WHEREAS, the Minnesota Women of Today and the Fridley Women of Today have set aside July 1 to
recognize the many community activities of dedicated Women of Today members across the state; and
WHEREAS, the Minnesota Women of Today is an organization of over 1,400 women in 70 chapters
across the state; and
WHEREAS, the Minnesota Women of Today and the Fridley Women of Today are dedicated to actively
promoting such public awareness and service programs as: Domestic Violence Prevention, People with
Development Challenges, Tour de Cure Bike Ride for Diabetes, the American Cancer Society, Isaac's
Journey, as well as the SACA Food Drive, School Supply Drive and Santa's Workshop; and
WHEREAS, the Minnesota Women of Today and the Fridley Women of Today provide personal
enrichment and leadership training; and
WHEREAS, the Women of Today believe that "Through us, great lessons can be learned, worthy deeds
performed, and a hand of fellowship extended to millions of women everywhere."

to Subdivide the Existing Large Lot into Three Separate Lots to Allow for
Potential Future Development Opportunities on the Site, Generally Located at
7011 University Avenue (Ward 1) (Tabled May 6,2013).
Darin Nelson, Interim City Manager, stated Mr. Fogerty is requesting an extension of the
final plat review and approval to the June 24, 2013, City Council meeting, in order to provide
the time necessary to complete the technical changes to the plat. Mr. Fogerty has signed a
waiver pursuant to Minn. Stat §15.99 which allows this item to be continued beyond the 60-
day period. Staff recommends Council's approval.

Councilmember Bolkcom asked what is the chance if at the June 24 meeting Mr. Fogerty
again says he is not ready.
Julie Jones, Planning Manager, stated they have no guarantee; but the change they need to
make is very minor in nature. They just have a document that needs to be completed and
signed and they will then be ready to execute the plat. Staff has every reason to believe they
will be able to complete that by June 24.

3. Vacation Request, SAV #13-02, by Carlson McCain for William Fogerty, to
Vacate a Public Road Easement, Two Sanitary Sewer Easements, and a Water
Main Easement on the Property Generally Located at 7011 University Avenue

Darin Nelson, Interim City Manager, stated Mr. Fogerty has requested to have the right-of-
way easement and utility easement vacation request continue to the June 24 Council meeting.
Both Mr. Fogerty and the petitioner have signed the waiver pursuant to Minn. Stat §15.99 in
relation to the 60-day process requirement. Staff recommends Council's approval.

5. Resolution Designating an Official Depository for the Year 2013.
Darin Nelson, Interim City Manager, stated in January, the City Council approved Wells
Fargo as the City's official depository. With the appointment of Walter Wysopal as the new
City Manager, the City needs to create a signature line for him on the Official Depository
Resolution. Staff recommends Council's approval.

6. Appointments: Police Officers.
Darin Nelson, Interim City Manager, stated there are two police officers to be appointed.
The first is Nicholas Steiger who is being recommended for hire to fill the patrol officer
position of Barry Pankonin. Mr. Steiger has been employed as a St. Francis police officer for
the last seven years, and prior to that he was a sworn patrol deputy for the Anoka County
Sheriffs Office. He graduated with honors from Alexandria Technical College in 2004 with

an Associate's Degree. Most recently, he graduated from Concordia University with a
bachelor of arts in criminal justice with the honor of high distinction.
Mr. Nelson stated the second officer is Kota Patton who is being recommended for hire. Mr.
Patton fills a vacancy created by the upcoming retirement of Sergeant Richard Cesare at the
end of this month. Mr. Patton is a native of Chattanooga, Tennessee, and is a seven-year
veteran of the Air Force where he served as a security police officer. His last assignment was
with Andrews Air Force base where he provided the security for VIPs flying in and out of the
base. He holds an Associate's Degree in general studies with honors as well as a Bachelor's
Degree in business administration project management from Colorado Technical University.
He is currently enrolled in a graduate program. If approved, both officers will start on
Monday, June 24, 2013.

NEW BUSINESS:
10. Resolution Approving a Subdivision, Lot Split, LS #13-01, to Create a Buildable
Single Family Lot, Generally Located at 925 Mississippi Street (Ward 1).
Julie Jones, Planning Manager, stated the petitioner is Shermer Homes on behalf of the
property owner at 925 Mississippi Street. They are seeking a lot split to subdivide this
single-family home property. The home that already exists on the southerly portion of the lot
will remain in place, and the subdivision will allow for the construction of a new home on the
northern portion of the lot.
Ms. Jones stated the subject property is zoned R-1, single family, as are all of the
surrounding properties. The existing home and garage on the site were constructed in 1950.
Fridley City Code does require that single-family lots in the R-1 zoning district be a
minimum of 75 feet in width and total lot area or square footage of 9,000 square feet. The
subject property is quite large at almost 32,000 square feet in size.
Ms. Jones stated the petitioner would like to split off the north 117 feet of the lot to allow the
creation of a new single-family lot. After the split, the new lot will be 11,700 square feet in
size and 117 feet wide. The lot with the existing home on it will be 21,000 square feet in size
and 100 feet wide.
Ms. Jones stated the lot for the existing home will continue to meet all of the required
setbacks and lot coverage requirements. There is adequate room for the new home to comply
with all of the code-required setbacks.
Ms. Jones stated the Planning Commission held a public hearing for this proposed lot split
on May 15, 2013. A few neighbors did speak out against the proposed split request. The
petitioner is trying to accommodate the neighbors' concerns by constructing the new house
as far south on the lot as possible.

Ms. Jones stated the Planning Commission unanimously recommended approval of the lot
because it does meet the minimum standards set forth in the Zoning Code. City staff
recommends concurrence with the Planning Commission with five stipulations.
Councilmember Bolkcom asked Ms. Jones to summarize what the neighbors' concerns are.
One of them was safety as to the traffic and location of the driveway.
Ms. Jones replied she did know one neighbor across the street was concerned about losing
the trees and the park-like look they had across the street from them. Also, the neighbor to
the northwest of the proposed lot was actually interested in buying part of the property
themselves to create a more standard sized lot. Even if the lot split proceeds, she is not sure
if they had any negotiations with the petitioner or the landowner and that would not preclude
that from happening in the future. It would require a plat and would not just be a simple lot
split. It would be a more complicated subdivision.
Councilmember Bolkcom asked was there a question about drainage?
Ms. Jones replied that she had not heard.
Rick Shermer, Shermer Homes, stated the problem for the people's property to the north is
their front yard is only 12 feet wide from the front of the house to the property line. He
proposed to push the garage all the way to the south. He wants to be neighborly. There will
be no windows on that side, the garage will be on the right side, and the driveway will not
interfere with the people coming off of Able Street. He is trying to be reasonable.
Councilmember Bolkcom replied that is very reasonable.
Mr. Shermer stated in the top northerly part there is a 12-foot high fence. He would like to
take the fence down and push the house all the way over. He addressed the neighbors after
the meeting and they had no concerns. He will be doing what he can do to keep the trees.
He has to hook up the sewer and do a street cut.
Councilmember Bolkcom asked Mr. Shermer if he knew how many trees will have to come
down.
Mr. Shermer replied he does not know where the sewer actually is. He is pushing the
garage all the way to the south side, and will do a retaining wall.
Councilmember Saefke stated he was by the property today. It is a beautiful lot. He thinks
Mr. Shermer will be able to save a good number of the trees. From his perspective, if you
meet the Code, legally you have every right to split that lot. There was some concern about
drainage but there are materials and/or techniques to avoid problems.

