STATED HARDSHIP: No hardship statement B. ADMINISTRATIVE STAFF REVIEW: Request The petitioners are requesting that a variance be granted to reduce the front yard setback from 35 feet to 34 feet. The request is for Lots 43 and 44, Block 5, Spring Brook Park Addition, generally located at 180 Liberty Street N.E. Site Located on the property is a single family dwelling unit with a detached two -car garage. The property is zoned R-1, Single Family Dwelling, as are all adjacent properties. Analysis Section 205.07.03.D.(1) of the Fridley City Code requires a front yard setback of not less than 35 feet. Public purpose served by this requirement is to allow for off- street parking without encroaching on the public right-of-way and also for aesthetic consideration to reduce the building "line of sight" encroachment into the neighbor's front yard. The petitioners are proposing to reconstruct the roof of the dwelling unit and install a new living room window in the front of the house. The addition of the window will require that the floor of the dwelling unit be expanded toward the street. A new roof structure will also be constructed over the window substantially changing the front facade of the dwelling unit. As the addition of the window expands the living area of the dwelling unit, a variance is necessary. The proposed variance does not encroach upon the sight lines of the adjacent properties. Ms. McPherson stated the property is located east of the inter- section of Ashton Avenue and Liberty Street. The property is zoned R-1, Single Family Dwelling, as are all surrounding properties. Ms. McPherson stated the petitioner is proposing to do some extensive reconstruction to the roof of the existing dwelling unit. As part of the reconstruction, a new front window is going to be installed. The window includes, not only a reconstructed roof, but also moving the floor of the dwelling out, thereby increasing the amount of living space. However, if approved, the variance would not encroach upon the sight lines of the adjacent properties and would not adversely impact the adjacent properties. Ms. McPherson stated staff has no recommendation regarding this variance request. Mr. John Wozniak, 180 Liberty Street, stated he really does not have a hardship. They want to vault their ceiling and in order to get the double vaulted effect in the ceiling, it involves putting the ceiling the other way. They looked at some newer homes, liked the way this looked on the inside, and decided to do it in their home. He stated they have a very small living room, and the new window will lengthen the living room a little and give it a larger, more airy feel. Mr. Wozniak stated they have talked to the neighbors on the east and west sides of their home, and the neighbors have no objection to this variance. MOTION by Dr. Vos, seconded by Ms. Beaulieu, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 8:13 P.M. Mr. Kuechle stated he would recommend approval of this variance. The impact is minimal, and he can understand the petitioners' desire to do this and to give the home a little different architectural look and aesthetic appeal. Ms. Smith agreed. Although there is -no hardship, she believed the public service is being served as granting the variance will not encroach into any sight lines, and the construction of the window will certainly improve the appearance of the home. Dr. Vos also agreed. He stated the real purpose for the 35 foot front yard setback is so no public right-of-way is being blocked. No one is going to notice the one foot encroachment.
