The Inspector of Buildings shall, before issuing permits for the erection of any building or structure, or for any addition to any existing building or structure, or for any alteration or repairs to any existing building or structure, upon application therefore, require the payment by the applicant for such permit of fees to the amount herein below set forth and in the manner herein provided to -wit: UNIFORM BUILDING CODE: Type 1, 2 & 4 - $2.15 for each one thousand cubic feet, or fraction thereof, in such cubical contents. Type 3 & 5 - $1.85 for each one thousand cubic feet. ADDITIONAL INFORMATION For the purpose of computing fees for building permits, the cubical contents of any building or addition, is determined by multiplying the ground area covered from a point six (6) inches below the floor line of the basement or the cellar to the average heights of the upper surface or to the average- height of the roof surface of the main gable of a pitched roof. For ,repairs or alterations to an existing structure, the fee shall be at the rate of $3.00 per each five hundred dollars ($500.00) or fraction thereof in the cost of all proposed work. In no case shall the fee charged for any permit as set forth in Section 2 be less than $5.00. VERIFICATION OF FOUNDATION NOTE: Permits for construction will be issued a minimum of 24 hours from the time of application, to allow for proper review of the proposed structure and of the construction site. A Certified Survey of the lot, showing the location of the foundation, once it has been constructed, will be required before proceeding with the framing. CERTIFICATE OF OCCUPANCY Application for a Certificate of Occupancy shall be made ten (10) days prior to the use or occupancy of any structure for which a building permit has been issued; and said structure shall not be used or occupied until a Certificate of Occupancy has been issued. t V. Acting Chairperson Gabel reminded the Commission that this request for variance had been tabled from their last meeting so that Mr. and Mrs. Schmitz could decide if they would like their house any other way on the lot. Mr. and Mrs. Larry Schmitz approached the Board, and Mrs. Schmitz stated they would either have to lose half the garage or have the front door facing the factory. She explained that on the lot the driveway was by the factory which meant the garage would have to face that way. She showed the Commission where the curve for the driveway was on a photograph, and said the rooms could be rearranged but the front door would have to face .the factory. Mr. Holden suggested depressed curbing might be a solution. Mrs. Gabel asked if it would be expensive to move the curbing for the driveway, and Mr. Holden replied it would be at least a couple hundred dollars. Mrs. Gabel said at the last meeting they had talked about turning the house the long way on the lot, and Mrs. Schmitz said she didn't like that idea as it would be the only sideways house on the block. B. STATED HARDSHIP: Family requests extension of existing kitchen for more living area. C. ADMINISTRATIVE STAFF REVIEW: The verifying survey in the file shows that the house at 5618 - 5th Street N.E. is located less than 10 feet from the common property line to the south, which would make this house an existing non- conforming use. Verifying surveys indicate a 5.6' setback from 5618 - 5th Street to the south property line, and a 4.2' setback from the garage at 5614 - 5th Street to the north property line. Field measurements by the staff show the distance between these two structures and a common line to be a total of 7.5' which is 2.3' less than the verifying survey distances of 9.8 feet. In other words, a discrepancy in the surveys exist. The petitioner has submitted a mortgage survey which doesn't correspond to the registered land survey for the same lot. The registered land survey would have to be considered the more valid of the two. Therefore, we have a request for a variance of 3 feet which covers the least possible distance of the house to the property line whichever survey is being used. If this variance is approved, staff recommends that there be no opening in the south wall, and that it be a firewall. Mr. Edward Dupay approached the Board and showed them photographs of his house and lot. He said that between the surveys there were discrepencies in the size of the house, where the house sits on the lot, etc. Mr. Holden stated that in that area there has been a discrepency in surveys, and when this survey was issued it was measured from the north showing two discrepencies on the lot line. He said that the house was either 5.6 or 3.6 feet from the lot line, and he thought that use of the land in the area would dictate a line somewhere in that area. Mr. Dupay said he had considered shifting the addition over 3' to get 9' between the garage and the house, but the kitchen and bedroom windows would be lost. He then decided he could go off the front of the house making it look like an "L" shape, and this would be more aesthetically pleasing. Mrs. Gabel said that if he wanted to do that he would need a new request for variance for the front yard. Mr. Dupay explained he would be out of town in two weeks, and Mrs. Gabel told him his wife could be present at that meeting. She told him that rather than act on this they could