriums and most funeral homes gave the same information.
There is no odor, no smoke, but some heat and steam depending on the weather conditions. The
funeral homes did not have any problems with any of the retorts they installed. Inspections are
done annually and their population was relevant to Fridley. She also looked on the internet and
found a lot more information, both negative and positive. There are some concerns with mercury
levels and why the EPA does not do more research on the retorts. The funeral homes do have to
meet other standards with the state. She also spoke with neighbors who wrote letters and they
have no concerns. There will be watchful eyes from the surrounding neighbors within that area.
After all the reseazch, she is comfortable with this and will vote yes tonight.
Councilmember Bolkcom asked staff to review the inspections again.
Mr. Hickok stated that the inspections are done every 18 months according to the stipulations.
The funeral home will make records available to the city as soon as the state has completed the
inspections. The Minnesota Department of Health will perform annual inspections.
Councilmember Bolkcom said she had a conversation with the Pollution Control Agency.
What she found out is there is currently no way to measure how much mercury is being emitted
into the air. They know there are emissions going into the air but have no way to measure it.
The funeral director can remove the teeth too. There will be a spike from the baby boomers
because they had the fillings with mercury but as this population goes away there will be less.
Right now they are concentrating on the big energy producing plants with coal and mercury

going into the air. Retorts are on their radar screen and they will work close with the EPA, the
Minnesota Department of Health and the Funeral Home Association. There is also a new
cremation technique coming in the future called chemical cremation. If people have questions
they may call the Minnesota Department of Health or the Pollution Control Agency. They are a
great resource.
Councilmember Saefke asked if the emissions are not able to be measured or if the testing is
unreliable.
Councilmember Bolkcom replied that the MPCA said there is currently not a device to measure
the levels.
Councilmember Saeflce stated if the Federal EPA guidelines or technology is available in the
future to measure and it becomes an issue, there may be a requirement to remediate. He asked if
Miller Funeral Home would remediate on the retort if directed by the Federal Government.
Shannon Asnus, Miller Funeral Home, replied if the law changed, they would comply with the
laws.
Mayor Lund said that vaporized mercury is not good for anyone. The question is why mercury
fillings are in people's mouths in the first place. Many people have old fillings and are still alive.
He asked how detrimental it could be.
Councilmember Bolkcom said she did not know how much mercury is still emitting once in the
mouth. Dental work with mercury has to be disposed of in a certain way.
Councilmember Varichak said the emissions come from the mercury when it is heated and a
gas is created.
Councilmember Barnette said he read the report about the Jordan crematory and that answered
all of his questions. Mercury exposure has been out there for all sorts of things for many years.
Mr. Asnus asked if they could submit a building permit application tomorrow.
Mr. Hickok replied yes.
MOTION by Councilmember Varichak to waive the reading of the ordinance and adopt
Ordinance No. 1300 on second reading and order publication. Seconded by Councilmember
Saeflce.

NEW BUSINESS:
9. First Reading of an Ordinance Amending Chapter 205 of the Fridley City Code
Pertaining to Home Occupations (Text Amendment, TA#12-03, by the City of Fridley).
Scott Hickok, Community Development Director, reviewed the text modification stating that the
garage sale reference changes to: "No more than three garage sales of no more than three
consecutive days per sales event may be conducted on a property in a 12-month period." A
public hearing was held at the December 19 Planning Commission meeting and City Council
held a public hearing on January 7. No one appeared from the public to speak at either hearing.
The Planning Commission unanimously recommended approval and staff concurs with the
Planning Commission's recommendation. Staff recommends proceeding to the second reading
of the ordinance on February 11.
Councilmember Bolkcom asked on page 62, under (4) Home Occupations, (0)(3), if 10 vehicles
per day meant that a pick-up and drop-off was considered one vehicle.
Mr. Hickok replied yes.
Councilmember Bolkcom thought the number of pick-ups in item (0)(4) seemed a little
restrictive. She asked how staff arrived at that number.
Mr. Hickok replied this relates to controlling the appearance of a business and changing the
character of a neighborhood. People can schedule regular pick-up/drop-off times three times a
week. The goal is to not have the business to look like a business. This has nothing to do with
controlling the volume of business that is done, but to control pick-up and deliveries so there are
no more than three per week.
Councilmember Bolkcom asked how this would be monitored.
Mr. Hickok said that staff is good at code enforcement but more likely it will be a situation
where someone calls in. Shipments are harder to control but the idea is to mimic business
operation to make it feel like a neighborhood and not a business.
Councilmember Bolkcom asked if the number could be taken out or if it were more enforceable
with numbers.
Mr. Hickok said saying that 7 took place and only 3 are allowed works much better.
Councilmember Barnette asked on page 62, (0)(1), where it talks about working on vehicles
out of a garage, was that a problem.
Mr. Hickok answered no but those are the most difficult code enforcement cases; repair in the
garage. If someone set up a paint booth in a garage to do body work, that would be an issue
because home occupations cannot take place in a garage.

10. First Reading of an Ordinance Amending Chapter 205.30, 0-5, of the Fridley Zoning
Code Pertaining to Clarifying Approved Locations for Telecommunications Towers
and Facilities and Adoption of a Map of Approved Tower Sites as Part of the
Appendix A to Chapter 205.30 (Text Amendment, TA#12-04, by the City of Fridley).
Scott Hickok, Community Development Director, stated that Appendix A of Chapter 20530
lists 15 approved sties by location name. Staff desires to have a more detailed list with addresses
and PIN numbers and a map. Text changes since the public hearing include "Existing Site"
further defined, re-instated "Non-Conforming Use" section, and simplified "Illumination"
requirements to only refer to FAA requirements. The language on signs remains unchanged as
no additional rules were listed in the code of Federal Regulations.
Councilmember Bolkcom asked on page 70, Section 205.30.3(C),why 12 months was chosen.
Mr. Hickok replied it is an administrative thing to catch up on billing and payments. After 12
months, it falls into serious abatement proceedings. Equipment goes up for one vendor and may
be owned by another vendor. Sometimes there is a misunderstanding of payments. Staff does
get caught up and does collect the payments.
Jim Kosluchar, Public Works Director, said that if they are behind over one payment period
staff is in contact with them. A late payment, according to the lease terms, means that there is a
default clause that staff can exercise. Staff does not wait a year to collect on the lease.
MOTION by Councilmember Saeflce to waive the reading of the ordinance and adopt the
ordinance on first reading. Seconded by Councilmember Varichak.

11. First Reading of an Ordinance Amending Chapter 11 of the Fridley City Code
Pertaining to Telecommunications Fees (Text Amendment, TA #12-05, by the City of
Fridley)
Scott Hickok, Community Development Director, stated no changes in the proposed ordinance
have been made since Council's January 7 public hearing. No rate change is being made in this
text amendment, only inclusion of fees that staff has been charging since 1998, which were never
added to Chapter 11. The Planning Commission held a public hearing on December 19 and

Darin Nelson, Interim City Manager, announced that on Wednesday, January 30, the EPA will
be offering informational sessions from 1 to 3 p.m. and 6 to 8 p.m. at the Fridley Community
Center. They will discuss the community action plans related to the Fridley superfund sites.
Also the Fridley newsletter should be received by residents tomorrow.