Mr. Shermer replied the drainage now runs towards the northeast portion of the lot. He is
not going to affect any of the drainage, and the drainage is not going to affect this property.
Councilmember Saefke stated all that stuff needs to be approved anyway. He does not
think there is any problem with this at all.
Bart Douglas, 871 —66th Avenue NE, stated he lives two doors down from the property. He
met Charles, the new neighbor, and he also met Brian and Kathy Hove. He visited with them
and got the approval he could represent them on a couple of issues. As to the lot, the Hoves
live on, 891 — 66th Avenue NE, he asked if anyone knew if that lot was originally owned by
the City.
Councilmember Barnette replied, the family who originally lived there was named
Bemster, and to the best of his knowledge,they owned that entire lot.
Mr. Douglas stated he is talking about the Hoves' lot. The one that was on the curve. If it is
true that it was never owned by the City, it is his understanding it was part of an existing,
undeveloped area owned by the City. It seems it was the decision of the City maybe to put a
house in there. He apologizes if that is wrong. In his view that was wrong from a neighborly
point of view. Not that it was not meeting Code, etc. To him that was like a strike one.
Going forward, people moving, and a fence goes up. He asked everybody to try and put
themselves in the position of the Hoves. Now a fence is up in your front yard.
Mr. Douglas stated he lives two doors down. It is quite irregular. He was asking his father
if he knows of any other lot in the City like that where there is an irregular lot where you do
not possess the property adjacent to your driveway to your front door. He could not think of
one.
Mr. Douglas stated, No. 1, in his view the City erred in putting that lot there and building a
house. Yes, the Hoves knew when they moved there the property line was there; but there
was no fence. It is one thing not to have a fence right outside your front door.
Councilmember Bolkcom asked who put the fence there.
Mr. Douglas stated, the second strike, is that the City is now going to put in a house. Not
that it is not by Code, etc. It is not quite neighborly to do that. His final point is, he does not
know what ordinances are in other cities but asked if they have an ordinance where if you
move and purchase a property there could be a period of time you must dwell there before
you are able to split the lot? In this housing climate, they are in with a lot of buying and
selling and moving. In his view, if he drove to this place and he saw a ripe apple to pick,
knowing he could make a quick $85,000 to $100,000 by splitting the lot, maybe he would go
in there, live there a couple of years, sell it and go.
Ms. Jones stated there are people who have lived in that area for 20 to 30 years. The Hoves
have lived there 23 years. Now the new neighbors are coming in, they have a full right to do

that but, again, if you live there would we do that to our neighbor? He also would like to
propose the City entertain such an ordinance, that they look at legal possibilities if it would
be out of line to have a two to three-year moratorium on lot splits when somebody new
moves in.
Mayor Lund stated he would ask the City Attorney to weigh on that but his first reaction is
no. Mr. Douglas is talking more about a morality type thing, rather than legality.
Councilmember Bolkcom stated you can buy a property and never live in it and split the lot.
Anyone can do that.
Councilmember Saetke stated if you go down on Jackson and 66th there is a house that is
not quite square with the lot. That is the original farm house that used to own that whole
property there. Typically what would happen when Fridley was being developed, the
farmers who owned the property sold it to developers, and the developers were responsible
for platting the property. The City probably never really owned that property. As far as
ownership of private property, he can buy whatever he wants.
Darcy Erickson, City Attorney, stated she is not aware of any city in the metro area or the
state for that matter that has any kind of restraint on the alienation of property, the selling of
property. Property rights are a bundle of sticks; and that is the right to rent it,the right use it,
and the right to sell it. The law itself does not always favor putting restraints on alienation or
sale of property. She does not believe there is any type of expectation anyone can have that
the property is not going to be developed. Here it appears to be meeting all of the Code
requirements and while it might be nice to have the view the neighborhood currently enjoys,
there really is not a way to stop something. The person has the right to develop property
assuming it meets the requirements of the Code.
Mayor Lund stated when he looked at it he thought it was a little bit of an odd lot. Put
yourself as if it were your house, he probably would have been talking to the neighbor that
owned that property a long time ago. Maybe even before considering buying it. See about
buying a little pie shape there. On an outside corner usually you do have a lot line that goes
out at an angle. This one is very square into the front yard and cuts off.
Mayor Lund said from Council's viewpoint it meets all the setback requirements, and he
does not see that they can stop this. He certainly understands the fact that it is an
inconvenience and an unusual scenario.
Councilmember Bolkcom stated Mr. Douglas made the comment that the City is doing this
lot split. However, it is coming before them for approval. The City did not seek out this
owner to split this lot and build a home. These lots split happen all over the place. This does
meet the requirements. She said she does not believe the City has the legal right to deny this
request, and would probably be sued for it.

Mr. Douglas replied he was not saying the City is soliciting it in any way. However, they do
have the authority to grant or deny. In conclusion, the City gains by a"yes" and it loses by a
"no"because it gets another taxpayer.
Councilmember Bolkcom stated she has a legal obligation to protect the City also, and she
does think the City would be sued. They have no reasonable reason to deny this request
because it meets all Code requirements to have a lot split here. She is not doing it because
they are going to get another property on the tax roll.
Mr. Douglas replied he is not saying they would make a decision for that reason. He is just
making an objective statement saying the City benefits by approving it. It loses by denying.
The City does not have a legal standing to deny it unless instead of going by the letter of the
law, they took also the second method of leadership which is to go by the spirit of the law
and try to empathize with the people they are representing.
Councilmember Bolkcom said she is not saying they would emphasize but they also gain
because they are bringing in another single-family home and another family into the
community. She would like the City Attorney to comment about legal rights vs. moral or
empathetic reasons to do something.
Attorney Erickson stated she thinks the City would be very hard-pressed to find a reason
grounded in the law as a basis for denying the request. It puts the City into a precarious
situation if it were to deny on those grounds. Reading through the City Code, she does not
see any distinction between the spirits of the law vs. the letter of the law. The Code is
drafted with various objective terms, square footage, minimum lot size for the dimensions of
a lot setback, etc. Those guidelines are drafted with the intent of protecting the surrounding
properties and making sure that properties are not being developed and houses are spaced too
closely. There is thought given to those requirements. She does not see there is any friction
between the letter of the law and the intent of the law. Those are harmonious.
Councilmember Saefke stated as to spirit of the law, it is private property ownership and
what you can do with that property. One aspect is a person living there already on a probably
funny looking lot. However, take it from the advantage of the person who owns this larger
lot. These laws, codes, etc. are there to protect people's rights. When you purchase property,
you have the right to do whatever is within the law. All the gentleman is asking for is his
right to split the lot and, as long as it meets all the legal requirements, that is the spirit of the
law. The City is legally bound to let him do that as long as it is within the law. Whenever
there is change, there will be people who object to it as things will not look the same or be
the same.
Mayor Lund commented as to Mr. Douglas' comment that, yes, the City gains and the other
way it does not. He believes Mr. Douglas is saying that relates to financially with respect to
property taxes. It adds another taxpayer.
Mr. Douglas replied, correct.

