The Inspector of Buildings shall, before issuing permits for the erection of any building or structure, or for any addition to any existing building or structure, or for any alteration or repairs to any existing building or structure, upon application therefore, require the payment -by the applicant for such permit of fees to the amount herein below set forth and in the manner herein provided to -wit: UNIFORM BUILDING CODE: Type 1, 2 & 4 - $2.15 for each one thousand cubic feet, or fraction thereof, in such cubical contents. Type 3 & 5 - $1.85 for each one thousand cubic feet. ADDITIONAL INFORMATION For the purpose of computing fees for building permits, the cubical contents of any building or addition, is determined by multiplying the ground area covered from a point six (6) inches below the floor line of the basement or the cellar to the average heights of the upper surface or to the average., height of the roof surface of the main gable of a pitched roof. For repairs or alterations to'an existing structure, the fee shall be at the rate of $3.00 per each five hundred dollars ($500.00) or fraction thereof in the cost of all proposed work. UPON.A VOICE VOTE, ALL VOTING AYE, CHAIRWOMAN SCHNABLE DECLARED THE PUBLIC HEARING OPEN AT 7.s44.P.M. Chairwoman Schnabel read the staff reports ADMINISTRATIVE STAFF REPORT 7419 Lakeside Road N.E. A. PUBLIC PURPOSE SERVED BY REQUIREMENT: Section 205.053, 4C, requires a rear yard depth of not less than 25 percent of the lot depth, with a minimum of 25 feet and no • more ,than 40 f eet required. Public purpose served by this requirement is to provide rear yard space to be used for green area which enhances the neighborhood. 0 K Appeals Commission Meeting February 12, 1980 __Page 2 STATED HARDSHIP: The hardship is financial in that the existing house and the addition both need the variance and to make the structure conform to Code would entail moving the entire house or tearing it down and building a new'one. C. AD14INISTRATIVE STAFF REVIEW: The-Persings to date have not supplied us with the evidence to substantiate a financial hardship; 'the difference between building the addition with garage and house modifications versus building - a new house in front of the existing house and then removing the existing house. The existing house appears to be built on a slab some thirty years ago and the garage is about ten years old and may also have a slab foundation. Both structures have hip roofs and therefore both roofs would have to be modified if the addition was placed between the two existing structures. The City would require that both existing structures have frost footings unless an engineer designs and certifies the connection between the new and existing structures. Given all these facts, we question the economic savings, if any, between the requested addition and the cost of building a new house'in front of the existing one. Other advantages, such as a larger rear yard, would be gained by building a new house. We would.certainly not discourage the planned improvements to this lot, however we do feel the petitioner should study every aspect of the improvement. If the Board approves this request, the staff would recommend the stipulation that the foundation and structural connections between the new and the old portions be designed'by an engineer and that since the improvement consists of more than half the value of the house, the existing house must be made to meet all existing buildinq Codes. Mr. Persing, the petitioner, was present for the request. The Commission members, along with Mr. Persing studied the survey, and plans of the proposed addition. Mr. Persing stated that the addition was needed for extra living space, and that it was financially feasible for them to add an addition on to the present structure, and bring the present structure up to code, easier, than it would be if they had to build a new home, then having to remove the present structure, because they still have a mortgage on the present home. Appeals Commission Meeting February 12. 1980 Pale 3 Mr. Persing further stated that they are -looking into all the different aspects, and arrangements in obtaining more living space. He stated that they wanted the variance granted at this time, so that they would be able to get . estimates from the necessary people for this addition. He stated that then they would further explore the difference financially, of this . proposed addition, versus building a new structure on this lot and thei removing the ,old house. Ms. Schnabel questioned Mr. Persing on their plans for the roof line? Mr. Persing stated that they would have to convert it from the present gable roof to a hip roof. Ms. Schnabel questioned if the -Persings had planned on having the work done for them by a contractor, or if they planned to do most of the work themselves? Mr. Persing stated that they would have some of the work such as the framing, etc., done for them, and they would do most of the finishing themselves. He further stated that they wanted to get the outside completed, so that it wouldn't be an eyesore to the neighborhood, and then complete the interior as time and money permitted. Ms. Schnabel questioned if whether they had spoken to any of the neighbors about this addition? Mr. Persing stated that'the contact that they have had with some of the neighbors, nothing negative was said about the addition. He further stated that they have lived there for about two and one-half years. Mr. Barna questioned if they were going to have someone do the excavating, and the blockwork? Mr. Persing stated that yes they would have someone contracted for that work. Ms. Schnabel, questioned Mr. Clark to what the City would require Mr. Persing to do in terms of tying together the existing slab, and the new addition together? Mr. Clark stated that if the Persing's would excavate down to expose the block, the City then could come out ,-nd.determine iif they would need an engineer design the foundation _system. Discussion ensued on the various methods, and means of tying the two structures together. Mr. Clark stated that he would recommend that the Persings look into the aspect of having a new home built. He stated Appeals Commission Meeting February 12,1980; Page 4 that in rough figures he felt that it would cost about $10,000 more to have a new home built, and that would only give them about 134 square feet less room than having an addition put on. Mr.Clark further stated that at this time the bank that he checked with was -only allowing a maximum of $15,000 for home improvement loans.. Mr. Persing stated that he was aware of the maximum of 'the' $1.5,000 for home improvements, and that he would check into both building a new home and putting on the addition. Ms. Gabel questioned the petitioners to what type of heat they now have? Mr. Persing stated that they now have electric heat, so that with the addition, they would have to have a new furnance installed. MOTION by Ms. Gabel, seconded by Mr. Barna, to close the Public Hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRWOMAN SCHNABEL, DECLARED THE PUBLIC HEARING CLOSED AT 8:15 P.M. Mr. Barna stated that he had no problem with the back, side or front yard setback, because of the parks in the area, and the other house alignments in the neighborhood. Iais. Schnabel stated that she was impressed with the obvious care that this house has been given, so that she stated, she felt confident, that any work that the petitioners would do would be done well. MOTION by Ms. Gabel, seconded by Mr. Barna to approve Variance Request pursuant to Chapter 205 of the Fridley city code, to reduce the rear yard setback from the required 35 1/2 feet ( 23%, of the lot depth) to 22 feet, to allow the construction of a 23 ft. by 34 ft. addition that will connect an -existing house and garage, located on Lot 11, Block 1, Dalberg Addition, the same being 7419 Lakeside Road N.E. (Request by Gregory Pe. -sing, 7419 Lakeside Road N.E., Fridley, Minnesota 55432) with the following stipulations: 1. That the foundation, and the structural connections between the new and the old portions be designed by ali engineer. 2. The existing house must be made to meet all existing build- ing codes. 3. If the petitioner does in the future decide to build in front of the existing house, a new house, that.the existing house not be used as a residence. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRWOMAN SCHNABEL, DECLARED THE MOTION CARRIED UNANIMOUSLY.