Background
City Council held a public hearing regarding amending regulations for home occupations in Fridley's
Zoning Code on January 7. Some questions were raised at the public hearing regarding the proposed
language. The draft code text regarding garage sales was further modified for the first reading of the
ordinance on January 28. Council indicated satisfaction with the garage sale text as modified. The
proposed code language repeated in the"Accessory Use" section ofthe R-1, Single Family, R-2, Two
Family, and S-1, Hyde Park Neighborhood, zoning districts.
Planning Commission Review
On December 19, 2012, the Planning Commission held a public hearing regarding TA# 12-03.No one from
the public appeared to testify, but the Commission spent some thoughtful time debating certain portions of
the proposed code language. Following debate, no changes were suggested.
Recommendation
Staff recommends that the City Council hold the second reading of TA#12-03, a text amendment regarding
regulations for home occupations, at the February 1 l, 2013 City Council meeting, directing publication of
the ordinance as required by code.

Background
On January 7, 2013,the City Council held a public hearing regarding adding a map to the
Telecommunications chapter of the Zoning Code. A first reading of the ordinance was held on January 28,
2013, where the City Council reviewed modifications to the proposed text changes. Some additional
corrections were made by staff to the table of approved sites and corresponding map since the first reading to
better clarify the location of the approved telecommunication sites. The draft ordinance is now ready for
second reading.
Planning Commission Review
On December 19, 2012, the Planning Commission held a public hearing for TA# 12-04. No one appeared at
the public hearing to speak. Following some discussion about clarification on fees,the Planning Commission
unanimously recommended Council approval of the text amendment.
Staff Recommendation
Staff recommends that the City Council hold the second reading of TA#12-04 on February 11, and,
following this final review, direct staff to publish the ordinance.

CODE PERTAINING TO CLARIFYING APPROVED LOCATIONS FOR
TELECOMMUNICATIONS TOWERS AND FACILITIES AND ADOPTION OF A MAP
OF APPROVED TOWER SITES AS PART OF APPENDIX A TO CHAPTER 205.30
The City Council of the City of Fridley hereby finds, after review, examination and
recommendation of staff, that Section 205.30 of the Fridley Zoning Code be hereby amended as
follows:

SECTION 205.30. O-5 TELECOMMUNICATIONS TOWERS
AND FACILITIES DISTRICT

205.30.1. PURPOSE AND INTENT
The general purpose of this Section is to create an overlay zone to regulate the placement,
construction, and modification of towers, wireless telecommunications facilities, and automatic
meter reading systems in order to protect the health, safety, and welfare of the public, while at
the same time not unreasonably interfering with the development of the competitive wireless
telecommunications marketplace in the City.
Specifically, the purposes of this Section are:
A. To protect residential areas and land uses from potential adverse impact of towers and
wireless telecommunications facilities; �
B. To minimize adverse visual impact of towers and wireless telecommunications facilities
through careful design, siting, landscaping, and innovative camouflaging techniques;
C. To promote and encourage shared use/collection of towers and existing antenna support
structures as a primary option rather than construction of additional single-use towers in
order to minimize the adverse visual impact of towers and wireless telecommunications
facilities;
D. To avoid potential damage to property caused by towers and wireless
telecommunications facilities by ensuring that such structures are soundly and carefully
designed, constructed, modified, maintained, located, and removed when no longer used
or determined to be structurally unsound;
E. To ensure that towers and wireless telecommunications facilities are compatible with
surrounding land uses;
F. To facilitate the provision of wireless telecommunications services to the residents and
businesses of the City in a streamlined, orderly, and efficient fashion;

G. To encourage the location of towers in industrial and business districts, rather than
residential areas;
H. To enhance the ability of providers of telecommunication services to provide such
services to the community quickly, effectively, and efficiently;
L To identify specific sites within the City where wireless telecommunications facilities
may be located.
205.30.2. DEFINITIONS
The following words, terms, and phrases, when used in this section, shall have the meanings
ascribed to them in this Section, except where the context clearly indicates a different meaning;
"Antenna Support Structure" means any building or other structure other than a tower which can
be used for location of wireless telecommunications facilities.
"Applicant" means any person that applies for a permit for wireless telecommunication facilities
or towers.
"Application" means the process by which a person submits a request to develop, construct,
build, modify, or erect wireless telecommunication facilities or a tower upon land within the
City. Application includes all written documentation, verbal statements and representations, in
whatever form or forum, made by an applicant to the City concerning such a request.
"Approved Site" means a site which has been approved by the City Council as an eligible
location for placement of wireless communication facilities.
"Automatic Meter Reading Device" means a device which is designed for collecting, storing,
processing, filtering and forwarding utility meter data within the Public Safety and Utility
bandwidth licensed by the Federal Communications Commission ("FCC"), including any
antenna attached to such device and excludin� devices readin� and transmittin� data from a
sin le utilitv meter.
"Automatic Meter Reading System" means a series of devices which is designed for collecting,
storing, processing, filtering and forwarding utility meter data within the Public Safety and
Utility bandwidth licensed by the FCC, including any antenna attached to such device.
"City" means the City of Fridley, Minnesota.
"Electrical Engineer" means an Electrical Engineer licensed by the State of Minnesota.
"Existing Site" means a tower or antenna support structure installed or erected �=����

located on an approved site.

"Owner" means any person with fee simple title to any approved site, existing site, site approved
by special use permit, or wireless telecommunications facility.
"Pad Mount Device" means a device which is designed for collecting, storing, processing,
filtering and forwarding utility meter data within the Public Safety and Utility bandwidth
licensed by the FCC, including any antenna attached to such device, like the automatic meter
reading device, but, which is installed on its own pedestal and not on an existing public utility
structure.
"Person" is any natural person, firm, partnership, association, corporation, company, or other
legal entity, private or public, whether for profit or not for profit.
"Public Utility Structure" means a structure or pole appropriate for supporting wires for
communications or the transmission of data or electricity and located on a public right-of-way or
public utility easement or privately owned property.
"Satellite Earth Station Antenna" is all equipment necessary for processing of traffic received
from terrestrial distributions prior to transmission via satellite and of traffic received from the
satellite prior to transfer of channels of communication to terrestrial distribution systems.
"State" means the State of Minnesota.
"Structural Engineer" means a structural engineer licensed by the State of Minnesota.
"Tower" Means a self-supporting lattice, guyed, or monopole structure constructed from grade
which supports wireless telecommunications facilities. The term "tower" shall not include
amateur radio operator's equipment as licensed by the FCC.
"Wireless Telecommunications Facilities" means any cables, wires, lines, wave guides,
antennas, and any other equipment or facilities associated with the transmission or reception of
communications (other than radio or television broadcast communications) which a person seeks
to locate or have installed upon or near a tower or an antenna support structure. However, the
term wireless telecommunications facilities shall not include:
A. Any satellite earth station antenna two meters in diameter or less which is located in an
area zoned industrial or commercial; or
B. Any satellite earth station reception antenna one meter or less in diameter, regardless of
zoning category; or
C. Automatic Meter Reading Systems.
205.30.3. NON-CONFORMING USES
A. Existing Ssites shall be considered a legal non-conforming use, unless otherwise provided
for in this Chapter.

