Dear Ms. Graves:
Enclosed you will find a Quit Claim Deed to Mr. and Mrs.
Nielsen for Lot 11, Block 20, Fridley Park. It will be necessary
for this document to be executed by the City and then sent to the
county for recording. I have been in contact with Mr. Nielsen
and I have informed him that we do not have an Abstract for the
property so consequently what we will be doing is merely provid-
ing him with a Quit Claim Deed and that he will not be receiving
an Abstract. I would suggest that you should be able to handle
this closing in your office by merely receiving from Mr. and Mrs.
Nielsen a $1,000.00 check and showing to them the executed Quit
Claim Deed which you will be recording. In addition, you should
have them sign a notice which should read as follows:
"Maynard and Elaine Nielsen, the Grantee(s) in a Quit Claim
Deed from the City of Fridley for Lot 11, Block 20, Fridley
Park, Anoka County, do hereby acknowledge that they are waiv-
ing and releasing the City from any liability or respon-
siblity for providing an Abstract for the subject property. "

Dear Maynard:
On September 24, 1984 the Fridley City Council approved the rezoning of your
property located off East River Road from R-1 to R-3. Ordinance 817 rezoning
your property was published on October 1, 1984 and the rezoning became offical
fifteen days after that date. There is no expiration date on this acticn,
however the property was rezoned for the purpose of constructing the proposed
loft homes on this site. Therefore any changes in the proposed development of
this property would need City Council approval. Please inform the City of
your intended use of the property as soon as it becomes known.
An additional issue that needs to be resolved is whether or not you wish to
purchase Lot 11, Block 20, Fridley Park. The City has agreed to the sale of
this property to you for $1,000. Please inform us of your decision on this
matter so that the City Attorney can draft the appropriate documents to
transfer title.

WHEREAS, the City Council has determined certain City owned properties in
Fridley are excess; and
WHEREAS, the excess properties are described as follows:
1. Lot 14, Block 1, Blcmberg Estates
2. Lot 15, Block 1, Blomberg Estates
3. Lot 16, Block 1, Blomberg Estates
4. The West 80 feet of the South 150 feet of Lot 6,
Auditor's Subdivision No. 129

MUTUAL AGREEMENT

This agreement made and entered into this day of
1984 by and between Maynard Nielson and Robert DeGardner, hereinafter
called the "Owner/Developer" and the CielY of Fridley, a Municipal
Corporation of the State of Minnesota, hereinafter called the "City".
WHEREAS, 1 Owner/Developer has requested City Council approval for a
rezoning from R-1 (one family dwellings) to R-3 (general multiple
dwellings) for part of Lots 3 and 21, not taken for street purposes, and
all of Lots 4-10 and 14-20, Block 20, Fridley Park. This action requested
to allow the constrution of twenty eight loft home units.
IN CONSIDERATION of this rezoning approval , the City and the
Owner/Developer, do hereby agree as follows:
1. The Owner/developer will revfse the berm layout on 61 1/2 Way so
as to block headlights from shining into the adjacent homes.
2. To accomplish Item #1 the Owner/Developer will shift the Fire
Truck emergency egress to the east. A curb cut will be provided
in the parking lot and Class V will be installed under this
emergency egress. No curb cut will be provided in the street.
3. The Owner/Developer agrees to construction nine new garages with
the initial construction of housing. These garages will be •
located in the southeast corner of the proposed lot. The garages
shall be finished in a similar fashion as the Loft Homes so as to
be consistent in character.
4. The Owner/Developer will provide to the City and register with
Anoka County a copy of an executed Towhouse Protective Covenant.
5. The Owner/Developer will submit for approval a complete landscape
and irrigation plan.
6. The Owner/Developer will submit for approval a drainage plan
7. The Owner/Developer agrees to purchase and rezone to R-3 Lot 11 ,
Block 20, Fridley Park. Purchase price shall be $1,000.
• 8. The Owner/Developer will provide a Performance Bond in the amount
of $10,000.
9. The Owner/Developer agrees to pay the City a Pork Fee of $500.00
per unit, or $14,000 for the twenty eight unit . This payment is
due prior to the issuance of any building permits.

