PUBLIC HEARING: VARIANCE REQUEST, VAR #0316 BY BRYAN RIEDEMANN: Per Section 205.07.03.D.(3).(a) of the Fridley Zoning Code, to reduce the rear yard setback from 25 feet to 21 feet to allow the construction of a three -season porch on Lot 3, Block 1, Ouimette Terrace, generally located at 7609 Lakeside Road NE MOTION by Dr. Vos, seconded by Mr. Jones, to open the public hearing and waive the full reading of the public notice. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING OPENED AT 7:36. Ms. Stacy Stromberg, Planner, stated the petitioner, Bryan Riedemann, on behalf of the property owners at 7609 Lakeside Road, is requesting a variance to reduce the rear yard setback from 25 feet to 21 feet to allow the construction a three -season porch off the east side of the existing home. Ms. Stromberg stated the property owners' hardship reads: "We would like to install the three season porch on the east side of the lot behind the garage. This is the only logical place to attach to our home without altering the structure of the house or removing trees. We currently use the backyard quite often as a sitting area. We would have great use of a three -season porch. This would give us protection from the sun and heat." . y I NOVEMBER 12, 2003 APPEALS COMMISSION MEETING PAGE 2 , Ms. Stromberg stated the property is zoned R-1, Single Family, as are all surrounding properties. The lot is 9,414 square feet and is located on the comer of Lakeside Road and 76u' Avenue. The home is positioned so it fronts on Lakeside Road. Ms. Stromberg stated the City Code requires a rear yard setback depth of not less than 25% of the lot depth. The subject property has a lot depth of 100 feet; therefore, the rear yard setback is 25 feet. Due to the positioning of the home on the corner lot, the petitioner is requesting a variance to reduce the rear yard setback from 25 feet to 21 feet to allow the construction of a three -season porch on the east side of the existing home. Ms. Stromberg stated the proposed addition meets all other setback and lot coverage requirements. City staff has no recommendation as similar variances have been granted in the past. If the Commission approves the variance request, staff recommends the following stipulations: 1. The petitioner shall obtain all necessary building permits prior to construction. 2. The proposed addition shall be architecturally compatible with the existing home and finished with complementary siding and color scheme. 3. No decks, stairs or other appurtenances shall extend closer than 15 feet to the rear property line. Mr. Bryan Riedemann, Manager of 3 Seasons & 4 Sunrooms, stated he and the homeowners are in agreement with staffs presentation and the recommended stipulations. A petition was sent to the surrounding neighborhood, and he believed the Commissioners had a copy of those signed petitions. All those neighbors indicated they were in favor of this variance. MOTION by Ms. Jackson, seconded by Mr. Jones, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING CLOSED AT 7:39 P.M. Dr. Vos stated he believed this was a reasonable request because of the shallow lot. Ms. Jackson agreed with Dr. Vos. Since the neighbors are not objecting to the variance request, she would vote to approve the variance. Mr. Blaine stated he agreed and would vote to approve the variance. Mr. Kuechle also agreed. The total lot coverage is adequate. Since the addition will be 30 feet off the road, it is not going to appear as an overbuilt lot. He would also vote to approve the variance. MOTION by Dr. Vos, seconded by Mr. Jones, to approve variance request, VAR #03-20, by Bryan Riedemann, to reduce the rear yard setback from 25 feet to 21 feet to allow the construction of a three -season porch with the following stipulations: 1. The petitioner shall obtain all necessary building permits prior to construction. 2.