Mayor Lund stated that is a little incorrect. With another property taxpayer, everyone else
who pays the property taxes benefits, not the City. The City has a levy, and if there is one
less taxpayer who meets that cap or that levy, then everybody else pays a little bit more.
Having one more taxpayer reaching that cap in the levy, it means they all pay a little less.
Mr. Douglas stated the request the homeowner has made and the request the neighbors have
made and the reason this should be denied is it would be an exception. The exception would
be that it is on an irregular road. Whoever moves in next will say I want to move into that
house, look at the weird front yard and there is a house right by it.
Mayor Lund stated he gets the impression this lot split makes it a natural okay and the
existing house with 12 feet from their house and their front yard seems to be the irregular
one. It makes it more normal to have this new house coming in with the one that is already
existing. He would have been talking to the property owner about buying a slice there to
make it a little bit more normal.
Councilmember Varichak stated she had the same situation a few years ago where she
lived. She had nobody across the street from her. About 8-10 years ago, the property owner
across the street decided to sell the land, split the lot 6 different ways and there were 6 new
homes in that area. She lost the woods across the street, and she felt her privacy was
invaded; but she now has two really nice neighbors and they all watch out for each other and
take care of the neighborhood. It was very hard for her to adjust.
MOTION by Councilmember Saefke to adopt Resolution No. 2013-29 with the following
five stipulations:
1. All necessary permits shall be obtained prior to construction on new home.
2. Grading and drainage plan to be approved by City's engineering staff prior to the
issuance of any building permits, in order to minimize impacts to the surrounding
properties.
3. Property owner, at time of building permit application, shall provide proof that any
existing wells or individual sewage treatment systems located on the site are properly
capped or removed.
4. Property owner, at time of building permit application for the construction of the
single family home, shall pay$750.00 required park dedication fee.
5. Property owner at time, of building permit application for the construction of the
single family home, shall pay all water and sewer connection fees.
Seconded by Councilmember Bolkcom.

11. Resolution Approving Antenna Site Lease Agreement between the City of
Fridley and Verizon Wireless (VAW) LLC, d/b/a Verizon Wireless, for Cellular
Communications Equipment and Facilities at Commons Park(Ward 1).
James Kosluchar, Public Works Director, stated this is for Water Tower No. 1 at the
Commons Filtration Plant site. Verizon Wireless contacted the City some years ago in
regards to leasing space for telecommunications equipment at this site, and they needed
additional coverage because of technology, etc. The water tower at Commons Water
Treatment Plant is the site proposed and is approved by the City telecommunications
ordinance. The proposed equipment under the terms of the lease include a communications
shelter, 12 antennas on Commons Park Water Tower No. 1, and 18 co-ax lines running
through the shelter to the antennas.
Mr. Kosluchar stated the shelter is located to the northeast of the water tower. The water
treatment plant faces 61st and the water tower is behind it. The proposed shelter location is to
the northeast. Independent access would also be part of the lease. Access just east of the
Commons Park treatment plant to that location would be fenced in and exclusively accessible
by Verizon. There will be antennas on top of the tower which is something new. The City's
current antennas are on the rail halfway up the tower.
Mr. Kosluchar stated, as to terms of the lease, the City started with the standard city lease
that got modified. There were a number of terms modified and updated and customized for
this site and this use. There is an initial five-year term and it is renewable for four additional
terms of five years. Those are actually standard terms. The lease rate would start at $34,200
per year. Rates will be increased by 3 percent annual during the term of the lease.
Mr. Kosluchar stated Verizon will have to have a building permit application review, a
structural analysis will be provided, and non-interference terms in the lease. Verizon will
provide an interference analysis. There are three existing private carriers on the site plus City
communications right now. He recommends the City Council adopt the attached resolution.
Councilmember Saefke asked how long will the antennas be?
Mr. Kosluchar replied he believed they are eight feet and about a foot wide.
Dave Fisher, Buell Consulting, stated he knows they are not taller than eight feet.
Councilmember Saefke asked how close together they were.
Mr. Fisher replied there are four per site and there are three sectors. That is a standard
configuration. All the carriers have them.
Councilmember Saefke stated seeing how this is going to be on top of the water tower, will
it obstruct the view of the aircraft light?

Mr. Fisher replied, no, he did not believe it would.
Mr. Kosluchar stated he recalled in the plans it showed the aircraft light being raised a
couple feet.
Councilmember Saefke asked what good would that do if the antennas are eight feet and the
aircraft light is raised only two feet.
Mr. Kosluchar stated the aircraft light right now extends beyond the rail and is still visible
above the rail. The difference between the rail height and the antenna height is the aircraft
light gets raised so it is visible.
Mr. Fisher replied he is sure it has to be in compliance with the FAA regulations.
Councilmember Saefke asked how close will the antennas be to the maintenance rail.
Mr. Fisher replied they are mounted on structural components that hold up the antennas.
Those are actually outside the rail. He cannot give a measurement offhand.
Councilmember Saefke asked Mr. Fisher if he has been on top of the water tower.
Mr. Fisher replied he has not.
Councilmember Saefke asked if there are hooks there for future maintenance/painting to
hang a screen to cover the tower while it is being painted or sandblasted. He asked if the
brackets would interfere. He asked what would happen when they do paint the water tower
and the tower is encapsulated. How would they temporarily mount them?
Mr. Fisher replied that is typically taken into account. They have antennas on top of
thousands of water towers, and they have the same situation where they want to make sure
there is no interference. They will make sure to work closely with Mr. Kosluchar.
Councilmember Saefke stated he does not object at all; however, his whole problem with
this is aesthetically it does not look very good. The antennas up there now are mainly
unobtrusive as they are on the outside rail about two-thirds of the way down on and they are
painted the same color as the tower. Most people do not even notice that. They will when
they see eight-foot antennas on top of the tower, because he has seen them in other
communities. It reminds him of a porcupine.
Mr. Fisher replied, sure, and he would not argue that. Unfortunately, because of the height
requirement, the spatial constraints, the lack of no other sites in the City, along with some
other concerns, the only space is on the tower. At least they were able to utilize this existing
structure rather than building a new one.

Councilmember Saefke stated he believed there would be some possible future issues with
painting maintenance. He asked if the antennas are able to be painted.
Mr. Fisher stated they will do everything possible to make it as aesthetically pleasing as
possible.
Councilmember Saefke asked if they have looked at Water Tower No. 2.
Mr. Kosluchar replied there is a pending easement. That would be an additional site to their
network. They have actually done their due diligence looking at all alternative sites.
Councilmember Bolkcom asked if there is some other nearby community that has a water
tower with these types of antennas on top.
Mr. Fisher replied, he is sure there are hundreds. He cannot think of any off the top of his
head. He has done this for 18 years and they have hundreds and hundreds of water towers.
Whenever they cannot go on the catwalk and there are space constraints because of other
carriers, etc., already there,they have to put it on top.
Councilmember Bolkcom stated although this is a site that is approved in the City's
telecommunication ordinance, it does not automatically get approved. There is still an
agreement they have to approve.
Mr. Kosluchar replied, that is correct. The telecommunications ordinance is the first task
that is required. The City does happen to own some of the approved sites.
Mr. Fisher stated Verizon is in the process of executing an agreement. They would like to
have a lease authorization for the Mayor and the City manager to sign so they do not have to
come back before the City Council to be executed upon an approval by the City Attorney and
Mr. Kosluchar of the construction drawing.
Councilmember Bolkcom stated also in no way does this affect the City's water tower.
They have their own structure where they can go into and have their own fencing. It does not
mean that anyone who works and maintains their antennas compromises any of the City's
structures.
Mr. Kosluchar replied that is correct. From a worker's safety standpoint, there is going to
be exposure and proximity to this equipment. The equipment stands off far enough where
that exposure is reasonable. If there is long-term maintenance, such as tower painting, the
equipment can be turned off. In addition, the lease document includes the requirement for
the tenant to remove their equipment in the event the City needs to do maintenance.
Councilmember Bolkcom stated also if they suddenly decide they do not want this
anymore,they cannot just abandon it and leave the large antennas up there.