10. The Owner/Developer agrees to build only the types of units
described as Loft Homes. These to consist of twenty eights units
of housing divided into the following arrangements: a. three
connected groups of four units each b. two connected groups of
four units each c. two groups of four units.
IT IS MUTUALLY AGREED that the provisions of this agreement shall be
binding and enforceable against the parties hereto, their successors and
*signs and all subsequent owners of the property here described.

Ms. Metcalf stated the Fridley League of Women Voters studied the matter of
solid waste disposal and supported a collection center for recyclables in
Fridley. She stated this past year the League studied solid waste disposal, e
particularly as it affects Fridley's householders.
Ms. Metcalf stated, as a result of the study, the League of Women voters
supports private crier municipal trash hauling for the City; does not support
trash hauling districts for the City; supports hauling fees based on the
volume of trash per household; supports door-to-door pickup of recyclables;
supports a municipal composting program; and encourages all businesses in
the City to recycle.
Ms. Metcalf stated this information is submitted to the Council to stimulate
and encourage actions which will reduce dependency on landfills and induce
residents to reuse materials and recycle.
She stated the League supports the City in its private trash hauling
position and believes residents would reduce their waste, if they had to pay
according to the number of trash cans or bags filled each week. She stated
the League also supports a municipal composting program.
Ms. Metcalf stated door-to-door or curbside recycling is now established in
many of the surrounding cities and others are planning pilot projects.
Ms. Metcalf stated the new Metropolitan Council Chairperson, Sandra
Gardebring, stated there is no alternative to landfill abatement, we must
reduce our waste.
Ms. Metcalf stated the League of Women Voters urges the Council and
administration to implement programs to encourage recycling and a compost
program. She stated she appreciated the`opportunity to present this
ooncensus to the Council.
Mayor Nee suggested it may be beneficial for Ms. Metcalf to attend the
Council's next conference meeting to further discuss this issue.

Ni Mr. Flora, Public Works Director, stated a mutual agreement has been

developed addressing the construction of 28 Loft Home units by Mr.
DeGardner. He stated in consideration of the rezoning request, the
owner/developer agrees to the following: revise the berm layout on 61-1/2
Way so as to block headlights from shining into the adjacent homes; relocate
the emergency egress to the east; construct new garages; provide to the
City, and register with the County, a copy of an executed Townhouse
Protective Covenant; submit a landscaping and irrigation plan for approval;
submit a drainage plan for approval; purchase and rezone to R-3, Lot 11,
Block 20, Fridley Park; provide a performance bond of $10,000; pay park fees
of $14,000 ($500 per unit) ; and to build only the types of units submitted
as Loft Haines.
Mr. Flora stated both the owner, Mr. Nielson, and the developer, Mr.
DeGardner, have signed this mutual agreement.
MOTION by Councilman Fitzpatrick to authorize the City to enter into this ?('
mutual agreement with Mr. Nielson and Mr. DeGardner for development of the
Loft Haines. Seconded by Councilman Barnette. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously.
MOTION by Councilman Fitzpatrick to waive the second reading of Ordinance
No. 817 and adopt it on the second reading and order publication. Seconded
by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee
declared the motion carried unanimously.
NEW BUSINESS:
3. itECEIVING STATEMENT OF CANVASS FOR THE SEPTEMBER 11, 1984 PRIMARY ELECTICK
MOTION by Councilman Hamernik to receive the statement of canvass. Seconded
by Councilman Schneider.
Iman, City Clerk, stated there was a canputer error in the results for
•�`� Ratte and Simoneau in Ward 3, Precincts 3 and 4, and the results should be
exactly opposite of what is presented. He stated the canvass board for the
County will meet regarding this issue.
It was the consensus of the Council to wait until the canvass board met to
determine their action, before receiving this statement of canvass.
Councilman Hamernik withdrew his motion with permission of the seconder,
Councilman Schneider.
LOTION by Councilman Barnette to not receive the statement of canvass at
this time. Seconded by Councilman Schneider. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously.
