We have reviewed your proposal to construct a retaining wall and fire pit at the above -
referenced address. The project will not involve impacts to wetlands or floodplain, no
stormwater requirements are triggered, and the plan is in conformance with the District's
shoreland rules. Therefore, no permit from the Rice Creek Watershed District will be
required provided that appropriate erosion control measures are implemented during
construction (silt fence, revegetation of disturbed areas, etc.). If the scope of your project
changes, please contact the District to determine if a permit is needed.

Mr. Burns, City Manager, ex lained that this agreement would provide for up to
$75,198.25 in SCORE funding or operation of the City's various recycling programs.
The new agreement contains mor demanding promotion requirements; however, they are
consistent with what Fridley is a1r ady implementing. In all other aspects, the agreement
is the same as the one the City ope ated under in 1998.
APPROVED 1999 RESIDENTIAL. RECYCLING AGREEMENT BETWEEN THE
CITY OF FRIDLEY AND THE COUNTY OF ANOKA.
Mr. Burns, City Manager, noted thal the City recently sought proposals for a new
telephone system which would allow t City to be Year 2000 compliant as well as take
advantage of new telecommunications City
that have been developed since the
current telephone system was installed in 1989. Proposals were received from two
vendors, with the lowest and best propos s being provided by Matrix Communications in
the amount of $131,218. Mr. Burns note that this amount was considerably higher than
the $85,000 budgeted for 1999; howev r, the new system would provide operating
savings of $13,200 per year. At this rate savings, the amount over budget will be paid
back in three and one-half years.

Mr. Burns, City Manager, explained that bidsere opened on February 24, 1999. Ron
Kassa Construction of Richfield, MN submitted a low bid in the amount of $53,375. It
provided for remedial curb, gutter and sidew repairs that have been necessitated by
utility and driveway entrance construction that occur throughout the year.

Mr. Tatting stated the variance request is to allow a reduction in the front yard setback
from 35 feet to 34 feet to allow the reconstruction of the garage, and to allow a residential
structure not complying with the code to be increased in size. A portion of the existing
house is 22 feet from the front property line. The hardship as indicated by the petitioner is
that the front of the existing garage encroaches onto the front setback. The proposed
remodeling would continue that setback 8 feet to the east. The addition itself does not
require any further variances. The house is nonconforming and any expansion needs a
variance.

Mr. Tatting stated the property is located east of East River Road on Locke Lake Road.
The property is zoned R-1, Single Family, as are the properties to the north and west. A
park is located to the south.
Mr. Tatting stated that the original house was built in 1953. In 1955, a porch was
constructed. In 1965, a bedroom addition was constructed. In 1989, a multi -story deck
was added. In 1994, the kitchen and bathroom was remodeled. In 1997, a permit was
issued for deck footings. The living room/office/guest space is proposed to be
remodeled. The living area addition will be built out to the rear and will not impact the
setbacks. The remodeling will include reconstruction of portions of the roof and
reconstruction of the garage with one garage door rather than the two as it exists today.
The property shares a driveway with the neighbor to the northeast. The neighbor could
potentially expand their garage also. Caution is advised if there are to be changes to the
driveway or the buildings as it pertains to parking vehicles on the driveways.
Mr. Tatting stated the DNR has reviewed and approved the plans. The Rice Creek
Watershed District does not require a permit for this project.
Mr. Tatting stated staff has no recommendation regarding this request due to the fact that
the request is within previously granted variances.
Ms. Beaulieu asked if the existing nonconformance needs a variance even without the
addition.
Mr. Tatting stated that is correct. The new addition does not need a variance. It is new
construction to the garage and putting on garage doors.
Dr. Vos stated the other part is the existing portion which does not fall into the air lock and
front door requirements.
Mr. Hickok stated this area projects further into the front yard than what is permitted for
that.
Mr. Jones stated there is a foundation in the front comer and an updated survey was
provided to the City.
Dr. Vos stated he understood by the staff report that in the reconstruction of the garage, a
variance is not needed all along the new addition, just some of it.
Mr. Jones stated he measured it. They now have two 8 -foot garage doors with a post in
between. The first garage door, the post, and a portion of the second garage door fall
under the 35 -foot measurement. The original design for the reconstruction was for the
two single garage doors, but the neighbors had a concern for parking and use of the
drive. They talked with the designer and found it would be easier to get in and out of the
garage with one double door. They have changed the design and minimized the need to
come into the garage straight.
Ms. Jones stated the opening from the drive to the garage will not change but the opening
will be clear so they can use the full width of the garage opening.

