Public purpose served is to allow for off-street parking without encroaching on the public right of way and also for the aesthetic consideration to reduce the "building line of sight" encroachment into the neighbor's front yard. B. STATED HARDSHIP:. Setting this home on a diagonal is a "natural" to take advantage of the present contours of the lot overlooking the creek, as it is about a 27 ft. drop from the top of the hill to the creek bottom. In order to do this and save hauling yards of fill to change the contour of the hill, one end of the home will be approximately 18 feet from the front lot line, and the garage end of the home will be 35 ft. or more back from the line. This is the last home than can ever be built on this street, as the street ends right here. C. The request is for a variance of the Fridley City Code, Section 205.053, 4, A by Samuel C. Dalberg. We have decided to submit some of our objections and questions to the matter before the council meeting to minimize time at the meeting. Our main objection to allowing the variance requested by Mr. Dalberg is that he is trying to squeeze two houses in an area that we believe is best suited for one house. Even though the variance request pertains to only one lot, we feel that the second house shoWl ni►t' be'.ignored. The small dead—end street has, we f�el, maximum traffic on -it already. If there is to be any more residents on the street, there must be a cul de sac put in to help accomodate the added traffic. The actual building space on either lot is quite limited even though the square footage gives the illusion that'there is ample space for two houses. The steepness of the bank and the point where the land drops off on both lots are very limiting factors as far as any building is concerned. There would be virtually no yard for either house. We realize that Fridley is close to 95% built and that the remaining land is odd—shaped. However, as existing residents of the area, it is important to us that our houses are not in too close proximity. This is, after all, a desir— able aspect of living in a suburb rather than in the inner—city. Two houses would definitely create over—crowding. The second house (not the one in question) would be practically in Mr. Hoffa's back yard between his house and his garage. This may not be a relevant point but if variances are granted on the first house, there are no building codes that we are aware of that would restrict building of the second house. Vie feel that Mr. Dalberg has very little hardship cause to request thiel variance because he does own both lots and a house could probably be built without variances on the combined space. There are other considerations of less importance,,but nevertheless, valid. The soil is sandy. 'With the building that Mr. Dalberg has proposed, a good deal of trees, substantial in size, will have to be removed. They are what is hold— ing the soil to the side of the bank. If they are removed, what will be the consequences and who will be paying for the consequences --the residents, the r � r • `,. M city? Mr. Dalberg is not going to be moving into the house he wants to build. He will be long gone if there are any damages to property. There was a house built at the other end of Liberty in 1974 (7998 East River Rd.) --one that was granted four variances in order to be built. The main argument for building the house there was'-th&t1-the`-buyer' ,was_ gbtfing-°.a lovr—interest government loan and wanted to live in the suburbs. The house was built, without garage, completely ignoring the recommended placement on the lot. There is now no ways, garage can be constructed; the original buyer is no longer living there; and it is our understanding that the people living in it are renting. We do not want a repeat of this: two more houses with no yards and probably a lack of buyer desirability. The minutes from the two appeals commission meetings seem to be missing a few details. There is no reference in the April lith meeting to the cul de sac proposal. Such a proposal was made. All of the commission members who.,.attended the meetings had come out to check the lot in question with the exception of Mr. Plemel--who was not present at ccccthe April 11th meeting, and who referred to Mr. Dalberg as "Sam." Mr. MeshowArOa-sked Mr. Plemel if he had seen the area. Mr. Plemel replied that he had not. Mr. Meshowe,said that he thought that before making a decision on anything he should at least see the lot in question. That is not in the minutes. Chairperson Schnabel made several references at both meetings to the fact that when the area was platted, it was done so -.with the intention of building houses.on it. How can this be true when it was platted in.1922 before Fridley was probably even thought of? How can this be true if the plat was accepted in 1965 before existing building codes? The sketches that Mr. Dalberg presented at the first meeting include.20 feet of Mr. Hoffa's land. If Mr. Dalberg is willing to stretch the truth to get the variance, will he build the same kind of house he proposed at the meetings? We think it is important that every council member see the lots in question before making a decision on the variance. rest deal differently than any sketch could show. Ile said that the reason was that the original "deal" fell through and that the proposed house would be smaller but that he would still need the variance because he still had to cope with the hill that was to the rear of the lot. Neighbors that were present at the meeting regarding this item were: Mr. Randy Lee Hoffa Mr, Doug Linguist Mr, Terry Hoffa Ms. Patty Chavez Mr. Larry Meshower. Mr. Frank