B. Installation of additional wireless telecommunications facilities beyond those in existence
on December 18, 1997 *�r����� �� *��� nra;����° on Eexisting Ssites is
prohibited. Failure to comply with this provision will be considered a violation of this
Chapter and subject to�the penalties described herein. Routine maintenance of wireless
telecommunications facilities on Eexisting Ssites is permitted, except that Eexisting
Ssites and any wireless telecommunications facilities installed on Eexisting Ssites may
not increase in size, height, weight, or otherwise result in an increase in the intensity of
the non-conforming use.
C. If any wireless telecommunications facilities in an Eexisting Ssite are abandoned for a
period of one year, such Eexisting Ssite shall lose is legal conforming status and shall be
considered an illegal nonconforming use. The abandoned wireless telecommunications
facilities shall not be re-established on the site, and must be removed within twelve (12)
months of the cessation of operations. If not removed, the City may remove the facility
and assess the costs of removal against the owner(s), according to the procedures
established in Chapter 128 of Citv Code.
205.30.4. DISTRICT BOUNDARIES FOR OVERLAY ZONE
A Telecommunications Towers and Facilities District, O-5, is created and shall apply to all land
within the City subject to the provisions and use requirements contained in this Chapter.
205.30.5. USES PERMITTED
A. The construction of towers and the installation, operation and maintenance of wireless
telecommunications facilities shall be permitted use in the approved sites identified on
Appendix A to this Ordinance, subject to the provisions of this Chapter. Additional
approved sites may be approved by the City Council, subject to the amendment
procedures set forth in Section 205.05.04 of the City Code, and the requirements of this
section.
B. All principal, special use, and accessory uses allowed in each underlying primary zoning
district are permitted in the Telecommunications Towers and Facilities District, except
that no towers shall be constructed, and no wireless telecommunications facilities shall be
placed on towers or antenna support structures, except as provided for in this Chapter.
C. Special Uses. The construction of towers and the installation, operation, and
maintenance of wireless telecommunications facilities shall be a special use in Zoning
Districts M-1, M-2, M-3, and M-4, and any abutting railroad rights-of-way, subject to the
special use approval procedures set forth in Section 205.05.05 of the City Code.
D. Automatic meter reading devices may be allowed on public utility structures as a
principal use in all zoning districts, subject to the provisions of this Ordinance and
Chapter 407, "Right-of-Way Management." In addition, all automatic meter reading
systems must meet the following performance standards:

(1) All automatic meter reading devices located in the public right-of-way, must obtain
an automatic meter reading device permit and pay the appropriate ��;�� ermit
fee, as provided for in Chapter 407 and Chapter 11 of Cit�. This permit
requirement does not apply to individual meters or mobile automatic reading devices
(2) Mapping information for the site(s) must be provided with the automatic meter
reading device permit application in a format compatible to be utilized by the City of
Fridley's Geqgraphic Information System ("GIS").
(3) All automatic meter reading device(s) must be located no higher than the top of a
public utilitv structure and no closer to grade than fifteen (15) feet ��^ ���'�'�� •�*�'�*��

(4) Automatic meter reading devices not installed on a public utility structure will be
considered as pad mount design. Its location shall be subject to review and approval
of the City prior to permit application.
(5) All automatic meter reading devices must be the same color as the public utility
structure on which they are located or as approved by City Staff.
205.30.6. CRITERIA FOR ADDING APPROVED SITES TO APPENDIX A
Additional approved sites, other than those provided in Appendix A to this Ordinance, shall be
approved by the City Council according to the amendment procedures of Section 205.05.04 of
the City Code. The criteria used to determine whether a site shall be designated as an approved
site shall include, but not be limited to, the following requirements:
A. Whether the proposed new site is capable of being developed to support more than two
operating wireless telecommunications facilities comparable to the others in weight, size,
and surface area.
B. Whether the proposed new site poses a risk of explosion, fire, or other danger due to its
proximity to volatile, flammable, explosive, or hazardous materials such as LP gas,
propane, gasoline, natural gas, or corrosive or other dangerous chemicals; and
C. Whether the proposed new site is necessary and that useable approved sites are not
located within a one-half(1/2) mile radius of the proposed new site; and
D. Whether all foreseeable telecommunications uses of the proposed new site could comply
with the setback requirements of the underlying zoning district; and
E. Whether all foreseeable telecommunications uses of the proposed site could comply with
any separation and buffer requirements of the underlying zoning district;
F. Whether the proposed site is accessible for service vehicles;

G. If applicable, whether the proposed site has been designed and certified by a structural
engineer to be structurally sound and, at minimum, in conformance with the Building and
Electric Codes adopted by the City, the National Electric Safety Code, and any other
standards and requirements outlined in this Section.
H. If applicable, whether the approved site complies with all applicable Federal Aviation
Administration("FAA") lighting and painting regulations.
I. Whether the proposed site will further the City's objective that all towers, antenna
support structures, and wireless telecommunications facilities be designed to blend into
the surrounding environment.
J. Whether the proposed site has adequate open space to allow wireless telecommunications
facilities to be installed without detrimentally impacting landscape, displacing parking, or
impeding sight lines of a current or future principal use.
K. Whether the proposed site adequately contributed to the City's overall effort to
adequately meet the needs of the wireless telecommunications industry.
L. Whether the proposed site has amenities such as trees that will allow screening and sight
line relie£ If not, whether the combination of site size and other site features help to
provide sight line relief.
M. Whether there are other structures near the proposed site that can serve as visual
distractions such as high power transmission structures, highway shoring, and billboards.
N. Whether there are existing buildings or natural topographic features that meet the height
requirements of wireless telecommunications facilities without a tower structure, or
which allow for a lower overall height of any necessary tower.
O. Whether there is adequate space on the proposed site so that the base of any necessary
tower can accommodate essential equipment.
P. Whether the proposed site is outside of any underlying residential zoning districts.
Q. Whether housed equipment can be placed on top or on the side of a structure that
currently exists in the proposed site.
205.30.7. APPLICATION FOR PLACEMENT OF TOWERS OR WIRELESS
TELECOMMUNICATIONS FACILITIES IN THE CITY.
A. All persons seeking to install, operate and maintain towers or wireless
telecommunications facilities in approved sites in the City must file a� special use permit
application with the City which shall include:
(1) The names, address, and telephone number of the applicant; and