Mr. Jones reviewed the site plan. They plan to add some concrete to the east side of the
driveway.
Ms. Jones stated they were concerned about the neighbor to the east and that there
would not be too much concrete. If cars are there, you cannot get in and out. They did
not want too many cars in between. Her house and the house next door were built this
way. She showed a photo dated March 30, 1957, showing a shared driveway at that
time.
Ms. Ferber stated she was the neighbor next door to the northeast. The drawing does
not show the relationship between the two houses and the shared driveway.
Ms. Beaulieu asked if they had easements recorded on each other's property.
Mr. Jones stated, no. They have a maintenance agreement for the shared part of the
driveway. It is not recorded on the title.
Ms. Mau asked on whose property the driveway was located.
Mr. Jones stated a portion is on Ms. Ferber's property and a portion on his property.
Ms. Ferber stated she purchased the home last October, remodeled the home
extensively and moved in in December. Her understanding is that the vast majority of the
shared driveway is actually her driveway. Her understanding is that it is her driveway,
and that the Jones' are allowed to use it to get onto their property: Mr. Jones showed her
the survey. Based on those markings, it appears that they are using her driveway to get
to theirs.
Ms. Ferber stated she has remodeled the house and has a rambler with one bedroom.
The garage faces the lake on two sides. If she were to expand, adding one or two
bedrooms, the garage would be the logical place to expand and then move the garage
space forward. If she wanted to do that without regard for the Jones', how will their
driveway tum out? She already has limited access because of the need for the neighbors
to get in. From the drawings, it looks like they will not need more of her driveway to get
into their garage. She is concerned about losing more parking. Right now, a car parked
in two or three feet from the garage is far enough back to prevent access. She is
concerned about parking for her guests. If she comes to within 35 feet and wants to do
an addition, she is concerned that she will not be able to do that because she will not
have enough access.
Dr. Vos stated there is a big boulevard there.
Mr. Hickok stated the boulevard is typically between 7.5 and 15 feet.
Ms. Ferber stated, because of the shared driveway, she can park on half of her driveway.
She wants to make sure the driveway is angled so she does not lose any more. If they
expand the garage, will she be able to move her garage forward?
Dr. Vos stated that if the space is used as a garage, it can be closer to the lot line or to 5
feet. If that space is used as living space, then it must be further away or 10 feet from the
lot line. The distance depends on the use.

Ms. Ferber stated her concern is that she not lose any more parking and that if the
neighbor's garage is expanded, there would not be enough room for her to expand. She
has no objections to their addition or driveway, but she is concerned if that will stop her
from future changes.
Mr. Tatting stated the addition will add 8 feet to the garage. The distance from the lot line
at the closest point is 15 feet.
Dr. Vos stated he did not see where moving the garage changes -much to where they
would have to come in to their driveway. Ms. Ferber would lose some parking. Other
than that, he does not see any change.
Ms. Ferber stated she did not think she would be denied a permit because of this
addition.
Mr. Beaulieu stated it sounds like there are some other issues that have to do with the
property that the Appeals Commission cannot settle for Ms. Ferber. The actual variance
is to redo the existing garage. She asked if Ms. Ferber was opposed to that change.
Ms. Ferber stated that depended on the driveway. If the driveway is going to come
straight out, she will lose parking on her driveway. If they angle it, that is not a concern
because she does not lose any parking.
Mr. Tatting stated the plans show the concrete comes straight out from the garage to the
existing concrete. It will not affect the neighbor's driveway.
Ms. Beaulieu stated, if Ms. Ferber is opposed to the request, this automatically goes to
the City Council. The petitioner has not requested a variance for the driveway. The
Appeals Commission cannot address that issue.
Ms. Ferber stated, if they angle the driveway, she does not lose any more space on her
driveway. Her concern is that the city would allow a neighbor to expand and then she
would not be able to because she would be blocking their passage. She is not there to
protest or object. She is there to address a concern. The parking situation is difficult.
Ms. Beaulieu stated, if Ms: Ferber plans to expand and is within the setbacks required by
code, she can do so. If she wants to do something else, she would have to go through
the process just as Mr. Jones has done.
Ms. Ferber stated she does not object to the variance itself.