Mr. Kosluchar replied that is correct. The City Attorney has put some assurances in the
agreement that there is a bond requirement Verizon would need to hold and that should take
care of removal of any abandoned equipment.
Darcy Erickson, City Attorney, stated they have the plans that are attached which are fine
for the construction, but the City would request that in the event a tweak needs to be made
because a nut, bolt, or something is in the way,the City Public Works Director can work with
Verizon on it.
Mayor Lund stated they just want to make sure that what is included in this lease is
essentially correct.
Attorney Erickson stated, yes, they have conceptual plans they believe are accurate.

INTRODUCTION
Staff is pleased to announce that it has received and reviewed the final version of the Alternative
Urban Areawide Review (AUAR) on the FMC Redevelopment Site in Fridley. All comments are
contained within and changes have been made as appropriate to address those comments. In the
interest of saving paper, Council can now review (as they have been through the process)the final
plan on-line at the City's home page and certify the adequacy of the AUAR and adopt the attached
resolution the complete the environmental process outlined in statutes. Thank you to Council
members for their hard work in reviewing documents and their attending the information meetings,
and thank you to Council Member Bolkcom, for reminding the public at each step that the latest
version of the revised AUAR could be found on the City's website. I have included the original 50-
word description of the project for your convenience and for those who may be tuning in to what
this project is for the first time. Once the AUAR resolution has been approved by Council, staff will
notify the Environmental Quality Board (EQB), of the State of Minnesota and the process will end
with their publication of Council's action in the EQB Monitor. Once approved, Hyde Development will
begin their land use requests, starting with a rezoning and potentially a re-platting to accommodate
the first phase of the redevelopment.
ELEMENTS
Project Title: FMC Redevelopment — Fridley, Minnesota
Description: The proposed project is the redevelopment of approximately 122 acres within the City of
Fridley, MN,just south of 1-694 and east of 1-94 and the Mississippi River, 4800 East River Road. An
existing 1.8 M square foot munitions factory on the site is proposed for initial repurposing and
eventual tear down and replacement. The final density on the site is anticipated to include a range
from 1.59M to 1.84M square feet of a mix of industrial(60,200-800,000 s.f.), office(up to 875,000
s.f.), and retail(up to 37,120 s.f.) uses.

Background
The City has received an annual livestock license application from Robin Hiney who lives at 6360 Monroe
Street.Ms. Hiney would like to keep six laying hens(no roosters)in a small coop in her backyard adjacent to
her garage. She plans to maintain the birds year-round as a source of eggs for her family. Any extra eggs will
be given to family and friends. Ms. Hiney's detailed proposal is attached for your review.
Chapter 101 of City Code requires anyone wanting to maintain fowl on their property to obtain a livestock
license from the City annually. The fee for this license is $100, and Ms. Hiney has paid the required fee. She
has met the requirements for coop placement being at least 30' back from any property line.
Site Visit Observations
Staff inspected the property on June 13, since measurements had to be taken to verify that the proposed
chicken coop would not cause the property to exceed accessory structure square footage requirements. By
investigating the building records on the property, it was discovered that a previous property owner added
onto the back of the garage without obtaining a building permit. The garage addition created an illegal
nonconforming status on the garage, as its square footage now exceeds that of the 1,061 sq. ft. house—
something prohibited by the zoning code. The chicken coop proposed by Ms. Hiney, however,will not be
attached to the garage, so it will not be expanding the illegal non-conformity of the garage. In addition,the
field visit confirmed that the additional 5' x 10' accessory structure proposed to harbor the chickens will not
cause this property to exceed the maximum square footage allowed for total accessory structure square
footage on an R-1 lot of 1,400 sq. ft.
During the site visit, staff observed an unmaintained compost bin, some outdoor storage, and fowl odors
coming from the garbage container. Ms. Hiney later explained that they were in the process of removing and
replacing old landscaping. There is a garden on the property to the west of the garage,which is where the
applicant proposes(see attached narrative)to deposit waste from the hens. The proposed coop location will
be hidden from view to the neighbors and street and meets the 30' setback requirement from any lot line.
Staff does, however,have some maintenance concerns. It needs to be stressed to the applicant that the
compost pile needs to be maintained according the Chapter 113,which requires regular turning, and there
should never be any offensive odors to neighbors coming from the property from the chickens or any other
source on the property.Noncompliance of these potential code violations would be reason for future license
revocation.

One additional issue that the applicant did not address in her narrative is what she proposed to do with the
chickens once they become too old to lay eggs(after about 2 years in most breeds). Besides waste removal in
the winter time when the garden and compost pile are frozen,this is a concern to staff as City Code does not
permit butchering on site. The applicant should be asked to address these concerns.
Recommendation
Staff recommends that the City Council approve the livestock license request from Robin Hiney as long as
staff's concerns about odor and future turnover of the brood are addressed by the applicant. In addition,the
applicant should be informed on record that the existing garage is illegal non-conforming, so the chicken
coop cannot ever be attached to the garage or expanded in size without first obtaining approval from the City.

Hen Proposal
The hens we have chosen are Black Australorp, Buff Orpington, Barred Rock, and or
Easter Egger.No Roosters. All these breeds are known for having calm and friendly
temperaments and are winter hardy. Below is a bit more in depth description and photo of
these hens.
All of the hens waste will be put in to the mulch in our garden.The hen coop will be
cleaned one to two times a week as it is needed.The coop will be well ventilated.We
understand the smell is a concern and will be sure to keep it in check. Pine bedding will also
help with this smell. Below is pictured what the coop will look like. The coop house will be
inside the run.The full enclosure will be 7'tall by 5'wide by 16' long,with 30'or more from it
to all property lines. The chickens will remain in the enclosure at all times. We will also be
clipping the outer flying feathers on one wing in the event they do get out of the coop they will
be unable to fly over our chain link fence.The back yard is already fenced in as an added layer
of protection against any chickens escaping. Attached is a`to scale'idea of where the coop will
be based on our property lay out.
The eggs produced by the hens will be for personal use only.We consume a lot of eggs
and will give any extras to family or friends.

Re: Replacing the Kalwall Roof at Springbrook Nature Center
The translucent panel roof (Kalwall) in the main exhibit room of the Springbrook
Nature Center continues to deteriorate and should be replaced as soon as
possible. We continue to have problems with water intrusion and I am growing more
concerned all the time with the potential damage to interior finishes, exhibits and
furnishings. The water issues we are seeing also raises concern with mold developing
and a decrease in energy efficiency of the roof. The heavy rains on the weekend of May
17 — 19 resulted in four different locations in the exhibit room area with significant water.
This item was discussed at a City Council conference meeting on June 10 and the City
Council was supportive of replacing the roof. We currently have $99,800 in the reserve
fund for Springbrook Nature Center and I would recommend using these funds to replace
the roof this year.
I have obtained two quotes for replacing the roof at the Nature Center. One is from W.L.
Hall Company in Hopkins, MN for $60,980. The second is from SpecPro, Inc. out of
Nebraska for $78,428.50. Kalwall is a specialized product, and this Minnesota company
is the only one in the five state area that deals with the Kalwall roof. That is why we got
the second bid from the company in Nebraska who also deals with Kalwall. I would
recommend working with the local company W.L. Hall to get this work complete.
Once the product is manufactured, the actual installation of the new roof would take
approximately three days. We would need to close the exhibit room during that
installation, but there would be no disruption to the restrooms, classroom and office
areas.
Please let me know if you, or the City Council, have any questions or need additional
information. Once again, my recommendation is to move ahead with the replacement of
the Kalwall roof this summer. Thank you for your assistance with this and please advise
on how we should proceed.