Taylor Ms. Shore Mr. Randy Lee Hoffa was spokesman for the neighborhood. Chairperson Schnabel explained to Mr. Hoffa what Mr. Dahlberg was proposing for the lots in question. Mr. Hoffa didn1t believe that the sketch that the Commission was looking at was an accurate picture of the actual contour of the land. Mr. Hoffa said that there were several questions in the minds of the neighbors. He said that the first question was exactly what effect would the removal of the trees and the building of a house have on the hill? He said that the hill consisted mostly of loose sand, the hill was very steep, and the trees were desperately needed to hold that hill together. He said that the drainage for the entire area was right through the lots in question. Mr. Hoffa said that the residents in the area were concerned about the lack of much green area in the front yard of the proposed house. He said that the driveway would take up a considerable amount of front yard as well as the house being moved forwards on the lot. He said that the neighbors would rather see more green area maintained on the front yard area of the lot. Mr..Hoffa said that there was already a situation in the area where a house had been allowed four different variances and now that house was no longer occupied by the original people and the house had been turned into rental property. He said that the residents of the area did not want another situation similar to that one. He said .that the neihbors did not grant any more crowding in the area. He said they were totally against the granting of any variances. ' APPEALS C01414TSSTON MEETING - APRIL 11 , 1978 PaaP • Mr. Linquist'wanted to know more about the future plans of Mr. Dahlberg and his building of another house to the East of the proposed property, Chairperson Schnabel explained where the future house would be located. Chairperson Schnabel pointed out the the variance request was only for Lots 51697,829910 and the -Westerly 16 feet of Lot 11. She said that it did not concern any other lots at this time. Mr. Hoffa felt that the two houses in conjunction made'up a situation as a whole. He said that it was the effect of the two houses together that was a concern of the neighborhood. Chairperson Schnabel said that the Appeals Commission only had the authority to act on the one piece of property. Mr. Holden said that Mr. Dahlberg was totally in his rights to propose a house for the piece of property in question without any variances and without any public hearings. Mr. Hoffa wanted to know if he could -build on that property without taking into account what effect it would have on the neighborhood. Chairperson Schnabel said that as long as he stayed within the Codes. Mr. Holden said that if Mr. Hoffa felt that the building on that lot would have a negative effect on his property, he would have the right to sue Mr. Hoffa in Civil Court. Mr. Holden explained that Mr. Dahlberg could build on the lot in question without any variances by positioning the house differently, using fill,.or by using pier footings and.moving the house back on the lot. He said that if Mr. Dahlberg decided to do any of those items, he could obtain a building permit the next day. Mr. Hoffa asked if he would have to meet any requirements at all. Mr. Barna said that as long as he didn't change the creek bed or as long as he didn't change the water course of the creek, he could build as he wanted to on his property. Chairperson Schnabel said that the area was platted for houses to be built. She said that as long as a person buys the property and can build something that meets the codes, there is no way they can be prevented from building. Mr. Hoffa said that the neighbors agreed that anything constructed on that property should "meet the codes". APPEALS COMMISSION MEETING - APRIL 11 , 1978 Pare 10 Mr. Hoffa said that the main objection was Mr. Dahlberg's plans to place two houses into the area, one right on top of the other. He said that the main reason most people moved to Fridley was to be able to not be so crowded. Ms. Chavez didn't like the idea of Mr. Dahlberg taking any trees off the hill on his property. Mr. Holden said that it had to be remembered that it was Mr. Dahlberg's property. He said that he didn't like to consider having trees removed, and the less removed the better; however, he said it was his property and he could'do as he pleased with his property. Mr. Meshoti-rer said he didn't think it was right for Mr. Dahlberg to be able to request a variance for a house that he didn't have any plans for. Chairperson Schnabel said that he could request the variance if he desired. She said that he didn't change his variance request so the Commission would be -acting on the same request. Mr. Hoffa said that the property o1mers present at the meeting did not want any variances allowed at all. He said that Mr. Dahlberg should build within the codes or not at all. Ms. Chavez said that it didn't make sense just to build a house to take up the property. She said that ilrith the hill and contour of the property, there was very little yard allowed for. She said that the house would not be a desirable house for anyone to buy because it wouldn't have any yard. She said that it would probably end up as rental property and the neighborhood definitely did not want any more rental property in the area. Mr. Meshower said that he enjoyed the open area and the privacy. He moved to Fridley to get array from the crowdedness of Minneapolis and he did not like the idea of crowding houses into the neighborhood. Mr. Barna said that most of the people present were in the position where with the additional two houses, they would no longer be able to see the creek from their homes. He said that as far as the aesthetic value and nature, it would block off the entire open spaces in the area. Chairperson Schnabel asked if Mr. Dahlberg had a buyer for the property. • Mr. Dahlberg said that he no longer had a buyer for the property. 