(2) Written, technical evidence from a qualified and licensed structural engineer that the
proposed tower or antenna support structure is capable of supporting the equipment
necessary to install, operate, and maintain the proposed antenna. The engineer shall
also certify the capability of the tower to provide adequate structural support
considerin� ��existing or other proposed antenna installations. The engineer
shall also assess and state the design safety margin of the entire antenna support
system. The engineer shall state that within the limits of engineering certainty, if the
structure would fall or collapse for any reason or due to any event, the structure will
be completely contained within the area identified; and
(3) If proposed on a City-owned site, a completed application form for lease approval as
provided by the City; and
(4) A report from a qualified and licensed professional engineer which described the
height and design of the proposed wireless telecommunications facility including a
cross-section and elevation; and
(5) A scalable sSite plan drawn at an engineering scale showing the location of the
wireless telecommunications facility in relation to surrounding structures; and
(6) If located on a water tower, a written report addressing the requirements contained
herein for water towers; and
(7) Foundation, cross-section, and building plans for installation of the wireless
telecommunications facility; and
(8) An application fee as required by Chapter 1 l; and
(9) The application shall also contain an affirmative statement indicating that the
applicant agrees to comply with the provisions in Section 205.30.23 regarding
abandonment; and
(10)No new or existing wireless telecommunications service will interfere with public
safety telecommunications. Before the introduction of new service or before
implementing any change in existing service, all wireless telecommunications
service providers shall notify the City at least ten (10) calendar days in advance of
such changes and allow the City to monitor interference levels during the testing
process; and
(11) Application for a building permit from the City pursuant to Chapter 206 of the code;
and
(12)A statement as to whether the proposed development of an approved site is capable
of being developed to support more than two (2) operating wireless
telecommunications facilities comparable to the others in weight, size, and surface
area; and

(13)Written, technical evidence from an independent consulting engineer licensed to
practice geological engineering in the State of Minnesota confirming that the soil at
the location of the tower or wireless telecommunication facility is capable of
supporting the proposed antenna arrays, equipment, and personnel performing
typical work functions; and
(14)A landscaping plan showing location of materials, height at planting, types of
materials, and installation practices.
B. All information submitted with an application that is trade secret information or is for
other reasons proprietary shall be clearly market as such when submitted with an
application. The City shall not disclose publicly, or to any third party, proprietary
information unless compelled to do so by federal, state or local law.
C. All persons seeking to install, operate, and maintain towers or wireless
telecommunications facilities in M-1, M-2, M-3, or M-4 Zoning Districts as a special use
permit shall submit the information required in 205.30.07.A, eXCept items (3) and (11).
205.30. �3 8. APPLICATION FOR AN AUTOMATIC METER READING DEVICE IN
THE CITY
A. All persons seeking to install, operate and maintain automatic meter reading systems in
the City must file an application with the City, which shall include:
(1) The name, address and telephone number of the applicant and property owner; and
(2) Written, technical evidence from a qualified structural engineer that the integrity of
the structure on which a proposed automatic reading device(s) will be attached and
the attachment device, itself will not jeopardize the structural integrity of the public
utility structure; and
(3) A location plan matching the public utility structure identification (address) and the
appropriate automatic meter reading device; and
(4) An individual automatic meter reading device permit fee as required by Chapter 11;
and
(5) The application shall contain an affirmative statement indicating that the applicant
agrees to comply with the provisions in Section 205.30.24 regarding abandonment;
and
(6) No automatic meter reading system will interfere with public safety
telecommunications. Before the introduction of new service or before implementing
any change in existing service, all automatic meter reading system operators shall
notify the City at least ten (10) calendar days in advance of such changes and allow
the City to monitor interference levels during the testing process.

205.30. 89. APPLICATION PROCESS
A. Upon submission of an application on an approved site, the City shall notify the applicant
in writing to confirm if the application is complete, addressing all of the requirements as
required by this section. If the application is incomplete, the letter will specify what
information is missing and the applicant must then submit a new application. If an
application is submitted on an approved site which is owned by the City, a lease
agreement must be approved by the City Council. The City shall comply with the time
deadlines for agency action as dictated in Minnesota State Statutes. Construction or
installation on approved sites may begin upon approval of the lease agreement, if
necessary, and issuance of a building permit.
B. If a tower or wireless telecommunications facility is approved by a special use permit, the
applicant must also apply for and receive a building permit.
205.30.310. TOWER HEIGHT
Tower height shall be measured from the average adjoining grade to the highest point of
construction of any tower or wireless telecommunications facility. Towers are exempt from the
maximum height restrictions of the districts where located. Towers shall be permitted to a
maximum height of one hundred twenty-five (125) feet.
205.30.�911. STEALTH DESIGN AND EXTERIOR FINISHES
All approved sites, towers, and wireless telecommunications facilities shall be designed to blend
into the surrounding environment. Monopoles with antenna arrays shall be finished so as to be
compatible with other buildings or structures in the area, and shall be finished with a non-
corrosive material. Wireless telecommunications facilities placed on water towers shall be
finished with a non-corrosive material to match the color of the water tower.
205.30.� 12. ILLUMINATION
Towers shall not be artificially illuminated except as required by the FAA. �

205.30.� 13. LANDSCAPING AND SCREENING
All sites shall include appropriate landscaping as required herein and shall comply with all
landscaping requirements of the underlying zoning district. Accessory above-ground equipment
must utilize existing buildings or structures, if possible. If no existing structures are available,

the owner of the wireless telecommunications facilities may construct such a structure. At
minimum, all ground equipment shall be fully screened from public rights-of-way or residential
property by existing structures, a brick decorative wall, or a solid one hundred percent (100%)
opaque vegetative enclosure, six feet in height at planting.
205.30.� 14. SECURITY
All towers must be reasonably posted and secured to protect against trespass. Chain link fences
may be used to protect towers and wireless telecommunications facilities. Barbed or razor wire
is prohibited. All facilities shall be designed to discourage unauthorized climbing on the
structure.
205.30.-�415. INSTALLATION REQUIREMENTS ON WATER TOWERS AND IN
CITY
Installation of wireless telecommunication facilities on water towers will be permitted when the
city is fully satisfied that the following requirements are met:
A. The wireless telecommunications facility will not increase the risks of contamination to
the City's water supply.
B. There is sufficient room on the structure and/or in the grounds to accommodate the
wireless telecommunication facility.
C. The presence of the wireless telecommunication facility will not increase the water tower
or reservoir maintenance costs to the City.
D. The presence of the wireless communication facility will not be harmful to the health of
workers maintaining the water tower or reservoir.
E. All state and federal regulations pertaining to non-ionizing radiation and other health
hazards has been satisfied.
205.30.15 16. BUILDING PERMIT REQUIRED
A building permit is required for installation of any tower or wireless telecommunications
facility. The completed installation, including all associated buildings, shall comply with all
applicable building codes including but not limited to the most currently adopted version of the
N.F.P.A. 70 National Electrical Code, TIA/EIA 222 Structural Standards for steel antenna
towers, and others as may be determined by the Building Official.
205.30.�b 17. SETBACKS
The tower or wireless telecommunications facility shall be located in rear or side yard areas and
shall be set back at least ten (10) feet from side or rear lot lines.