RENEWAL INTO THE NEXT GENERATION) PROJECT AND SUPPORTING THE
REQUEST TO THE STATE OF MINNESOTA FOR FINANCIAL ASSISTANCE
WHEREAS,the Springbrook Nature Center is a 127-acre City of Fridley park that provides year-
round opportunities to experience and learn about nature; and is an environmental education center
that serves school groups, community organizations and families; and
WHEREAS, the Springbrook Nature Center serves the people living in the north suburban area with
enjoyable and educational programs,hands-on exhibits and nature center facilities; and
WHEREAS,the Springbrook Nature Center SPRING Project will enhance this park as a learning
center for people from the metropolitan area,the State of Minnesota, and the City of Fridley; and
WHEREAS,the Springbrook Nature Center SPRING Project includes facility improvements that will
provide spaces for education, health and wellness, community gatherings, celebrations and
business meetings; and
WHEREAS,the Springbrook Nature Center SPRING Project will create public spaces that minimize
future operating and environmental costs through design and technology improvements;
and
WHEREAS, the Springbrook Nature Center SPRING Project has been developed with the input of
citizen groups, environmentalists, City officials and architects to preserve the Springbrook experience
for future generations; and
WHEREAS, the Springbrook Nature Center Foundation is a local non-profit organization dedicated to
supporting the overall planning, development and management of the Springbrook Nature Center; and
WHEREAS,the Springbrook Nature Center Foundation has committed to taking the lead in raising
the balance of the SPRING project costs from private sources; and
WHEREAS,the increased operating costs associated with the Springbrook Nature Center
SPRING Project will be covered through a combination of additional program revenue and funds
provided by the Springbrook Nature Center Foundation; and
WHEREAS,the recent legislative shifts in government aides, levy limits and real estate tax changes
make it impossible for the City council to pass on tax increases to Fridley property
owners for the future development and future maintenance of this regional facility;

improvements included in the Springbrook Nature Center SPRING Project and recognizes the positive
impact this project will have upon the citizens of the northern Twin Cities metropolitan area.

Attached is an agreement between the Minnesota Commercial Railway Company, Fridley
49er Days Community Festival Committee, and the City of Fridley regarding use of a
locomotive for the Touch a Truck and Train Event for your approval.
This agreement has been drawn up by our City Attorney and approved by both our insurance
company the League of Minnesota Cities and representatives from the Minnesota Commercial
Railway.
The Minnesota Commercial Railway Company will be added to our insurance policy for this
event and will not cost the City any additional premium. A copy of the Certificate of Liability
Insurance is also attached.

COMPANY,FRIDELY 49ER DAYS COMMUNITY FESTIVAL COMMITTEE,AND
THE CITY OF FRIDLEY REGARDING USE OF A LOCOMOTIVE FOR THE TOUCH
A TRUCK AND TRAIN EVENT
This Agreement is entered into this_day of June, 2013 by and between the City of Fridley
("City"), a Minnesota Municipal Corporation, the Fridley 49er Days Community Festival
Committee ("Festival Committee"), a Minnesota Nonprofit Corporation, and the Minnesota
Commercial Railway Company("Railway"),and Minnesota Corporation.
The Festival Committee, in conjunction with the City, will host a "Touch a Truck and Train"
Event ("Event") as part of the 49er Days Celebration ("Celebration") at the Medtronic Rice
Creek Campus, 7000 Old Central Avenue NE, in the City of Fridley, Anoka County, Minnesota
("Event Location") on Saturday,June 29,2013 ("Event Date"). As part of the Event,the Railway
hereby agrees to bring a locomotive ("Locomotive") and Railway personnel to the Event
Location froml p.m. to 5 p.m. on the Event Date and to allow attendees of the Event to view and
enter onto the Locomotive. Railway shall supply personnel to explain the features and function
of the Locomotive for the duration of the Event.
In consideration of the provision by the Railway of the Locomotive and Railway personnel, the
City will provide general liability insurance coverage and indemnification for the Railway for the
duration of the Event as noted herein. The City hereby agrees to maintain municipal liability
insurance in an amount not less than $1,500,000 per occurrence for the Event. The City shall
add the Railway as an additional insured to the City's liability coverage for purposes of the
Event.
To the fullest extent permitted by law, the City agrees to defend and indemnify the Railway and
its officers, employees, and agents from and against all claims, damages, losses, and expenses,
including attorney fees,arising out of or resulting from the performance of its obligations under
this Agreement; but only to the extent caused in whole or in part by: (1) the negligent acts,
errors, or omissions of the City,or anyone directly or indirectly employed or hired by the City, or
anyone for whose acts the City may be liable;or(2)the negligent acts,errors,or omissions of the
Railway and its officers, employees, or agents. In no event shall the City be required to defend
or indemnify the Railway for any actions,errors or omissions that constitute gross negligence or
intentional misconduct by the Railway, or its officers, employees, or agents. The City's
maximum indemnification obligation shall be limited to the City's maximum liability as set forth
in Minnesota Statutes, Section 466.04,subd. 1.
The City's insurance and indemnification requirements pursuant to this Agreement shall apply
only from the time when the Locomotive arrives at the Event Location until the Locomotive
leaves the Event Location on the Event Date. The Railway shall be responsible for insurance
coverage for the Locomotive and its personnel, including officers, employees, and agents before
and after the Event.
At no time shall the City be responsible for providing workers' compensation insurance for the
driver of the Locomotive or for any other personnel provided by the Railway as part of the
Event.

This Agreement may be executed in any number of counterparts,each of which shall be deemed an
original but all of which shall constitute one and the same instrument.
The parties covenant and warrant that each has full power and authority to enter into this
Agreement.

SUBJECT: Public Hearing-Ordinance To Declare Property Excess and Authorize the Sale Thereof
INTRODUCTION
Nearly one year ago, Council Member Barnette received a call requesting information as to why the
South Street Apartments had been allowed to use City property for years with no lease or other form of
City reimbursement. Staff received Council member Barnette's follow-up inquiry and researched the
history of the parcel.The findings indicated that Council's caller was correct.The land is owned by the
City.The City acquired the land in the late 1960's.The City acquired the property through an appraised
value purchase after the property had been allowed to go tax forfeit. By having the City purchase the
property straight out for market value, it did not limit or place restrictions on a later sale by the City.
Staff approached Krishna Jaine, KJ Management,the owner.After much time,talks, site visits/revisits,
and negotiation, it appears there is no interest on the part of Ms.Jaine to purchase or arrange to lease
the property. In spite of the fact that it is located where their second ingress/egress driveway now
exists. With these facts known, staff recommends that the City Council deem Lot 11, Block 2, Marian
Hills 2nd Addition excess and authorize the sale thereof.
ELEMENTS
This property was developed along with the remainder of the Marian Hills 2nd Addition Plat in 1960.
Harvey Peterson, 1200 Development Company was listed as taxpayer until the property went tax forfeit
a few years after the plat was filed.The parcel sat undeveloped and in somewhat of a limbo forfeit
status until 1981,when the City purchased the property for the then, market value price. Meanwhile,
the South Fridley Apartment complex had been using the property as a less formal second
ingress/egress.