Mr. Tatting stated there is a section of approximately 15 feet to go from the driveway to
the street.
Mr. Jones stated they cannot do so as it exists right now. That situation will not change
with the proposed addition. This situation seems to have existed since the properties
were constructed.
Dr. Vos stated, in terms of the variance request, the variance is necessary because what
is existing is being remodeled or reconstructed. By pulling a building -permit, they have to
grant a variance. The new additions do not require a variance. The option the petitioner
has is to saw off a part of the porch and move the garage back one foot. He did not see
that as an option so he would vote in favor.
Ms. Mau agreed. It is not practical to change what is already there.
Ms. Beaulieu stated this is not giving a variance for the use of the neighbor's driveway.
That is not the issue. This is a variance request to make improvements on an existing
condition.

DEVELOPMENT SITE
Blaine Jones and Lee Ann Ulrick have requested a variance to allow a
reduction in their front yard setback from 35 feet to 34 feet to allow the
reconstruction of the garage, and to allow a residential structure that is not
complying to be increased in size and to remain at a reduced setback
dimension of 22 feet, rather than the Code required 35 feet.
The Jones/ Ulrick is part of Auditor's Subdivision No. 23, and part of Lot 2 and
all of Lot 3 Ostman's Second Addition. Auditor's Subdivision 23, was recorded
in 1939. Ostman's Second Addition was recorded in November 1952.
One month after the Ostman's Second Addition plat was recorded, a building
permit was issued to Otto Ostman to build what is now the Jones/Ulrick home.
In 1955, a second permit was issued to allow the construction of a porch. In 1965
a bedroom addition was added on to the home. In 1989, a permit was issued to
Blaine/ Lee Jones for the addition of a multi -story deck of 815 square feet. In
1994, Blaine and Lee Jones, were issued a permit to allow a kitchen and bath
remodeling. In 1997, a permit was issued to Blaine Jones to install footings under
a detached deck for a hot tub.
The history of the front yard bay encroachment has not been clear in the permit
records, however, site visits by staff have lead to a determination that the
encroachment appears to have been built as part of the original structure.
Code Section 205. 07.03.1)(1), requires that a home in an R-1, Single Family
Residential zoning district maintain a front yard of 35 feet between any living
area and the front property line.
The current proposal is to tear down and reconstruct the garage on this site.
There will also be a remodeling project involving the living room and an
office/ guest space in the home. The living area addition will be built out at
the rear of the home and will not impact the front setbacks. Both the
Department of Natural Resources (DNR) and the Rice Creek Watershed
Management Organizations have been contacted regarding these plans since
the home is located on Locke Lake.

