Minneapolis, MN 55435 RE: EG-608 SUBSURFACE INVESTIGATION SPUR STATION #2446 6485 East River Road Fridley, MN 55432 Dear Mr. Andelin: Pursuant to your verbal authorization on January 31, 1990, Braun Environmental Labs Inc., (BRAUN) has completed a subsurface investigation at the above referenced site. The investigation, consisting of the installation and sampling of five standard penetration tests borings, was completed as part of a rezoning application. The remainder of this letter describes the methodology utilized and the data gathered in completion of this investigation. Five soil borings were completed on-site at locations selected by you (Figure 1). All five borings were advanced to a termination depth of 201/2-feet below grade. Penetration tests borings were performed with a truck mounted core and auger drill. Sampling for the borings was conducted in accordance with the ASTM D1586 "Penetration Tests and Split Barrel Sampling of Soils". Using this method, the borehole was advanced with a hollow-stem auger to the desired test depth. Then, a 140 pound hammer falling 30-inches drove a standard, 2-inch OD, split barrel sampler a total penetration of 11/2-feet below the tip of the lead Hite of the hollow- stem auger. The blows for the last foot of penetration were reported and are used an index of soil strength characteristics and for stratigraphic correlation. Samples EG-608 Murphy Oil USA, Inc. -2- February 15, 1990 were taken at 21/2-foot intervals to the termination depth of each boring (see attached boring logs). Soils encountered in the borings were visually and manually classified in the field by the crew chief in accordance with ASTM D2487 "Unified Soils Classification System" and an ASTM D2498 "Recommended Practice for Visual and Manual De-scription of Soils". A copy of ASTM D2487 is attached. All samples were then returned to the laboratory for review of the field classifications by BRAUN environmental geologists. Representative samples will remain in our Minneapolis office for a period of 60 days to be available for your examination. During the field investigation, soil samples were visually examined by an environmental professional for staining or other signs of apparent contamination. In addition, soils were scanned for the presence of organic vapors using a photoionization detector (PID). The PID was equipped with a 10.2 electron volt lamp and was calibrated to a benzene equivalent. The PID was used to test fresh surfaces of soil retrieved in the split barrel samples, bore hole cuttings brought to the surface during drilling, and using jar headspace procedures (see attached organic field data sheets). Soil conditions observed in the borings consisted of 3 to 912-feet of sandy fill overlying coarse alluvium to the termination depth of the boring. Groundwater was not encountered in any of the five borings advanced on-site. Based on topographic data groundwater is estimated to be approximately 40 to 50-feet below grade on-site. The regional groundwater flow is assumed to be to the west, with discharge to the Mississippi River. Contaminant screening of soils recovered from the boring was completed with a PID and utilizing visual and olfactory observations as criteria. With the exception of the sample collected at 5-feet below grade in ST-2 no evidence of subsurface contamination was noted on-site. The PID readings recorded in the ST-2 sample were 2 parts per million (ppm) above background levels of 0 to 1 ppm in the split spoon sample and 10 ppm above background levels utilizing head space criteria. Visual review of the sample indicated that wood coated with a creosote like material was present. Further drilling completed at ST- 2 indicated that a large void space (approximately 5-vertical feet) was present immediately underlying the sample containing the wood. It is inferred that when this portion of the site was back-filled, railroad ties or similar materials were buried. In conclusion, field observations indicate that subsurface contamination associated with the storage of petroleum products was not detected in the samples retrieved from the borings. The soil borings were advanced as close as site constraints would allow to the existing tanks and pump islands. Although the borings did not encounter groundwater (estimated to exist 40 to 50-feet below grade on-site) soils samples were collected and screened from depths BRA unTM EG-608 Murphy Oil USA, Inc. -3- February 15, 1990 assumed to be below the base of the tanks. Based on evidence available from BRAUN's field observations it appears unlikely that a large scale leak or loss of petroleum products has occurred on-site. However, future investigations in different locations of the site may yield different results, at which time BRAUN will be pleased to review our conclusions. Due to the likely presence of structurally unsuitable materials in the vicinity of ST-2, additional geotechnical investigation is recommended if future construction is planned for that area of the site. Services performed by the geologists and environmental scientists for this project have been conducted in a manner consistent with that care and skill ordinarily exercised by members of the profession currently practicing in this area under similar budget and time restraints. Mr. Gary Andelin, from Murphy Oil, conducted the meeting. Only two neighbors attended the meeting. On February 20, 1990, the Appeals Commission reviewed the variance request by Murphy Oil, and recommended approval of the variance to the City Council, contingent upon approval of the special use permit and rezoning requests. (7) ) . These parcels are addressed as 6443 and 6485 East River Road N.E. Site Located on Lot 10 is a