$65,000 MORTGAGE. DO YOU'KNOW HOW MANY SINGLE FAMILY
HOMES THERE ARE IN FRIDLEY FOR SALE? THE ANSWER IS ALOT,
BUT NOT ONE OF THEM IS UNDER $65,000.
SO, SOMEONE SAYS TO MOVE INTO AN APARTMENT. THE PROBLEM
WITH THAT IS WE HAVE A DOG AND VERY FEW APARTMENTS IN THE
AREA ACCEPT DOGS AND THOSE THAT DO ARE BASICALLY OUT OF
OUR PRICE RANGE AS WELL.
FACT OF THE MATTER IS AT 611 LAFAYETTE STREET THE MORTGAGE
PAYMENT WAS $430.00 A MONTH AND THE APARTMENT WE HAD TO
MOVE INTO IS ALMOST $850.00 A MONTH. THE ISSUE BECOMES
THAT OUR INCOME STAYED THE SAME.
I COULD CONTINUE TO GIVE YOU WHAT MAY SEEM LIKE A SOB
STORY, BUT THEY ARE JUST FACTS.
I ALWAYS GREW UP WITH THE IDEALISTIC VIEW OF "FRIENDLY
FRIDLEY,' WELL, THAT BELIEF WAS SHATTERED INTO A MILLION
PIECES.MY IMAGE OF FRIDLEY NOW IS THAT THEY WANT TO
"REMOVE" ALL LOWER INCOME PEOPLE FROM THE TOWN BECAUSE I
WOULD SUSPECT THAT THE 50 FOOT LOTS PROBABLY CONTAIN
"AFFORDABLE" HOMES. MOST OF THESE FAMILIES ARE ALSO
PROBABLY UNAWARE OF YOUR ORDINANCES AND WHEN TRAGEDY
STRIKES WILL ALSO BE TOLD BY THE CITY "TOUGH LUCK".

Dear Mr. Saxe:
This letter will serve as notification to you that a building permit to repair the above structure will not be
issued by the City as the structure is a nonconforming structure and has been damaged more than 50% by
the fire. According to Section 205.04.03.3D, of the Fridley Zoning Code, "Whenever a lawful nonconforming
structure is damaged by fire, flood, explosion, earthquake, tornado, riot, or act of God, it may be
reconstructed and used if it is reconstructed within 12 months after such calamity, except if the damage
to the building or structure is fifty percent (50%) or more of its fair market value, as determined by the City,
in which case the reconstruction shall be for a use in accordance with the provisions of this chapter".
The building itself is assessed at a value of $23,000.00 and the estimate for fire repairs is $25,000.00.
Therefore the City of Fridley will not allow the structure to be repaired but must be demolished.
If you desire to rebuild on this site, a variance must first be approved for lot area by the City Appeals
Commission. Other variances may be required depending on the type of dwelling that will be constructed.
The City of Fridley will allow you 30 days to remove the structure and clean the site of all demolition debris.
A demolition permit will have to be applied for and the utilities must be disconnected at the property line.
We should also get a final reading, if possible, from the water meter and remove the meter from the building.

The purpose of this letter is to extend the timeframe previously established to demolish
the structure at 611 Lafayette Street N.E. The structure must be demolished and the
site cleaned of all demolition debris by 5:00 p.m. on Monday, March 2, 1998. A
demolition permit must be obtained and the utilities disconnected at the property line. A
final reading from the water meter should also be obtained prior to removing the meter.
On Tuesday, February 5, 1998 1 spoke to Michael Pakkala at United Claims and verified
that the City cannot issue a building permit for the repair of the structure, nor the
reconstruction of a house, according to Sections 205.04.03.B and D of the Zoning
Code. He stated that he will be in contact with you regarding the final disposition of
your claim.
I would also like to suggest some options regarding the sale of your property. You may
inquire as to whether your adjacent property owners are interested in purchasing half or
all of your property, or the City of Fridley Housing & Redevelopment Authority (HRA)
may agree to purchase the property as well. Should you wish to negotiate with the
HRA, please feel free to contact me.

