of an addition to the existing home and garage on Lot 11, Block 2, Spring Lake

On September 10, 2003, the Fridley Appeals Commission officially approved a request for
variance, VAR #03-19, to reduce the rear yard setback from 30 feet to 23.79 feet to allow the
construction of an addition to the existing home and garage on Lots 10 & 11, Block 2, Spring Lake
Park Lakeside Addition, generally located at 7500 Lakeside Drive NE, with the following
stipulations:
1. The petitioner shall obtain all necessary building permits prior to construction.
2. The proposed addition shall be architecturally compatible with the existing home and
finished with complementary siding and color scheme.
You have one year from the date of the Appeals Commission action to initiate construction. If
you cannot begin construction during this time, you must submit a letter requesting an
extension at least three weeks prior to the expiration date.

REQUEST
Petitioners, James and Jennife�S edberg are seeking a variance to reduce the rear
yard setback from 30 feet to 1 -Ieet to allow for the construction of an addition to
their existing home and garage which is located at 7500 Lakeside Road.
SUMMARY OF HARDSHIP
"Our garage has been rendered useless for a number of years now due to water runoff
from the city street during even a normal rainfall. The floor of the garage sits lower than
the street and water follows the driveway into it. The inside of the house poses a more
serious problem. The existing stairs are too steep to meet today's building code. As
we get older it will become more and more of a problem, not to mention more
dangerous. There is no room in the existing structure to extend the stairs out, so we
have remedied the situation by putting a new set of stairs in the new addition."— see

ANALYSIS AND CODE REQUIREMENTS
The property is zoned R-1, Single Family as are all surrounding properties. The lot is
rectangular shaped and the home is positioned so it fronts on Lakeside Road, however
75' Avenue is considered the code required front yard. The lot dimensions are 73.63
ft. by 120.01 feet, therefore, the property doesn't meet the R-1, Single Family code
requirements for lot area and lot width. However, the lot falls into the 0-6 overlay
zoning district that was approved for small lots that were created prior to December 29,
1955. The existing home was built in 1950, with a deck constructed in 1998.
Existing Home
City Code requires a rear yard setback with a depth of not less than twenty-five (25%)
of the lot depth. The subject property has a lot depth of 120.01 feet; therefore a rear
yard setback of 30 feet is determined. Due to the positioning of the home on the lot, the
petitioners are requesting a variance to reduce the rear yard setback from 30 feet to
12.19 feet to allow for the construction of an addition to the existing home and garage.
The proposed addition meets all other setback and lot coverage requirements. City
staff hasn't received any comments from neighboring property owners.
RECOMMENDATIONS
City Staff has no recommendation as similar variances have been granted in the past.

Dr. Vos stated that this is one of the corner lots where the rear yard is like the side yard.
The petitioners, James and Jennifer Swedberg, stated they had clothing to add, but
would be available to answer any questions.
Mr. Kuechle asked the petitioners if they were agreeable to the stipulations.
Mr. and Mrs. Swedberg said that they were agreeable to the stipulations. Mr. Swedberg
said the addition would look similar to the existing house.
Mr. Zinter asked the petitioners how they were going to deal with the issue of the garage
slab being lower than the street.
Mr. Swedberg said that the new garage floor would be raised above street level so it
would eliminate any water coming into the garage.
Chair Kuechle asked the petitioner how many square feet would the new addition have.
Mr. Swedberg stated the new addition would be 700 sq. ft. with the garage and addition
to the house.
Mr. Jim Maki, 7520 Lakeside Road, stated he was the,petitioners' neighbor and he is
supportive of the Swedberg's request.
Mr. Ben Kasper, neighbor of the petitioners, stated his concern had been that the home
would be too close to the other home next to it. However, after seeing the plans, he said
that there would be plenty of room between the two houses. He was very happy to see
the new development.
MOTION by Mr. Jones, seconded by Dr. Vos, to close the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED
THE MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING CLOSED AT
8:15.
Mr. Kuechle indicated that the Commissioners received four letters supporting the
petitioners' request and a letter from Ms. Jill Dutcher, 7550 Lakeside Road, at the start of
the meeting.
MOTION by Mr. Jackson, seconded by Mr. Jones, to receive into the record a letter from
Ms. Jill Dutcher, 7550 Lakeside Road, supporting the petitioners' variance request.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED
THE MOTION CARRIED UNANIMOUSLY.
Upon discussion of the request, the Commissioners agreed that this was a reasonable
request.

Dear Ladies and Gentlemen:
This letter is in regards to the variance we need to complete the building project on our
house. We hope it helps put some perspective on why we believe this addition to our
house is necessary.
Our garage has been rendered useless for a number of years now due to water runoff from
the city street during even a normal rainfall. The floor of the garage sits lower than the
street and water follows the driveway into it. Winter is especially harsh because of the
sun melting snow during warmer days and the runoff making its way into the garage and
freezing at night. Our car has actually been frozen solid in the garage. A new garage will
be raised above street level and will be large enough to have some storage space, which is
something we are greatly lacking at this time.
The inside of the house poses a more serious problem. The existing stairs are too steep to
meet today's building code. As we get older it will become more and more of a problem,
not to mention more dangerous. There is no room in the existing structure to extend the
stairs out, so we have remedied the situation by putting a new set of stairs in the new
addition. They are wider, less steep, and should be much, much easier to climb as we get
older. It will also be nice to have a bathroom upstairs where we sleep. As it is now, we
have to navigate the steep set of steps in the dark once the lights go out.
We would like to thank you for this chance to explain our thinking, and we hope it helps
speed us through this process.