convenience store/gas station. A single family home with a three car garage is located on Lot 33 . The petitioner is proposing to remove the existing structures on both sites and construct a new convenience store/gas station. Analysis The C-1, Local Business, zoning district requires that a special use permit be granted for a motor vehicle fuel and oil dispensing service. Currently, Lot 33 is zoned R-1, Single Family Dwelling. The petitioner has applied for a rezoning to rezone this parcel to C-1, Local Business, with the existing Lot 10 which is currently zoned C-1, Local Business. In addition, the proposed site plan requires that two variances be granted for the hardsurface setback and the building setback from the public right-of-way. The Appeals Commission recommended approval of these variances on February 20, 1990. The new site plan meets the C-1 code requirements and provides adequate green space to screen and buffer the residential parcels on the east and south portions of the site from the proposed use. The petitioner has also responded to the Engineering Department's concerns about increased traffic safety at the site by proposing to relocate and close some of the existing driveways to facilitate better traffic maneuvering. Anoka County has reviewed the plans and is recommending that the driveway closest to Mississippi Street be closed. It is staff's opinion that access to the site from East River Road should occur at two places, as the site has employee parking at the south. The petitioner is revising the radius on the driveway to discourage existing traffic for travelling northbound. This issue should be resolved with Anoka County prior to issuance of the building permit. The petitioner has conducted soil tests to check for underground contamination from the existing petroleum tanks, and the results of these tests have been reviewed by the City Engineering Department. The test results found that there is no contamination on the site, and new tanks with monitoring devices will be installed as required by MPCA and the Uniform Fire Code. sc Staff Report SP #90-01, Murphy Oil Page 3 Mr. Philip Franklin, 6437 East River Road, attended the February 20, 1990 Appeals Commission meeting and raised the issue of a lack of an identified sidewalk which the City would maintain along East River Road. Staff met on site with Murphy Oil and it was agreed that Murphy Oil would construct a sidewalk five feet wide which would accommodate the City's snow removal equipment. Recommendation Staff recommends that the Planning Commission recommend to the City Council approval of the request, SP #90-01, pending approval of the variances and the rezoning, and completion of any stipulations related to those requests. The proposed request meets the minimum standards in Section 205. 13.01.C. (7) of the zoning code. The proposed request reduces the traffic hazards and increases the buffering and screening between the two zoning districts. Staff recommends the following stipulation for the special use permit for approval: 1. Reconstruct the existing sidewalk to a minimum width of five feet from the south property lines around the site to the northeast corner. 2 . Drainage calculations shall be submitted to the Engineering Department prior to issuance of a building permit. 3 . The driveway issue shall be resolved with Anoka County prior to issuance of a building permit. 4 . Approval of the variance request. Planning Commission Action The Planning Commission voted unanimously to recommend to the City Council that the special use permit request by Murphy Oil be approved with the stipulations as recommended by staff. Discussion by the Planning Commission included the issues of the location of the northern-most driveway on East River Road, the location of the privacy fence proposed by the petitioner, and the amount of standing water, if any, that would be in the detention pond. Commissioner Dahlberg recommended that the fence be relocated so that the proposed landscaping would be on the residential side of the fence. In addition, the Commissioners recommended that the northern most driveway on East River Road be moved an additional 15 to 20 feet farther south. Anoka County has recommended that this driveway be closed. The petitioner is continuing to work with Anoka County regarding this issue. The petitioner has submitted a revised site plan incorporating the recommended changes. The proposed detention pond has been designed to drain completely, so there will be no standing water on site. The petitioner will need to submit a final grading plan. The first curb cut east- bound on Mississippi Street will be closed and the two curb cuts on East River Road will be shifted further south away from the intersection. There is some concern as the right turn lane onto Mississippi from East River Road curves in front of those two driveways. Anoka County has reviewed this plan and has recommended, although no correspondence has been received, to close the northernmost driveway on East River Road. The petitioner is proposing to shift that driveway even farther south and change the radii on that driveway such that it will allow a northbound exit from that driveway but will have the appearance of a one-way in only. There will be adequate space for cars to go in and out at the same time; however, it is the intent through the design to discourage people from exiting northbound on East River Road. Ms. McPherson stated the petitioner has been very cooperative and has worked with City staff in trying to find a solution that will work for both the petitioner and lessen the traffic hazards at this corner. Ms. McPherson stated, as stated by Mr. Barna, Mr. and Mrs. Franklin who live directly