Dear Representative Johnson:
Councilmember Ann Bolkcom contacted me on Thursday, February 12, 1998,
requesting that I mail you a copy of the correspondence from Barbara and Gary Saxe, a
copy of the appropriate code section pertaining to nonconforming properties, and any
other information to help explain the situation at the Saxe's home at 611 Lafayette
Street.
On December 23, 1997, a fire occurred at 611 Lafayette Street. The Fire Department
responded and extinguished the fire and made an estimate of damage to the property
of approximately $25,000 at that time,. It is typical for the Fire Department to estimate
the valuation of the damage at the time of the incident.
The building itself is assessed at a value of $23,000. According to Section 205.04.03.13
and D of the Zoning Code, a lawful nonconforming structure cannot be repaired or
reconstructed if the damage of the building is 50% or more of its fair market value. I
met with Mr. and Mrs. Saxe on December 24, 1997, and reviewed the Zoning Code
information with them and gave them copies of a variance application form..A letter
was also sent to Mr. and Mrs. Saxe on January 8, 1998.
The lot is nonconforming because it is only 5,000 square feet in size. The minimum lot
size for this type of platted lot is 7,500 square feet. Previous to this incident, the City
received a variance request in the summer of 1997 to build a new structure on a similar
sized lot in the same neighborhood. At that time, the City Attorney advised that
granting a variance for this sized lot would establish a precedent, and the City would
have to evaluate similar requests in a favorable manner. Because of the number of
small sized lots in the City and because the City Council determined that building on
this sized lot was not appropriate, the Council denied that variance request. This
standard also applies to 611 Lafayette, even though the structure was damaged by a
fire. The intent of the nonconforming section of the ordinance is to encourage
conformity to the standards in the ordinance.

In September 1997, the City contacted the homeowners under the auspices of our
scattered site acquisition program. The Housing & Redevelopment Authority (HRA)
conducted a systematic assessment of homes in the City and determined those homes
that would be eligible under state statute for acquisition. As you know, this is a
voluntary program, and the HRA inquired whether Mr. and Mrs. Saxe would be willing to
sell their property. At that time, they were not prepared to sell, because there was at
least a year remaining on a second loan which they had taken on the property in 1989.
Since the fire occurred, City staff has tried to cooperate and respond to the inquiries
that the homeowners have made on several occasions. -I believe there may be some
confusion as to what the City is required to do in these instances. In a letter received
on February 9, 1998, the Saxes state that, "No one from the City, to our knowledge, has
ever went through the house to see actual damages and give an estimate of what they
feel it would cost to repair to make it structurally sound." On December 23, 1997, the
Fire Marshall did, in fact, provide the estimate of the actual damage from the fire. The
City's building inspectors are not required to provide an estimate for homeowners.
Typically, either the homeowner or the insurance company hires a contractor to provide
an estimate of the damage and submits the information to the City. Then, if the
estimate and work meets the City Code, the contractor files for a building permit.
The letter of February 9, 1998, also indicated that the Saxes were retaining a contractor
not associated with "any agencies involved in these discussions". This quote was
received from Donahue Construction, Inc., on February 9, 1998. The City building
inspector and fire inspector will be inspecting 611 Lafayette Street and will evaluate this
proposal to determine if it is adequate to render the property to a livable and safe
condition. The Donahue estimate was $11,457, just below 50% of the assessed
valuation. The estimate does not include costs for backspraying and sealing of smoke
and the fire damage in the interior of the building. This type of work is typically done to
eliminate the odor. The estimate also does not include repairs that are needed to the
electrical wiring. The result of the Friday afternoon inspection may reveal additional
areas which I would be happy to communicate to you next week.
The February 9, 1998, letter from Mr. and Mrs. Saxe states that the Fridley Fire
Department's total damage estimate is approximately $4,000. This is not true. An
estimate of approximately $25,000 was made and communicated to the Saxes on
January 8, 1998. Subsequent to this letter, Richard Larson, Deputy Chief Fire Marshall,
wrote a memo to the City Manager detailing the cost estimates for the damage and
verified the amount of the estimates.

Further, I recently sent a letter to the Saxes dated February 6, 1998, extending the
deadline to have the building demolished by March 2, 1998. 1 also suggested that the
HRA would be interested in negotiating for the acquisition of the property.
The next step is to render a determination on the most recent estimate submitted by
Donahue Construction and to work with the Saxes to see if they would be interested in
selling their lot. Please refer to the January 30, 1998, memo from myself and Grant
Femelius regarding more background on this issue.
The City is trying to work with the homeowners at every available opportunity and will
continue to do so. If you have any questions, please do not hesitate to contact me at

$18,300 for a number of years. My response was that the $18,300 value
was based on a saleable property prior to the damage of the fire, which
unfortunately left the site unbuildable. He disagreed with my remarks and
said he would contact me with a counter offer. I told him I was not optimistic
about the HRA offering beyond what is in essence $8,000 ($3,000 plus
demolition costs).
In the meantime, I have asked Ed Hervin to review the appraisal which was
completed for the HRA and to advise me on his approach regarding the land
value of the lot.
The counter offer, once received, will be discussed with you and then we
can determine our next step. The HRA postponed action on the acquisition
until some type of an agreement can be reached.

worker is and arrange a meeting to find out how he/she will approach the
case. It will be important for the case worker to understand the history of the
case and the necessity to clean the property according to the ordinance.