205.30.�819. CERTIFICATIONS AND INSPECTIONS
A. All towers and wireless telecommunications facilities shall be periodically reviewed by
the City to be structurally sound and in conformance with the requirements of the City
�g Code, this Chapter, any conditions of approval placed on a special use permit
and all other construction standards set forth by the City's Code, and federal, state, and
local law. Existing sites may be inspected for compliance with this Chapter at any time if
the City believes there are questions regarding compliance with the City's�g Code,
this Section, any conditions of approval placed on a special use permit, all other
construction standards set forth in the City's Code, and all other federal, state and local
laws.
B. The City and its agents shall have authority to enter onto any approved site, existing site,
or site approved by special use permit between the inspections and certifications required
above, to inspect the site for the purpose of determining whether the sites comply with
the r''� State Building and Electrical Codes, the National Electric Safety Code and all
other construction standards provided by the City's Code and federal and State law.
C. The City reserves the right to conduct such inspections at any time, upon reasonable
notice to the owner(s). All expenses related to such inspections by the City shall be
borne by the site owner(s).
205.30.�3 20. MAINTENANCE
A. Ordinary and reasonable care of towers, wireless telecommunications facilities and
automatic meter reading systems/devices shall be employed at all times. All towers,
wireless telecommunications facilities and automatic meter reading systems shall at all
times be kept and maintained in good condition, order and repair so that the same shall
not menace or endanger the life or property of any person.
B. Owners shall install and maintain towers, wireless telecommunications facilities and
automatic meter reading systems/devices in substantial compliance with the requirements
of the National Electric Safety Code and all FCC, State and local regulations, and in such
manner that will not interfere with the use of other property.
C. All maintenance or construction on towers, wireless telecommunications facilities or
automatic meter reading systems/devices shall be performed by qualified maintenance
and construction personnel.

D. All owners of wireless telecommunications facilities and automatic meter reading
systems/devices shall maintain compliance with current radio frequency emission
standards of the FCC. In order to provide information to its citizens, copies of all FCC
information concerning wireless telecommunications facilities and automatic meter
reading systems/devices shall be made available to the City and updated annually.
E. In the event the use of a tower, or a public utility structure, or a wireless
telecommunications facility or an automatic meter reading system/device is discontinued
by the owner of the wireless telecommunications facility or automatic meter reading
system, or in the event an owner files notice to the FCC of its interest to cease operating,
the owner shall provide written notice to the City of its intent to discontinue use and the
date when the use shall be discontinued.
205.30.38 21. PRIORITY FOR USE
Priority for use of the installation, maintenance and operation of towers and wireless
telecommunications facilities will be given to the following entitles in descending order:
A. City of Fridley.
B. Public safety agencies, including law enforcement, fire, and ambulance services, which
are not part of the City of Fridley and private entities with a public safety agreement with
the City of Fridley.
C. Other governmental agencies, for uses which are not related to public safety.
D. Entities providing licensed commercial wireless telecommunication services including
cellular, personal communication services (PCS), specialized mobilized radio (SMR),
enhanced specialized mobile radio (ESMR), paging, and similar services that are
marketed to the general public.
205.30.3�22. CO-LOCATION
Towers shall be designed to support more than two wireless telecommunications facilities.
205.30.33 23. FEES
The applicant shall pay the fees listed in r°���°°*°a '��� Chapter 11 for processing a request to
install, operate, and maintain a tower, public utility structure, pad mount device, or a wireless
telecommunications facility or an automatic meter reading system and/or devices in the City. If
deemed as necessary due to the nature of the application, the applicant shall also be required to
reimburse the City for its cost to retain a consultant to review the requested application.
205.30.�24. ABANDONMENT
If any site for which approval to install, maintain, and operate a tower, or a public utility
structure, or wireless telecommunications facilities or au�omatic meter reading systems has been
granted by the City shall cease to be used for a period of 365 consecutive days, the City shall

notify the wireless telecommunications facility operator, automatic meter reading device
operator and the owner of the property, that said site has been deemed abandoned. Upon a
finding of abandonment by the City, the tower, public utility structure, wireless
telecommunications facilities, or automatic meter reading system that has been abandoned must
be removed or an annual user fee shall be paid to the City. If it is determined that the abandoned
tower, e� public utility structure, e� wireless telecommunications facility, or automatic meter
reading system cannot be removed in a reasonable time period by the owner, the City shall assess
all costs related to the removal to the owner(s), according to the procedures established in
Chapter 128 of City Code.
205.30.34 25. SEVERABILITY
If any clause, section, or other part of this Section shall be held invalid or unconstitutional by any
court of competent jurisdiction, the remainder of this Section shall not be affected thereby, but
shall remain in full force and effect.
205.30.�26. VIOLATION
Any person who shall violate any of the provisions of this Section shall be guilty of a
misdemeanor and subject to the provisions of Chapter 901 of the Fridley City Code.

I. Title
An ordinance of the City of Fridley, Minnesota, amending Chapter 205.30 of the Fridley Zoning

II. Summary
The City Council of the City of Fridley does hereby ordain as follows:
That Chapter 205.30 is hereby amended with a revised table and map of approved
telecommunications sites and revised regulations for telecommunications facilities and automatic
meter reading devices. No approved sites have been changed, but rather the location of the
originally approved sites has been defined in more detail by specifying addresses and GPS
locations.
III. Notice
This title and summary has been published to clearly inform the public of the intent and effect of
the City of Fridley's modifications to the map of existing approved telecommunication sites. A
copy of the ordinance, in its entirety, is available for inspection by any person during regular

Background
On January 7, the City Council held a public hearing regarding amending Chapter 1 1 of City Code to insert
two fees related to the Telecommunications Overlay Zoning District, which had previously been omitted
from the list of fees. These fees are not being proposed to be changed from the rates that were approved by
the City Council in 1998. Staff has analyzed the fees and finds them to be appropriately matched to staff
costs associated with administering such permits. Staff is suggesting that the City Council address the needed
correction at this time since the Telecommunications code language is being updated.
Planning Commission Review
On December 19, 2012, the Planning Commission held a public hearing on TA# 12-05. Since Chapter 1 1 is
not part of the Zoning Code, a public hearing before the Commission was not required by code, but staff
scheduled the hearing since it related to proposed changes to the Telecommunications Zoning Overlay
District that the Commission was holding a public hearing regarding. No one appeared at the public to speak
to either text amendment.
Recommendation
Staff recommends that the City Council hold the second reading on TA #12-05, a text amendment to include

PERTAINING TO TELECOMMUNICATIONS FEES
The City Council of the City of Fridley hereby finds, after review, examination and
recommendation of staff, that Chapter 11, Fees, of the Fridley City Code be hereby amended and
appended into the table alphabetically as follows:

SUBJECT: 2013 Miscellaneous Concrete Repair Project No. 429
Attached is a resolution ordering advertisement for bids for the 2013 Miscellaneous
Concrete Repair Project No. 429. This annual project includes concrete replacement of
sidewalk, pavement, curbing, and other miscellaneous concrete work throughout the City
due to utility repairs, sub-standard condition, or driveway entrance permits.
The project cost estimate is $43,000 and within budget. Staff anticipates opening bids
March 6`h, 2013 and awarding March 11`h, 2013.
Recommend the City Council adopt the attached resolution ordering advertisement for bid
for the 2013 Miscellaneous Concrete Repair Project No. 429.