Over time,the driveway became more finished, more permanent. In 2004 the asphalt drive still present
today was installed. Since driveways do not require building permits,they likely had a contractor
complete the work, without there being a formal discussion with the City.
Since the City purchased the property at market value, as opposed to acquiring it at a discount price for
a specific purpose like right-of-way, utility and drainage, etc.there is no reason for the City not to sell
the property for its current market value. Had we bought it from the county at a reduced price for a
specific purpose,we would need to offer it back to the County, rather than selling it.That is not the case
here.We can sell this property without restriction.
Prior to deciding to make this recommendation staff corresponded with Krishna Jain, who then
forwarded the information to her attorney.Attached you will find a lease agreement that Attorney
Erickson prepared at staff's request.This was a starting point for discussion that did not appear to gain
serious consideration by the Apartment owner. Her suggestion was that she pay a portion of what the
annual taxes would be (on the land), based on what percentage of the property was being used for their
driveway. For simplicity, let's call the 13,585 s.f. lot 14,000 s.f..Then, say the driveway is 4,800 s.f. (34%
of the property). Now say the taxes on the land are$900.00/yr. Ms.Jaine would come as far as agreeing
to pay 34%of$900, or$306/yr toward taxes, but she would not agree to any lease amount.
On a separate but related note,we spoke with John Berg regarding the lack of a driveway, if the City
were to remove theirs and sell the lot. He said that there is ample opportunity for a turn-around on their
site and that he would likely not bring a truck to the south side of the building through this drive
location anyway. Chief Berg did indicate that he has spoken with the owner of South Fridley
Apartments about their need for a fire hydrant south of their building.A complex of this size in a bit
different configuration would require 8 hydrants. Because of the design of south Fridley Apartments 3
hydrants would be adequate, but they currently just have access to two. I mention this only because
without the driveway, a new hydrant on the south side of their complex will be even more beneficial.
Staff will continue their quest with the owner to get this additional hydrant installed.
Since the time when the survey stakes were first installed, we have had 3 builders request information
about potentially purchasing the property.Though Council would need to act on this ordinance first,
staff believes a sale could then occur quickly and that a new home could possibly be built on the lot yet
this year.The proceeds of this sale would be City revenue, but Paul Bolin has suggested that he could
help facilitate the sale of the lot. He will add this parcel in with his inventory of HRA lots for builders to
consider.
RECOMMENDATION
Staff recommends that Council approve the attached Ordinance declaring Lot 11, Block 2, Marian Hills
2nd Addition excess property and authorize the sale thereof.

LEASE AGREEMENT
THIS LEASE AGREEMENT ("Agreement") is made and entered into this day
of , 2012, by and between City of Fridley, a Minnesota municipal
corporation, ("Landlord") and South Fridley Apartments, LLC, a Minnesota limited liability
company ("Tenant"). Landlord and Tenant hereby agree:
ARTICLE 1
RECITALS
Recital No. 1. Landlord owns real property locate lin the p ity of Fridley, County of
Anoka legally described as: 3f
Lot Eleven (11), Block Two (2), Marian Hills 2nd Addition (Subject to
utility easement and drainage easement over,Westerly Six'(6)feet).
(the "City Property").
Recital No. 2. Tenant owns real property consisting of three tax parcels, Property Tax
Identification Numbers 25-30-24-22-001:3, 25-30-24-22-0014,25-30-24-22-0015 improved with
three residential rental buildings, known',as 1050 52 Avenue NE, 1120 52nd Avenue NE., and
1170 51 nd NE in Fridley ("Tenant's 0 ®My"), adjacent to the City Property;
Recital No. 3. Tenant ha 1previously improved a portion of the City Property with an
impervious access drive to provide,means of ingress and egress to Tenant's Property.
Recital No. 4. Landlord'"desires to lease to Tenant and Tenant desire to lease from
Landlord the City Property to be used for an access drive to provide non-exclusive ingress and
egress to residents of Tenant's Property.
ARTICLE 2
AGREEMENT
2.1 Lease of Premises. Under the terms and conditions hereafter set forth, Landlord
leases to Tenant and Tenant hereby leases from Landlord the City Property:
A. Rent. For the time period from the date hereof through December 31, 2012, the
rent shall be $1,000 and Tenant shall pay Landlord the rent of$1,000 at the time
this Agreement is signed. Beginning January 1, 2013, the rent shall be $500.00
per month payable in quarterly installments of $1,500.00 on the first day of the
following months: January, April, July, and October.

Said annual rent shall be increased automatically and without notice on January1,
2014, and each year thereafter on January 1 by either: five percent (5%) of the
previous year's annual rent; or the percentage change in the Consumer Price
Index—All Urban Consumers, U.S. City Average, All Items, 1982-1984=100, for
HALF 1 of the immediately preceding year (the "Preceding Year") as compared to
year prior to the Preceding Year, whichever is greater.
By way of illustration and applying the rent escalation formula above, assume that
the lease was in existence from January 1, 2011 to December 31, 2011, with
monthly rent of$500 and the parties desired to calculate the rental increase for the
period January 1, 2012 to December 31, 2012. The CPI for the 2011 HALF1 was
223.6 and the CPI for the 2010 HALF1 was 217.5. The CPI point change
between 2010 and 2011 is 6.1. The CPI point change, 6.1, is divided by the 2010
CPI (6.1 ± 217.5 = .028). The result is then multiplied by 100 to determine the
percentage change (.028 x 100 = 2.8%). Because the percentage change of 2.8%
is smaller than 5%, the rent would increase 5% for.2012, effective January 1,
2012.
B. Duration of Lease. The initial term of this lease shall 1*,tor the time period
commencing upon the signing of this lea through December 31, 2013 (the
"Initial Term"). Thereafter, thease shall'automatically renew for successive
twelve (12) month terms, commencing January r of each year and ending
December 31 of each year°beach a "Renewal Terrr") unless Landlord or Tenant
cancels and terminates this lease. Either party may cancel and terminate this
Agreement upon giving the other party a written notice sixty (60) days prior to the
end of Initial Term or Renewal Term, whichever the case may be. If Tenant has
not timely ,paid rent or if Tenant has otherwise breached a provision of this
Agreement, 'f dndlord may terminate this Agreement by giving Tenant written
notice ten(10) days=in advance of the termination date.
CV"' Permitted Use.
a d� Without Landlord's advance approval, Tenant has previously
fin proved a portion 'the City Property with a paved driveway. Tenant may use
,City Property for non-exclusive use as an access driveway and may not use
the' lty Property lbr any other purpose.
D. Governs ent Permits. Tenant, at his expense, must obtain all licenses and
governmental permits to maintain and improve the City Property.
E. "As-Is" Condition. Tenant accepts the City Property in its as-is condition.
Landlord has no responsibility to make any changes, modifications or
improvements to the Property.
F. Repair and Maintenance. Landlord has no responsibility to maintain, repair or
replace the paved driveway Tenant previously installed. At its sole expense,
Tenant must maintain, repair an d replace the driveway on the City Property and
keep it in good working order. Landlord has no obligation to snow plow the City
Property. Tenant shall keep the City Property in a lien free condition.