Ron Julkowski advised me that about 100 square feet of work is remaining.
Unfortunately, the cold weather will make it difficult to complete the
brickwork immediately since the temperature should be around 38 degrees.

This is to notify you that I will extend the demolition deadline for the structure at 611
Lafayette Street to March 31, 1998, in order to provide additional time for your clients to
resolve this issue with the City. The previous deadline had been March 2, 1998, as
stated in my letter to the Saxes dated February 6, 1998.
Also, your clients contacted Councilmember Ann Bolkcom regarding the lot area and lot
width of 623 Lafayette Street which the HRA had sold to a private homebuilder to
construct a new house. The City vacated 50 feet of the Broad Avenue right-of-way and
conveyed that to the HRA who, in tum, also acquired Lot 26, Block C, and combined
the two parcels for one tax parcel. The lot area for this parcel totals approximately
11,800 square feet. The lot width is 106 feet. Mrs. Saxe was alleging that the HRA
built a home on a substandard lot. I can assure you that this is not the case.
Please contact me at your earliest convenience regarding the City's proposal for 611
Lafayette Street as outlined in my letter dated February 25, 1998.

Dear Ms. Saxe:
Per your telephone request of February 19, 1998, we offer the
following information on the above noted address.
The Building Inspection records indicate no building permits were
issued for this address between May 8, 1989, when a building permit
for siding was issued, and December, 1997 when a fire damaged the
structure. We did issue a plumbing permit (copy enclosed) on May
28, 1996 for a replacement water heater, gas range and gas dryer.
Enclosed are copies of the Fire Department reports you requested
covering the fires that occurred at this address on April 24, 1996

Ms. Saxe said she was drying some clothes when the dryer started to make a thumping noise. She
turned it off and went next door to get a neighbor's advice. When she tried to enter her house it was
full of smoke. Neighbors called the fire department.
Upon arrival I opened the back door to the laundry room. I observed a fire on top of the dryer
(basket of clothes) that had extended to the shelves above the dryer location. The fire was
extinguished with 1-1 % inch handlines.
The fire appeared to start in the rear of the Westinghouse gas dryer (15+ years old) as evidenced by
heavy burn and char pattern on rear of dryer.

1 have been involved in the repair of fire damaged houses for over 30 years. I
have carefully inspected the damage at the above referenced property, and it is in my
opinion that this property is very repairable. There is minimal structural to the siding,
wall studs and roof rafters. The building is not compromised structurally. The majority
of dollar value for repair is sheetrock, trim, cabinets, cleaning and decorating. There is

SUBJECT: 611 Lafayette Street
On Friday, February 13, 1998, Ron Julkowski, Dick Larson, Barry Riesch, and I met
with Mrs. Saxe and contractors from Donahue Construction and JB Contractors at 611
Lafayette Street. The purpose of the inspection was to review the bid submitted by
Donahue Construction of Spring Lake Park for $11,457.00.
After our inspection and review of the bid, it was determined that the proposed bid did
not include key repairs and costs that would bring the structure and the interior to a
livable and safe condition. The bid did not include electrical wires. The bid did not
include the cost for installing and connecting the water heater and ventilation
equipment. The bid did not include the costs for back spraying and sealing the smoke
damage. The bid did not include correcting the damage to the metal piping. The bid
did not include cleaning the walls and windows from smoke damage.
Foam was used to extinguish the fire. It is very important to clean this chemical from all
surfaces to eliminate dangerous vapors which emit into the atmosphere. The foam will
also corrode metal piping. It is typical to replace the metal piping. The bid did not
include these costs.
The Saxe's have contacted the Anoka County Mediation Service, who, in turn,
contacted Bill Hunt. The City indicated that it is more than happy to meet with them in
mediation hearings. Further, as of Thursday, February 19, 1998, the staff person at
Anoka County Mediation advised me that the Saxe's have retained an attorney. The
attorney has apparently sent me a letter, which I have not seen as of the writing of this
memo.
Once I have reviewed the attorney's correspondence, I will be contacting Fritz Knaak
and will be meeting with you regarding our response and approach on this issue. In the
meantime, I may extend the deadline for the demolition of the house beyond the
previously established March 2, 1998 deadline.

The work being done to repair the fire damage will assure the house to be structurally sound.

DETAILS OF INVESTIGATION:
Ms. Saxe said she was drying some clothes when the dryer started to make a thumping noise. She
turned it off and went next door to get a neighbor's advice. When she tried to enter her house it was
full of smoke. Neighbors called the fire department.
Upon arrival I opened the back door to the laundry room. I observed a fire on top of the dryer
(basket of clothes) that had extended to the shelves above the dryer location. The fire was
extinguished with 1-1 3/ inch handlines.
The fire appeared to start in the rear of the Westinghouse gas dryer (15+ years old) as evidenced by
heavy burn and char pattern on rear of dryer.