Another part of this project involves the roof. The current flattened pitch of
the roof will be replaced by a modern, engineered hip roof.
If not for the bay/ entry addition that encroaches into the front yard of this
home, a variance may not have been necessary. The proposed garage addition
is located at a point where the setback is extremely close to the 35'
requirement. As a matter of fact staff spent much time with the surveys to
make a determination of the magnitude of encroachment (if any) caused by the
garage itself. A determination was ultimately made that the end post outside
of the garage door may encroach by 6 to 8 inches.
As staff analyzed this addition one other element did become apparent. This
home shares a driveway with an adjacent property owner. Caution would be
required as motorists leave and enter the driveway and garage. Because of the
design of the shared driveway and no typical separation such as a strip of
lawn or landscape, the petitioner may want to consider preserving as much
separation as possible to eliminate the possibility of conflict in the shared
portion of the driveway
To the east of the Jones/ Ulrick property is a house with an attached garage.
The garage is the closest structure to the Jones/ Ulrick's house. There is over
30 feet between the two structures, however the new garage addition will
diminish this separation to 22 feet.
The home to the east is around a corner from the Jones/Ulrick home and is
setback at 45'. If that owner chose to bring their garage closer to the street, the
shared driveway and proximity of garages to one another would become
magnified to where even greater caution would be required as these
homeowners maneuver to -and -from their respective garages. This point is
made not to recommend against the proposed addition, but to remind the
petitioner of the importance of compatibility between adjacent dwelling units.
Drainage from the site would change very little. The proposed addition
would replace an existing concrete walkway.

Attachment 2: Reason for Variance
Reason for Variance: This variance is being requested to allow for the remodeling of our home at 54
Locke Lake Road in Fridley. We are seeking a variance to the DNR set back requirement of 50 feet
from the ordinary high water mark for Locke Lake and for a variance from the front yard set back of
35 feet to cover the existing structure which was built before the setback requirements were
formalized (see survey on file with City of Fridley). In addition, we are asking for this variance to
include the proposed structure (see drawings) which will enable us to correct some roof structure as
described below.
Currently the house has flat roofs over an existing family room and 3 season porch. These roof areas
have leaked consistently (both from melting snow in the winter and during hard rains in the spring,
summer and fall) since we purchased this house in 1986 despite attempts to repair the roof. We have
looked at several different ways to permanently fix these roofs using the existing structure. However,
the consensus from talking to several contractors is that it would be better to take down the existing
structure and rebuild using a design which eliminates the flat roofs. In addition to these problems, the
garage is in need of repair. It is our proposal to tear off the existing garage, family room and screen
porch, and to rebuild them in a way to eliminate the roof problems and repair the garage.
Our existing house and deck already encroach on the two set back requirements. The screen porch,
deck, family room, and garage encroach on the DNR set back. Our proposed remodeling of the back
side of the house pulls back from the DNR set back in one area in the southwest corner of the
structure and infringes slightly more in the southeast corner of the structure. Most of the remodeling
takes place over existing structure.
The front of the house and current garage encroach slightly on the 35 foot front yard set back. The
proposed remodeling will follow the front-line of the existing garage approximately 8 feet to the east.
This addition does not cause further problems with any set back lines. There are no plans to change
any of the foundations of the laundry room, kitchen, or garage with respect to their current
encroachment of the 35 foot set back. See attached drawings for details.

SUBJECT: Locke Lake Water Elevation
The DNR has essentially denied the City's request to operate Locke Lake dam based on a normal water
elevation of 821.0 feet. Operation based on water elevation is extremely difficult due to variations in flow
which can occur on a daily basis. Therefore, I have evaluated what would happen if we were to operate the
dam based on a top of gate elevation of 820.3 feet and 820.0, as suggested by the DNR as an alternate.
Operation based on a fixed gate elevation allows for a more natural stream flow and lake variation as well
as requiring less direct involvement by the City.
The following chart is based on flow data obtained from the Rice Creek Watershed District.

Recommend we submit an operating plan to set the top of gate elevation at 820.0 feet. The City would then
only operate the dam by lowering the gates when we receive greater than 3 inch of rain in a 24 hour period.
The gates would be returned to 820.0 when the flows return to the base levels. This operation plan would
emulate the original dam's operation.

