The City has, received your letter stating your intentions in
regard to installing rough -in plumbing in your garage. This letter
is to further explain the zoning laws that will regulate the use of
this. structure. As you stated in your letter, the garage cannot be
converted to a dwelling unit or "accessory apartment" unless the
property is rezoned. The garage could be converted to living space
if another garage is built at the same time. Once again, this living
space could not be a separate dwelling without the approval of the City.
The garage cannot be used for a home occupation. Home occupation
is defined as. any occupation or profession engaged by the occupant of
a dwelling unit and carried on within the unit and not in an accessory

RE: Residence at 59 Logan Parkway
We have reviewed the structure to support a hot tub on the fifth
level of the above referenced residence. The following are our
findings and recommendations. Please find our calculations and
sketch enclosed.
The Owners are required to add six more 2x10 joists under the tub
area (see Sketch). They shall provide three rows of solid bridging
between the joists at quarter points. They shall place two layers
of 3/4" plywood, glued and nailed on the joists. They shall place
four metal stud walls under the tub on top of a double 6" x 16 Ga.
header. The metal stud header will help spread the load of the tub
over a larger area. The studs will be shimmed with -wood shims at
the top of the wall to ensure the weight is distributed to the stud
walls. Also, the stud walls shall be kicked to the plywood deck at
every third stud.

hard surface access to the addition. The existing turn-
around may be utilized as part of the driveway expansion.
The City has previously granted similar variances to 1,300,
1,248, and 1,196 square feet. The variance request is
within previously granted variances. The petitioner could
construct a detached accessory structure of 848 square feet
without requiring a variance; however, a special use permit
would be required.

Ms. McPherson stated this property is located just west of East
Raver Road on Logan Parkway. The property is zoned R-1, Single
Family Dwelling, as are all surrounding properties.
Ms. McPherson stated the petitioner is proposing to construct a 520
square foot (20 feet by 26 feet) addition to the existing 522
square foot attached garage. The petitioner proposes to use this
addition for the storage of a fishing boat, a camper, lawn
equipment, and firewood.

Ms. McPherson stated that Section 205.07.01.B.(4) of the Fridley
-zoning. Code requires_ that -a firsts accessory. building 'shall not
exceed 100% of the first.floor area of the dwelling unit or a
maximum of 1,000 square feet. The,petitioner'.s .dwelling' -measures
2, . 140 square . feet; therefore, the- . maximum size. . of the _ first
accessory structure permitted -by code -is 1,000 square•feet.
Ms. McPherson stated the proposed addition will be six feet from
the easterly lot line which meets the required five foot setback
for attached accessory structures. The dwelling to the east is
located approximately 18 feet from the common lot line. The lot
coverage with the proposed addition.will be approximately 13%.
Ms. `.McPherson stated' the petitioner 'is proposing to -expand the..

turnaround maybe used as part -of'the* driveway' expansion;. however;
the petitioner has not yet determined whether that will be feasible
or not.
Ms. McPherson stated the City has previously granted similar
variances for first accessory structures to 1,300, 1,248,.l,.196,
and 1,400 square feet.
Ms.. McPherson stated the petitioner does have the option 'of
constructing a detached garage of 848 square feet without a
variance; however, a special use permit would be required for a
second accessory structure.
Ms. McPherson stated staff has no recommendation regarding this
variance request; however, if the Commission chooses to approve the
request, staff recommends the following stipulations:
1. The addition shall not be used for living area.unless a
variance is approved by the City Council.
2. The driveway expansion shall be completed by October 1,
1994.
Mr. James Foss stated staff has done a very good job of explaining
his variance request. He stated the roofline of the addition will
match the lines of the existing garage. The addition will be
stuccoed to match the existing house and garage.
Ms. Smith asked if there were any objections from the neighbors.
Mr. Foss stated that he has talked to his neighbors on all three
sides, and they are all in favor of the addition. He stated he has
a fishing boat, a camper, and a pile of firewood stored outside.
The.plan shows how these items and lawn equipment would be stored
in the additional garage space. With the addition, he will still t

be able to store his car and extended cab pickup in the existing
garage.
Ms. Smith asked Mr. Foss if he had any objections to the two
stipulations.
Mr. Foss stated he has no objection to the stipulations. As far
as the driveway, he will have that put in at the same time'the
foundation for the garage is poured.
Ms. Beaulieu stated that a 20 foot by 22 foot addition would be
allowed without a variance, and the petitioner is proposing a 20
foot by 26 foot addition. What would happen if the variance was
not granted and the addition had to be shortened by'four feet? .

DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:45
P.M.
Ms. Beaulieu stated she really did not see.any hardship; however,
there does not appear to be any detrimental impact to the
neighborhood and there is no neighborhood objection. The City has
granted variances for larger garages in the past, and this proposed
addition will be very attractive. This is a big yard,.and there
is a lot of distance from the addition to the neighbor's house to
the east. She would vote to approve the variance based on the fact
that there would be no detrimental impact to the neighborhood.
Ms. Smith stated she believed the public purpose is being served.
The overall square footage is small compared to the size of the
lot. She would vote to approve the variance request.
Mr. Kuechle stated the lots in this area are quite large --about
twice the minimum lot requirement. The amount of variance
requested is small. He believed that requiring a smaller addition
next to the existing large garage might look architecturally out
of place. He stated he would also vote to approve the variance.
MOTION by Ms. Beaulieu, seconded by Ms. Smith, to approve variance

♦ To increase the maximum square footage of a first accessory
structure from 1,000 square feet to 1,048 square feet. The
petitioners are proposing to construct a 520 square foot
addition (20 feet by 26 feet) to the existing 552 square
foot garage to store a fishing boat, camper, lawn equipment,
and firewood.
ANALYSIS•
♦ Section 205.07.0l.B.(4) requires that a first accessory
building shall not exceed 100% of the first floor area of
the dwelling unit or a maximum of 1,000 square feet.
Public purpose served by this requirement is to maintain the
residential quality of a neighborhood by limiting the size
of accessory structures.
The petitioner's dwelling is 2140 square feet, therefore,
the maximum size of the first accessory structure permitted
by code is 1,000 square feet. If the dwelling was less than
1,000 square feet, the first accessory structure could not
exceed the first floor area of the dwelling unit. The total
square footage of all accessory structures may not exceed
1,400 square feet.
The proposed addition will be six feet from the easterly lot
line, meeting the setback requirement of five feet for
garages. The lot coverage with the proposed addition will
be 13%. The dwelling to the east is located approximately
18 feet from the shared lot line.

The petitioner will be expanding the driveway to provide
hard surface access to the addition. The existing turn-
around may be utilized as part of the driveway expansion.
The City has previously granted similar variances to 1,300,
1,248, and 1,196 square feet. The variance request is
within previously granted variances. The petitioner could
construct a detached accessory structure of 848 square feet
without requiring a variance; however, a special use permit
would be required.
RECOMMENDATIONISTIPULATIONS:

Please find the enclosed variance application form, along with our check for $60.00 made out to
the City Of Fridley.
Also enclosed are 1 set of drawings for the proposed garage addition which include:
A floor plan, site plan, and a East, and South elevation.
Please consider that our house is not the average Fridley rambler.
Since 1983 we have remodeled, added on, and up from our original 3 bedroom rambler, and we
now have a 5 bedroom, 4 bathroom, 5 level home.
We also have 2 wood stoves, and 1 fireplace.
Right now the items that we own that sit out side are:
16 foot fishing boat
16 foot pop up camper
A large pile of firewood
A large riding lawn mower
A large roto tiller
A push lawn mower
We also have plans to purchase a larger boat & camper in the future.
All of these things make for quite the unsightly view for our neighbors, and would all be hidden
away should you decide to grant the variance.

CALL TO ORDER:
Vice -Chairperson Kuechle called the June 21, 1994, Appeals
Commission meeting to order at 7:30 p.m.

APPROVAL OF JUNE 7,-1994, APPEALS COMMISSION MINUTES:
MOTION by Ms. Smith, seconded by Ms. Beaulieu, to approve the June
7, 1994, Appeals Commission minutes as written.
UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON RUECHLE
DECLARED THE MOTION CARRIED UNANIMOUSLY.
1. CONSIDERATION OF VARIANCE REQUEST, VAR #94-09, BY JAMES AND
CAROL FOSS•
Per Section 205.07.01.B.(4).(a) of the Fridley Zoning Code,
to increase the maximum square footage of a garage from 1,000
square feet to 1,048 square feet, to allow the expansion of
an existing garage on Lot 3, Block 1, Oak Creek Addition, the
same being 59 Logan Parkway N.E.
MOTION by Ms. Beaulieu, seconded by Ms. Smith, to waive the reading
of the public hearing notice and open the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON KUECHLE
DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING OPEN A 7:32 P.M.
Ms. McPherson stated this property is located just west of East
River Road on Logan Parkway. The property is zoned R-1, Single
Family Dwelling, as are all surrounding properties.
Ms. McPherson stated the petitioner is proposing to construct a 520
square foot (20 feet by 26 feet) addition to the existing 522
square foot attached garage. The petitioner proposes to use this
addition for the storage of a fishing boat, a camper, lawn
equipment, and firewood.