'She said it was difficult for the Commission to approve variance requests on plans they could not see. She said that she would like to see the item continued until such time that a more definite and exact plan could be presented. Mr. Holden said that if the item was continued until April 25th, it would only delay Mr. Dahlberg by one week. MOTION by Mr. Barna, seconded by Ms. Gabel, to continue the request for variance to the Fridley City Code, Section 205.053,4,A, to reduce the minimum requirement for a front yard setback from 35 feet to 18 feet to allow the construction of a duelling and garage on Lots 516,618,9,10 and the West 16 feet of Lot 11, Block 8, Spring Brook Park Addition, except that part lying North and Nest of the center line of Spring Brook Creek, the same being 465 Liberty Street NE, Fridley, MN, until April 25, 1978, at which time Mr. Dahlberg would have plans in detail of the proposed house for the property in question. PUBLIC PURPOSE SERVED BY REQUIREMENT: Section 214.045, C, 4, limiting roof signs in C-1 and C-2 (commercial) districts to 80 square foot maximum. Public purpose served is to control visual pollution and excessive use of signs in commercial areas. B. STATED HARDSHIP: Because of the setback from the road, I would like to have at least a 4' high sign. To stay within the ordinance we would be forced to use "Food - Liquor" on our sign. We would much rather use the wording "Food -Cocktails" but the extra letters runs us over the 80 square foot limit. In the future when money is available, we wish to do away with a*roof sign in favor of a free standing sign. C. ADMINISTRATIVE STAFF REVIEW: In as 'much as plans or drawings have not been supplied at this time (4/6/78), an accurate evaluation cannot be made. Mr. Purmont had plans of what he -was proposing for the building, Mr. Holden said that the House of Lords didn't feel they were getting e=nough exposure and they were proposing a sign to be on the upper -most part of their roof on the East part of the building that faced University Avenue. Mr. Purmont said that he really didn't like the idea of having a sign located on his building, but due to lack of exposure he did need the sign. He said that in the future, he hoped to be able to remove the sign because his clientele would be built up enough. Ie explained that he could stay within the codes by putting the words "Food and Liquor" on the signs but he preferred to be able to put the words "Food and Cocktails" on the sign. He felt that the proposed sign would give the establishment the best exposure until enough people realize that it is a good place to dine. Mr. Purmont said that he wanted the sign to be a temporary thing. He said lie wanted to be able to keep "dignity's in the building. He said that the sign would only be needed until the House of Lords had adequate exposure to the people in the area. 13.p This is in reference to the request for a variance on property located at 465 Liberty St. NE. The request is for a variance of the Fridley City Code, Section 205.053, 4, A by Samuel C. Dalberg. We have decided to submit some of our objections and questions to the matter before the council meeting to minimize time at the meeting. Our main objection to allowing the variance requested by Mr. Dalberg is that he is trying to squeeze two houses in an area that we believe is best suited for one house. Even though the variance request pertains to only one lot, we feel that the second house should::nbt'be ignored. The small dead—end street has, we feel, maximum traffic on it already. If there is to be any more residents on the street, there must be a cul de sac put in to help accomodate the added traffic. The actual building space on either lot is quite limited even though the square footage gives the illusion that"there is ample space for two houses. The steepness of the bank and the point where the land drops off on both lots are very limiting factors as far as any building is concerned. There would be virtually no yard for either house. We realize that Fridley is close to 95% built and that the remaining land is odd—shaped. However, as existing residents of the area, it is important to us that our houses are not in too dlose proximity. This is, after all, a desir— able aspect of living in a suburb rather than in the inner—city. Two houses would definitely create.over-crowding. The second house (not the one in question) would be practically in Mr. Hoffa's back yard between his house and his garage. This may not be a relevant point but if variances are granted on the first house, there are no building codes that we are aware of that would restrict building of the second house. We feel that Mr. Dalberg has very little hardship cause to request this variance because he does own both lots and a house could probably be built without variances on the combined space. There are other considerations of less importance,,but nevertheless, valid. The soil is sandy. 'With the building that Mr. Dalberg has proposed, a good deal of trees, substantial in size, will have to be removed. They are what is hold— ing the soil to the side of the bank. If they are removed, what will be the consequences and who will be paying for the consequences --the residents, the city? Mr. Dalberg is not going to be moving into the house he wants to build. He will be long gone if there are any damages to property. There was's. house built at the other end -of Liberty in 1974 (7998 East River Rd.)