SECTION 2. The Inspector of Buildings shall, before issuing permits
for the erection of any building or structure, or for any addition to any
existing structure or building, or for any alteration or repairs to Any
existing building or structure, upon application therefore, require the
payment by the applicant for such permit of fees to the amount herein
below set forth and in the manner herein provided to -wit:
Uniform Building Code: Type 1, 2, & 4 - $1.75 for each one thousand
cubic feet, or fraction thereof, in such cubical cantents. Type 3 & 5 -
$1.50 for each one thousand cubic feet.
For the purpose of computing fees for building permits, the cubical
contents of any building or addition to a uniform height throughout by
multiplying the ground area covered from a point six (6) inches below
the floor line of the basement or the cellar to the average height of
the upper surface or to the average height of the roof surface of the
main gable of a pitched roof.
For repairs or alterations to an existing structure, the fee shall be
at the rate of $3.00 per each five hundred dollars ($500.00) or
fraction thereof in the cost of all proposed work.
In no case shall the fee charged for any permit as set forth in Section
2 be less than $5.00.

NOTICE IS HEREBY GIVEN that the.Appeals Commission of the City of
Fridley will meet'in the Council Chamber of the City Hall at 6431
University Avenue Northeast on Tuesday, December -13, 199 at 7:30 P.M.
to consider the following matter:
Request for variance of the Fridley City Code,
Section 205.053, 4, (B,4) to reduce the required
five foot side yard.for an attached garage to
2.69 feet, for an existing attached garage, located
on the North 86 feet of the South 197 feet of Lot 1,
Audi'tor's Sulidivisfon No. 129, the same bring 7470
Lakeside Road N.E., Fridley, Minnesota. (Request

A. PUBLIC PURPOSE'SERVED BY REQUIREMENT:
Section 205.053, 4, B,4, requiring a side yard setback of 5 feet
from an attached garage i'n an R-1 zone.
Public purpose served is to provide open space between structures
to reduce conflagration of fire, to provide access to the rear
yard in emergencies, and to limi't the condition of crowding in the
residential neighborhood.
B. STATED HARDSHIP:
Without clearing up the encroachment, it may be difficult to sell
the property.
C. ADMINISTRATIVE STAFF'REVIEW:
The original premit application showed that the builder fully
intended to have 9 ft. of space between his garage and the north
property line. Obviously the builder misplaced the structure on
the lot. The matter has been confused by two surveys which differ
by 1.1 foot. Thus this request is for the most conservative survey
distance which shows the petitioner's garage to be 2.69 feet from
the property line. The house to the north is 20 feet from the
petitioner's garage.

Legal Description
The North 86 feet of the South 197 feet of Lot 1, AUDITOR'S
SUBDIVISION NO. 129, Anoka County, Minnesota. Subject to street
easement over the East 25 feet thereof and utility and drainage
easement over the West 6 feet thereof.
Request for Variance
About 7 years ago, Ray E. Teague bought a house on the described
property. The belief of all parties concerned was that the garage
attached to the house was 9 feet from the North lot line. Sub-
sequent surveys have shown the garage to be somewhere between 4
feet and 2.69 feet from the North lot line. Mr. Teague has removed
a fence and a shed that were encroaching upon the property to the
North and now asks the City of Fridley for a variance from the
normal 5 foot set back requirement from his garage to the North lot
line to avoid any title problems at the time.of future sale of his
property.

Mr. John W. Terpstra, an attorney at law representing
Mr. Ray E. Teague, was present at the meeting,
ADMINISTRATIVE STAFF REPORT
A. PUBLIC PURPOSE SERVED BY REQUIR - 4ENT:
Section 205.053, 49 B, 4, -requiring a side yard setback
of five feet from an attached garage in an R-1 zone.
Public purpose served is to provide open space between
structures to reduce conflagration of fire, to.provide
access to the rear yard in emergencies, and to limit
the condition of crowding in the residential neighborhood.
B. STATED HARDSHIP:
Without clearing up the encroachment, it may be difficult
to sell the property.
C. ADMINISTRATIVE STAFF REVIEW:
The original permit application showed that the builder
fully intended to have nine feet of space between his
garage and the north property line. Obviously the
builder misplaced the structure on the lot. The matter
has been confused by two surveys which differ by 1.1 foot.
Thus, this request is for the most conservative survey
distance which shows the petitioner's garage to be
2.69 feet from the property linea The house to the north
is 20 feet from the petitioner's garage.
Mr. Holden explained that there was a confusion as to which
survey was correct. He pointed out that it was not the intent
at the Appeals Commission to try to decide which survey was
correct. He said that in filling out the variance request they
had taken the most conservative distance.
Mr. Terpstra indicated to the Appeals Commission the survey
that was being used. He said that they.wanted to use the
most conservative survey to take care of any problems that could
arise in the future.
Mr. Holden indicated that Mr. Teague had requested the
second survey to be done. He pointed out that the City files
showed that the builder had intended the house to be
constructed to meet all codes. However, he said, that during
construction the positions were altered.
Chairperson Schnabel asked when the house had been constructed.
Mr. Holden said that it had been constructed in 1969.
Mr. Terpstra said that Mr. Teague was not presently
planning to sell the property involved. He said that
Mr. Teague had moved his fence and shed and he wanted the
entire matter cleared up.
Mr. Plemel asked if Mr. Teague was the original owner.
Mr. Terpstra said that Mr. Teague had not been the original
owner.
Mr. Barna asked what the distance was between Mr. Teague's
house and the adjacent structure.
Mr. Holden said that it was 20 feet between structures.

MOTION by Mr. Plemel, seconded by Ms. Gabel, to close the
Public Hearing. Upon a voice vote, all voting aye, the motion
carried unanimously. The Public Hearing was closed at 7:54 P.M.
Ms. Gabel had no objections to the request. She said that
it was merely a matter of "house cleaning".
Mr. Plemel didn't feel that the petitioner should be
penalized for something that happened before he bought the
property.
Mr. Barna said that he agreed with Mr. Plemel. He said
that Mr. Teague was ending up with less property than he
believed that he had when he purchased the property.
Chairperson Schnabel felt that the intent of the
Public Purpose was being met. She said that there was adequate
distance between the structures.
MOTION by Mr. Barna, seconded by Ms. Gabel, that the
Appeals Commission approve the request for variance of the
Fridley City Code, Section 205.053, 4, (B,4), to reduce the
required five foot side yard for an attached garage to 2.69 -feet,
for an existing attached garage, located on the North 86 feet
of the south 197 feet of Lot 1, Auditor's Subdivision No. 129,
the same being 7470 Lakeside Road N.E., Fridley, Minnesota.

This letter is to inform you that the variance request for 7470 Lakeside
Road, before the Fridley Appeals Commission last night, was approved. The
setback of 2.69 feet from the garage to the north property line was
approved without stipulation or contention, therefore no further hearings
will be required before the Planning Commission or City Council.
