RESOLUTION NO. 2013 - 38
A RESOLUTION APPROVING SPECIAL USE PERMIT SP# 13-07 FOR CBRE, INC. ON
BEHALF OF FIRSTCAL INDUSTRIAL 2 ACQUISITIONS, THE PROPERTY OWNER
FOR THE PROPERTY LOCATED AT 5155 EAST RIVER ROAD NE
WHEREAS, Section 205.18.01.C.12 of the Fridley City Code allows limited outside storage in an
M-2 zoning district by a Special Use Permit if certain conditions can be met; and
WHEREAS, on July 17, 2013, the Fridley Planning Commission held a public hearing to consider a
request by CBRE, Inc., for the property generally located at 5155 East River Road in Fridley,
legally described as Lot 2 through 4, Block 2, Outlot R and Lot 1, Block 4, all in Great Northern
Industrial Center, subject to easement of record, for a Special Use Permit, SP#13-07 for limited
outside storage; and
WHEREAS, at the July 17, 2013 meeting, the Planning Commission unanimously recommended
approval of Special Use Permit, SP #13-07; and
WHEREAS, on August 12, 2013, the Fridley City Council approved the stipulations represented in
Exhibit A to this resolution as the conditions approved by the City Council on Special Use Permit
SP# 13-07; and
WHEREAS, Section 205.05.5.G of the Fridley City Code states this special use permit will become
null and void one year after the City Council approval date if work has not commenced or if the
petitioner has not petitioned the City Council for an extension; and
WHEREAS, the petitioner, CBRE, Inc., was presented with Exhibit A, the stipulations for SP# 13-
07, at the August 12, 2013 City Council meeting and has agreed to abide by said stipulations in
order to maintain Special Use Permit SP# 13-07;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fridley that Special
Use Permit SP# 13-07 and stipulations represented in Exhibit A are hereby adopted by the City
Council of the City of Fridley.

EXHIBIT A
SP# 13-07 Special Use Permit for Limited Outdoor Storage
CBRE Inc., 5155 East River Road NE, Fridley, MN 55432
Stipulations
1.Outdoor storage area shall be limited to the square footage amount requested as part of
this special use permit request.
2.Screening fence shall be installed within 60 days of tenant occupying the site.
3.The types of materials stored inside of the containers shall be reviewed by the Fire
Marshal.
4.Per Section 205 of the Fridley City Code, this Special Use Permit will become null and
void one year after the City Council approval date if work has not commenced or if the
Petitioner has not petitioned the City Council for an extension.