RESOLUTION ORDERING ADVERTISEMENT FOR BIDS:
2013 MISCELLANEOUS CONCRETE REPAIR PROJECT NO. 429
WHEREAS, the construction of certain improvements is deemed to be in the interest of the City of Fridley and the
properly owners affected thereby.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fridley, Anoka County, Minnesota as
follows:
1. That the following improvements proposed by Council Resolutions are hereby ordered to be effected and
completed as required:
2013 Miscellaneous Concrete Repair Project No. 429
2. The plans and specifications prepared by the Director of Nublic Works for such improvements are hereby
approved and shall be f led with the City Clerk.
'The Director of Public Works shall accordingly prepare and cause to be inserted in the oPficial newspaper
advertisements fior bids upon the making of such improvements under such approvcd plans and specifications. The
advertisement shall be published at least 10 days prior to bid opening,and shall specify the work to be done and
will state that the bids will be opened and considered at 10:00 AM THURSDAY, MARCH 6`�', 2013, and that no
bids will be considered unless sealed and filed with the Director of Public Works. That the advertisement for bids for
2013 MISCELLANEOUS CONCRETE REPAIR PROJECT NO. 429 shall be substantially in the standard form.

Attached is Change Order No. l for the City of Fridley AV System Project. This change order includes
work outside of the original contract for additional materials. The amount of the change order is
$806.91, which includes a credit for the equipment that is being upgraded.
This change order is for the upgade in the Biamp audio mixing platform from a Nexia version to a
Tesira version. "The Nixia version did not meet our audio input needs and was not expandable. 'rhe
Tesira version meets our audio and teleconferencing needs and is expandable should other needs arise.
"I'his change order will be paid for with dedicated equipment funds from the Cable �1,V Special Revenue
Fund.

Attached is Chang�e Order No. 3 for the City of Fridley AV System I'roject. 7'his change order includes
work outside of the original contract for additional materials. �l�he amount of the change order is
$2,780.89.
This chan�;e order adds a scaler/receiver for the document ima�;ing camera located above the staff
presentation area. "The addition of a scaler/receiver allows the document camera and computer outputs,
which are two different platforms, to be automatically converted to a single fixed video signal. The
signal is then sent to the production switcher, allowing the producer to switch between inputs.
This change order will be paid for with dedicated equipment funds trom the Cable TV Speeial Revenue
Fund.

SUBJECT: PUBLIC HEARING -The Final Scoping Document for the Alternative Urban Area-wide
Review(AUAR) For the FMC Site
Introduction:
The purpose of this hearing is to provide Council information, answer their questions and those from
members of the public, relative to Council's approval of the Scoping Document of the AUAR for the FMC
Site.
Elements:
As redevelopment of the FMC (most often referred to as the BAE) site nears; the City has required that
the developer complete an AUAR in accordance with Rules of the Minnesota Environmental Quality
Board (EQB).The Developer is Hyde Development. Paul Hyde, Hyde Development has hired the
Consulting Engineering group of MFRA, along with the Environmental Engineering firm of Braun Intertec
to assist with completing that task. One might ask, what is an AUAR Scoping Document and why is it
required?
More familiar is the term, Environmental Assessment Worksheet(EAW), which is a document that
defines environmental associated aspects of a development and points to whether an Environmental
Impact Statement(EIS) would be required. The AUAR Scoping Document is the EAW surrogate in this
case. We,the City/Responsible Governmental Unit (RGU) have already determined that the AUAR will
be required, so this EAW, instead of defining what will be covered in the EIS, will define what will be
covered in the AUAR.
The AURA scoping document's purpose is to define what will be studied in and accomplished by the
actual AUAR.The AUAR simply defines environmental impacts of a development on the surrounding
area and what will be done to address the impacts through the development/redevelopment process.
As stated in the Scoping document, The AUAR will indude a complete description of the potential
development scenarios including the projected timing and length of all phases of construction and

operation. The AUAR will describe the process, plans and reporting that will be performed in accordance
with local, state, and federal environmental laws and regulations for the mitigation of soils, and
groundwater impacts at the site and the proper management of all regulated wastes that may be
encountered or generated through the redevelopment process. The response action plans that will be
developed for the different phases of work will be supported by regulatory approved Work Plans,
Remedial Investigations, Soil Management P/ans, Construction Quality Assurance Plans, Contingency
Plans and related documents and document reporring.l Ali of these facts are highlighted in the scoping
document as work that will be accomplished in the actual AUAR.
Where the AUAR Scoping Document has been to this point, is that it was provided to City staff in draft
form on December 7th. Staff reviewed a draft of the Scoping Document and provided comments.The
process has proceeded in accordance with the Rules of the Environmental Quality Board.That schedule
has been as follows:

THE RECORDED PLAT THEREOF, ANOKA COUNTY, MINNESOTA, COMMONLY REFERRED
TO AS 4800 EAST RNER ROAD
WHEREAS, The FMC site also commonly referred to as the FMC site has been guided in the City's
Comprehensive Plan as Redevelopment District, and
WHEREAS, The FMC site is now under consideration for the redevelopment of the northern 122 acres,
and
WHEREAS, the threshold for requiring an EAW has been met and either an EIS or AUAR would be then
required,and
WHEREAS,the City of Fridley(as the RGU) has deemed that the AUAR process is appropriate and
should be required, and
WHEREAS, the Developer has responded in accordance with the requirements and proceeded with the
first step, AUAR Scoping EAW Document, and
WHEREAS, The appropriate public meeting and comment period was offered to the public and ended
January 23, 2013, at 4:30 PM, and
WHEREAS, all comments received through this comment process have been added to the Scoping
document and answers will be given to those comments in the AUAR, and
Whereas, staff has reviewed the Scoping document and verified its completeness and accuracy to this
point of the process, and
WHEREAS,NOW, THEREFORE, BE IT RESOLVED, The City Council of the City of Fridley is
hosting a public hearing to discuss the document and to take comments and ask questions as necessary to
understand the document elements, completeness, and approve the document in its form as presented, and
BE IT FURTHER RESOLVED, that Council approval of the Scoping AUAR EAW document will mean
that the developer's consultants can then move forward with completion of the AUAR, and
BE IT FURTHER RESOLVED, that the City Council approves and adopts the Scoping AUAR EAW