G. No Alterations. Tenant shall not make any further alterations or improvements to
the City Property without first obtaining the written consent of Landlord. Upon
any termination of this Agreement, Tenant agrees that Tenant shall not be
compensated for any alterations and improvements make to the City Property and,
upon termination of this Agreement, any such alterations and improvements shall
become the property of the Landlord.
H. Insurance. Tenant, at the Tenant's sole cost and expense, shall maintain:
a.) Comprehensive general public liability insurance with contractual liability
coverage insuring Tenant and Landlord against all Claims for personal injury,
death or property damage occurring upon, in or about the City Property in
amounts as may from time to time reasonably be required by Landlord, but
not less than$1,500,000 for injury or death`sustained by one or more persons
as a result of any one occurrence and $1,500,000 for damage to property for
any one occurrence,
b.) Workers' compensation insurance within statutory limits covering Tenant's
employees on the City Property;
c.) Personal property insurance for Tenant's assets used in connection with the
City Property.
Landlord shall be listed as a co-insured on the comprehensive general public liability
insurance policy.
All policies oinsur' ce shall be form and substance reasonably satisfactory to
the Landlord, shah¢- e written .with companies reasonably satisfactory to the
Landlord, and shall` :R wide for at least ten(10)days written notice to Landlord prior
to cancellation or reduction in coverage. Such policies, or certificates thereof, shall
be delivered to Landlord prior to the commencement of the Lease Term; and
evidence of renewal of such insurance shall be delivered to Landlord not less than
thirty(30)days prior to the expiration of such coverage.
Hazardous```Substances. Tenant shall not store, place, release or deposit any
Hazardous Substances on the City Property. The term"Hazardous Substances" as
used in this Agreement, shall include, without limitation, medical waste,
flammables, explosives,radioactive materials, asbestos, polychlorinated biphenyls
(PCBs), chemicals known to cause cancer or reproductive toxicity, pollutants,
contaminants, hazardous wastes, toxic substances or related materials, petroleum
and petroleum products and substances declared to be hazardous, toxic or a
pollutant or a contaminant under any law or regulation now or hereafter enacted
or promulgated by any governmental authority.
J. Indemnification. Tenant hereby agrees to indemnify, defend and hold the
Landlord harmless from any claims, losses or damages made against Landlord or

incurred by Landlord that arise out of or relate to Tenant's use of the City
Property.
K. Real Estate Taxes. Before penalty accrues, Tenant shall pay the real estate taxes
and special assessments related to the City Property directly to the taxing
authority at a rate to be determined by the Anoka County Assessor. Tenant shall
provide Landlord with written proof of payment of real estate taxes and special
assessments related to the City Property within ten (10) days of their due dates of
May 15 and October 15. In the event Tenant fails to pay the real estate taxes and
special assessments related to the City Property, Landlord may pay such
delinquent real estate taxes and special payments;aid recover such amounts from

Tenant and pursue any other remedy available to it pursuant to this Agreement,
including but not limited to termination. r„ .
L. Subletting and Assignment. Tenant shall not sublet the City Property or assign
this Agreement without the prior written consent of Landlord.
M. Surrender of Premises. Upon termination of this Agreement, Tenant shall
surrender the City Property to Landlord in substantially the°same condition as
existed as of the date of this Agreement.
N. Notices. Any notices required o be g en shall[be personally delivered to the

ANALYSIS
The Council will recall, in 2012, Carlson McCain on behalf of Bill Fogerty,the property owner of the
Columbia Arena at 7011 University Avenue,went through the preliminary plat process to subdivide the
existing large lot into three separate lots to allow for potential additional development opportunities on
this site. The City Council approved the preliminary plat on September 10, 2012.
The proposed final plat will consist of three lots; Lot#1, Lot#2, and Lot#3, Block 1, COLUMBIA ARENA

On May 6, 2013, Mr. Fogerty singed a waiver to State Statute 15.99 for the platting process,to give the
property owner additional time to work on the plat mylars. That wavier requires the plat mylars come
back before the City Council by September 9, 2013. On June 10, 2013,the City Council continued final
plat review of PS#12-01.
The final plat mylars are before you tonight for approval. Prior to recoding of the final plat; however,
the City will need to vacate various easement agreements that are being replaced with dedicated
easements shown on the final plat. This vacation went before the Planning Commission on May 15,
2013, and will also be reviewed by the City Council tonight,June 24, 2013.
City staff would like to explain how the stipulations on this plat are being met, or will be met in the
description below:
Stipulation#1—will be met with the filing of this final plat.
Stipulation#2—will be reviewed and approved at time of building permit.
Stipulation#3—will be filed after the final plat has been filed and the development on Lot 1, 2 or 3 starts
occurring through issuance of a building permit. The fire department didn't want to vacate the existing
easement until a new one is necessary.
Stipulation#4—will be filed after the final plat has been filed and any development on any of the lots
starts occurring through issuance of a building permit.
Stipulations#5—this document has been prepared and will be signed by Mr. and Mrs. Fogerty tonight.
Stipulations#6—this document has been prepared and will be signed by Mr. and Mrs. Fogerty tonight.
Stipulation#7—remains as is, and is part of the trail easement that the property owner will sign.
Stipulation#8—remains as is.
RECOMMENDATION
The Planning Commission approved the preliminary plat for PS#12-01 on August 15, 2012. Staff
recommends approval of the final plat along with the following modified stipulations:
STIPULATIONS
1. University Avenue Service Drive and 715t Avenue shall be dedicated as public right-of-way on
final plat.
2. A 5 ft.sidewalk shall be installed along the University Avenue Service Drive and 71st Avenue to
meet the specifications of the City engineering department upon issuance of a building permit
for Lot 1, 2 or 3.
3. An easement to provide perpetual access to the fire training facility has been discussed, and
agreed to, but has not been shown on preliminary or final plat. An easement description and
easement agreement must be prepared,approved by the City's Fire Chief, executed by the
parties and made ready for filing, prior to issuance of a building permit for the project on Lot 2.
4. A water main and utility maintenance agreement to provide maintenance of water and other
utilities servicing Lots 1, 2 and 3 and also affecting nearby City property has been discussed, and
agreed to; a utility agreement must be prepared, approved by the City's Public Works Director,
executed by the parties and made ready for filing, prior to issuance of a building permit for any
project on Lots 1, 2,or 3.
5. An easement to provide perpetual shared parking between Lot 3 and Locke Park to the south
shall be prepared, approved by the City Parks and Recreation Director and made ready for
signature and filing, prior to final plat approval.

6. An easement for the Anoka County Trail with Anoka County shall be prepared, approved by the
City's Park and Recreation Director and made ready for signature for filing, prior to approval of
final plat.
7. The existing Anoka County Trail shall remain in its current location until such time Lot 3 is
developed. When Lot 3 is developed,the Anoka County Trail may be relocated pursuant to the
terms of the Anoka County trail easement referenced in Stipulation 6 and the relocated trail
shall be constructed according to Anoka County standards at the property owner's expense.
8. The relocation of the Anoka County Trail and the filing of the trail easement described in
Stipulations 6 and 7 and the parking easement described in Stipulation 5,will eliminate the
developer's need to contribute park dedication for this plat.
9. Creation of limited liability company named, "Columbia Development, LLC" and transfer of
property that is the subject of the plat to "Columbia Development, LLC" by William E. Fogerty
and Carmel C. Fogerty. Upon proof businesses entity formation and transfer of property, City
will execute final plat for filing.

