1973 Fencing AGREEMENT THIS AGREEMENT entered into this 5 day of , 1973, by and between ©e4--e, ,t,✓ -- 4°.tt� hereinafter designated as "Owners", and the City of Fridley, a municipal corporation, County of Anoka, State of Minnesota, hereinafter referred to as the "City". WHEREAS, the Owners have requested that the City allow the place- ment of fencing across the following described property: That property lying between Lot 1, Block 5, City View and Lot 15, Block 6, City View, from 57th Avenue N.E. to 57th Place N.E.; as shown on the attached map which is made part of this' agreement, and; WHEREAS, the Owners understand that the above described property is a public right of way, and; WHEREAS, the Owners and the City understand that sanitary sewer and storm sewer piping exists in the public right of way, and; WHEREAS, the City understands that the public right of way is not presently open to through traffic. NOW THEREFORE, it is agreed as follows: 3( 1. The City shall allow the Owners, at their own expense, to place a fence across the above described property in the following location: On the South property line of 57th Place and on the North property line of 57th Avenue. 2. In the event the public right of way is required for use by the City and/or other utility companies, the Owners, at their own expense, shall remove and/or replace the fence; Agreement Page Two 3. That after placement of the fencing, the inaccessible portion of the public right of way shall be maintained by the abutting property owners.