Subject: Resolution Authorizing Safe Routes to Schools Grant Application
Background
In 2011, the City of Fridley, working jointly with the Fridley School District, obtained $88,000 in Safe
Routes to Schools (SRTS) funding. The City now has a final opportunity to apply for additional SRTS
funding. The SRTS program is being folded into other federal programs and will likely not continue.
In 2010, as part of Fridley's SHIP grant, the City hired SRF Consulting to analyze traffic safety at the
intersections of Hwy. 47 (University) and 61 S`Avenue and 57`�' Avenue. This was an action step in Fridley's
2030 Comprehensive Plan. The consultant recommended creating on-road bike lanes on 61 S` Avenue and
designed curb-cut transitions to existing off-road sidewalks a set distance away from the highway
intersection to more safely allow cyclist safe passage near the busy, high-speed, signalized crossing. Staff
saw the SRTS funding as a perfect match for this suggested improvement that would both benefit the City's
transit connection goals in the TOD Overlay Zoning District and provide a safer means for kids to bicycle to
school and after-school activities in the area.
Staff is still working on the details of cost estimates for the SRTS grant application, but preliminary
estimates are that the bicycle lane project(see enclosed map) on 61s`Avenue(from Starlite to Hwy. 65)will
cost approximately $100,000. Cost estimates created in 201 1 for a 10' multi-use trail on 7`� Street(from 59",
to Medtronic Parkway)totaled $198,663. These two project component costs combined, will then total the
maximum allowable grant of$300,000. There are no local match requirements with the SRTS program and
grant funds can be used for design and construction oversight expenses.
Recommendation
Staff recommends that the City Council permit staff to apply for $300,000 in SRTS grant funds as a means to
provide safer bike/pedestrian routes to the Fridley Middle School and the many other community functions in
this part of the community. A resolution, which is required by the SRTS application process is attached for
Council's consideration.

INFRASTRUCTURE FUNDS FOR IMPROVED BIKE/PEDESTRIAN ACCESS TO FRIDLEY
MIDDLE SCHOOL ON 615� AVENUE, W. MOORE LAKE DRIVE, AND 7TH STREET
WHEREAS, Section 1404 of the Safe, Accountable, Flexible, and Efficient Transportation Equity Act: A
Legacy for Users Act(SAFETEA-LU)created the Safe Routes to Schools(SRTS) program in 2005; and
WHEREAS, SRTS funding from the Federal Highway Administration is administered by the Minnesota
Department of Transportation (MnDOT), which is soliciting proposals from state aid cities far
infrastructure projects that improve the built environment to promote bicycling and walking within two
miles of schools for students in grades K-8; and
WHEREAS, it is a common goal of the Fridley School District ISD 14 and the City of Fridley to improve
safety, reduce vehicle traffic, reduce fuel consumption, and reduce air pollution in the vicinity of our
schools; and
WHEREAS, the City of Fridley is using the previous round of SRTS infrastructure funds it was granted
to provide secure bicycle parking areas at the Fridley Middle School and sees the need to complete those
improvements with safe bike trail access from three directions to the school;
NOW, THEREFORE, BE IT RESOLVED, that the City of Fridley chooses to be a Project Sponsor for a
SRTS project that would install safe bicycle access to Fridley Middle School on 61 S' Avenue, West Moore
Lake Drive, and 7`�' Street south to Medtronic Parkway and hereby agrees to assume full responsibility for
the design, construction, operation and maintenance of property and facilities related to the
afarementioned transportation enhancement project. �
BE IT FURTHER RESOLVED, That the City of Fridley act as the fiscal agent for this Safe Routes to
School (SRTS) Project within the City of Fridley and acknowledges herewith that it is willing to be the
project sponsor knowing full well that such sponsorship includes a willingness to secure and guarantee
the local share of costs associated with this project and responsibility for seeing this project through to its
completion, with compliance of all applicable laws, rules and regulations.

SUBJECT: 2012 Street Rehabilitation ProjectST2012-01 - Change Order No. 3
Attached is Change Order No. 3 for the 2012 Street Improvement Project ST2012-01 in the Rice
Creek Terrace neighborhood. �This chang�e order includes work outside of the original contract
for pavement marking materials, subsoil and base correction, concrete sidewalks, water main
repairs and enhancements to infiltration facilities. l,he amount of�the change order is $39,227.11.
Item #1 is for pavement striping and marking material substitution. Pavement markings on this
project included lane striping, symbols, messages,and cross walks. The Contract required the
installation of pavement striping and markings using poly preform material. Staff determined that
the poly perform bid prices under the Contract were inflated and alternates should be considered.
The Contractor provided unit pricing for epoxy paint as an alternate material. Epoxy paint has
been used on other City projects with satisfactory results. In this case the price of epoxy was
significantly less than poly perform and determined to be more cost effective. The Contractor
was directed to use epoxy paint in lieu of poly perform for approximately 1,200 feet of striping,
10 pavement messages and 13 cross walks. The original poly perform Contract cost was
$28,730.50. The cost of the epoxy paint is $12,928.50. The difference is a reduction of
$15,802.00 to the Contract and Street fund.
Item #2 is for the furnishing and installing a hydrant extension. One of the 5 hydrants replaced
on the project was found to be unusually deep. Staff directed the Contractor to provide and
install a hydrant with a riser. "I`he riser increased the height of the hydrant to closely match the
surrounding landscape. "The cost of this item is $865.83. "I'his work will be paid with Water
Utility funds.

Item #3 is for revising the street rehabilitation process for 3 street segments from reclaiming to
full depth reconstruction (see Exhibit A). These street segments are designated as part of the
Minnesota State Aid System (MSAS) and insufficient aggregate base and material existed to
construct the street to MSAS standards. The 3 streets that underwent reconstruction are 67`h
Avenue (7`" Street to 6rh Street), 6`�' Street(67`" Avenue to Rice Creek Terrace), and Rice Creek
Terrace (from 6`" Street to 68`�Avenue).
"1'he reclaiming process requires a thicker pavement and aggregate base to produce an acceptable
base product. A reclaim material with too much sand or silt mixed in doesn't provide adequate
stability and may lead to pavement c�uality and durability issues. Staff closely monitors the
production of reclaim material to ensure a quality product is produced. City records and the soil
exploration report both indicated that adequate aggregate and pavement thickness was inplace
and would result in producing excellent reclaim material. But during water main installation on
Rice Creek Terrace, staff found the aggregate base and asphalt pavement to be thinner than
reported and reclaiming would result in sub-standard aggregate base material (reclaim). Staff
isolated the reconstruction area by directing the Contractor to excavate small inspection holes
along the MSAS route including 6`" Street (67`�' �venue to Rice Creek Terrace), 67`� Avenue (6`n
Street to Monroe Street) and Monroe Street (67`�' Avenue to Mississippi Street). Staff visually
inspected the excavations and determined that MSAS routes west of 7r� Street were found to be
deticient (1,500 feet) and MSAS routes east of 7`" Street were found to have adequate material
(2,100 feet).
Staff and Contractor determine the most feasible option was to produce 6" of reclaim (pavement
and base), salvage the reclaim material and excavate underlying soils in order to build the
roadway to the proper section. The excavation of the underlying soils resulted in a shortage of
aggregate base material and the Contractor utilized excess reclaim material throughout the job to
minimize cost impacts. The work included salvaging the reclaim material, excavating and
disposing underlying soils, placing the reclaim back, providing additional reclaim material,
compacting and shaping in preparation of paving. The cost of this item is $30,236.01. This work
will be paid with Street funds.
Item #4 is for replacement of 4" concrete sidewalk adjacent to pedestrian ramp upgrades. The
pedestrian ramps were upgraded to accommodate Americans with Disabilities Act (ADA)
requirements and ensure positive drainage. Twenty four (24) pedestrian ramps were upgraded to
current ADA standards along with adjacent sidewalk. ADA slope requirements require the
pedestrian ramps to be relatively flat behind the curb and resultEd in replacement of adjacent
sidewalk panels. A total of 1,399 sguare feet of sidewalk replacement was required to allow for
proper transition. Staff overlooked inclusion of�the concrete walk work in the bidding
documents. All sidewalk work was necessary and staff spent considerable time and effort to
ensure walk and pedestrian ramps were built properly and quantities were minimized. The cost
of this item is $6,155.60. This work will be paid with Street funds.
Item #5 is for modification of 2 new storm sewer manholes that were delivered to the site. Staff
provided underground pipe network information to the Contractor in advance so storm sewer
structures could be constructed properly. The manholes requiring modification had multiple pipe