south of this site are concerned about the existence of a sidewalk of some kind along the west and north property lines of this parcel. In order to catch the public school bus on Ashton Avenue, their children need to walk along that sidewalk to Ashton Avenue. Ms. McPherson stated the Engineering and Planning staff met with the petitioner on site to discuss the issue of the sidewalk. Mr. Franklin brought up some issues of maintenance. He is currently clearing the snow on the paved -area that is there now, because the area is not wide enough for the City's snow removal equipment. The petitioner will be removing the existing asphalt paving and will be constructing a concrete sidewalk at a slope that will be adequate for the City's snow removal equipment. In addition, there is an existing power pole on the site that narrows the amount of room needed to construct a sidewalk. The petitioner has spoken with the utility company, and the utility company will be moving that pole so the 5 ft. wide sidewalk can be constructed along the west property line. So, the sidewalk issue has been resolved. Ms. McPherson stated staff recommends the Planning Commission recommend to City Council approval of the special use permit with four stipulations: 6G PLANNING COMMISSION MEETING, MARCH 14, 1990 PAGE 9 1. Reconstruct the existing sidewalk to a minimum width of five feet from the south property lines around the site to the northeast corner. 2. Drainage calculations shall be submitted to the Engineering Department prior to issuance of a building permit. 3. The driveway issue shall be resolved with Anoka County prior to the issuance of a building permit. 4 . Approval of the variance request Mr. Dahlberg asked if a grading and drainage plan has been submitted. Ms. McPherson stated a grading and drainage plan has been submitted. It is the petitioner's intention to have an infiltration trench in the grassy area directly to the east of the building. Additional drainage will occur toward the green area at the south of the site. That has also been left for snow storage and drainage. Mark Winson, Assistant Public Works Director, has not yet received the drainage calculations. Mr. Dahlberg stated this project really should have little impact on the neighbors to the east except for the two closest residences to the east. Mr. Saba asked about the store's operating hours. Mr. Andelin stated the hours are up to the lessee; however, it has been a 24 hour operation, and they wish to continue that. Mr. Kondrick asked about lighting. Has there been complaints about lighting into the neighborhood? Ms. McPherson stated she has not received any complaints about lights or the current operation. Mr. Andelin stated at the present time, they have area lights on the entrances and egress. They try to keep maximum lighting for security purposes. The lights are wall mounted and on the canopy. He stated he can foresee no area lights in back of the building, but they do try to keep as much lighting as possible at the entrances for traffic. The canopy lights do give a majority of the lighting. They will keep the lights to a minimum on height, so the lighting will not go over into the residential properties. Mr. Saba asked about any plans for a P.A. system. -PLANNING COMMISSION MEETING, MARCH 14, 1990 PAGE 10 Mr. Andelin stated they are required by law to have an intercom system. This is used mainly to contact people at the gas pumps. It is not a loud system. Mr. Barna asked about any plans for signage. Mr. Andelin stated that at the present time, they will not be changing the signage. The sign will remain in approximately the same location as it is now. Mr. Dahlberg stated staff can review the existing condition of the signage and review the requirements of the Sign Ordinance with the petitioner. Mr. Dahlberg stated the present lessee stores his mobile home on the site a great percentage of the time. He believed the Planning Commission would like that not to be there. He would not suggest that this concern be part of the approval of the special use permit, but is there anything the petitioner can do about it? Mr. Andelin stated that as part of their lease package, this type of storage is not supposed to be happening. Mr. Dahlberg stated he thought the site plan is a significant improvement over the existing site. He would like to discuss a possible change to what has been proposed. He stated the property line is very close to the two residences on the east, and the parking and hard surface is being moved away from that property line. He would suggest that this be turned around and the fence and landscaping be put on the opposite side of the fence, rather than having the fence towards the residence and landscaping on the service station side. He would think the neighbors would rather look at greenery than a wooden fence and the neighbor would perceive his yard as being larger. The issue is that it is a maintenance headache for the owner of the property, because they have to go outside their property to maintain the landscaping and pick up litter along the fence. If the fence could maybe not follow the property line but could cut off on a diagonal by the trees and put some landscaping on the residence's side, it would seem to be a more neighborly approach. This is a suggestion for the petitioner to consider. Mr. Dahlberg stated another concern is whether or not there is standing water in the ponding area. He believed there are requirements relative to fencing around detention and retention ponds. With standing water, there is potentially a hazard for children. This may or may not be a problem, but it is something that should be investigated. y 61 PLANNING COMMISSION MEETING, MARCH 14, 1990 