Dear Mr. & Mrs. Krack:
On Monday June 8, 2009, the Fridley City Council officially approved your extension until June
11, 2010, for the Variance, VAR #08-02, to reduce the rear yard setback from 25 feet to 18 feet
9 inches, to allow the construction of a 20 foot by 23 foot living addition off the back of the
home, legally described as the South 85 feet of Lot 19, Block 1, Spring Lake Park Lakeside,
subject to easement of record, generally located at 7629 Lakeside Road NE.
Approval of this variance is contingent upon the following stipulation:
1. Petitioner shall obtain all necessary building permits prior to construction of addition.
2. Addition shall be architecturally compatible with the existing home and finished with
complementary siding and color scheme.
You have until June 11, 2010, to initiate construction. If you cannot begin construction during
this time, you must submit a letter requesting an extension at least three weeks prior to the
expiration date.

INTRODUCTION
On June 11, 2008, the Appeals Commission unanimously approved variance request, VAR
#08-02 to reduce the rear yard setback from 25 feet to 18 ft. 9 in. to allow the construction of a
20 foot by 23 foot living addition off the back of the home of John and Caroline Krack. The
petitioner's home is located at 7629 Lakeside Road.
After receiving approval of the variance last summer, the petitioner put the project on hold, but
would now like to reactivate it and hope to begin construction this summer. As a result, the
petitioner's would like to request a one-year extension.
PLANNING STAFF RECOMMENDATION
City Staff recommends approval of a one-year extension for the construction of the petitioner's
addition until June 11, 2010.

Stacy Stromberg, City Planner, stated the summary of hardship is as follows: "We use our back
yard very little and would like to convert some of it into living space. It should be noted that the
property to our rear has a very large open yard, so this project would not result in any impact on
out neighbor's privacy or sight lines,,and will not alter the character of the neighborhood." Also
provided is a hardship statement.
Ms. Stromberg stated the subject property is zoned R-1 Single Family as are all surrounding
properties. The property is located south of Osborne Road on Lakeside Road. The existing
home was constructed in 1964 and the detached garage was constructed in 1965. This lot is in
the 0-6 Overlay District, which was created to allow the expansion and new construction on lots
created and recorded prior to December 29, 1955, that are between 5,000 and 7,499 square feet
in size. This overlay not only recognizes smaller lot sizes as conforming, it also allows for more
compatible setback and lot coverage requirements other than a typical single family lot.
Ms. Stromberg stated the 0-6 Overlay district requires a rear yard setback of twenty-five (25)
feet. The petitioner's would like to construct a 20 ft. by 23 ft. (460 sq. ft.) addition off the back
of their house. This addition would have a full basement underneath. The petitioner's plan to
utilize the proposed addition as a family room on the main level and a workshop in the basement.
Ms. Stromberg stated the subject property and proposed addition will comply with all other
code requirements, including but not limited to setbacks and lot coverage.
Ms. Stromberg stated City staff has heard from one neighboring property owner who expressed
that they don't have any problems with the proposed addition.
Ms. Stromberg stated City Staff has no recommendation as similar variances have been granted
in the past as follows:
VAR #05-02 7310 Jackson Street
Variance approved to reduce the rear yard setback from 28 ft. to 17.3 ft. for a 4 season
porch addition.
VAR #05-03 1383 76`x' Avenue
Variance approved to reduce the rear yard setback from 29 ft. to 16 ft. to allow a living
addition.
Ms. Stromberg, stated. Staff_ recommends that if the variances , are granted, the following
stipulations be attached.
1. Petitioner shall obtain all necessary building permits prior to construction, of addition.
2. Addition shall be architecturally compatible with the existing home and finished with
complementary siding and color scheme.
John Krack, Petitioner, stated he thinks all the details are in the application that they submitted.
He would just like to say that they have been in Fridley since 1980. They like the location and
would really like to stay here but feel they need a little more space to kind of spread out. They
would hope the Commission would see fit to grant their petition.