connections at varying angles and depths. During installation of new manholes, it was found that
several manhole openings were not aligned with the existing pipe network and required
modification in the excavation trench. Staff negotiated with the Contractor to pay for labor only
(no machinery) to minimize costs. The cost of this itcm is $459.40. 1'his work will be paid with
Storm Water Utility funds.
Item #6 is for additional 21"' concrete storm pipe at 67`�' Avenue and 6r" Street (see Exhibit B).
While tlie contractor was replacing the storm sewer along the curb line of 67`� Avenue, staff
observed a sinkhole forming in the residential yard where the storm sewer extended through an
easement to the south between 430 and 440 67`� Avenue. Staff determined the existing 15" pipe
had significantly deteriorated and soil was entering the pipe causing a sink hole. Staff directed
the contractor to replace the deteriorated 15" pipe with a new 21" pipe to the area of the sinkhole.
1'he Contractor promptly responded with acquiring and installing the pipe to minimize exposure
of a dangerous sinkhole in a residential neighborhood. The remaining pipe that was left in place
was inspected for deticiencies and staff determined no additional pipe replacement was needed at
this time. It should be noted that the pipe size was increased to accommodate future pipe
replacement to enhance drainage on 66`" Avenue. 1'he depth of this pipe was approximately 17'
which is 12' lower than typical storm sewer. This extra depth increases cost significantly by
requiring increased excavation to maintain safe working conditions. The cost of this item is
$6,723.71. This wark will be paid with Storm Water Utilitv f�unds.
Item #7 is for additional riprap installation in the infiltration basin on thc north end ol�Oakley
Drive at about the 6700 block. Af-ter several rain events, statf found the riprap quantity to be
insufficient to slow the water and prevent erosion. Staff directed the Contractor to place
additional riprap along with minor grading and restoration. "I�he cost of this itcm is $2,5�0.40.
This work will be paid with Storm Water Utility funds.
Item #8 is for repairing water main breaks adjacent to the proposed water main work on Rice
Creek Terrace. On the first day of water main replacement, two separate water leaks appeared to
the west of their work. Staff requested that the Contractor repair the leaks on a time and material
basis. Inspection by City staff found that one leak was only a crack and the other was a complete
break. One repair required a clamp and the other required replacing a short section of pipe. The
Contractor also disposed of saturated soils unsuitable for road reconstruction, placed and
compacted granular backfill materials. "I'he Contractor completed the work immediately, thereby
minimizing water disruption to adjaccnt residents. "1'he cost of this item is $6,047.37. "This work
will be paid with Water Utility f�unds.
Item#9 is for removal of trees, installation of pipe and �radi»g ai the rain gardens adjacent to
Community Park. Prior to excavation, Parks Supervisor Dave Lindquist determined that the 3
maple trees along the east side of Community Yark were stunted and beginning to show signs of
distress. He recommended removal in favor of a different species of tree to be planted in 2013.
The Contractor removed the trees during rain garden excavation. Staff directed the Contractor to
install a 4" pipe between the rain gardens to enhance ponding capacity and infiltration.
Additional grading and restoration was required due to tree removal and pipe installation. Staff

observed the Contractor's work to ensure the work was performed expeditiously. "I�he cost of this
item is $1,990.79. This work will be paid with Storm Water Utility funds.
Currently, the street and utility portion of this project is complete except for minimal corrective
work in the spring. 1�he Community Park parking lot rehabilitation portion of the project is
anticipated to take place this coming summer. 1�he work was delayed in order to address Rice
Creek Watershed District concerns and meet their requirements in a cost effective manner. Thc
Contractor has agreed to perform the work in 2013 and will honor the original unit bid pricing.
Staff anticipates no further change orders on the �-emainder of the project and will continue to
look for opportunitics to minimire costs.
Stafi�recommends the City Cotincil approve Change Order No. 3 to Midwest Asphalt
Corporation in the amount of$39,227.1 1. "I�he revised contract amount shall be increased from
$1,054,126.O1to $1,093,353.12. The additional cost will be paid using Street funds ($20,589.61),
Storm Water Utility funds ($11,724.30), and Water Utility funds ($6,913.20). Street fund costs
are anticipated to be reimbursed using available Minnesota State Aid funding. The revised
contract amount is within the budgeted (including utility wark)of$1,234.000.

Fridley's Stormwater Pollution Prevention Plan (SWPPP) for 2012.
In conformance with the City of Fridley's Stormwater Poilution Prevention Plan (SWPPP) to
conform to its National Pollutant Discharge Elimination System (NPDES) requirements, the City of
Fridley, as a Municipal Separate Storm Sewer System (MS4) is required to hold an annual
meeting reviewing its SWPPP activities for the previous year.
The meeting is intended to provide the public with information on the City of Fridley's SWPPP. A
presentation will be made summarizing SWPPP activities for 2012. This item can be moved in the
agenda sequence as necessary to accommodate public attendance related to this item and other
items.

Annual Public Update to Fridley's Stormwater Pollution Plan Scheduled
The City of Fridley has developed a Storm Water Pollution Prevention Program
(SWPPP) in compliance with the requirements of the Minnesota Pollution Control
Agency (MPCA) and the federal National Pollutant Discharge Elimination System
(NPDES).
This program requires that cities with populations greater than 10,000 maintain a
Municipal Separate Storm Sewer Systems (MS4) permit for operation and
maintenance of a storm sewer system. This permit details how storm water will be
managed within the City and is based on the City's comprehensive storm water
management plan.
Cities are required to present an update on the operations of this plan to the public
annually. The review of 2012 activities and goals for Z013 will be presented before
the City Council at its February 11, 2013 meeting.
Copies of the plan can be reviewed at the office of the Director of Public Works at the
Fridley Municipal Center. If you have questions or comments, please attend the
public meeting at 7:30 p.m., Monday, February 11, 2013, in the Council Chambers of
the Fridley Municipal Center, 6431 University Ave NE, Fridley.
