VAR #87-14
A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.07.03. D, 1, requires a front yard setback of not less than
35 feet.
The public purpose served by this requirement is to allow for off-street
parking without encroaching on the public right-of-way and also for
aesthetic consideration to reduce the building 'line of sight" encroach-
ment into the neighbor's front yard.
B. STATED HARDSHIP:
"Existing garage is not capable of holding two cars. I have personal
property in need of storage. The existing driveway is to be replaced
during construction; it will be replaced with concrete."
C. ADMINISTRATIVE STAFF REVIEW:
If this addition is constructed, it will not be in the line of sight
from either of the two adjacent homes because of the curve in the street.

Because of the driven portion of the street paraliels.;_the opposite right-
of-way line, the boulevard ,on this side of the street.is very large
(about 45 feet). Therefore, the new addition would still be about 70
feet from the :curb. r
If the Appeals,Commission approves this request,.Staff has no stipula-
tions to suggest.
Mr. Clark stated that as stated in,the Administrative Staff Review, the
right-of-way had an odd shape; there was a different radius on the outside
than there was on the inside. The city street paralleled the property
line across the street which had enlarged theboulevardabout 45 ftr'. If
the garage was constructed, it would not be seen by the houses on either
side.
fir. Rystedt stated the existing garage was 19 ft. x 20 ft: He has a 20 ft.
boat and two cars. He cannot get the.boat`,'into the _existing garage at -all,
but the new garage could hold both his boat and his two cars. He would
also construct a concrete driveway. -,"He stated he had just bought the
property which was pretty run down. He was putting in landscaping and
trying to improve the property.
Mr. Betzold stated the petitioner could expand his existing garage toward
the lot line another 5 ft. which would make the existing garage 24 ft. wide.
fir. Rystedt stated there were two reasons for not expanding his existing
garage. First was the expense in just expanding 5 ft-, and the other

was that a 24 ft. wide garage would not take care of his needs for storage.
He stated he thought his garage addition would improve the looks of the
house by making it look like an L-shaped rambler.

Mr. Clark stated the distance from the curb to the proposed garage addition
would still be about .70 ft. The petitioner has a 95 ft. driveway now.

MOTION by Mr. Barna, seconded by Or. Vos, to close the public hearing.
Upon a voice vote,: all voting aye, Chairperson 6etzold declared the
public hearing .closed at 7:56 p.m.
Mr. Barna stated the Commission has previously used the need for storage
space and a small garage not up to the present code size as a hardship
more than anything else in his experience on the Appeals Commission.
He stated he agreed it was easier to match into a hip roof.from the front
side than it was to tear off a hip roof and expand it out. So, he felt
the additional need for storage space "and the construction restraints were
definite hardships. Obviously, the code was satisfied a5 far as front yard
line of sight encroachment to the neighbors, and as far as distance from
the street, due to an extremely wide boulevard, he felt that part of the
code was also satisfied. He would be in favor of granting the variance.

Ms. Savage stated she agreed with Mr. Barna. Certainly the spirit of the code
was being met. Because of the shape of the curb, there was not going to be
any encroachment into the line of sight for the neighbors. This plan seemed
to be very aesthetically pleasing, and she would have no objection to the
variance as stated.
Mr. Sherek stated he also did not object to the variance. The plan asproposed
seemed like a good plan.
Mr. Betzold stated he agreed also. The size and shape of the lot were things
that definitely could be taken into consideration. He would not be opposed
to granting the variance because of -the uniqueness of the lot.
MOTION by Dr. Vos, seconded by Mr. Barna, to approve Variance Request, VAR #87-14,
by minas Rystedt, Pursuant to Chapter 205.07.03, D, 1, of the Fridley City
Code to reduce the front yard setback from 35 feet to 25 feet to allow the

Because of the driven portion of the street parallels the opposite right-
of-way line, the boulevard on this side of the street is very large
(about 45 feet). Therefore, the new addition would still be about 70
feet from the curb.
If the Appeals Commission approves this request, Staff has no stipula-
tions to suggest.

