That part of the Northeast Quarter of Section 10, Township 30, Range 24, Anoka County, Minnesota described as follows:
Beginning at the intersection of the easterly right of way line of County State Aid Highway No. 1 (also known as East River Road) as
delineated on Anoka county Highway Right -Of -Way Plat No. 28 and a line parallel to and 556.6 feet southeasterly of the southeasterly
boundary of Aus Addition; thence northwesterly along said right of w' y line h distance of 99.66 feet to an intersection with a line 457.00
feet southeasterly of and parallel to the southeasterly boundary of Aus Addition; thence northeasterly and parallel to said southeasterly
boundary of Aus Addition a distance of 371.33 to an intersection with the westerly of the right of way of the Northern and Pacific Railroad;
thence southeasterly along said railroad right of way line a distance of 100.43 feet to an intersection with a line parallel to said southeasterly
boundary of Aus Addition which passes through the point of beginning; thence southwesterly a distance of 355:16 to the point of beginning.
SCOPE OF WORK:
1. Showing the length and direction of boundary lines of the above legal description. The scope of our services does not include
determining what you own, which is a legal matter. Please check the legal description with your records or consult with competent
legal counsel, if necessary, to make sure that it is correct, and that any matters of record, such as easements, that you wish shown on the
survey, have been shown.
2. Showing the location of existing improvements we deemed important.
3. Setting new monuments or verifying old monuments to mark the comers of the property.
4. We notice that the southeasterly boundary on Aus Addition, Anoka County, Minnesota, is labled "Line parallel with and 556.6 feet
northerly from the southerly line of Lot 6 ", referring to Lot 6 in Auditor's Subdivision No. 77 and that the 556.6 foot dimension matches the
total of the four 90 foot tracts, one 97 foot tract and the 99.6 foot tract that is being surveyed. We have surveyed and marked the boundary
of this property based on that relationship and notice that the southerly line of Lot 6 in Auditor's Subdivision No. 77 seems to be the same as
the southerly line of Lot 8 in Revised Auditor's Subdivision No. 77. We notice that there is about 7 or 8 feet of extra land southerly of this
tract so surveyed to the centerline of Osborne Road as established by the plat of Osborne Commerce Center compared with the distances
shown on Auditor's Subdivision No. 77. This location of the boundaries of this parcel gives this parcel and the parcels to the north
everything their deeds say they should have in frontage along East River Road and leaves more than enough for the parcels to the south and
is one way of interpreting conflicting information in the deed records but only a court has jurisdiction to decide the boundaries of such a
parcel and if absolute certainty is required and deemed worth the time and expense of pursuing a registration of title and boundaries then that
should be done.