—one that was granted four variances in order to be built. The main argument for building the house there was'_'thkt -the"buyer ,was,gbtting--.a low–interest government loan and wanted to live in the suburbs. The house was built, without garage, completely ignoring the recommended placement on the lot. There is now no way.'a garage can be constructed; the original buyer is no longer living there; and it is our understanding that the people living in it are'renting. We do not want a repeat of this: two more houses with no yards and probably a lack of buyer desirability. The minutes from the two appeals commission meetings seem to be missing a few details. There is no reference in the April 11th meeting to the cul de sac proposal. Such a proposal was made. All of the commission members who.,.attended the meetings had come out to check the lot in question with the exception of Mr. Plemel—who was not -present attheApril '11th meeting, and who referred to Mr. Dalberg as "Sam." Mr. MeshowArrNa-sked Mr. Plemel if he had seen the area. Mr. Plemel replied that he had not. Mr. Meshowe"fPsaid that he thought that before making a decision on anything he should at least see the lot in question. That is not in the minutes. Chairperson Schnabel made several references at both meetinga to the fact that when the area was platted, it was done s©%with the intention of building houses.on it. How can this be true when it was platted in. 1922 before Fridley was probably even thought of? How can this be true if the'plat was accepted in 1965 before existing building codes? The sketches that Mr. Dalberg presented at the first meeting include.20 feet of Mr. Hoffa's land. If Mr. Dalberg is willing to stretch the truth to get the variance, will he build the same kind of house he proposed at the meetings? Lots 10 & 11, Block 8 SiSrinct Brook ark As requested, our firm has provided earthwork observation services for the above referenced project. The purpose of the earthwork observation was to assist in evaluating the suitability of the soils observed at the bottom of the excavation for support of the proposed house structure. DESIGN DATA Based upon our conversation with you, it is our understanding that the proposed structure is to be a four level, rear -walkout single family home of wood frame construction. Based upon the information provided, we have assumed that the loads will be relatively light; on the order of 2500 pounds per lineal foot of wall. The proposed structure will be "notched" into a northwest - facing slope which is currently 20+ feet in height and exhibits an average surface gradient of 2:1 (horizontal:vertical). The dimensions of the house are to be 51.5 feet wide by 42.5 feet long, which includes the attached garage on the southeast side. The lowest floor elevation is at 943.4 and garage slab is at elevation 957.4. Top of block elevations vary through -out. This information was obtained from the Certificate of Survey which you provided to us. To our knowledge, soil borings were not BL90-183 - 2 - October 18, 1990 Fireside Homes, Inc. performed on this site to evaluate soils conditions at depth. EARTHWORK OBSERVATIONS Evaluation Procedures: Our provided on October 15, 1990 The house area was excavated elevation, with the exception not excavated yet. earthwork observation was by an engineering assistant. to proposed bottom of footing of the garage area which was Our evaluation of the in-situ materials consisted of visual examination at the floor and sidewalls of the excavation. Further, textural classification of auger cuttings extracted from below the excavation floor were made. A 4 -foot long, 1-1/2 inch diameter hand auger was used to obtain the cuttings. The force required to advance the auger was used to judge strength characteristics of the soils. SOILS ENCOUNTERED Prior to our arrival on site, the house area had been excavated to the proposed bottom of footing elevations, which varied. Also excavated was the footing area for a column support pad. Approximately 12 feet was excavated at the southern portion of the house area and approximately 3 feet was excavated at the northern portion. The garage area was not excavated yet. The native soils observed at the base of the excavation consisted of poorly graded sand and poorly graded sand with silt which appeared to be naturally deposited. Based upon the results of approximately 10 hand auger probes, these materials were generally interpreted as being in a medium dense to dense condition. It should be noted that soil hand auger probes are rather penetration test boring data approximate. Soils on the south side, where the excavation is the deepest may actually experience a load reduction. October 18, 1990 is our opinion that the construction is not likely to effect the stability of the slope in an adverse manner. It should be noted, however, that we were not requested to perform a stability analysis of the slope. REMARKS It should be noted that standard penetration test borings with power equipment were not taken to evaluate the soils at depth. However, the soils which were visible and the results of the hand auger probes indicates that the risk of detrimental settlement due to poor soils at depth is likely small. Services performed by the geotechnical and materials engineers for this project have been conducted in a manner consistent with that level of care and skill ordinarily exercised by members of the profession currently practicing in this area under similar budget and time restraints.