Mr. Vos asked the petitioner as they looking over the addition to the back yard, is it one or two
properties that his property comes across to?
Mr. Krack stated the property immediately to the east has a very large backyard. The primary
area they would see is that yard, but then they can actually see across the yard into the one that
starts right next to it.
Mr. Vos asked before any of the houses on the north end on the corner of that lot?
Mr. Krack replied, that is correct.
Mr. Vos asked, because the one that comes from the south from McKinley, that is a pretty short
lot as well?
Mr. Krack replied, their neighbor to the south, yes, that is a relatively small lot. The way those
lot lines are established, his rear lot line is the same as theirs.
Mr. Vos stated the impact is really on one rear yard.
Mr. Krack replied, yes, 1624.
Mr. Vos commented all the other ones do not have any overlap with the petitioner's back yard.
Mr. Krack replied, as far as buildings that is correct. For 7609 there actually will not be any
overlap because they will be to the north of their garage, and the garage is really what overlaps.
Mr. Vos stated the neighbor to the north has quite a bit of growth, a wall, etc.
Mr. Krack stated he has talked to their bordering neighbors to the north, the south, and the east.
All of them have indicated they see no problem with what they want to do.
MOTION by Commissioner Vos to close the public hearing. Seconded by Commissioner
Blaine.
UPON A UNANIMOUS VOICE VOTE, CHAIRPERSON SIELAFF DECLARED THE
MOTION CARRIED AND THE HEARING WAS CLOSED AT 7:15 P.M.
Mr. Vos stated he thinks it is a reasonable request for a variance. The lot is short. You cannot
build much. He does not know what it was, but he thinks the petitioner had it in his petition how
little bit you could build out the back of the home and still stay within the setback. That would
not be very economically feasible but it would not give them any space either. He is comfortable
with this kind of variance. Mostly because if you look at the affected properties, with the big
backyard, it is not right up against another home. So he would vote in favor of it.
Mr. Jones stated he is comfortable with the same reasons plus the small lot is sort of constricted,
and the good news is that the one property it does affect the most it has a relatively large yard.
Also, the petitioner has talked to all his neighbors. He will vote in favor of it.
Mr. Sielaff stated he did not have any problem with it either.
MOTION by Commissioner Vos approving Variance, VAR 08-02, by John & Caroline Krack,
to reduce the rear yard setback from 25 feet to 18 feet 9 inches, to allow the construction of a 20

Osborne Road on Lakeside Road. The existing home was
constructed in 1964 and the detached garage was
constructed in 1965. This lot is in the 0-6 Overlay District,
which was created to allow the expansion and new
construction on lots created and recorded prior to December
29, 1955, that are between 5,000 and 7,499 square feet in
size. This overlay not only recognizes smaller lot sizes as
conforming, it also allows for more compatible setback and lot
coverage requirements other than a typical single family lot.
The 0-6 Overlay district requires a rear yard setback of
twenty-five (25) feet. The petitioner's would like to construct
a 20 ft. by 23 ft. (460 sq. ft.) addition off the back of their
house. This addition would have a full basement underneath.
The petitioner's plan to utilize the proposed addition as a
family room on the main level and a workshop in the basement.

STIPULATIONS
Staff recommends that if the variances are granted, the following stipulations be attached.
1. Petitioner shall obtain all necessary building permits prior to construction of addition.
2. Addition shall be architecturally compatible with the existing home and finished with
complementary siding and color scheme.
Request for Variance — Justification
We've lived in this house since late 1980. We like the location, and prefer not to relocate. As we move
into our senior years and spend more time at home, we want more space to entertain, work on projects,
and "spread out". We use our back yard very little, and would like to convert some of it into living
space. We also plan to update siding and windows on the rest of the house to give it a more modem
appearance and make it more energy efficient.
We would like to put an addition, with a full basement, on the rear of the house, to project 20 feet into
the rear yard. The basement would become a workshop, and the upstairs would be a family room. Due
to our lot size, this would result in a rear setback of 18 feet, 9 inches, which is 6 feet 3 inches less than
the 25 -foot zoning requirement. To comply with the 25 foot requirement, we would be limited to a 13'
9" addition, which we feel would not be worth the investment.
Thus, we request a variance to allow the 18 foot, 9 inch rear setback dictated by our lot size.
It should also be noted that the property to our rear has a very large open yard, so this project would not
result in any appreciable impact on our neighbor's privacy or sight lines, and will not alter the character
of the neighborhood.

Elevation and Materials
The new structure would be of the same elevation and use the same or similar materials (block
foundation, wood frame structure, asphalt shingles, etc.) as the existing house, updated as necessary to
meet current code or improve eye appeal and energy efficiency.
Rear Lot Line Determination
The rear lot line was determined as follows:
1. Physically located comer stakes. The SE stake was 3.5' below grade, directly underneath a fence
post. The NE stake was at grade.
2. Drove vertical poles along the lot line next to each stake. Stretched a string between the two
poles, and checked that the poles were plumb in the plane perpendicular to the lot line.
3. Positioned a laser level parallel to the N and S sides of the foundation so that the laser beam was
perpendicular to the lot line. Using a board, determined the point at which the laser beam
crossed the lot line.
4. Using a plumb bob, determined the point on the ground directly underneath the lot -line string
where the laser beam crossed the lot line.
5. Measured parallel to the laser beam from the NE and SE comers of the foundation to the points
on the lot line determined above.
6. The distance from the SE foundation corner to the rear lot line was 38' 9.25". From the NE
foundation comer to the rear lot line was 38' 9", as shown in the diagram.
Addition Details
Would like the basement floor in the addition to be about 8" lower than current floor, with a step down.
Access to the new basement would be via a 3 -foot door from the existing basement.