table it and he could decide exactly what it was he wanted, and added that it would be necessary to send out a formal notice. Mr. Holden said that they would have to clean up the bookwork with the non -conforming side yard, also. 1. Mr. Holden stated that the factory was in the process of building a parking lot, and it would be, done in about a month and a half. Mr. Barna asked if the five foot setback would be on the living area side, and Mrs. Schmitz replied it was. Mr. Holden asked if the garage would be on the factory side, and Mrs. Schmitz answered it would. Mrs. Gabel questioned if any of the neighbors objected, and Mrs. Schmitz said there were no objections. MOTION by Barna, seconded by Kemper, to close the public hearing. FRIDLEY APPEALS CUMMISSION MEETING OF MAY 25, 1976 - PAGE 6 C. ADMINISTRATIVE STAFF REVIEW: The petitioner has requested to maintain the size of his building and shift it to the north. Apparently this variance is requested in order to allow adequate maneuvering on the south side of the building. Staff feels that the petitioner has failed to show a true hardship. The problem could be solved by; 1. reducing the size of the building, or, 2. purchasing additional land (10' on south). Staff feels that any and all avenues of solution to the problem should be pursued before granting this variance. Mrs. Gabel stated that this item had come before the Planning Commission meeting of May 19 as there was a request for a special use permit which was approved with the stipulation that if a rear road was put in it would require the transmission shop to put in a 20' green area on their property. She added that there was an approval for a lot split with two stipulations; that the street dedication be vacated to 50' and that the city prohibit permanent construction on the west side of the property. Mr. Jon Peterson and Mr. Schroer were at the meeting to present the request. They pointed out on the survey where the variance would be needed. Mr. Peterson explained the building was planned with one garage door on the side and just the customer door in the front for aesthetic purposes. He said they were asking to move the building up to five feet from the property line on the north in order to minimize potential driving congestion on the south side by the one door. He added that the back was strictly a loading door for the truck pick-up service, parts receiving, etc. Mr. J. E. Schoin of Capp Homes was present, and asked about the customer parking. Mr. Peterson answered that what customer parking would be necessary would be in front. Mr. Schoin asked if any cars to be repaired would be in this area, and Mr. Peterson said yes, and then explained where the green area and blacktopped area would be. Mr. Schoin asked how many cars they would service, and Mrs. Gabel said it would service fifty to seventy cars a week. Mr. Schoin said that then cars would be parked out on at least a twelve hour basis, and Mr. Peterson replied that from what he had seen they didn't let them sit out for very long. Mr. Schoin asked about outside storage, and Mr. Peterson said the dumpsters were always kept inside. Mr. Holden asked if for some reason the 9,000 square feet was a magic figure, and Mr. Peterson replied it was chosen for potential based on what they wanted to do in this area. He stated their Bloomington building was double, but that was their home office. He explained that the garage area shown here was very much like that in Bloomington. Mr. Holden asked about the road in back, and Mrs. Gabel said the land was all platted out and there was the possibility of industry going in there. She stated there was presently a 20' easement that had been retained from Capp Homes, the Pancake House, etc., and would be retained from Kennedy. She said there would have to be more roadway if industry were to go in behind. Mr. Holden suggested if the road were to shift it might be possible to pick up another ten feet of land and eliminate the variance. Mr. Peterson said he was not sure they could get ten feet of salable land as they would run out of room going toward the existing buildings. ADMINISTRATIVE STAFF REVIDi: Checking surrounding properties, Staff finds that several other houses in the area have been built on 60 foot and even 50 foot lots. 698 Janesville is bordered on the East and South by vacant lots. This address is serviced with sewer and water. Staff cannot comment on the house design or size until plans are provided. Mr. Williams explained to the Commission he would be using the same house plan. He showed to them the survey and a photograph of the lot. Mrs. Gabel asked 14r. Williams if he would be able.to save some of the trees, and he replied he wouldn't be able to save too many, but they were box elder trees. He stated he didn't take any trees down that didn't have to come down. Chairwoman Wahlberg asked if the entrance to the garage would come off of Janesville, and Mr. 14illiams replied it would. She asked 11r. Holden what constitutes making a front yard, and he replied that it was a yard extending across the full width of the lot and lying between the front line of the lot and nearest line of the building. Mrs. Gabel asked if the neighbors had any objections, and Mr. Williams replied they did not. MOTION by 11r. Barna, seconded by Mr. Kemper, to close the