Ms. McPherson stated that Section 205.07.01.B.(4) of the Fridley
Zoning Code requires that a first accessory building shall not
exceed 100% of the first floor area of the dwelling unit or a
maximum of 1,000 square feet. The petitioner's dwelling measures
2,140 square feet; therefore, the maximum size of the first
accessory structure permitted by code is 1,000 square feet.
Ms. McPherson stated the proposed addition will be six feet from
the easterly lot line which meets the required five foot setback
for attached accessory structures. The dwelling to the east is
located approximately 18 feet from the common lot line. The lot
coverage with the proposed addition will be approximately 13%.
Ms. McPherson stated the petitioner is proposing to expand the
existing driveway to provide access to the addition. The existing
turnaround may be used as part of the driveway expansion; however,
the petitioner has not yet determined whether that will be feasible
or not.
Ms. McPherson stated the City has previously granted similar
variances for first accessory structures to 1,300, 1,248, 1,196,
and 1,400 square feet.
Ms. McPherson stated the petitioner does have the option of
constructing a detached garage of 848 square feet without a
variance; however, a special use permit would be required for a
second accessory structure.
Ms. McPherson stated staff has no recommendation regarding this
variance request; however, if the Commission chooses to approve the
request, staff recommends the following stipulations:
1. The addition shall not be used for living area unless a
variance is approved by the City Council.
2. The driveway expansion shall be completed by October 1,
1994.
Mr. James Foss stated staff has done a very good job of explaining
his variance request. He stated the roofline of the addition will
match the lines of the existing garage. The addition will be
stuccoed to match the existing house and garage.
Ms. Smith asked if there were any objections from the neighbors.
Mr. Foss stated that he has talked to his neighbors on all three
sides, and they are all in favor of the addition. He stated he has
a fishing boat, a camper, and a pile of firewood stored outside.
The plan shows how these items and lawn equipment would be stored
in the additional garage space. With the addition, he will still

be able to store his car and extended cab pickup in the existing
garage.
Ms. Smith asked Mr. Foss if he had any objections to the two
stipulations.
Mr. Foss stated he has no objection to the stipulations. As far
as the driveway, he will have that put in at the same time the
foundation for the garage is poured.
Ms. Beaulieu stated that a 20 foot by 22 foot addition would be
allowed without a variance, and the petitioner is proposing a 20
foot by 26 foot addition. What would happen if the variance was
not granted and the addition had to be shortened by four feet?
Mr. Foss stated that something would have to be stored outside.
The whole idea of proposing the extra four feet was to get
everything stored inside.
MOTION by Ms. Beaulieu, seconded by Ms. Smith, to close the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON KUECHLE
DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:45
P.M.
Ms. Beaulieu stated she really did not see any hardship; however,
there does not appear to be any detrimental impact to the
neighborhood and there is no neighborhood objection. The City has
granted variances for larger garages in the past, and this proposed
addition will be very attractive. This is a big yard, and there
is a lot of distance from the addition to the neighbor's house to
the east. She would vote to approve the variance based on the fact
that there would be no detrimental impact to the neighborhood.
Ms. Smith stated she believed the public purpose is being served.
The overall square footage is small compared to the size of the
lot. She would vote to approve the variance request.
Mr. Kuechle stated the lots in this area are quite large --about
twice the minimum lot requirement. The amount of variance
requested is small. He believed that requiring a smaller addition
next to the existing large garage might look architecturally out
of place. He stated he would also vote to approve the variance.
MOTION by Ms. Beaulieu, seconded by Ms. Smith, to approve variance
request, VAR #94-09, by James and Carol Foss, per Section
205.07.01.B.(4).(a) of the Fridley Zoning Code, to increase the