RESOLUTION APPROVING FINAL PLAT, P.S. #12-01, FOR WILLIAM FOGERTY,
OWNER OF THE COLUBMIA ARENA PROPERTY,LOCATED AT 7011
UNIVERSITY AVENUE NE.
WHEREAS, the Planning Commission held a public hearing on August 15, 2012, and
recommended approval of said plat; and
WHEREAS, the City Council approved the preliminary plat for COLUMBIA ARENA
ADDITION at its September 10, 2012, meeting; and
WHEREAS, because of William Fogerty's request for an extension for final plat approval, on
March 11, 2013, the City Council approved a two-month extension until May 11, 2013, for final
plat approval; and
WHEREAS, on May 6, 2013, the property owner, William Fogerty, signed a waiver to Minn.
Stat. § 15.99 and all applicable deadline requirements related to the platting process, that would
allow him additional time to prepare the final plat mylars;
WHEREAS, on June 10, 2013, at William Fogerty's request, the City Council continued the final
plat approval until the June 24, 2013, City Council meeting;
WHEREAS,the City Council approved the final plat at its June 24, 2013, meeting; and
WHEREAS, a copy of the final plat COLUMBIA ARENA ADDITION has been attached as
Exhibit B; and
WHEREAS, the stipulations of the final plat are attached in Exhibit A;
NOW, THEREFORE, BE IT RESOLVED, that conditioned on and subject to the stipulations set
forth in Exhibit A to this Resolution, said stipulations being incorporated herein by reference, the
City Council approves the Final Plat for COLUMBIA ARENA ADDITION and requires the
filing and recording of the plat at Anoka County within six months of this approval or such
approval shall be null and void.

ANALYSIS
Mr. Krystofiak, of Carlson McCain, who is representing Bill Fogerty, the owner of Columbia Arena at
7011 University Avenue, is requesting to vacate an existing public right-of-way easement and three
utility easements that will be dedicated on the new plat for the Columbia Arena project, when that is
filed at Anoka County.
As part of the platting process, new utility easements will be dedicated on the new plat; as a result,the
existing easements need to be vacated.
The existing lot lines for the subject property extend beyond the University Avenue Service Road and
715t Avenue. Therefore, those roadways are on the petitioner's property through road easements.
Once the new plat is filed, both the University Avenue Service Drive and 715t Avenue will be dedicated
to the City. As a result,the right-of—way easements also need to be vacated. Please see attached
drawings to show locations of easements to be vacated.
PREVIOUS CITY COUNCIL ACTION
The City Council approved a continuation of approval of the resolution for SAV#13-01, as requested by
the petitioner on June 10, 2013, to the June 24, 2013, City Council meeting.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission reviewed the proposed vacation request at their May 15, 2013, Planning
Commission meeting. After a brief discussion, the Commission recommended approval.

RESOLUTION TO VACATE A PUBLIC ROAD EASEMENT,TWO SANITARY
SEWER EASEMENTS AND A WATER MAIN EASEMENT FOR THE PROPERTY
GENERALLY LOCATED AT 7011 UNIVERSITY AVENUE, PETITIONED BY THE
PROPERTY OWNER,WILLIAM FOGERTY
AND PETITIONER, CARLSON MCCAIN
WHEREAS, the City has given preliminary plat approval to plat the real property legally
described on Exhibit A(the "Subject Property"); and
WHEREAS, as a result of platting the Subject Property, new public road, drainage and utility
easements will be dedicated as part of the final plat for the subject property; and
WHEREAS, the public road easement legally described on Exhibit B to be vacated will be
dedicated as public right-of-way as part of the final plat for the subject property; and
WHEREAS, the two public sanitary sewer easements legally described in Exhibits C and D to be
vacated will be dedicated to the City as a part of the final plat for the Subject Property; and
WHEREAS, the public water main easement legally described in Exhibit E to be vacated will be
dedicated to the City as a part of the final plat for the Subject Property; and
WHEREAS, on April 12, 2013, the City received a request by the property owner and petitioner
for the vacation of public right-of-way, two public sanitary sewer easements and a public water
main easement; and
WHEREAS, after notice of a public hearing on said request was provided, a public hearing was
held on vacation, SAV #13-01 for these easements by the Planning Commission on May 15,
2013; and
WHEREAS, the final plat of the Subject Property, to be known as COLUMBIA ARENA
ADDITION, is before the City Council tonight, June 24, 2013, for approval; and
WHEREAS, the property owner, William Fogerty, and the petitioner, Carlson McCain, was
presented with Exhibit F, the stipulations for SAV #13-01, at the June 24, 2013, City Council
meeting; and
WHEREAS, a copy of the EASEMENT VACATION EXHIBIT has been attached hereto as
Exhibit G; and
NOW THEREFORE, BE IT RESOLVED that:

1. Conditioned on and subject to the stipulations set forth in Exhibit F to this Resolution,
said stipulations being incorporated herein by reference, the City of Fridley vacates
the following easements situate in the City of Fridley, County of Anoka, State of
Minnesota,
a. City of Fridley, public road easement per document no. 78098 (see legal
description attached as Exhibit B)
b. City of Fridley, sanitary sewer easement per document no. 247307 (see legal
description attached as Exhibit C)
c. City of Fridley, water main easement per document no. 308807 (see legal
description attached as Exhibit D)
d. City of Fridley, sanitary sewer easement per document no. 308808 (see legal
description attached as Exhibit E)

SAV#13-01 Vacation Request for Owner William Fogerty and Petitioner Carlson McCain
Stipulations
1. Owner, William Fogerty, and petitioner, Carlson McCain shall provide the City with the quit
claim deed transferring the property from William Fogerty and Carmel Fogerty to Columbia
Development, LLC (the "Quit Claim Deed").
2. The easement vacations authorized by this Resolution shall only be effective upon
contemporaneous filing and recording of the Quit Claim Deed, a certified copy of this Resolution
and related Exhibits, the trail easement and the parking easement set forth in greater deal in City
zoning application P.S. #12-01 and the recording of the COLUMIA ARENA ADDTION plat(the
"Plat");
3. The easement vacations authorized by this Resolution and related Exhibits shall not serve to
vacate any public easements dedicated by the COLUMBIA ARENA ADDITION plat;
4. The owner, William Fogerty, and the petitioner, Carlson McCain, delegate to and authorize the
City to file and record the legal documents contemplated by and involved with the platting of the
Subject Property in City zoning application P.S. #12-01, including but not limited to the Quit
Claim Deed, the Plat, the vacation of the easements identified in this Resolution and related
Exhibits, and the conveyance of the rail and parking easements set forth in greater detail in City
zoning application P.S. #12-01 (collectively the"Development Documents").
5. In the event the Development Documents are not filed and recorded by August 30, 2013, the
vacations of the easements identified in Exhibits B through E and authorized pursuant to this
Resolution are hereby null and void.

INTRODUCTION
The property at the south west corner of 52nd Street and Taylor Avenue is legally described as: Lot 11,
Block 2, Marian Hills 2nd Addition.A public hearing was set for June 24th, 2013,to have Council
consider the request to deem the property excess and authorize the sale thereof. Unless the public
hearing reveals reasons to act otherwise; staff, recommends first reading of the attached ordinance that
same evening.
RECOMMENDATION
Staff recommends that Council approve the attached Ordinance declaring Lot 11, Block 2, Marian Hills
2nd Addition excess property and authorize the sale thereof.

ORDINANCE NO.
AN ORDINANCE UNDER SECTION 12.06 OF THE CITY CHARTER DECLARING
CERTAIN REAL ESTATE TO BE SURPLUS AND AUTHORIZING THE SALE
THEREOF.
SECTION 1. The City of Fridley is the fee owner of the tract of land within the City of
Fridley, Anoka County, State of Minnesota, described as follows:
Lot 11, Block 2, Marian Hills 2nd Addition
SECTION 2. It is hereby determined by the City Council that the City no longer has
any reason to continue to own said property, and the City Council is
hereby authorized to transfer the above described to a private party,to be
named upon completion of negotiations.
SECTION 3. The Mayor and City Clerk are hereby authorized to sign the necessary
contracts and deeds to affect the transfer of the above-described real
estate.