public hearing. Mr. and Mrs. Schmitz approached the Board to present tjEir request, along with Mr. James.Bergstrom of 170 Liberty Street. Mrs. Schmitz showed the Commission photo- graphs of the lot and -`the house plan. She -explained the lot was on a dead end street with•a factory on the other side. Mr. Bergstrom', their neighbor 'to the West,described the problem he had with the factory workers parking -'in front of his house and up and do7,m the street. Mr. Holden said that either the factory's parking facilities were not being used, or there t:asntt adequate parking provided, and he.would look into it. Chairwoman Wahlberg pointed out that there would be serious.problems when.construction started with trucks coming to the site with all the parked cars on the street. Chairwoman Wahlberg asked if "they were planning to build within five. feet of the lot line on both sides, and Mrs. Schmitz replied they were. Mrs. Wahlberg asked if they needed`a double garage, and Mrs. Schmitz answered they would as they had two cars. Chairwoman Wahlberg said the problem was they were literally fenced in on both sides, and Mr. Bergstrom said he intended to take his fence down. He said he was concerned about building a separated garage in the back on„his lot thre6leet from the property line, and he was told he could do that. Chairwoman Wahlberg suggested to the Schmitz' that they turn their house plan totally around so that their living area would run along the back of the lot. She pointed out that they would gain more privacy. Mr. Holden suggested they have Plywood Minnesota do a mirror image of the floor plan, so the bedrooms would be to the factory side. Chairwoman Wahlberg said they would still need a variance, but it would be less of a variance. Chairwoman Wahlberg told Mr. and Mrs. Schmitz that it would be unfair -of the Commission to suggest this change without giving them time to consider it, and offered to table the request until the next meeting to give them time to think it over. FRIDLEY •APPEALS COMMISSION MEETING OF MAY 11, 1976 - PAGE 14 Chairwoman Wahlberg said she was concerned about granting this variance when she felt that perhaps if.the floor plan was turned there would be another alternative to consider. A sixty foot lot is buildable, she said, and she didn't see any problem !•ith the ?.ot size in finding a plan th3.t �,.ould fit on the lot. Mr. Kemper pointed out that they had already contracted for that particular plan on that lot. Mrs. Schmitz said she would like to wait and have time to consider turning the house around. Chairwoman Wahlberg suggested she take the plot plan with them to Plywood Minnesota and an explanation of the code saying they had to be so many feet from the lot line, which requires these setbacks. She added she would put Mr. and Mrs. Schmitz on the agenda for the next meeting. MOTION by Mrs. Gabel, seconded by Mr. Kemper, to table this request for variance. Upon a voice vote, all voting aye, the motion carried unanimously. DISCUSSION ON'FORTY FOOT LOTS - MR. VILLELLA'S REQUEST FOR VARIANCE: Chairwoman Wahlberg explained to the Commission that Mr. Villella's request had gone to the City Council, and they ended up changing the Commission's suggestion to them. She said they granted the varianceproviding that one side ,yard be from the required 17.5 feet to 13 feet; the other side yard from the required 10 feet to 8 feet; and with the stipulation that the petitioner arrange for a lot split that would provide for an additional five feet. She further explained that there had been considerable discussion at the Council meeting and she had hoped to find that in the minutes. Mrs. s,lahlberg stated she would like to obtain a copy of the transcription of those minutes. Mr. Holden stated he had not knoifn about the minutes from the February 10, 1976 meeting when Mr. Villel2ds request was originally presented, and there had been no discussion of the additional five feet at the recent meeting. Mrs. Gabel nointed out that more information came out at the City Council meeting than this Commission had to work with. Chairwoman Wahlberg said that in the minutes of the February 10, 1976 meeting it said the neighbor to the North had no objection as he was the one who was selling the lot. Mr. Villella said a purchase agreement had been signed for this lot. She continued that she thought some of the discussion was omitted from the minutes pertaining to whether or not he could buy additional land from the adjacent neighbor, as she recalled.talking about it. Mrs. Wahlberg stated that it appeared that if the Council was going to ask Mr. Villella to buy an additional five feet, that it could come to the edge of the garage. Mr. Holden commented that they would be solving one problem but creating another. Chairwoman lrahlberg said her concern was that there had been quite a bit of. discussion which was not reflected in the minutes, and asked Mr. Holden if he could obtain a transcription for her. She stated that if the City Council felt they acted improperly, then they should be advised of that and given some guidelines so they would know how to act in the future. Mrs. Gabel asked Mr. Holdenifhe could include in the Administrative Staff Reports concerning the forty foot lots, information showing who presently owns the lot and how long they have owned it.