Mr. Clark stated that as stated in the Administrative Staff Review, the
right-of-way had an odd shape; there was a different radius on the outside
than there was on the inside. The city street paralleled the property
line across the street which had enlarged the boulevard about 45 ft. If
the garage was constructed, it would not be seen by the houses on either
side.
Mr. Rystedt stated the existing garage was 19 ft. x 20 ft. He has a 20 ft.
boat and two cars. He cannot get the boat into the existing garage at all,
but the new garage could hold both his boat and his two cars. He would
also construct a concrete driveway. Ile stated he had just bought the
property which was pretty run down. He was putting in landscaping and
trying to improve the property.
Mr. Betzold stated the petitioner could expand his existing garage toward
the lot line another 5 ft. which would make the existing garage 24 ft. wide.
Mr. Rystedt stated there were two reasons for not expanding his existing
garage. First was the expense in just expanding 5 ft., and the other
was that a 24 ft. wide garage would not take care of his needs for storage.
He stated he thought his garage addition would improve the looks of the
house by making it look like an L-shaped rambler.
Mr. Clark stated the distance from the curb to the proposed garage addition
would still be about 70 ft. The petitioner has a 95 ft. driveway now.
MOTION by Mr. Barna, seconded by Dr. Vos, to close the public hearing.
Upon a voice vote, all voting aye, Chairperson Betzold declared the
public hearing closed at 7:56 p.m.
Mr. Barna stated the Commission has previously used the need for storage
space and a small garage not up to the present code size as a hardship
more than anything else in his experience on the Appeals Commission.
He stated he agreed it was easier to match into a hip roof from the front
side than it was to tear off a hip roof and expand it out. So, he felt
the additional need for storage space and the construction restraints were
definite hardships. Obviously, the code was satisfied as far as front yard
line of sight encroachment to the neighbors, and as far as distance from
the street, due to an.extremely wide boulevard, he felt that part of the
code was also satisfied. He would be in favor of granting the variance.

Ms. Savage stated she agreed with Mr. Barna. Certainly the spirit of the code
was being ret. Because of the shape of the curb, there was not going to be
any encroachment into the line .of sight for the neighbors. This plan seemed
to be very aesthetically pleasing, and she would have no objection to the
variance as stated.
Mr. Sherek stated he also did not object to the variance. The plan as proposed
seemed like a good plan.
Mr. Betzold stated he agreed also. The size and shape of the lot were things
that definitely could be taken into consideration. He would not.be opposed
to granting the variance because of the uniqueness of the lot.
MOTION by Dr. Vos, seconded by Mr. Barna, to approve Variance Request, VAR #87-14,
by Thomas Rystedt, Pursuant to Chapter 205.07.03, D, 1, of the Fridley City
Code to reduce the front yard setback from 35 feet to 25 feet to allow the

it difficult to see the Payless Shfrom Central Avenue. In
addition, access to the Payless pais not directly off 53rd,
but rather is off a service drive ices Target, the United Store,
the car wash, and Payless. The peare seeking the above-mentioned
sign variances in an attempt to in'r visibility and to better
define their parking lot entrance.
This property was granted variances for maxim uma lowable sign height
(from 25 feet to 35 feet above grade) and sign siz from 80 sq. ft. to
120 sq. ft.) for a free-standing sign in 1985. Thes variances were
reapproved for Payless when they moved onto the site 1 st year.
Mr. Clark stated the variances requested were for the rota tio of the pylon

Dear Mr. and Mrs. Rystedt:
Recently, I sent you a letter concerning the parking of one or more
vehicles on your property in a manner not in compliance with the
Fridley City Code. Upon speaking with you, I learned that you
wished to comply, but you required additional time to make the
necessary arrangements. Based on this information, I granted you
an extension of one year to fully comply with the City's parking
requirement.
This letter is to confirm that you have until December 311 1991,

This may be accomplished by creating additional paved parking