Dear Mr. Jones:
This is being written in response to your letter of February 13, 1998. The Department of Natural
Resources (DNR) has reviewed the information you submitted regarding the proposed renovations
to your home at 54 Locke Lake Road NE in Fridley. On February 5, 1998, Melissa Wester from this
office visited the site and spoke with you about the renovations which would include replacing the
flat portions of your roof and expanding the southeast corner of the garage about 7 feet further into
the setback area. Currently, the southeast corner of the existing house/garage does not meet the
required setback from the Ordinary High Water Level. Conversation with you indicates that the
existing deck will not be moved or expanded, and that the increases to the house will be
compensated by the decreases in the deck area.
Based on the submitted information and site visit, the DNR would not object to the proposed
renovations provided that the City find that there is hardship and the visibility of structure and other
facilities as viewed from Locke Lake is limited. This means that we would like to see some sort of
permanent natural area established on your property adjacent to the lake. Vegetation removal should
be minimized and additional vegetation should be established if needed between the house and the
lake. There are no particular standards for this. It may take the form of a permanent landscape plan
or conservation easement that is recorded with the title as a condition of the variance. It may be
acceptable to place permanent markers in the yard identifying the area needed to be left in a natural
condition. Our main concern is that vegetation screen the structure from the Lake permanently.

I apologize for the brevity of this letter. We are just on our way out the door. Enclosed is a
color highlighted version of our proposed project that we discussed when you visited the site
and during our phone conversation this week. It is identical to the design prints that I sent you
last week except that I have highlighted the DNR setbacks, the current outside walls, and the
proposed outside walls to make it easier to see. As I mentioned during our conversation, Scott
Hickock from the City of Fridley and I were not clear on some of the points in the first
paragraph of your letter regarding the location of the new structure. Also, as we discussed, my
wife and I are in agreement with your wishes regarding the plants, etc. and would like to know
that we need to do with regards to the easement discussed in the second paragraph. I would
like you to clarify these points in another letter which I will submit with the other materials
needed for the variance. I have made additional copies of the enclosed document and will be
submitting these to the city as part of the variance.

Dear Mr. Hovey,
Thank you for returning my phone call yesterday. As we discussed, I have enclosed several
documents which pertain to the proposed renovation my wife and I are planning for our home
at 54 Locke Lake Road in Fridley. As you may recall from earlier conversations, our house is
in need of a new roof. In addition, sections of our roof are flat and as a result leak during
heavy rains and from melting snow. We have spent considerable time and money attempting to
fix and/or repair these areas. Unfortunately none of these efforts have solved the problem.
We have talked to several contractors regarding about our roof and how to eliminate the flat
areas. They have said that in order to eliminate the flat areas over our family room the existing
structure of our garage roof would need to be reinforced. During our investigation of having
the roof replaced/reinforced my wife and I came to the conclusion that it would make better
economic sense to renovate the existing the areas with the flat roofs than try to patch the
existing structure together. We have pursue this and have hired an architect who has come up
with a design that we like. I would like you to review it and, if it is acceptable to you and your
office, write a letter to me to that affect. We will the apply for a variance from the City of
Fridley prior to starting this project.
I have the labeled the attached documents 1 through 6 for reference purposes. Number one is
an overview plat given to my wife and I by the previous owners of our house (Robert and Helen
Buckley). I have shaded our lot in orange. Number 2 is the engineering drawing portion of a
survey we had done this past summer showing the location of our house and deck on the lot.
The drawing shows the set back lines including the 50 foot contour line from the ordinary high
water mark at the 821 foot elevation. Also draw in is the 100 year flood contour at the 825 foot
elevation. I have hi -lighted the areas of the house with flat roofs in orange. These are the areas
which we have repaired but still leak.
Document number 3 is the survey with the proposed finished renovation "foot print" drawn in.
I have noted where the new portion will infringe on the 50 foot set back in black. Much of this
area is over existing deck and or side walk. Also, please note we were able to eliminate some
areas where the existing house was infringing on the set back and we were able to move the
existing structure back from the lake in one location.
Documents 4, 5, and 6 show renditions of the finished structure from the outside and inside as
well as a floor plan. They give a fair representation of what the finished structure will look
like.
Please review these documents and let me know if you have any questions. As I mentioned
during our telephone conversation, I want to get your approval of the final plans before I
proceed with the city. Our current time line is to start demolition/construction in early spring.