PAGE 11 Ms. McPherson stated Mr. Winson may be looking at this issue when he looks at the drainage calculations and the volume of water that would be retained. Mr. Dahlberg stated he concurred with the County relative to the northernmost curb cut onto the site from East River Road. The revised sketch indicates that the north edge of that curb cut is 100 ft. probably from the center line or edge of the traffic lane on Mississippi Street, but not 100 ft. from the turn lane. He felt that the curb cut is too close to that intersection, even though it does have a configuration such that it will draw traffic in and potentially discourage people from going back out, it will not discourage people entirely from going out that curb cut. He would suggest that curb cut be no farther north than the present south curb cut. This is a busy intersection, and a lot of traffic goes east on Mississippi Street off East River Road. Mr. Andelin stated that as long as the variance is not affected, he is certainly willing to have LBH Architects look at it. Mr. Dahlberg stated he has no difficulty with the two curb cuts on East River Road as long as the northernmost curb cut is moved to the south at the location of the present southerly curb cut which he feels is a reasonable distance from the intersection, even to the extent that vehicles could make that right turn and head north onto East River Road without too much difficulty. Mr. Dahlberg stated the County has given them no information as to why they are recommending only one curb cut on East River Road. Mr. Dahlberg stated that on the southerly curb cut, it appears to him that as traffic is heading into the parking area, it is better to design that curb cut 90 degrees perpendicular to the street rather than perpendicular to the parking area. It is just a better design for access to that parking area at the south. This is just another suggestion for the architect to consider. City staff met with Mr. Gary Andelin of Murphy Oil and Jerry Putnam, the project architect, on-site on Monday, March 5, 1990, and determined that it would be possible to reconstruct the existing asphalt paving with concrete at a width that would allow the City's snow removal equipment to access the sidewalk. Murphy Oil has contacted the power company and will be relocating the existing power pole in order to widen the sidewalk to the minimum width of five feet. Mr. Mark Winson, Assistant Public Works Director, has contacted the maintenance division of the Public Works Department in order to see if snow removal by the City maintenance equipment would be possible if the sidewalk was reconstructed. Once the sidewalk has been reconstructed by Murphy Oil, the City will begin to be responsible for the snow removal on the sidewalk. Said storm sewer is located approximately 200 feet south of the project sight and there is a catch basin located on the east side of East River Road. For that reason it would seem logical that the four inch PVC discharge line from the pumping station could be constructed along East River Road to discharge into said catch basin. The discharge of a half cubic foot per second of flow into the curb line of East River Road is unacceptable from a safety perspective. In addition in reviewing the plan we note that there are two driveways proposed on East River Road and one proposed on Mississippi Street. We would submit that one access on each street should be sufficient and would request that the city limit access to two driveways one on each roadway. In addition all of the sites should be graded so that his water flows into the pond first and into the storm sewer system rather than discharging directly out the driveway entrances onto the roadway. We think that i* would be easier and less expensive to remove the lilacs , l (one) pine tree and 1 (one) locust tree while the new construction is in progress. We think that an 8 (eight ) foot Cyclone fence with Vinyl inserts , which is to be built on a mound of dirt; would provide more privacy and more protection for our property. It would also keep debris from blowing through onto our property and there also would be less up keep than with a wooden fence . We think that by planting the Buckthorn shubbery every 2 ( two) feet apart , along the east side of the fence would make a very attractive view. Some of the disadvantages of a wooden fence are : 1 . All present agreed that removal of the existing lilacs bordering John Kimbler's property is an acceptable course of action. 2 . All present agreed that the fir tree growing among the lilacs, to the southwest of the Spur building, should remain. It was decided, however, that the black locust growing inside Murphy Oil's south property line should be removed. 3 . Dewey and John recommended removal of the lilacs along Murphy Oil's south property line. Barbara agreed to consult the property owners immediately to the south of the construction site about such action. 4 . Pending approval by Murphy Oil Inc. , all lilacs will be replaced by approximately (40) Columnar Buckthorn Shrubs (Rhamnus frangula 'Columnaris' ) . These shrubs shall be no less than three feet tall at the time of planting and shall be spaced at five feet on center. 5. The existing wooden screen fence shall be replaced by a new wooden screen fence. All present agreed that the 3/4" board spacing on the new fence will be sufficient to prevent any trash from blowing onto John Kimbler's property. He indicated that he was aware of the situation and had instructed the landscaping contractors to return to the site to make the necessary corrections. I stated that I wished to be present in a meeting with all parties involved prior to the sodding and landscaping replacement.
